Issuing Recruitment Regulations and Promotion Rules,
for Grade Advancement and Rank Promotion of Civil Servants and Public Officials
Pursuant to the Government Decree No. 25/2025/NĐ-CP dated February 21, 2025 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Based on the proposal of the Director of the Cadre and Civil Servant Department;
Pursuant to Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain articles of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of public officials;
Pursuant to Decree No. 138/2020/NĐ-CP dated November 27, 2020 of the Government on recruitment, use, and management of civil servants;
Pursuant to Decree No. 116/2024/NĐ-CP dated September 17, 2024 of the Government amending and supplementing certain articles of Decree No. 138/2020/NĐ-CP dated November 27, 2020 of the Government on recruitment, utilization, and management of civil servants;
At the request of the Director of the Civil Servant and Public Official Department;
The Minister of Home Affairs issues this Circular on Recruitment Regulations and Promotion Rules for Grade Advancement and Rank Promotion of Civil Servants and Public Officials.
Article 1. Accompanying this Circular are the Recruitment Regulations and Promotion Rules for Grade Advancement and Rank Promotion of Civil Servants and Public Officials.
Article 2. Effectiveness
1. This Circular shall take effect from May 1, 2025.
2. In cases where agencies, organizations, or units with authority organize examinations and recruitments for civil servants and public officials, grade advancement examinations for civil servants, and rank promotion examinations for public officials according to plans or programs approved by competent authorities under Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of public officials, which has been amended and supplemented by Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government, or under Decree No. 138/2020/NĐ-CP dated November 27, 2020 of the Government on recruitment, utilization, and management of civil servants, which has been amended and supplemented by Decree No. 116/2024/NĐ-CP dated September 17, 2024 of the Government, before this Circular takes effect, they may continue to apply the Examination Organization Rules and Recruitment Rules for civil servants and public officials, grade advancement examinations for civil servants, and rank promotion examinations for public officials; Examination Regulations and Recruitment Regulations for civil servants and public officials, grade advancement examinations for civil servants, and rank promotion examinations for public officials issued together with Circular No. 06/2020/TT-BNV dated December 2, 2020 of the Minister of Home Affairs on Examination Organization Rules and Recruitment Rules for civil servants and public officials, grade advancement examinations for civil servants, and rank promotion examinations for public officials; Examination Regulations and Recruitment Regulations for civil servants and public officials, grade advancement examinations for civil servants, and rank promotion examinations for public officials within six months from the date this Circular takes effect; if not completed within this period, they must follow the provisions of this Circular.
3. Circular No. 06/2020/TT-BNV dated December 2, 2020 of the Minister of Home Affairs issuing Circular on Examination Organization Rules and Recruitment Rules for civil servants and public officials, grade advancement examinations for civil servants, and rank promotion examinations for public officials; Examination Regulations and Recruitment Regulations for civil servants and public officials, grade advancement examinations for civil servants, and rank promotion examinations for public officials are hereby repealed.
Article 3. Responsibility for Implementation
1. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairpersons of provincial and municipal People's Committees directly under the central government, relevant agencies, organizations, units, and individuals are responsible for implementing this Circular.
2. During implementation, if there are difficulties, please report to the Ministry of Home Affairs for guidance and resolution./.

GRADE ADVANCEMENT EXAMINATIONS FOR CIVIL SERVANTS

Article 1. Regulations for candidates
- Must be present in the examination room at the time specified. Candidates who arrive late after the start time of the examination period, section, or subject (hereinafter referred to as the examination) shall be allowed to take the examination in the following cases:
- Not more than 05 minutes for examinations with a maximum duration of 30 minutes or not more than 10 minutes for examinations with a maximum duration of 60 minutes or more;
- An unforeseeable event or an objective obstacle as prescribed by law that prevents the candidate from being present on time or within the time limit stipulated in Point a of this Clause. The Head of the Examination Board, the Head of the Interview Board, and the Head of the Assessment Board report to the Chairman of the Board for consideration and decision regarding the candidate's eligibility to take the examination in specific cases.
- Neat, civilized, and courteous attire.
- Present a Citizen Identity Card or a Citizen Card or any other valid identification document containing a photograph and personal information.
- Sit in the designated seat according to the registration number or as assigned by the Examination Board.
- Only permitted items to bring into the examination room include: rulers, writing pens for the examination; drinking water contained in a clear container without labels or any markings; types of documents and materials required for each examination; certain medications that the candidate must carry due to a medical condition.
Prohibited from bringing into the examination room: mobile phones, audio recorders, cameras, computers, technical devices for receiving, transmitting, or storing data, or any other device for transmitting or storing information, except where otherwise provided.
- Adhere to the instructions of the invigilator, members of the Interview Board, members of the Assessment Board, and the Examination Board; if there are questions or concerns, they must be raised publicly to the invigilator, members of the Interview Board, or members of the Assessment Board; maintain order and refrain from smoking or using stimulants, alcoholic beverages, or food and drink containing alcohol in the examination room or examination area.
- Prohibited from exchanging information, examination papers, or scratch paper with others during the examination period; prohibited from viewing another candidate’s work or engaging in any form of cheating. Strictly forbidden to copy or transmit examination-related questions and answers outside the examination room or to receive information from outside the examination room.
- Answers on paper must be written in blue or black ink. Only examination paper provided may be used for the examination; all sections required to be filled out by the candidate on the examination paper must be completed. Except for mandatory entries on the cover page, candidates are not allowed to mark or make special signs on their work, nor write their name, signature, title, symbols, characters, or other marks on their work. If rewriting is necessary, cross out or draw a line through the previously written portion (except where otherwise provided).
- Candidates are not allowed to leave the examination room during examinations with a maximum duration of 60 minutes or less. For examinations exceeding 60 minutes, candidates may only leave the examination room after two-thirds of the examination time has passed; if a candidate submits their work, they must submit the examination paper and scratch paper before leaving the examination room.
In urgent situations requiring departure from the examination room for personal reasons, permission from the invigilator is required.
10. Candidates must stop working and submit their work immediately when the invigilator, member of the Interview Board, or member of the Assessment Board announces the end of the examination time; sign the submission list or result list (for computer-based examinations). For paper-based examinations, clearly indicate the total number of examination sheets submitted; if unable to complete the work, candidates must still return the examination paper.
- In the case of computer-based examinations:
a) In the event of technical issues with the examination computer during the examination, the candidate must immediately inform the invigilator and the computer technician to record the incident; the candidate will be allowed to retake the examination immediately during the same session or on the same day. If it is not possible to retake the examination immediately during the same session or on the same day, the candidate will be scheduled to retake the examination on the following day, as decided by the Chairman of the Board.
Strictly forbidden for candidates to engage in actions that affect the computer system used for the examination. Violations will be handled based on the motive, nature, severity, consequences, cause of violation, and specific circumstances, as prescribed in Article 2 of these Regulations.
- Candidates may only leave the examination room after submitting their work and signing the submission list or result list.
If a candidate does not sign the submission list or result list before leaving the examination room, the examination score will be determined as 0 (zero) points. If the invigilator, member of the Interview Board, or member of the Assessment Board discovers that a candidate signed on behalf of another candidate, the examination scores of these candidates will also be determined as 0 (zero) points. These cases must be documented.
- Candidates have the right to report violations of the examination regulations and rules by other candidates to the invigilator.
Article 2. Handling violations by candidates participating in examinations
- Forms of handling violations by candidates who violate examination rules and regulations:
- Reprimand.
- Warning.
- Suspension from examination.
- Cancellation of examination results.
- The reprimand form shall be applied to candidates violating any of the following cases:
- Not sitting in the designated seat after being warned for the first time;
- Exchanging with other candidates and having been warned for the first time but not complying or still repeating the violation.
- The warning form shall be applied to candidates violating any of the following cases:
- Having been handled with the reprimand form according to the provisions of Clause 2 of this Article and then repeating the violation;
- Exchanging answers or scratch paper with other candidates;
- Allowing other candidates to copy their answers or copying answers from other candidates;
- Using prohibited materials; bringing mobile phones, audio recorders, cameras, computers, and other technical means for receiving and transmitting information, data storage devices, and other information-containing devices into the examination room (except where otherwise provided).
- The suspension from examination form shall be applied to candidates violating any of the following cases:
- Having been handled with the warning form according to the provisions of Clause 3 of this Article and then repeating the violation;
Using mobile phones, audio recorders, cameras, computers, and other technical means for receiving and transmitting information, data storage devices, and other information-containing devices during the examination period (except where otherwise provided);
- Causing safety and order issues affecting the examination room.
Candidates suspended from an examination will have their results for that examination canceled and will not be allowed to continue participating in subsequent examinations (if any).
- The cancellation of examination results form shall be applied to candidates violating any of the following cases:
- Writing or drawing irrelevant content on the examination paper or another candidate's examination paper.
