Implementing Decree No. 68/CP dated November 1, 1996 of the Government detailing the implementation of the Law on Minerals;
Pursuant to Decree No. 42/CP dated July 16, 1996 of the Government promulgating the Regulations on Investment Management and Construction, and Decree No. 92/CP dated August 23, 1997 of the Government amending and supplementing certain provisions of the Regulations on Investment Management and Construction issued together with Decree No. 42/CP dated July 16, 1996;
Pursuant to Decision No. 497/BXD-GD dated September 18, 1996 of the Minister of Construction promulgating the Rules on preparation, review, and approval of construction project designs; Circular No. 09 BKH/VPTD dated September 21, 1996 of the Ministry of Planning and Investment guiding the preparation, review of investment projects, and investment decisions;
The Ministry of Industry provides detailed guidelines on the content of feasibility study reports, mine designs, and procedures for reviewing and approving mine designs as follows:
I. SCOPE AND APPLICABLE OBJECTS OF THE CIRCULAR
All investment projects of all economic sectors within domestic sources of capital and foreign direct investment projects in the field of mineral exploitation in Vietnam.
All organizations and individuals participating in mineral exploitation activities, and consulting agencies engaged in mine design when preparing investment projects and mine designs (including technical designs and construction-execution mining designs).
This Circular does not apply to the activity of "exhaustive exploitation" as defined in the Law on Minerals.
II. CONTENT OF FEASIBILITY STUDY REPORTS AND MINE DESIGNS
II.1- Content of feasibility study reports for mining exploitation.
The content of feasibility study reports for open-pit and underground mining projects is specified in Appendix 1 and Appendix 2 of this Circular.
For Group A projects and some Group B projects if a preliminary feasibility study report must be prepared, its content must comply with the guidance provided in Appendix 1 of Circular No. 09 BKH/VPTD dated September 21, 1996 of the Ministry of Planning and Investment guiding the procedures for preparing, reviewing investment projects, and making investment decisions.
For projects with foreign direct investment (except for special cases related to large-scale and complex investment projects), the feasibility study report for mining exploitation is prepared and reviewed together with the application for investment license (joint venture contracts, company regulations, etc.) according to the regulations on the formation, review, and implementation of foreign direct investment projects issued by the Government.
II.2- Content of mine designs.
The content of open-pit and underground mining designs is specified in Appendix 3 and Appendix 4 of this Circular.
III- PROCEDURES FOR REVIEWING AND APPROVING MINE DESIGNS.
III.1- Content of mine design reviews.
Mine designs by all organizations and individuals, both domestic and foreign, shall be reviewed based on the following contents:
1. Legal basis of the design dossier: legal status of the designing organization; compliance of the design with the approved investment project; adherence to construction technical standards and current regulations applicable to the mining and mineral processing industry;
2. Reasonableness of the layout of infrastructure facilities serving mining operations on the industrial site, the safety level of these structures (houses, roads, etc.) in terms of labor safety, environmental protection, and safety for adjacent structures during construction and use;
3. Technical and technological basis for mining that is appropriate to geological conditions to maximize the recovery of explored mineral reserves, rational use of resources, and environmental protection, specifically:
The reasonableness of the delineation of the boundary for open-pit mining methods, the boundary for underground mining methods, and the parameters of the mine boundary at the end of mining;
The reasonableness of the choice of panel development options for specific seam characteristics as well as the selected mining system;
The reasonableness of the chosen mining system and its parameters such as: height of mining levels, height of final stopes, slope angle of benches, ensuring safety during mining, and suitability to the mechanical properties of the rock mass;
The reasonableness of the selection of tunnel cross-sections and tunnel support (when using underground mining methods) considering the mechanical properties of the roof, walls, and floor of the tunnels, ensuring the stability of the tunnels throughout the mining process;
Safety levels for people and structures needing protection in the vicinity during the blasting and drilling process;
The reasonableness and safety levels of water drainage systems, ventilation systems for transport tunnels, mining tunnels, etc.;
4. Technological basis for mineral processing (for projects involving mineral processing): The reasonableness of mineral processing technology to ensure maximum recovery of primary minerals and accompanying minerals, and to ensure labor safety and environmental protection in the processing area.
For mining works belonging to state-funded investment projects, in addition to the above technical content, the following economic aspects are also reviewed:
