DECREE OF THE GOVERNMENT

THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Resolution No. 37/CP dated June 20, 1996 of the Government on the strategic orientation for health care and protection work for the people during the period 1996-2000 and the national policy on medicine of Vietnam;
At the proposal of the Minister of Health, the Minister, Chairman of the Civil Service Committee of the Government,
DECREE:
Article 1. The local health organizations referred to in this Decree include:
1. Provincial Department of Health under the central city;
2. District Health Center under the district, urban district, town, provincial city (hereinafter collectively referred to as District Health Center);
3. Commune Health Station under the ward, town, township (hereinafter collectively referred to as Basic Health Station).
Article 2. The Department of Health is a specialized agency under the People's Committee of the province, central city, assisting the People's Committee in performing state management functions regarding health work within its jurisdiction; managing and directing in terms of professional and technical matters concerning health work; managing health funds and personnel within the provincial health system under the central city according to the authority delegated by the competent authority.
The Department of Health is subject to comprehensive management by the People's Committee of the province, central city, and at the same time is subject to professional and technical guidance from the Ministry of Health.
Article 3. The District Health Center is an organization under the Department of Health, subject to management, direction, supervision, and inspection by the Director of the Department of Health in terms of professional and technical matters, funds, and health personnel; it is also subject to management and direction by the People's Committee of the district, urban district, town, provincial city (hereinafter collectively referred to as the People's Committee of the district) in the development of health plans for the district to be submitted to the competent authority and is responsible for implementing such plans after approval.
The District Health Center performs tasks related to disease prevention, treatment, maternal and child health care, and family planning technical tasks; directs, guides, and supervises the professional and technical activities of basic health stations; provides professional and technical training for grassroots health staff; collaborates with relevant departments and mass organizations in the district to participate in health care and protection activities for the people; assists the People's Committee of the district in inspecting compliance with laws in state health activities and private medical practices within its jurisdiction.
The Director and Deputy Director of the District Health Center are appointed, relieved of duty, or dismissed by the Director of the Department of Health after obtaining written agreement from the Chairman of the People's Committee of the district.
Article 4. The Basic Health Station is responsible for assisting the Director of the District Health Center and the People's Committee of the commune, ward, town, township (hereinafter collectively referred to as the People's Committee of the commune) in carrying out assigned health tasks within their jurisdiction.
The Basic Health Station is subject to management, direction, and guidance by the Director of the District Health Center in terms of professional and technical matters, funds, and health personnel; it is also subject to management and direction by the People's Committee of the commune in developing health plans to be submitted to the competent authority and is responsible for implementing such plans after approval; it collaborates with relevant departments and mass organizations in the commune to participate in health care and protection activities for the people.
The Head and Deputy Head of the Basic Health Station are appointed, relieved of duty, or dismissed by the Director of the District Health Center after obtaining written agreement from the Chairman of the People's Committee of the commune.
Specific duties and policies of the Basic Health Station continue to be implemented according to Decision No. 58/TTg dated February 3, 1994 and Decision No. 131/TTg dated March 4, 1995 of the Prime Minister.
Article 5. The Minister of Health shall coordinate with the Minister, Chairman of the Civil Service Committee of the Government to provide specific guidance on the implementation of this Decree.
Article 6. This Decree takes effect fifteen days after the date of signing the document. All provisions in Resolution No. 15/CP dated January 14, 1975 of the Council of Ministers (now the Government) on improving the local health organization system that conflict with this Decree are hereby abolished.
Article 7. The Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of Provincial People's Committees directly under the Central Government shall be responsible for enforcing this Decree./.