- Committing any of the following acts: swapping answer sheets, doing another candidate's examination for them, allowing another candidate to do their examination for them, or taking the examination for another candidate.
- Being suspended from the examination according to the provisions of Clause 4 of this Article.
- Handling procedure:
- Examination room supervisors, interview panel members, and examination board members shall prepare a report on the violation behavior of candidates in the examination room. Both the person preparing the report and the violating candidate must sign the report. The report shall be publicly announced in the examination room.
In case the violating candidate does not sign the violation report, the person preparing the report shall invite two nearby candidates to confirm the incident. If one or both invited candidates do not sign the report, the report shall still be prepared and publicly announced in the examination room.
- For the reprimand and warning forms:
The person preparing the report shall publicly announce it in the examination room; report to the Chief Examiner or Interview Panel Leader or Examination Board Leader to report to the Chairman of the Examination Council.
- For the suspension from examination form:
The person preparing the report shall prepare the report in the examination room and immediately report to the Chief Examiner or Interview Panel Leader or Examination Board Leader to promptly report to the Chairman of the Examination Council for immediate decision to suspend the examination of the violating candidate during the examination period;
Representatives of the Examination Council or the Chief Examiner, Interview Panel Leader, or Examination Board Leader shall publicly announce it in the examination room.
- For the cancellation of examination results form:
The Chairman of the Examination Council shall report to the head of the organization authorized to organize civil servant recruitment, career advancement examinations before deciding to cancel the examination results of the candidate.
- Related provisions regarding handling of violating candidates:
- Examination results:
Candidates reprimanded in any examination will have 25% deducted from the total number of correct answers or 25% deducted from the total score achieved in that examination.
Candidates warned in any examination will have 50% deducted from the total number of correct answers or 50% deducted from the total score achieved in that examination.
When compiling results, based on the violation handling report prepared by the examination room supervisor and reports from the Chief Examiner, Interview Panel Leader, or Examination Board Leader, the Chairman of the Examination Council shall decide on the deduction of the number of correct answers or points.
- In case candidates cause safety and order issues affecting the examination room, in addition to being suspended and having their examination results canceled, they may also be subject to administrative or criminal penalties depending on the nature and severity of the violation.
- Candidates who are civil servants or public officials, if suspended from the examination or have their examination results canceled, their supervising authority shall handle them according to the laws on civil servants and public officials.
Article 3. Provisions for invigilators in examination rooms, corridor supervisors, computer technicians, interview panel members, and examination review board members.
- Must be present at the examination venue at the designated time. Dress appropriately.
- Carry out their assigned duties and responsibilities in accordance with the examination rules and regulations.
- Maintain order, refrain from personal work; do not smoke; do not consume alcoholic beverages or stimulants; do not use mobile phones, audio recorders, cameras, computers, technical devices for receiving and transmitting information, data backup devices, or other information storage and transmission equipment in the examination room, except for computer technicians who may use computers and related equipment for computer-based examinations and for interviews or question-and-answer sessions using recording devices provided by the Examination Board.
- Shall not communicate privately with any examinee during the examination period.
Article 4. Handling violations by civil servants and officials involved in organizing examinations and other individuals who violate the examination rules and regulations.
- Civil servants and officials participating in the recruitment of civil servants and officials, or in civil servant grade promotion examinations, who commit violations of the examination rules and regulations shall, in addition to being suspended from serving in the recruitment of civil servants and officials or civil servant grade promotion examinations, also be subject to legal proceedings according to laws on civil servants and officials.
- Civil servants and officials who engage in behaviors such as proxy examination taking; transferring questions and answers outside the examination room; providing solutions to examinees; disseminating false information that negatively impacts the examination; causing disturbances leading to disorder in the examination area shall be dealt with according to laws on civil servants and officials.
- Individuals participating in the recruitment of civil servants and officials, or in civil servant grade promotion examinations, who are not civil servants or officials and who violate the examination rules and regulations shall be handled according to the nature and severity of the violation by the competent authority as stipulated by law.
- Individuals participating in the recruitment of civil servants and officials, or in civil servant grade promotion examinations, and other related individuals who violate the examination rules and regulations shall not be assigned tasks related to organizing the recruitment of civil servants and officials or civil servant grade promotion examinations by the heads of agencies or units with management authority, in accordance with regulations on handling acts of corruption and negative practices in personnel work, inspection activities, and other Party and legal provisions.

Chapter I
GENERAL PROVISIONS
Article 1. Scope of Application
This regulation sets forth principles, procedures, and formalities for organizing the recruitment of civil servants and officials, civil servant grade promotion examinations, and reviews for rank promotion in official professional titles.
Article 2. Applicability
This regulation applies to individuals participating in the recruitment of civil servants and officials, civil servant grade promotion examinations, and reviews for rank promotion in official professional titles.
The head of the agency authorized to recruit civil servants and officials decides to apply the provisions of this regulation to organize examinations when accepting individuals into civil service or official positions.
Article 3. Interpretation of Terms
In this Regulation, the following terms shall be understood as follows:
- Examination refers generally to the examination portion, subject, or discipline corresponding to the requirements for the position applied for in the recruitment of civil servants or public officials, or the professional standards required for promotion examinations for civil servant grades.
An examination conducted on a computer is collectively referred to as a computer-based examination; an examination conducted on paper is collectively referred to as a paper-based examination. Examinations for interviews, oral responses, practical work, and thesis defense are respectively referred to as interview examination, oral response examination, practical work examination, and thesis defense examination.
- Examination Answer is the content presented by the examinee according to the examination question as prescribed.
- Examination Question is a set of questions for each examination, ensuring that the total score of all questions in the examination matches the prescribed grading scale.
Computer-based Examination Question is a set of examination questions and corresponding answer options generated by the examination software based on the database of questions provided by the Examination Question Committee or the organization, entity, or unit contracted to prepare the examination questions, and the technical operations of the Examination Supervision Committee (computer technicians responsible for the server).
- Examination Paper is the paper for examinees to complete paper-based examinations, printed according to a standardized format for each examination period or examination.
- Examination Service Unit or Examination Review Unit includes receptionists, medical personnel, electric power staff, security, and protection personnel at examination venues and working areas of the Examination Board.
6. Question and Answer Data is electronic data compiling the content of questions and answers for creating examination questions and grading computer-based examinations. The question data includes questions and multiple corresponding answer options for each question for examinees to choose from when answering; the answer data shows the correct answer option for each question.
- Examination Organization Data is electronic data compiling information about examinees and examination results entered or extracted from software used during the examination period.
- Bag or Envelope (hereinafter abbreviated as bag) containing examination questions, examination questions, marking guidelines, and answers must be made of durable paper, sealed tightly, opaque, and securely taped without peeling edges, and sealed.
- Computer-based Examination Software is designed, accepted, has copyright, and is used to organize computer-based examinations. The examination software ensures compatibility with the content and structure of examination questions; ensures secure management and storage of data on examinees, questions, and answers, and has automatic functions to: calculate the time taken by examinees to complete the examination; stop the examination work of examinees, collect their examination work when time is up; grade the examination and display the examination result notification on the examinee's account interface immediately after collecting the examination work; extract examination result data; transfer all examination room data to the server; not store examinee examination result data on the examination computer or workstation.
- Examination Computer is a computer arranged by the Examination Board at the examination venue for examinees to use to complete and submit computer-based examinations.
- Workstation is a computer used by computer technicians in the examination room to manage computer-based examination work, extract and print examination results of examinees in the examination room.
- Server is an information system installed with examination software to implement examination procedures and operations.
- Incident Abnormal Situations
14. refers to situations occurring during the examination organization process that cause interruptions or prevent the examination from being carried out. Unusual Circumstances
- refers to circumstances leading to prolonged interruptions of examinee examination time or requiring the cessation of examination room activities or examination venues. Technical Infrastructure of the Examination Area
- includes examination rooms, server rooms, examination computer rooms, other operational rooms or spaces, and adjacent areas sufficient to ensure the independence of the examination venue along with internal network systems, power grid lines, water supply lines, fire prevention and extinguishing systems, security systems, ensuring safety and security. Technical Infrastructure of the Examination Period
Article 4. Examination Board
1. The examination board for civil servant recruitment (competitive examination, selection examination); the examination board for civil servant grade promotion; the examination board for career title rank advancement of public officials (hereinafter referred to collectively as the Examination Board) shall be established by the head of the agency or unit with the authority to recruit civil servants or public officials, or organize civil servant grade promotion examinations or public official career title rank advancement examinations. The Examination Board operates during one examination period or corresponding review period and dissolves itself upon completion of its tasks.