Economic and technical indicators compared to the approved project;
The appropriateness of the total budget estimate compared to the reviewed and determined reasonable total cost, ensuring it does not exceed the total investment amount recorded in the investment decision.
III.2- Principles and procedures for reviewing and approving mine designs.
III.2.1- For mine designs of state-owned enterprises' investment projects.
Approval authority for mine designs of state-owned enterprises' investment projects is stipulated in Clause 2, Article 45 of Decree No. 68/CP dated November 1, 1996 of the Government detailing the implementation of the Law on Minerals as follows:
Mine designs of Group A projects are approved by the Minister of Industry;
The procedures for reviewing and approving mine design of state-owned enterprises shall comply with the provisions of the "Regulation on the Preparation, Review, and Approval of Construction Project Designs" issued together with Decision No. 497/BXD/GĐ dated September 18, 1996, by the Minister of Construction - Ministry of Planning and Investment - Ministry of Finance.
III.2.2 - For mine designs of investment projects of non-state-owned enterprises.
The authority to review mine designs of investment projects of non-state-owned enterprises as stipulated in Clause 4, Article 45 of Decree No. 68/CP dated November 1, 1996, of the Government is as follows:
For investment projects licensed for exploitation by the Ministry of Industry, the mine design shall be reviewed by the specialized agency of the Ministry of Industry before submitting to the Minister of Industry for approval;
For investment projects licensed for exploitation by the Chairman of the People's Committee of provinces and centrally-administered cities, the mine design shall be reviewed by the specialized agency of the provincial or city People's Committee before submitting to the Chairman of the People's Committee of the province or city for approval.
The procedures for reviewing and approving mine designs of non-state-owned enterprises shall comply with the provisions of the "Regulation on the Preparation, Review, and Approval of Construction Project Designs" issued together with Decision No. 497/BXD/GĐ dated September 18, 1996, of the Ministry of Construction and Circular No. 08/TTLB dated November 25, 1997, of the Joint Ministries of Construction - Planning and Investment - Finance.
III.2.3 - For mine designs of projects with direct foreign investment.
Mine designs of projects with direct foreign investment of all scales shall be reviewed by the specialized agency of the Ministry of Industry and approved by the Minister of Industry before implementation. The application for review and approval of mine designs shall be submitted to the Board of Design Feasibility Studies, Mineral Resources Activity Reports, Ministry of Industry, at No. 6 PhamNguLao Street, Hanoi.
III.2.3.1 - Documents for submission:
The documents for submission for review and approval of mine designs include:
Application for approval of mine design (Form No. 1);
Copy of the Investment License;
Copy of the Mining License, accompanied by a map of the mining area;
Mine design (three copies).
III.2.3.2 - Organization for review:
The specialized agency of the Ministry of Industry responsible for reviewing mine designs must prepare necessary materials and other required tasks for the review, draft the review report, and prepare documents to submit to the Minister of Industry for decision.
III.2.3.3 - Time for review and submission for approval of mine designs:
Depending on the scale and complexity of each project, the time limit for reviewing mine designs of investment projects with direct foreign capital is as follows:
For mining works of mineral mines belonging to investment projects in Group A, not exceeding 45 days from the date of receipt of complete valid documents;
For mining works of mineral mines belonging to investment projects in Groups B and C, not exceeding 30 days from the date of receipt of complete valid documents.
IV. CONTENT OF THE APPROVAL DECISION:
The content of the approval decision for mine designs (Forms No. 2 and No. 3) for mining projects of organizations and individuals both within and outside the country includes:
Name of the mineral mine and location of the mining area designed;
Method of mining (open-pit, underground, etc.);
Production capacity (or production volume);
Duration of operation of the mine;
Main technical parameters:
Applied mining technology (brief description);
List of mining and processing equipment (if any) used in the technological chain;
Quantity of basic construction (internal mine roads, stripping volumes, etc.);
Infrastructure facilities serving mining operations (housing, roads, etc.);
Solutions and progress of basic construction of the mine;
Total budget estimate (for projects using state funds);
Matters to note;
Relevant organizations are responsible for implementing the Decision.
V. IMPLEMENTATION PROVISIONS:
This Circular shall be uniformly applied throughout the country and takes effect from February 1, 1998. Previous regulations contrary to this Circular are abolished.
During implementation, if there are issues requiring supplementation or adjustment, the implementing agencies shall report in writing to the Ministry of Industry for study and resolution.

