OF THE MINISTER OF PUBLIC SECURITY NO. 001/CA ON DECEMBER 4, 1957 REGULATING PROCEDURES FOR REGISTRATION OF PERSONS ENGAGED IN THE BUSINESS OF ENGRAVING STAMPS
ENGAGED IN THE BUSINESS OF ENGRAVING STAMPS
THE MINISTER OF PUBLIC SECURITY
WHEREAS, Decree No. 488/TTg dated March 30, 1955 of the Prime Minister on registration of various types of commercial and industrial businesses;
WHEREAS, Decision No. 609/TTg dated November 4, 1955 of the Prime Minister on permission for business operations and registration of commercial and industrial businesses;
WHEREAS, Circular No. 3191 dated December 9, 1955 of the Prime Minister on allocation of departments responsible for registering commercial and industrial businesses;
AFTER CONSULTATION WITH THE MINISTRY OF TRADE;
DECREE
Article 1: All individuals engaged in the business of engraving characters, printing plates, stamps (wet seals, sunken seals, raised seals) on metal, wood, plastic, etc., generally referred to as stamp engraving, whether operating a shop, selling goods outdoors, or only providing engraving services without displaying goods or operating a shop, must complete registration procedures at the designated public security agencies as stipulated in this decree.
Article 2: Within thirty days from the date of promulgation of this decree by the People's Committees of provinces, cities, and areas without provincial administration, all individuals who have been engaged in stamp engraving prior to the promulgation of this decree must submit the following documents to the Provincial, Municipal, or District Public Security Departments:
An application for business registration
A personal history record
A recent half-body photograph measuring 4x6 centimeters, with a two-thirds profile view.
While awaiting approval of the registration application, those individuals engaged in stamp engraving may continue their business operations until a new decision is issued.
Article 3: Individuals engaging in stamp engraving activities after the promulgation of this decree must comply with the registration procedures set forth in Article 2 and may only commence operations upon receipt of a permit.
Article 4: Whenever there is a change in the business name, alteration of shares, relocation of the business premises to another location, reduction or expansion of the scope of business, transfer of the business premises to another person, or closure of the business premises, individuals engaged in stamp engraving must notify the directly managing public security agency ten days in advance. In cases where the business premises are relocated to another province or city, upon arrival, they must simultaneously report their continued business operations along with their household registration to the public security agency of the new location.
Article 5:
a- Individuals engaged in stamp engraving may only accept orders to engrave stamps belonging to government agencies, military units, and mass organizations at various levels when the person placing the order provides sufficient introduction letters from the relevant agency or organization and an introduction letter for stamp engraving from the public security agency where the stamp engraver operates, accompanied by the identification card of the person placing the order.
b- When accepting orders to engrave stamps such as "Confidential," "Urgent," "Express," "Proxy Signature," personal signatures, titles affixed to documents, printed materials, or private stamps (individuals or organizations), individuals engaged in stamp engraving must require the person placing the order to present one of the following documents for recording in the logbook: Identification card, business registration certificate, household registration book.
Article 6: Each stamp engraved must be recorded in a logbook with the full name, name, age, address, nationality, occupation of the person placing the order, the number and date of issuance of the introduction letter from the agency, organization, or public security agency, or the number and date of issuance of the identification card, business registration certificate, or household registration book, the quantity, size, and content of the item, the date of receipt, and the date of delivery. Upon completion of each stamp, the individual engaged in stamp engraving must affix a sample of the stamp in the logbook for presentation to authorities if required.
Specifically, for stamps belonging to government agencies, mass organizations, and the military as mentioned in Clause a of Article 5 of this decree, before delivering the stamp to the customer, the business owner must take the stamp to the police station where they operate or the public security agency of the commune (if there is no police station) to affix a sample, while returning the introduction letter from the agency placing the order and the public security agency.
Article 7: If an individual engaged in stamp engraving does not operate continuously for two months and the registration authority finds no valid reason, the business permit will be deemed invalid.
Article 8: Any individual engaged in stamp engraving who violates the provisions set forth above shall be subject to criticism, warning, temporary or permanent revocation of the business permit, or prosecution depending on the severity of the offense.
Article 9: Previous regulations contrary to this Decree are abolished.
Article 10: The People's Committees of regions, provinces, and cities, the Heads of Administrative Security Departments, and the Directors of Administrative Security Services of the Ministry of Public Security are responsible for implementing this Decree.