- The examination board for civil servant recruitment (competitive examination, selection examination) performs the duties and powers stipulated in Clause 2, Article 7 of Decree No. 138/2020/ND-CP dated November 27, 2020 of the Government on civil servant recruitment, utilization, and management (hereinafter referred to as Decree No. 138/2020/ND-CP), which has been amended in Clause 3, Article 1 of Decree No. 116/2024/ND-CP dated September 17, 2024 of the Government (hereinafter referred to as Decree No. 116/2024/ND-CP).
- The examination board for public official recruitment (competitive examination, selection examination) performs the duties and powers stipulated in Clause 3, Article 8 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government on public official recruitment, utilization, and management (hereinafter referred to as Decree No. 115/2020/ND-CP), which has been amended and supplemented in Clause 3, Article 1 of Decree No. 85/2023/ND-CP dated December 7, 2023 of the Government (hereinafter referred to as Decree No. 85/2023/ND-CP).
- The examination board for civil servant grade promotion performs the duties and powers stipulated in Clause 2, Article 35 of Decree No. 138/2020/ND-CP.
- The examination board for public official career title rank advancement performs the duties and powers stipulated in Clause 2, Article 38 of Decree No. 115/2020/ND-CP, which has been amended in Clause 38, Article 1 of Decree No. 85/2023/ND-CP.
6. The Examination Board may use the seal and account of the agency or unit with the authority to establish it or of the direct advisory agency in its activities, as decided by the head of the agency or unit with the authority to establish the Examination Board.
- The Examination Board decides specifically on examination and review organization work; responsibilities of the Examination Board's assisting units and Secretary in accordance with this Regulation and relevant laws.
- The Examination Board decides on signing contracts with organizations and units meeting the standards and conditions prescribed by law to provide technical infrastructure, perform technical operations; provide test questions, organize grading to serve the examination and review periods after reporting to the competent authority.
- The Chairman of the Examination Board assigns specific tasks to each member of the Examination Board; directs the implementation of Examination Board tasks in compliance with internal regulations and rules as prescribed; bears responsibility under the law and before the head of the agency or unit with the authority to establish the Examination Board for Examination Board activities; is authorized to have the Vice-Chairman of the Examination Board exercise the Chairman's powers as prescribed.
Article 5. Assisting Units of the Examination Board
- Based on the examination form in civil servant and public official recruitment, civil servant grade promotion examination, and public official career title rank advancement review, and job requirements, the Examination Board decides on establishing appropriate assisting units from among the following units:
- Registration Review Committee: reviews the conditions and qualifications of candidates registering for civil servant and public official recruitment.
- Question Bank Committee: builds question and answer databases for computer-based tests; builds test papers and answers, marking guidelines, and marking sheets for paper-based tests; builds model test papers and answers, marking guidelines, and marking sheets for interviews, oral exams, and practical exercises.
- Interview Committee: organizes and grades interview tests.
- Oral Exam and Practical Exercise Committee: organizes and grades oral exam and practical exercise tests.
d) Examination Supervision Committee: organizes examination supervision and related tasks concerning the implementation of examination rules and regulations in the examination area for paper-based and computer-based tests.
- Answer Sheet Committee: organizes the numbering and scanning of answer sheets for paper-based tests.
- Grading Committee: organizes the grading of paper-based tests and thesis defense.
h) Re-grading Committee (if necessary): organizes the re-grading of paper-based tests.
- File Review Committee (if necessary): organizes the review of files for public official career title rank advancement review.
The Examination Board decides on the number of members participating in each unit based on the number of candidates participating in the examination; decides specifically on the functions, tasks, and powers of these units on the principle of non-overlapping tasks, ensuring full implementation of Examination Board activities and meeting examination requirements.
- In cases where necessary, the Chairman of the Examination Board establishes and decides specifically on the number of members, functions, and tasks of the following units:
- Secretarial Assistance Team: performs the duties of the Secretary and other tasks assigned by the Chairman of the Examination Board.
- Copying Team: organizes the creation of copies of materials serving the examination (test papers, answers, instructions, marking sheets, and other materials as required by the Examination Board and the Chairman of the Examination Board).
- Examination or Review Service Unit.
- Members of the Examination Board's assisting units:
- The structure of the assisting unit members includes: Head of the unit, Deputy Head of the unit (if necessary), members including one member who also serves as the unit's Secretary.
- Individuals appointed to assist the Examination Board are civil servants, public officials, or employees of the agency or unit with the authority to organize the examination or review, or another agency or unit as decided by the Chairman of the Examination Board; they must have the appropriate professional qualifications and experience in the relevant field, matching the functions and tasks of each unit and the nature of the examination or review.
- A person may participate in multiple units (this does not apply to the Head of Unit or Deputy Heads of Unit) on the principle of ensuring the independence of the units, the objectivity and transparency of the examination and review processes, without simultaneously performing tasks from different units at the same time or in consecutive works according to a sequence, or in works requiring confidentiality of information, documents, files according to the functions and responsibilities of each unit.
- Duties and powers of the units assisting the Council:
a) The Head of Unit shall be responsible under the law and before the Chairman of the Council for organizing the implementation of tasks according to the functions, duties, and powers of the unit.
- Deputies of the Head of Unit and members participating in the unit shall perform tasks according to the division of labor by the Head of Unit; they shall be responsible under the law and before the Head of Unit for the assigned tasks.
- Coordinate with related units, organizations, entities, and individuals to ensure the successful completion of tasks.
- Manage, preserve, and secure information, documents, and files to ensure safety according to the functions and duties of the unit and the assigned tasks.
d) When transferring and receiving examination and review documents and files to perform assigned tasks according to functions, a handover protocol must be established, signed by both the transferring and receiving parties, and representatives of the units as stipulated by the Council's Regulations (if invited to participate).
- Carry out other tasks assigned by the Council and the Chairman of the Council.
Chapter II
RECRUITMENT OF CIVIL SERVANTS AND CIVIL SERVICE OFFICERS,
GRADE ADVANCEMENT EXAMINATIONS FOR CIVIL SERVANTS
Section 1. GENERAL ORGANIZATIONAL WORK
Article 6. Preparation Work
- The Council is responsible for announcing the list and convening candidates meeting the conditions and standards for the examination and recruitment of civil servants and civil service officers, and providing relevant information on the organization of the recruitment of civil servants and civil service officers, and the examination for promotion to higher ranks of civil servants as prescribed by laws on recruitment, management, and utilization of civil servants and civil service officers.
- At least one working day before the opening ceremony, the Council is responsible for completing the following tasks:
- Posting the list of candidates according to their registration numbers, examination rooms, seating arrangements, rules, formats, and times for each subject at the examination venue.
- The call sheet for entering the examination room must include at least the following information: full name, date of birth, personal identification code, agency or unit of work (for examinations for promotion to higher ranks of civil servants), and registration number. Each candidate has a unique registration number. Candidate registration numbers consist of digits and letters (if any) arranged in ascending order continuously; ensuring that there are no duplicate registration numbers.
- Examination questions, data, answers, marking guidelines, marking sheets, various forms of protocols, lists, and materials serving the examination.
- Badges for members of the Council, Supervisory Board, units assisting the Council, and units serving the examination.
d) Physical facilities to organize computer-based examinations, interviews, discussions, practical exercises, and office supplies serving the examination.
Article 7. Technical Infrastructure of the Examination
- The technical infrastructure of the examination includes the software system used, a list of main and specialized equipment, along with the primary technical standards for each type of equipment and technical requirements for end-users during the operation and exploitation of the technical infrastructure.
- Equipment serving the examination and the process of answering examination questions must be inspected to ensure good operation, properly arranged, and facilitate candidates.
- Examination Room:
- Examination rooms are numbered in ascending order.
- Outside the entrance to the examination room, the list of candidates in that room must be posted.
Article 8. Construction of examination papers, questions, and answers
- Examination paper preparation area and security requirements:
- Examination papers, examination questions, marking guidelines, and answers exclusively for civil servant recruitment periods, examinations for upgrading civil servant ranks that have not been used shall be classified as State Secrets of Confidential level and declassified immediately after the completion of the examination; marking guidelines and answers shall be declassified after the marking process is completed.
- The construction of examination papers, examination questions, marking guidelines, and answers must be carried out at a secure location with adequate protective measures, fire prevention and firefighting equipment, ensuring no electronic information or data transmission between inside and outside the examination paper preparation area.
- All members involved in constructing examination papers, examination questions, marking guidelines, and answers for any examination must be isolated from the outside from the time they gather to prepare the examination papers until the end of that examination. In cases where it is necessary and with the written consent of the Examination Committee Chair, members may leave the area or contact the outside using fixed or mobile phones; conversations must be recorded on speakerphone under the supervision or witness of a member of the Supervisory Board and a representative of the police agency (if invited to participate).
