RESOLUTION

On the land use plan for the entire country for five years from 1996 to 2000

OF THE NATIONAL ASSEMBLY SOCIALIST REPUBLIC OF VIET NAM

Pursuant to Article 84 of the Constitution of the Socialist Republic of Vietnam in 1992;

Pursuant to Article 18 of the Land Law;

After considering the Government's report on the planning and land use plan for the entire country until 2010 as presented in Report No. 1091/KTN dated March 10, 1997, and the opinions of the National Assembly deputies;

RESOLUTION:

1- Approves the land use plan for the entire country for five years from 1996 to 2000 with the main targets as follows:

The total natural land area of the entire country is: 33,104,200 hectares, allocated as follows:

a) Agricultural land reaching 8,992,500 hectares by 2000;

Where:

Paddy fields: 4,230,000 hectares;

Additional agricultural land and perennial crop land due to reclamation:

500,000 - 700,000 hectares;

b) Forestry land with standard forests reaching 11,008,900 hectares by 2000

Where:

New planted forests and forest regeneration: 2,500,000 hectares, including:

Newly planted forests: 1,000,000 hectares;

Forest regeneration: 1,500,000 hectares;

Thus, the coverage rate reaches 40% of the total natural land area; of which:

Coverage by forest trees: 33%;

Coverage by perennial agricultural crops: 7%;

c) Special-use land: 1,468,300 hectares;

d) Rural residential land: 751,100 hectares;

đ) Urban land: 155,400 hectares;

e) Unused land: 10,728,000 hectares.

2- Based on this Resolution, the Government directs Ministries, ministerial-level agencies, agencies under the Government, Provincial People's Councils, and centrally-administered city People's Councils within their respective functions and powers to develop land use plans until 2000 and annual plans to be submitted to the Government for review and implementation of these plans.

During the process of implementation, attention should be paid to the following issues:

a) The implementation of the land use plan must be closely linked to economic and social development goals, national defense and security tasks; ensuring national food safety; protecting the ecological environment; minimizing the conversion of paddy fields and forest land to other uses; having reasonable policies for farmers and foresters to have land for production and feel secure in production; encouraging investment in the exploitation and utilization of vacant hills and barren mountains; land allocation and leasing must be carried out according to authority, based on land use planning and economic-technical feasibility studies approved by competent state agencies, ensuring economical, rational, purposeful, and effective land use;

b) Reviewing laws and regulations on land, promptly submitting to the National Assembly and the Standing Committee of the National Assembly for amendment, supplementation, and issuance of laws and regulations on land; at the same time amending, supplementing, and issuing guiding documents for the implementation of the Land Law and related laws and ordinances, creating a consistent legal basis for land management and use;

c) Consolidating, strengthening, and perfecting the organizational structure of land management agencies at central, provincial, and centrally-administered city levels, district, county, town, and provincial city levels, and cadres of land administration at commune, ward, and town levels; ensuring that these agencies operate effectively, enhancing the effectiveness of state management over land;

d) Strengthening the guidance of statistical work, land inventory, accurately determining the area and quality of various types of land nationwide, especially forestry land with forests; accelerating the progress of issuing certificates of land use rights; strengthening supervision and inspection of land management and use; promptly resolving land disputes; resolutely handling cases of violation of land laws, especially the conversion of paddy fields to other uses; reclaiming areas of land not used or used improperly by organizations, households, and individuals;

đ) In case it is necessary to adjust the main targets stipulated in point 1 of this Resolution, the Government shall promptly submit to the National Assembly for consideration and decision;

3- Based on the national strategy for economic and social development and on the implementation of this Resolution, the Government directs Ministries, ministerial-level agencies, agencies under the Government, Provincial People's Councils, and centrally-administered city People's Councils within their respective functions and powers to continue completing the planning and land use plans for the land they manage; on this basis, the Government will complete the long-term land use plan for the entire country to be submitted to the National Assembly for consideration and decision.

4- The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, and National Assembly deputies supervise the implementation of this Resolution.

People's Councils at all levels supervise the implementation of this Resolution in their localities.

5- The Vietnam Fatherland Front, its member organizations, within their respective functions and powers, coordinate with relevant state agencies to publicize and mobilize the people to implement this Resolution and participate in supervising the implementation of this Resolution.