Mine development plan (stripping) chosen based on topographic conditions and ore body characteristics.

4- MINING SYSTEM
I/ Selection of the mining system based on mining conditions, general technology flow from preparation, loading, transportation, waste disposal, and processing (if applicable).

Calculation of waste volume, selection of disposal site, calculation of dump capacity, technology and equipment for waste disposal.
7- WATER DRAINAGE FROM THE MINE
Calculation of water inflow into the open pit and selection of appropriate drainage methods, equipment for mine drainage (if necessary).
8- SAFETY MEASURES AND FIRE PREVENTION
Safety measures for mining technology stages and fire prevention.
9- ORE SCREENING AND PROCESSING
In cases where the project only aims at processing or grinding, the processing, grinding, and screening technology and equipment must be planned to maximize mineral resource utilization. If the project requires the establishment of a deep processing plant, a detailed processing project must be established and approved by competent authorities.
10- MECHANICAL REPAIRS AND STORAGE
Selection of auxiliary facility solutions such as components, production programs, construction scale, and equipment selection for each component (such as repair storage, equipment storage, material storage, spare parts, lubricants, etc.) to synchronize the production line according to the selected mining technology plans.
11- Supplying and equipping electricity and water for mine exploitation
Calculate loads and determine reasonable power supply solutions. Calculate the demand for domestic water and water for mine exploitation and select supply solutions.
12- Communication and automation.
Determine the level of necessity, technical solutions, choose equipment and materials, and determine the volume of construction work for communication, automation, and machine control systems at the mine.

16- Section (or Chapter) on environmental impact assessment report in mineral exploitation activities.
For mineral mining projects that do not require a two-step environmental impact assessment report, the environmental impact assessment report (EIA) shall be established according to the guidelines set forth in Circular No. 1100/TT-MTg dated August 20, 1997, and other guiding documents of the Ministry of Science, Technology, and Environment.