- The entire process of handing over, receiving, and transporting examination papers, examination questions, marking guidelines, and answers must be supervised by a member of the Supervisory Board and a representative of the police agency (if invited to participate); examination paper bags, examination question bags, marking guideline bags, and answer bags must be securely stored and kept confidential during handover, receipt, and transportation.
d) Equipment at the examination paper preparation site (including damaged or unused equipment) can only be removed from the isolation area after the last examination has ended.
- General requirements for examination papers, examination questions, answers, and marking guidelines:
- Ensuring accuracy and scientific rigor;
- Language and wording must be clear, coherent, grammatically correct, and correctly spelled. Absolutely no ambiguous terms or terms with multiple meanings should be used. If it is necessary to use a term with multiple meanings, it must be explained according to its usage in the question;
- Examination papers and questions must be constructed based on the approved list of materials and examination structure and must cover the basic content requirements of the job position being recruited for or the professional standards required for the civil servant rank being upgraded;
d) Examination questions must assess theoretical knowledge; thinking and logical abilities; practical application skills; the combination of theory with testing of thinking, reasoning, synthesis, analysis, and situation handling; evaluation and classification of candidates;
đ) Examination papers must clearly indicate the maximum score for the examination and the points for each examination question.
Article 9. Organization of Opening Ceremony
- The opening ceremony of the examination is organized before the start of the civil servant recruitment period or examination for upgrading civil servant ranks.
- The procedure for organizing the opening ceremony is as follows: Flag-raising ceremony; statement of purpose; introduction of representatives and management agency representatives; announcement of the Decision establishing the Examination Committee; other decisions (establishment of the Supervisory Board; establishment of the Examination Board, Interview Board, and Examination Review Board) must be posted at the location of the opening ceremony; the Chairman of the Examination Committee declares the opening; speech by the management agency representative (if any); the Secretary of the Examination Committee disseminates the organizational plan and internal regulations.
Section 2. ORGANIZATION OF COMPUTER-BASED EXAMINATIONS
Article 10. Preparation for Computer-Based Examinations
1. The server shall be located at a secure site, protected with adequate facilities for preservation, fire prevention, and firefighting, ensuring that it does not receive or transmit electronic information and data between inside and outside the server area except for question and answer data transmitted to workstations and examination computers.
2. The technical infrastructure of the examination area shall not be connected to the outside through the Internet except for a backup connection to the server room to handle unexpected technical situations during the examination period. The backup connection shall only connect to the examination server room. Before the start of the examination, the backup connection must be sealed with confirmation from the Examination Board Chairperson, computer technician, and members of the Supervisory Board. During the examination period, the Examination Board Chairperson may only open the seal on the backup connection upon instruction from the Examination Council Chairperson for the computer technician to perform tasks. After completing the work, the Examination Board Chairperson shall reseal the backup connection with confirmation from the Supervisory Board member.
- Examination Room on Computer-Based Examinations:
- Examination computers in the examination room shall be arranged to ensure each candidate uses one computer to directly complete the examination. The number of candidates in each examination room shall be appropriate to the actual infrastructure conditions.
- Each candidate shall sit at least one meter apart horizontally; if this cannot be met, each examination computer must have partitions or screens at minimum behind, left, and right sides of the screen, ensuring that it does not limit the candidate's examination activities and the proctor's observation.
4. Questions and Answers for Computer-Based Examinations:
- Questions and answers for computer-based examinations must comply with the design requirements of the examination software, compiled in the form of true/false questions, multiple-choice questions, and fill-in-the-blank questions; the number of examination questions shall be built at a minimum three times the total number of questions specified in the examination outline according to each examination subject. The Examination Council Chairperson and the Examination Question Board Leader shall bear legal responsibility in case the number of questions and answers is insufficiently constructed.
True/false questions shall have two options: A and B. Multiple-choice questions shall have four options: A, B, C, and D, which are predefined as the content of the answer. Fill-in-the-blank questions shall have spaces for filling in words or phrases accurately.
- The answers to examination questions shall be presented clearly, detailed, concise, and easily understandable, consistent with the requirements of the questions for testing and evaluation.
- The Examination Question Board Leader shall organize the review of each question and answer; members of the Examination Question Board shall review the questions and answers proposed by other members of the board and suggest necessary revisions and corrections. After the final revision and correction, the Examination Question Board Leader shall compile the questions and answers to form the question and answer data, back up onto a minimum of two secure data storage devices, seal the data storage devices, report to the Examination Council Chairperson for consideration and decision on the use of the question and answer data.
- In cases where the competent authority organizing the civil service grade promotion examination uses the common knowledge question bank provided by the Ministry of Home Affairs, they still must establish an Examination Question Board to implement the business related to questions and answers, report to the Examination Council Chairperson for consideration and decision on the use of the question and answer bank in accordance with regulations.
d) The computer technician responsible for the server receives examination question and answer data from the Examination Board Leader and examination organization data from the Examination Council, enters the data into the server; prints, seals, and hands over the examination shift code to the Examination Board Leader before the examination time; seals the server and examination data storage devices when the examination period ends, witnessed by representatives of the Examination Council, Examination Board, Supervisory Board, and authorized agencies, organizations, and units. The receipt and entry of data shall be completed within 24 hours from the start of the first examination and recorded in a logbook with confirmation from all parties involved. The computer technician responsible for the server must be isolated from the time of entering examination question and answer data into the server until the end of the examination.
Article 11. Organizing the Examination Board Meeting for Computer-Based Examinations
- Prior to organizing the examination, the Head of the Examination Board shall convene a meeting to disseminate plans, regulations, internal rules, tasks, authorities, responsibilities of each member of the board; guide members on necessary contents to uniformly instruct candidates during the examination process.
- At least 30 minutes before the start time of each examination session, the Head of the Examination Board shall convene a meeting to assign tasks to members of the board according to each examination room ensuring non-repetition; disseminate necessary instructions and reminders regarding the examination to members of the board.
- Based on the number of candidates in each examination room, the Head of the Examination Board shall assign invigilators to ensure that each examination room has at least two invigilators, including one main invigilator responsible for invigilation (referred to as Invigilator 1) and at least one computer technician.
- The Head of the Examination Board shall hand over the examination shift code sealed in envelopes to Invigilator 1 to announce the examination shift code according to each examination room.
The Head of the Examination Board shall hand over the examination invigilation files (documents, records serving invigilation work), scratch paper, necessary office supplies to Invigilator 2 or other invigilators in the examination room (in cases where more than two invigilators are arranged in the examination room).
When handing over and receiving, a handover record must be established with signatures confirming from both parties involved, representatives of the Examination Council, and representatives of the Supervisory Board.
Article 12. Examination Organization Method on Computers
- The start time of the examination is pre-programmed in the examination software, automatically starting the examination time according to regulations, uniformly for each examination, independent of the candidate's login account.
- The invigilation procedures are specifically stipulated in the Examination Organization Guidelines of the Examination Council, including the following basic contents:
- Inspect the examination venue, examination rooms, technical infrastructure before the examination time.
- Input examination organization data and question and answer data for computer-based examinations into the server; print out the examination shift code.
c) Call candidates into the examination room, check the Identity Card or Citizen Identification Card or other valid identification documents of the candidates; guide candidates to sit in their designated positions; only allow candidates to bring into the examination room items as prescribed, not allowing candidates to bring prohibited materials and items into the examination room according to examination regulations and rules.
d) Disseminate internal rules, regulations, and matters that candidates need to know and do; guide and support candidates to log in to the examination software correctly using their examination accounts.
đ) Distribute scratch papers clearly marked with the name and signature of the invigilator to candidates in sufficient quantity (without excess); distribute additional papers only upon request; guide and inspect candidates to record information on scratch papers according to regulations.
- When the signal is given or when the specified time arrives, announce the examination shift code to candidates ensuring they can see both sides and the sealing status of the envelope containing the examination shift code before opening it; require two candidates to witness and sign the confirmation record of the examination shift code status before announcing it.
- Manage candidates' examination performance; maintain order and discipline in the examination room; handle any incidents or abnormal situations (if any) or violations by candidates (if any) within the assigned authority.
h) Announce the remaining time before the end of the examination period for candidates to check and complete their information according to regulations before submitting their answers.
i) Collect computer-based examination responses:
During the examination period, candidates may submit their responses through the examination software at any time. Upon the expiration of the examination period, the examination software will automatically stop the examination and collect the responses.
After the examination period ends, the computer technician in the examination room shall check, extract results from the examination software, and print the list of examination results for candidates in the room for them to sign and confirm submission.
Only allow candidates to leave the examination room (end the examination) after the examination period ends for examinations lasting 60 minutes or less, or at least 15 minutes before the end of the examination period for examinations lasting more than 60 minutes but not earlier than 60 minutes from the start of the examination period.
