 of the Radio Frequency Management Agency under the Ministry of Information and Communications

Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

정부가 2007년 12월 25일 제정한 정부령 제187/2007/NĐ-CP에 의거하여 정보통신부의 기능, 임무, 권한 및 조직 구조를 규정함;

Considering the proposal of the Minister of Information and Communications.

결정함에 있어서:

조 1. 위치와 기능

1. The Radio Frequency Management Agency is an organization under the Ministry of Information and Communications, performing the function of advising the Minister of Information and Communications on state management and organizing the implementation of specialized state management tasks related to radio frequency spectrum across the country.

2. The Radio Frequency Management Agency has legal personality, its own seal and separate account according to the provisions of the law, with its headquarters located in Hanoi city and its units located in localities.

조 제2항. 임무와 권한

The Radio Frequency Management Agency performs the following tasks and powers:

1. Taking the lead in drafting and submitting to the Minister of Information and Communications for promulgation within his/her authority or for submission by the Minister to the competent authority for promulgation, amendment, and supplementation of legal normative documents on radio frequency spectrum and satellite orbits.

2. Drafting and submitting to the Minister of Information and Communications for submission to the Prime Minister for approval or promulgation decisions on: national radio frequency spectrum planning; band division for defense and security purposes.

3. Submitting to the Minister of Information and Communications for approval or promulgation decisions on: band planning, radio frequency channel planning, regulations on conditions for allocation, assignment, and use of radio frequencies and bands.

4. Cooperating with relevant units under the Ministry of Information and Communications to draft and submit to the Minister of Information and Communications for promulgation technical standards and regulations on radio equipment, radio emission, and electromagnetic compatibility according to the provisions of the law.

5. Taking the lead and cooperating with relevant units under the Ministry of Information and Communications to draft and submit to the Minister of Information and Communications for promulgation regulations on technical conditions and operation of conditional-use radio equipment, regulations on frequencies and transmission power for radio equipment before allowing production or import for use in Vietnam.

6. Implementing legal documents on radio frequency spectrum and satellite orbits; disseminating, popularizing, and educating laws on radio frequency spectrum; guiding business practices for Provincial Departments of Information and Communications in the field of frequency management and radio equipment according to the provisions of the Minister of Information and Communications.

7. Issuing, renewing, temporarily suspending, revoking, and managing various types of radio frequency spectrum licenses and satellite orbit usage according to the provisions of the law.

8. International cooperation in technical and operational matters related to radio frequency spectrum according to the delegation of the Minister of Information and Communications; registering radio frequency spectrum and satellite orbits with the International Telecommunication Union (ITU); organizing coordination of radio frequency spectrum and satellite orbits with other countries, regions, and international organizations; lodging and resolving interference complaints from Vietnam with other countries, regions, and international organizations; participating in international radio frequency spectrum control programs.

9. Monitoring domestic radio broadcasting stations and foreign radio stations broadcasting to Vietnam according to the provisions of Vietnamese law and international treaties that Vietnam has signed or joined.

10. Inspecting radio equipment according to the provisions of the license and related technical standards; handling radio interference; inspecting and confirming electromagnetic compatibility for radio-emitting equipment according to the provisions of the law.

11. Inspecting and supervising the implementation of legal provisions on radio frequency spectrum and satellite orbits; resolving complaints and accusations and handling administrative violations in the field of radio frequency spectrum and satellite orbits according to the provisions of the law.

12. Being the permanent agency of the Radio Frequency Management Committee.

13. Collecting, managing, and using fees and charges related to radio frequency spectrum according to the provisions of the law.

14. Implementing financial mechanisms like self-financing public service units taking into account factors such as investment, regular expenses, labor, and wages.

15. Organizing and managing the provision of specialized public services in managing radio frequency spectrum and satellite orbits according to the provisions of the law.

16. Managing organizational structure, civil servants, officials, employees, and assets of the Agency according to the provisions of the law and the delegation of the Minister of Information and Communications.

17. Performing other tasks and powers assigned by the Minister of Information and Communications and according to the provisions of the law.

The Minister of Information and Communications shall stipulate the functions, tasks, powers, and organizational structure of the Regional Radio Frequency Management Centers and the Technical Center.

조 장. 기 국

1. The Radio Frequency Management Agency has a Director and not more than three Deputy Directors.

2. The Director and Deputy Directors are appointed, relieved of duty, or dismissed by the Minister of Information and Communications according to the provisions of the law.

3. The Director of the Radio Frequency Management Agency is responsible to the Minister of Information and Communications and the law for all activities of the Agency. Deputy Directors are responsible to the Director and the law for the areas of work they are assigned.

조 제5항. 효력 및 시행 책임

This Decision takes effect 15 days after its publication in the Official Gazette. Previous regulations contrary to this Decision are abolished.

2. 재무부는 주관하여 정보통신부와 협력하여 본 결정 제2조 제14항에서 규정된 무선주파수국의 재정제도를 시행하기 위한 지침을 마련한다.

3. 각 장관, 정부 직속 기관의 수장, 중앙에 직속하는 성시의 인민위원회 주석, 정부 소속 기관의 수장 및 무선주파수국 국장은 본 결정의 집행에 대한 책임을 진다./.