UNDERGROUND MINING OF MINERAL DEPOSITS
FOREWORD
PART I - GENERAL OVERVIEW OF THE PROJECT
The content requirements in Part I are similar to the requirements in the guidance for preparing feasibility study reports for open-pit mining of mineral deposits in Appendix 1
PART II - ECONOMIC AND SOCIAL CHARACTERISTICS AND GEOLOGICAL FEATURES OF THE MINES.
The items and contents required under the items as set out in Part II of the guidelines for the content of the feasibility study report on open-pit mining of mineral resources in Appendix No. 1.
PART III - TECHNOLOGICAL SOLUTIONS.
1. Boundaries and reserves of the mine.
Mine boundaries according to the north, south, east, west directions; upper boundary, lowest level of exploitation; size of the mine along the axis (length, width, area). Reserves of the mine: Calculation of geological reserves, industrial reserves.
2. Working system, capacity, and life span of the mine.
The working system of the mine (for each part; direct exploitation, indirect exploitation, processing (if any)) based on the number of working days, rest days stipulated by the Labor Code and specific exploitation conditions of the mine.
Propose capacity options: based on investment conditions, exploitation forecasts, production experience, equipment, market consumption, etc., there must be at least two capacity options.
The life span (existence time) of the mine is determined based on the exploitable reserves and the designed exploitation capacity (including the basic construction period of the mine, the exploitation period with designed capacity, and the closure period of the mine).
3. Mine development and preparation of the mining area.
+ Development: Development options, description of proposed options, advantages and disadvantages, etc. (at least two options should be presented for decision-making).
+ Preparation of the mining area: Diagram of mining area preparation (layer division, layering, section division, etc.); Tunnel excavation preparation plan (rock tunnel excavation, seam tunnel excavation); Length of the mining area, market tunnel, etc.
+ Exploitation sequence of areas and seams: Analysis and argumentation, selection of the exploitation sequence of areas and seams (ore bodies), simultaneous extraction from top to bottom, etc.
+ Volume of tunnels for development and preparation of the options to reach the designed capacity by the end of the year, including rock tunnels and seam tunnels or ore body tunnels (horizontal tunnels, inclined tunnels, vertical shafts, inclined shafts).
4. Mine shafts, surface yards, and bottom station of the shaft.
Argumentation of passability capability, selection of cross-section, anti-collapse materials; selection of bottom yard type; listing main and auxiliary shaft parameters; listing of lifting equipment.
5. Ore cars.
Determine the requirements for various types of ore cars and their technical characteristics, quantity of ore cars for transporting valuable minerals, waste rock, anti-collapse materials, and personnel.
6. Hoisting equipment (lifting devices).
Argumentation of solutions and determination of types and quantities of equipment for hoisting operations such as main shaft hoists, auxiliary shaft hoists, inclined shaft hoists.
7. Mining system, mechanization of mining and tunnel preparation.
Argumentation to select a reasonable mining system ensuring the designed capacity, saving anti-collapse materials, safety, and suitability with geological conditions of seams, determining mechanized means in the market tunnel.
Calculation of parameters of the mining system; argumentation and selection of tunnel preparation means; technical characteristics of mining and tunnel preparation equipment.
Organization of tunnel excavation (anti-collapse support passport, organization chart) in the market tunnel and preparation tunnel. Drilling and blasting work in the market tunnel and preparation tunnel (if applicable).
8. Transportation within the tunnel.
Determination of reasonable transportation methods and types and quantities of transport equipment at the main transportation level, intermediate transportation level, and inclined tunnel, etc., based on the development and preparation diagram to ensure transportation of valuable minerals, waste rock, materials, and personnel according to capacity options, development plans, etc.
9. Mine ventilation.

I- EXPLANATORY SECTION
I.1 - General Explanations
Basis and grounds for establishing the mine design;
Main content of the investment decision (for state-funded projects) or investment permit (for non-state-funded projects);
Summary of the chosen design and comparative design options.
Technical parameters and standards achieved by the project according to the chosen option.
Appendices of copies of approvals and agreements for each stage of the design, list of construction standards, design standards, procedures and regulations used in mining operations.
I.2 - Explanatory Materials on Natural Conditions
Topographic data, geological exploration reports, hydrogeological and engineering geological surveys collected from the mine area and assessments of their adequacy for mine design.

9. Waste Rock Disposal
Annual volume of waste rock to be disposed of and disposal schemes regarding location, capacity, and method of disposal at the waste dump, sequence and schedule of disposal during different periods of mine operation.
10. Mine Drainage.
Estimate the sources of water flowing into the mine (surface water, groundwater, etc.) and calculate the total amount of water flowing into the mine in a year, as well as the flow rate of water flowing into the mine on a daily and hourly basis, based on which to develop reasonable drainage plans for the mine, select equipment and the quantity of equipment serving the drainage process, and solutions to reduce the inflow of water into the mine.
11. Engineering techniques.
Calculations for power supply, water supply, steam, electricity, and oil for the mine.
Internal and external communication systems within the mine, signals, and automation.