After completing the collection, checking, and extraction of examination organization data; compile reports of the examination shift into the examination invigilation file to hand over to the member assigned by the Head of the Examination Board; delete all stored data on the server; seal the server, workstations, examination computers, or the server room, examination room.
- The Head of the Examination Board shall seal the envelope containing examination responses and the examination invigilation file before handing it over to the Examination Council.
- Handling complaints about the examination: In case candidates discover errors in examination questions or test papers, they must immediately report after the examination ends; the invigilator in the examination room shall immediately report to the Head of the Examination Board to report to the Chairman of the Examination Council for immediate consideration and resolution during the examination.
- In case there are errors in the examination questions, all candidates will automatically be credited points for the erroneous question; if correct options coincide in different orders within the same question, candidates will be credited points if they choose one of those options. Resolutions of errors (if any) must be recorded in a protocol with confirmation from the representative of the agency providing the question bank.
- Candidates exempted from an examination are allowed to be absent from that examination.
Mục 3. ORGANIZATION OF PAPER-BASED EXAMS
Article 13. Preparations for Paper-Based Exams
- Each examination room shall arrange seating positions to ensure that each examinee sits at one table or is seated at least 01 meter apart horizontally. The number of examinees in each examination room shall be appropriate to the actual infrastructure conditions.
- Examination Questions and Answers for Paper-Based Exams
- Examination questions, answers, and marking guidelines shall be compiled according to each question and have detailed grading scales up to 05 (five) points. In cases where detailed answers and marking guidelines are less than 05 (five) points, they shall be reviewed by the Chairman of the Exam Board who will make the decision.
- The Head of the Question Committee is responsible for developing examination questions, answers, and marking guidelines. If a contract is signed with an agency, organization, or unit providing examination questions, the requirements must be clearly stated in the contract. If the bank of questions from an authorized agency is used, the content of the questions, answers, and marking guidelines must be reviewed before forming the official and backup examination papers.
The Head of the Question Committee shall randomly select questions to compile at least 03 different versions of examination papers (accompanied by corresponding answers and marking guidelines); sign off on each version, seal them, and report to the Chairman of the Exam Board. The Chairman of the Exam Board shall randomly choose one of these versions as the official examination paper; the remaining versions shall serve as backup examination papers and be numbered in the order of use if necessary.
- Examination papers must clearly indicate "END" at the end point and must specify the total number of pages (for examination papers with two or more pages).
Article 14. Organization of the Exam Supervision Committee for Paper-Based Exams
- The Head of the Exam Supervision Committee shall convene the committee, hand over the examination question envelopes, supervision files, examination papers, scratch paper, and similar office supplies as stipulated in Clause 1, Clause 2, and Clause 4 of Article 11 of this Regulation for computer-based exams.
- Based on the number of examinees in each examination room, the Head of the Exam Supervision Committee shall assign supervisors to ensure that each examination room has a minimum of 02 invigilators, including one main invigilator responsible for supervising the examination room (referred to as Invigilator 1).
Article 15. Method of Organizing Paper-Based Exams
- The time for starting the exam shall be counted from the moment the start command is given. The maximum time for completing the exam shall be indicated on the examination paper. The invigilator shall record the start time and submission time on the board in the examination room.
- The invigilation procedures are specifically stipulated in the Examination Organization Guidelines of the Examination Council, including the following basic contents:
- Inspect the examination venue, examination rooms, technical infrastructure before the examination time.
b) Call examinees into the examination room, check their Identity Card or Citizen Identification Card or other valid identification documents; guide examinees to sit in the correct position; only allow examinees to bring into the examination room items permitted by regulations, and prevent them from bringing prohibited materials and items according to the examination rules and regulations.
- Announce the examination rules and regulations and matters that examinees need to know and do.
- Distribute examination papers and scratch paper marked with the examinee's name and the signature of the invigilator in sufficient quantity (without excess signatures), and distribute additional papers only upon request; instruct and check that examinees fill in their information on the examination papers and scratch paper as required.
d) Distribute paper-based examination papers:
When the signal is given or when the specified time arrives, open the envelope containing the examination papers to ensure that examinees can see both sides and the sealing condition of the envelope; require 02 examinees to witness, sign the confirmation form regarding the condition of the envelope before opening it, and then distribute the examination papers to the examinees.
In case errors in the examination papers are discovered after opening them (such as mistakes, wrong examination papers, missing pages, or extra pages), or if there are insufficient examination papers, the invigilator shall immediately inform the Head of the Exam Supervision Committee to prepare a report; simultaneously, the Head of the Exam Supervision Committee shall immediately report to the Chairman of the Exam Board for review and resolution. In case of excess examination papers, the invigilator shall only hand over the sealed excess examination papers to the designated member assigned by the Head of the Exam Supervision Committee after 15 minutes from the start of the examination time.
e) Manage the process of examinees taking the exam; maintain order and discipline in the examination room; handle emergencies and unusual situations (if any) or violations by examinees (if any) within the assigned authority.
g) Announce the remaining time before the end of the exam to allow examinees to check and complete their information as required before submitting their work.
- Collecting paper-based examination papers:
Only collect examination papers from examinees after two-thirds of the examination time has passed. At the end of the examination time, instruct examinees to stop working; call each examinee individually to submit their papers, and receive the submitted papers. Upon receiving the papers, count the total number of examination sheets submitted by the examinee, ask the examinee to correctly record the total number of sheets and sign the submission list before allowing the examinee to leave the examination room.
Check and organize examination papers in ascending order of registration numbers contained in the examination paper envelopes. Any incident reports, unusual situation reports, and violation handling reports (if any) shall be compiled into the supervision file and placed in a separate envelope. Hand over the examination papers and supervision files to the members assigned by the Head of the Exam Supervision Committee for the task of collecting examination papers. The examination papers and supervision files must be publicly checked and cross-referenced with the number of examination papers and the total number of sheets of each paper against the submission list.
After checking, the envelope containing the examination papers and the submission list of each examination room shall be sealed on-site by the member assigned by the Head of the Exam Supervision Committee for collecting examination papers and the invigilators of that examination room; sign across the seal label with the envelope and sign the handover receipt.
- The Head of the Examination Board shall seal the envelope containing examination responses and the examination invigilation file before handing it over to the Examination Council.
- Handling complaints about the exam: If an examinee discovers errors in examination questions or papers during the examination time, the examinee must immediately lodge a complaint; the invigilator shall immediately report to the Head of the Exam Supervision Committee to report to the Chairman of the Exam Board for immediate review and resolution to ensure the examinee's right to examination time.
- Sealing
The sealing process of the Sealing Committee is specifically defined in the Examination Organization Guidelines of the Exam Board, including the following basic contents:
- Receive examination papers enclosed in envelopes still intact and sealed from the Exam Board to organize the numbering of the examination papers ensuring the principle that the sealing number does not match the examinee's registration number.
- Cutting the seal; sealing the answer sheets that have been cut and handing them over to the Examination Board; sealing the top of the seal, the sheet for matching seals with candidate numbers and preserving them throughout the marking period until the marking is completed;
- After the Examination Board completes the marking, hand over the sealed envelopes containing the top of the seal, the sheet for matching seals with candidate numbers to the Examination Board for organizing the consolidation of examination results;
- Securing the seal number and related information until the examination results are approved and announced;
d) In cases where a re-examination does not involve redoing the seal, the Examination Board decides on the allocation of the working group or members of the Examination Board to consolidate the scores of the re-examined papers;
- Consolidation and announcement of examination results;
- After completing the marking as stipulated in Article 16 of this Regulation, the Examination Board organizes the consolidation of examination results from the summary sheet of marking results and the sheet for matching seals with candidate numbers, forming the initial examination results to announce and inform about the acceptance of appeals according to regulations;
- After completing the re-marking as stipulated in Article 17 of this Regulation, the Examination Board consolidates the final examination results after processing the examination results according to Article 18 of this Regulation, reports to the head of the competent authority for recruiting civil servants and officials, or the organization conducting the civil servant grade promotion examination for approval and recognition of the examination results before the Examination Board announces the approved and recognized examination results according to regulations;
In cases where there is no re-examination, after the deadline for submitting appeals has expired, the Examination Board reports to the head of the competent authority for recruiting civil servants and officials, or the organization conducting the civil servant grade promotion examination for approval and recognition of the examination results before the Examination Board announces the approved and recognized examination results according to regulations;
Article 16. Marking paper-based examination papers;
- Organization of marking:
- The marking shall be carried out centrally in a protected area equipped with sufficient fire prevention and firefighting equipment as decided by the Chairman of the Examination Board; it must be fully equipped with tools and materials necessary for marking;
- Answer sheets must be sealed and securely stored; when transferring answer sheets, a record must be made and signed in the presence of members of the Supervisory Committee and representatives of the police force (if invited);
- Marking can only be done using red ink pens provided by the Examination Board;
- Examination papers cannot be taken out of the marking location;
d) Mobile phones, audio recorders, cameras, computers, technical devices for transmitting and receiving information, data backup devices, other storage devices containing information, personal documents, erasers, pencil erasers, pencils, and other types of pens not specified in the marking rules are prohibited from being brought into or out of the marking area;
- Before marking, the Head of the Marking Committee organizes a meeting to assign tasks; marking must follow the marking guidelines, answers, and grading scales that have been approved;
- Members of the marking committee and the Head of the Marking Committee must check the marking results to ensure no incorrect points are added and bear legal responsibility before the Chairman of the Examination Board for the marking results;
- If there is a correction of marked points, the old point must be crossed out, the new point must be recorded, and the person making the correction must sign at the place of correction;
- The Head of the Marking Committee organizes the consolidation of individual marking results into the general summary sheet, which must be signed by all marking committee members and the Head of the Marking Committee, accompanied by the individual marking score sheets, placed in sealed envelopes, and handed over to the Examination Board;
- Marking paper-based examination papers;
Marking of paper-based examination papers shall be conducted according to the principle of two independent rounds as follows;
- First round of marking (by marking member 1);
The Head of the Marking Committee randomly selects answer sheets and assigns them individually to each marking member;
Before marking, each marking member must check each answer sheet to ensure the correct number of pages, seal numbers, and cross out all unused blank spaces left by candidates. Marking members cannot mark papers that are not on the designated examination paper;
The Head of the Marking Committee will consider and decide on the marking of papers in cases where they lack the required number of pages or seal numbers, are written on different paper than the examination paper, contain more than two different handwriting styles, are written in more than two different ink colors (except in cases confirmed by the invigilator and the Chief Invigilator), are written in ink not conforming to regulations, contain unrelated content, are torn, or have suspicious markings;
During the first round of marking, apart from crossing out unused spaces, marking members cannot write any other content or symbols on the candidate's paper or envelope. Detailed marking results for each question, total marks for the paper, and comments (if any) must be recorded on the individual marking score sheet and attached to the paper; the marking score sheet must clearly state the name and signature of marking member 1;
- Second round of marking (by marking member 2);
After marking member 1 has completed their marking, the Head of the Marking Committee randomly assigns marking member 2 to ensure that the same marking member 1 does not receive the same set of answer sheets again;
Marking member 2 performs marking similar to marking member 1 as stipulated in this point. Once marking is complete, marking member 2 returns the marked answer sheets to the Head of the Marking Committee;
- Processing of marking results after the second round of marking is completed;
If the total marks of the two rounds differ by five points or less, the official marking result for that paper is the rounded average of the two total marks, recorded in the designated position on the examination paper. All marking members involved in marking that paper must sign and clearly state their names on all examination papers.
In case the total score of an answer sheet differs by more than five (5) points but less than ten (10) points between two graders, the Head of the Grading Committee shall organize a dialogue with the two graders to reach an agreement. If they cannot agree, the Head of the Grading Committee shall decide on the final grading result and bear legal responsibility for such decision. The final grading result shall be rounded off to one (1) decimal place and recorded in the designated position on the answer sheet. All members involved in grading that answer sheet and the Head of the Grading Committee shall sign and write their full names on all answer sheets. In case there is any correction to the final grading result of an answer sheet, the Head of the Grading Committee and the members who graded that answer sheet shall jointly sign to confirm.
In case the total score of an answer sheet differs by ten (10) points or more between two graders, the Head of the Grading Committee shall assign it to a third grader. The scores of each question, the total score of the answer sheet, and any comments (if any) shall be detailed recorded on the grading form and attached together with the answer sheet; the grading form shall clearly state the name and signature of the third grader.
d) Handling the grading results after the third grader completes the grading:
In case the scores of two out of three graders are the same, the final grading result of that answer sheet shall be the same scores, recorded in the designated position on the answer sheet. All members involved in grading that answer sheet shall sign and write their full names on all answer sheets.
In case the scores of the three graders differ from each other, the Head of the Grading Committee shall organize a collective grading and decide on the final grading result. The final grading result shall be rounded off to one (1) decimal place and recorded in the designated position on the answer sheet. All members involved in grading that answer sheet and the Head of the Grading Committee shall sign and write their full names on all answer sheets. In case there is any correction to the final grading result of an answer sheet, the Head of the Grading Committee and the members who graded that answer sheet shall jointly sign to confirm.
- Assigning zero (0) points for paper-based exams:
The Head of the Grading Committee shall decide to assign zero (0) points based on the written report of the grader, applicable in one of the following cases:
a) There are two or more answer sheets of the same candidate for the same exam.
b) An answer sheet contains two or more different handwriting styles.
c) An answer sheet is written in two or more different ink colors or in an ink color not in accordance with regulations, except in cases where there is a record confirmed by the invigilator in the examination room and the Head of the Invigilation Committee.
d) An answer sheet is written on paper that is not the examination paper distributed by the invigilator in the examination room.
Article 17. Re-grading paper-based exams
- Before transferring the answer sheets of candidates requesting re-grading (except for the cases stipulated in Clause 8 of this Article) to the Head of the Re-grading Committee, the Board shall carry out the following tasks:
- Search by registration number to find the answer sheet according to the ticket number; withdraw the answer sheet, compare with the list of submitted answer sheets to check the number of examination papers and related information, ensuring that the wrong answer sheet of another candidate is not withdrawn.
- Cover the grading results and the names of previous graders before creating a true copy of the candidate's answer sheet, ensuring that the members of the Re-grading Committee do not recognize the grading results and previous graders.
- The Chairman of the Board decides to redo the ticket number of the candidate's answer sheet; if the ticket number is redone, it shall be carried out in accordance with the provisions of Clause 3 of Article 15 of this Regulation.
- Transfer the true copies of the answer sheets to be re-graded, sealed in bags (the outside of the bag should clearly indicate the answer sheet number and the total number of examination papers), to the Head of the Re-grading Committee.
d) Carry out other related tasks for re-grading.
- The Head of the Re-grading Committee receives the transfer of answer sheets from the Board, assigns members to re-grade and organizes re-grading for each subject. The re-grading of paper-based exams shall be conducted as stipulated in Article 16 of this Regulation.
- Handling re-grading results:
- In case the re-grading results of an answer sheet are the same between two graders, the re-grading result shall be the same score, recorded in the designated position on the answer sheet. All members involved in re-grading that answer sheet shall sign and write their full names on each answer sheet.
- In case the re-grading results of an answer sheet differ between two graders, the Head of the Re-grading Committee shall assign it to a third re-grader. If the re-grading results of two out of three re-graders are the same, the re-grading result shall be those same scores. If the re-grading results of the three re-graders differ, the re-grading result shall be the average of the three re-grading scores, rounded off to one (1) decimal place. All members involved in re-grading that answer sheet shall sign and write their full names on all answer sheets.
- The Head of the Re-grading Committee shall organize the compilation of re-grading results along with the Re-grading Score Sheet of each re-grader for each answer sheet, seal them, and hand them over to the Board. When handing over, a record must be made with the presence of a member of the Supervisory Board and a representative of the police force (if invited to participate).
- The re-grading results shall be notified to the person who requested re-grading; at the same time, they shall be publicly announced on the website or electronic portal of the competent authority for recruiting civil servants and officials, or organizing the promotion of civil servant ranks.
- During the process of handling re-grading, in addition to the members of the Re-grading Committee, there must be at least two members of the Board participating, under the supervision of a member of the Supervisory Board and a representative of the police force (if invited to participate).
- During the re-grading process, members involved in re-grading must keep confidential the registration number and personal information of candidates with the ticket number.
8. No re-examination shall be conducted for papers for which the application for re-examination is received after the prescribed deadline (as determined by the postmark if the application is sent via postal service); no re-examination shall be conducted for papers submitted via email, fax, or telex.
Article 18. Handling Examination Results After Re-examination of Written Exams
- The Chairman of the Board shall examine and decide on the handling of examination results after re-examination as follows:
In cases where the re-examination result and the announced examination marking result differ by less than five (5) points, the examination result shall be adjusted according to the re-examination result.
In cases where the re-examination result and the announced examination marking result differ by five (5) points or more, the Chairman of the Board shall organize a direct dialogue between the Head of the Examination Marking Committee and the Head of the Re-examination Committee (with minutes recorded). Following the dialogue, the Chairman of the Board shall decide on the re-examination score and adjust the paper score according to the re-examination score.
In cases where there is sufficient evidence to determine that there has been misconduct, the Chairman of the Board shall report to the head of the agency or unit with the authority to recruit civil servants and officials, or to organize the promotion examination for civil servants, for consideration and handling in accordance with the provisions of the law.
- The result recognized after re-examination is the official examination result of the candidate.
Section 4. ORGANIZING INTERVIEW, QUESTION-AND-ANSWER, PRACTICE, AND DEFENSE OF PROPOSALS
Article 19. Preparation Work for Interview, Question-and-answer, Practice, and Defense of Proposals Examinations
- Examination Room:
- The examination room shall be arranged appropriately for the content and method of organizing interview, question-and-answer, practice, and defense of proposals examinations, ensuring that each candidate's examination portion is carried out independently without being affected or affecting other candidates' examination portions; soundproofed from the waiting room for candidates who have not yet taken the examination; and having an exit route that does not pass through the waiting room to ensure that candidates do not come into contact or exchange examination content with candidates in the waiting room after the interview.
- For interviews, question-and-answer sessions, and proposal defenses, examination rooms shall be arranged in separate rooms; in cases where multiple interview, question-and-answer, and proposal defense marking tables must be set up in the same room, it must be ensured that there are partitions and sufficient distance between the tables to comply with the principle stipulated in point a of this clause. The minimum distance between the position of the interviewers, question-and-answer session members, and proposal defense markers and the candidates shall be one meter and shall facilitate communication.
- Examination questions, interview, question-and-answer, and practice questions:
- The examination questions shall be developed with marking guidelines and marking sheets reflecting specific evaluation criteria and scoring targets.
- Interview examination questions must be based on the nature and characteristics of public service activities to focus on evaluating the candidate's abilities: thinking, communication, situational judgment, learning, development, expression, attitude, and other required abilities for the position of the civil servant to be recruited. Question-and-answer examination questions must be based on the nature and characteristics of professional activities to test the candidate's knowledge and skills in professional activities according to the requirements of the position of the official to be recruited. The number of questions in the examination shall be at least equal to the number of members of the Interview Committee and the Examination Committee implementing the interview and question-and-answer sessions as stipulated for each examination.
- The content and number of practice examination questions must be based on the nature and characteristics of professional activities to test the candidate's knowledge and skills in professional activities according to the requirements of the position of the official to be recruited; they must be suitable for the examination time decided by the head of the recruiting authority.
- In addition to the examination questions in the examination, to serve the purpose of evaluating, scoring, and classifying candidates effectively, members of the Interview Committee and the Examination Committee may ask additional related questions but must ensure that the examination time of the candidates does not exceed the prescribed examination time. These questions must meet the requirements for examination questions as stipulated in this Regulation; members of the Interview Committee and the Examination Committee are responsible for their questions and their scoring.
Article 20. Organizing the Interview Board, Examination Board, and Grading Board Meetings
- The Head of the Interview Board, the Head of the Examination Board, and the Head of the Grading Board shall organize meetings of their respective boards, hand over examination question bags, guide on grading, marking sheets, and similar office supplies for computer-based examinations as stipulated in Clauses 1, 2, and 4 of Article 11 of this Regulation.
- The Head shall assign members to ensure that each candidate has at least two board members conducting interviews, questioning, practical assessment grading, and project defense grading.
Article 21. Methods of Conducting Interviews, Questioning, Practical Assessments, and Project Defenses
- The examination time starts from when the candidate begins the interview, questioning, practical assessment, and presentation of the project after completing the preparation period as prescribed. If the candidate does not start the examination upon completion of the preparation period, the examination time will commence immediately after the end of the preparation period.
- The process of organizing interviews, questioning, and practical assessments is detailed in the Examination Organization Guidelines of the Council, including the following main contents:
- Inspect the examination venue, examination rooms, technical infrastructure before the examination time.
- Calling candidates into waiting rooms, checking the candidate's Identity Card, Citizen Identification Card, or other valid identification documents; guiding candidates to their designated positions in the examination room; allowing only permitted items to be brought into the examination room, prohibiting prohibited materials and items according to examination rules and regulations.
- Announce the examination rules and regulations and matters that examinees need to know and do.
- Guiding and checking candidates' information recording on necessary documents for the examination (if applicable).
d) Based on the content and nature of the examination, recruitment plans, and recruitment announcements, the Chairman of the Council decides on the method of announcing examination questions to candidates to ensure they have sufficient preparation time as required. The announcement must ensure transparency, fairness, and equal access to information for all candidates.
In case errors in the examination questions are discovered after announcement (including errors, wrong questions, missing pages, or incorrect pages), a record must be made and reported immediately to the Head of the Interview Board and the Head of the Examination Board for review and resolution within their assigned authority.
e) Conducting interviews, questioning, and grading candidates. The content of interviews and questioning (including candidates' responses) must be recorded simultaneously in writing with signatures of confirmation from the interviewers, questioners, and candidates, or through one of the following methods: audio files storing the voices of interviewers, questioners, and candidates, or multimedia files storing images and voices of interviewers, questioners, and candidates.
Managing candidates' examination performance; maintaining order and discipline in the examination room; handling unexpected situations and irregularities (if any) or dealing with candidates' violations (if any).
- Reporting immediately to the Head of the Interview Board and the Head of the Examination Board for review and resolution when unexpected situations occur.
i) Notifying candidates of the remaining time before the end of the examination; checking and completing candidates' information as required before the conclusion of the examination.
k) Handling complaints regarding practical examinations: If candidates discover errors in examination questions or papers during the examination, they must immediately report them; Examination Board members must promptly report to the Head of the Examination Board to inform the Chairman of the Council for immediate review and resolution to ensure candidates' rights to examination time.
- For project defense examinations, implementation shall follow the examination organization guidelines established by the Council.
Article 22. Grading Interview, Questioning, Practical Work, and Project Defense Exams
- The grading of interviews, questioning, practical work, and project defense shall be independently conducted by each grader on a scoring sheet for each candidate, with signatures and full names of the graders recorded.
- Processing the results of interview, practical work, and project defense grading:
- In cases where the scores differ by up to 05 (five) points (the highest score compared to the lowest score), the official grading result will be the rounded average of all scores to one decimal place, recorded in the comprehensive grading result table. All participating graders will sign and record their full names in the comprehensive grading result table.
b) In cases where the scores differ by more than 05 (five) points but less than 10 (ten) points (the highest score compared to the lowest score), the official grading result will be determined by the Head of the Interview Board, the Head of the Examination Supervision Board, and the Head of the Grading Board after holding a dialogue with the participating graders, rounded to one decimal place, and recorded in the comprehensive grading result table. Participating graders and the Heads of the Interview Board, Examination Supervision Board, and Grading Board will sign and record their full names in the comprehensive grading result table.
- In cases where the scores differ by 10 (ten) points or more (the highest score compared to the lowest score), the official grading result will be decided by the Chairman of the Council based on reports from the Head of the Interview Board, the Head of the Examination Supervision Board, and the Head of the Grading Board, and the outcomes of dialogues between participating graders. The official grading result will be rounded to one decimal place and recorded in the comprehensive grading result table. Participating graders and the Chairman of the Council will sign and record their full names in the comprehensive grading result table.
- The Head of the Interview Board, the Head of the Examination Supervision Board, and the Head of the Grading Board will hand over the sealed envelope containing the graded interview, questioning, practical work, and project defense results to the Council immediately after the exam ends.
- Appeals regarding the grading results of interviews, questioning, practical work, and project defense will not be accepted.
Chapter III
ORGANIZATION OF RANK PROMOTION REVIEW FOR PROFESSIONAL CIVIL SERVANTS
Article 23. Preparation for Rank Promotion Review
Based on current regulations concerning standards and conditions for registering to participate in rank promotion reviews, the Chairman of the Council decides on specific methods for organizing the review of application files, the Application File Review Form, and other forms serving the review process, ensuring accuracy, fairness, objectivity, scientific rigor, and compliance with legal provisions.
Article 24. Organization of Application File Review for Rank Promotion
- When assigned to review one application file, all designated reviewers will jointly conduct the review.
- Based on the components of the application file and the criteria for reviewing, the reviewer evaluates whether the application file meets the standards and conditions for rank promotion and records the evaluation results and related information (if any) on the Application File Review Form.
- During the review process, if the reviewers do not reach a consensus on the review results, the application file and the individual review results will be referred to the Head of the Review Board for consideration and decision or reported to the Head of the Review Board for consolidation and reporting to the Chairman of the Council for consideration and decision.
- The review results of each application file will be compiled into a comprehensive review result table, signed by all participating reviewers and the Head of the Review Board.
- The Head of the Review Board will hand over the review results of each application file and the comprehensive review result table, sealed in an envelope, to the Council.
- When handing over and receiving, a handover record must be established with signatures confirming from both parties involved, representatives of the Examination Council, and representatives of the Supervisory Board.
- Depending on the number of application files, the nature of professional activities, standards, and conditions for rank promotion, the Council may directly review the application files according to this provision without establishing a Review Board.
Article 25. Decision on the results of the promotion examination
1. The Chairman of the Council shall convene the Council to review the results of the promotion examination; members of the Council shall openly and democratically exchange and discuss the results of the promotion examination; unify the results of the promotion examination period and the list of successful candidates.
- The Chairman of the Council shall report to the head of the agency or unit organizing the promotion examination of the occupational title of civil servants for consideration and decision to approve the results of the promotion examination period and the list of successful candidates in accordance with regulations.
- Determining the successful candidates in the promotion examination period shall be carried out in accordance with the provisions of Article 40 of Decree No. 115/2020/ND-CP, amended at Clause 20, Article 1 of Decree No. 85/2023/ND-CP and the regulations of the Ministry managing the occupational titles of civil servants in specialized fields.
Chapter IV
OTHER TASKS
Article 26. Supervision of the recruitment examination for civil servants and public officials, the examination for upgrading the rank of civil servants, and the promotion examination of the occupational title of public officials
- The head of the agency authorized to recruit civil servants and public officials, organize examinations for upgrading the rank of civil servants, and promote the occupational title of public officials must establish a Supervisory Board, including: Head of the Supervisory Board, Deputy Head of the Supervisory Board, members of the Supervisory Board, and members兼任秘书处直接参与监督委员会活动的秘书。在主席团成员、组织或单位负责人授权招聘公务员、考试晋升公务员职级、审查晋升公务员职业职称的情况下,由上级主管干部、公务员和职员的机关或组织负责人决定成立监督委员会。
The Supervisory Board may use the seal of the agency, organization, or unit authorized to establish the Supervisory Board or the seal of the direct advisory body in the activities of the Supervisory Board, as decided by the head of the agency, organization, or unit authorized to establish the Supervisory Board.
- Duties and powers of the Head of the Supervisory Board:
To be responsible under the law, before the head of the agency or unit authorized to recruit civil servants and public officials, organize examinations for upgrading the rank of civil servants, and promote the occupational title of public officials during the process of supervising the implementation of the examination and review by the Council in accordance with the law; to assign specific tasks to each member of the Supervisory Board and perform duties and powers stipulated in points b and c of Clause 4 of this Article.
- Duties and powers of the Deputy Head of the Supervisory Board:
To assist the Head of the Supervisory Board in managing some activities of the Supervisory Board according to the assignment of the Head of the Supervisory Board; to be responsible under the law, before the Head of the Supervisory Board for the assigned tasks.
- Duties and powers of the members of the Supervisory Board:
- To carry out supervision tasks as assigned by the Head of the Supervisory Board; to report to the Head of the Supervisory Board on the results of supervision and be responsible under the law, before the Head of the Supervisory Board for the assigned tasks.
b) Members of the Supervisory Board have the right to enter the examination room or review room during the examination or review period, the marking room during the marking period, and the re-marking and sealing process when discovering violations of examination rules and regulations; they have the right to remind examinees, other members of the Council, and members of the Council's assisting units to comply with examination rules and regulations; they have the right to request the invigilator of the examination room to record the misconduct of examinees in the examination room (if any).
- Members of the Supervisory Board have the right to record misconduct in cases where members of the Council or members of the Council's assisting units violate rules and regulations, and to propose that the head of the agency or unit authorized to recruit civil servants and public officials, organize examinations for upgrading the rank of civil servants, and promote the occupational title of public officials consider and handle such violations in accordance with the Party's regulations and laws on cadres, civil servants, and public officials.
- Within three working days from the date of announcing the final results of the examination or review, the Supervisory Board has the responsibility to report to the head of the agency or unit authorized to recruit civil servants and public officials, organize examinations for upgrading the rank of civil servants, and promote the occupational title of public officials on the results of the Supervisory Board's activities.
- The content of supervision includes: Implementation of legal provisions on organizing the recruitment examination for civil servants and public officials, examinations for upgrading the rank of civil servants, and promotion examinations of the occupational title of public officials; implementation of regulations and internal rules as stipulated in this Circular and those issued by the Council; performance of responsibilities and tasks by members of the Council and members of the Council's assisting units; consistency between documents issued by the Council and the provisions of this Circular and relevant laws.
Supervision shall not affect the results of examinees, except in cases of serious violations of examination marking regulations.
- Location of supervision: At the workplace of the Council, the workplace of the Council's assisting units, and the location of the examination or review.
- Criteria for members of the Supervisory Board:
- Members of the Supervisory Board are civil servants or public officials of the agency or unit authorized to recruit civil servants and public officials, organize examinations for upgrading the rank of civil servants, and promote the occupational title of public officials, or of another agency or unit designated by the head of the agency or unit authorized to recruit civil servants and public officials, organize examinations for upgrading the rank of civil servants, and promote the occupational title of public officials.
- People who participate as members of the Council, members of the Council's assisting units; people who have marital relationships, blood relations, adoption relations, or close kinship with the candidates for recruitment of civil servants and public officials, candidates for examinations for upgrading the rank of civil servants, or candidates for promotion examinations of the occupational title of public officials; people currently undergoing disciplinary measures or implementing disciplinary decisions; people who have been punished for corruption or negative behavior or are currently implementing disciplinary decisions shall not be appointed as members of the Supervisory Board.
- In case a member of the Supervisory Board fails to fulfill their assigned duties and responsibilities or interferes with the work of members of the Council or members of the Council's assisting units for personal motives or purposes, the members of the Council and the members of the Council's assisting units have the right to request the Chairman of the Supervisory Board to suspend the performance of duties by that member of the Supervisory Board; at the same time, the Chairman of the Supervisory Board has the responsibility to report to the head of the agency or unit with management authority for examination and handling according to the regulations of the Party and laws on cadres, civil servants, and public officials.
9. In cases where the competent state agency managing civil servants and public officials appoints representatives to participate in supervision or organizes independent inspection and supervision teams regarding the authority, procedures, and processes for organizing the recruitment of civil servants and public officials, promotion examinations for civil servants, and evaluation for promotion of professional ranks for public officials as prescribed, such activities must also ensure the principles of supervision as stipulated in this Article.
Article 27. Handling complaints and reports
During the organization of the recruitment period for civil servants and public officials, promotion examinations for civil servants, and evaluation for promotion of professional ranks for public officials, the handling of letters and petitions reflecting, proposing, complaining, and reporting shall be carried out in accordance with the provisions of the law on complaints and reports, specifically:
- In cases where letters and petitions reflect, propose, or report about the Chairman of the Council and its members, the head of the agency or unit with the authority to recruit civil servants and public officials, organize promotion examinations for civil servants, and evaluate for promotion of professional ranks for public officials shall examine and resolve.
In cases where the head of the agency or unit with the authority to recruit civil servants and public officials, organize promotion examinations for civil servants, and evaluate for promotion of professional ranks for public officials is the Chairman of the Council, the head of the superior agency or organization with the authority to manage cadres, civil servants, and public officials shall examine and resolve.
- In cases where letters and petitions reflect, propose, or report about the assisting units of the Council or about the results of the examination or evaluation period, the Council shall examine and resolve in accordance with the provisions of the law on complaints and reports.
- In cases where there are letters and petitions reflecting, proposing, complaining, or reporting about matters related to the recruitment period for civil servants and public officials, promotion examinations for civil servants, and evaluation for promotion of professional ranks for public officials after the Council has been dissolved, the head of the agency or unit with the authority to recruit civil servants and public officials, organize promotion examinations for civil servants, and evaluate for promotion of professional ranks for public officials shall examine and resolve in accordance with the provisions of the law on complaints and reports.
Article 28. Archiving Documents
- The files and documents relating to the recruitment period for civil servants and public officials, promotion examinations for civil servants, and evaluation for promotion of professional ranks for public officials include: Documents on the implementation process; minutes of meetings of the Council and meetings of the Council's assisting units; consolidated lists of individuals meeting the conditions to participate in the recruitment of civil servants and public officials, promotion examinations for civil servants, and evaluation for promotion of professional ranks for public officials; handover records throughout the entire implementation process (as prescribed by the Examination Council); original test questions, answers, marking guidelines, marking sheets, file review sheets; audio files, multimedia files (if applicable for interview or questioning tests); summary tables of examination and evaluation results; minutes of violations of rules and regulations (if any); decisions recognizing examination and evaluation results; decisions resolving complaints and reports (if any), and other types of minutes, documents, and materials related to the recruitment period for civil servants and public officials, promotion examinations for civil servants, and evaluation for promotion of professional ranks for public officials.
Within one year from the end date of the recruitment period for civil servants and public officials, promotion examinations for civil servants, and evaluation for promotion of professional ranks for public officials, the Council Member兼任秘书负责在该招聘期结束后一年内,将本条第1款规定的全部文件和材料连同密封的答题袋和密封的试卷袋移交给有权招聘公务员和职员、组织晋升考试和专业职级评定的机关或单位,以便按照档案法的规定进行保管。
