Regarding the implementation of the Project for Building and Managing
Legal Bookshelves at Communes, Wards, and Towns

In order to strengthen the dissemination and popularization of laws widely among cadres and people and to create conditions for compliance with and supervision of the enforcement of laws, policies, and systems of the State, on November 25, 1998, the Prime Minister issued Decision No. 1067/QĐ-TTg approving the Project for Building and Managing Legal Bookshelves at Communes, Wards, and Towns to provide materials for local government officials to study and use, while also creating opportunities for the public to access and understand the laws of the State.
To effectively implement the construction and management of Legal Bookshelves, the Minister of Justice issues the following directive:
1. From the beginning of 1999, Directors of Provincial Departments of Justice shall directly oversee the review and summary of the construction of Legal Bookshelves at Communes, Wards, and Towns within their provinces. Based on this, they shall develop an overall plan for building and maintaining Legal Bookshelves over three years (from 1999 to 2001) and a separate plan for 1999, incorporating selectively and developing good experiences from the process of directing, constructing, and managing Legal Bookshelves at Communes, Wards, and Towns in recent times, to be submitted to the Chairman of the People's Committee of the province for decision.
2. The overall plan for building and managing Legal Bookshelves must meet the following basic requirements:
General Requirements: Legal Bookshelves must be built according to appropriate models for each type of area based on geographical, economic-societal, demographic, educational level, and the capacity of grassroots administrative officials, including judicial officials. The minimum content of Legal Bookshelves must include four parts of books, newspapers, and legal documents as stipulated in Decision No. 1067/QĐ-TTg dated November 25, 1998, of the Prime Minister, and must be updated regularly according to the six-monthly and annual guidelines of the Ministry of Justice; ensuring timely service for the needs of understanding and applying laws by local cadres and people. For Communes, Wards, and Towns that have already established Legal Bookshelves, plans should be made to improve them in terms of content, form, and service conditions.
Specific Requirements: During the planning and implementation of building and managing Legal Bookshelves, attention should be paid to the following points:
Legal Bookshelves should be placed in convenient locations where cadres and people can read on-site, borrow for research, and reference, but priority should be given to placing them at the headquarters of the People's Committees of Communes, Wards, and Towns. The exploitation and management of books, newspapers, and legal documents in Legal Bookshelves should follow the general guidelines of the Ministry of Justice to widely disseminate laws among the people.
Legal Bookshelves must be uniformly managed by dedicated judicial officials and the Judicial Boards of Communes, Wards, and Towns. To ensure the assigned tasks, the overall plan must include a plan to improve the team of dedicated judicial officials at Communes, Wards, and Towns to gradually meet the requirements set forth in Decree No. 09/1998/NĐ-CP amending and supplementing Decree No. 50-CP dated July 26, 1995, of the Government regarding living expenses for commune, ward, and town officials. Gradually stabilize the team of judicial officials at Communes, Wards, and Towns; train and enhance professional skills in judicial work, including training in managing Legal Bookshelves.
The overall plan must establish a coordination mechanism between the Department of Justice and relevant Departments and Agencies, and this plan must be integrated into the overall work of disseminating and educating the law in the locality.
Guide the preparation of budgets and the use of funds for building and maintaining Legal Bookshelves according to the joint Circular of the Ministry of Finance and the Ministry of Justice No. 05/1999/TTLT-TC-TP dated January 28, 1999.
3. The direction of building and managing Legal Bookshelves must be carried out in a coordinated manner, with timely and focused evaluation of models of Legal Bookshelves in different types of areas, thereby drawing lessons and proposing appropriate measures to continue directing this work.
The target of directed guidance for each province to select from 1 to 2 districts or cities under provincial jurisdiction; each district or city under provincial jurisdiction to select from 1 to 2 communes or wards to focus on directed guidance. Directed guidance points need to be combined with areas that have implemented "Cultural Post Offices".
The content to be concentrated on evaluating through directed guidance includes:
Suitable models of Legal Bookshelves for each type of area;
Difficulties and obstacles that need to be resolved;
The actual effectiveness, independence of Legal Bookshelves, and the effectiveness of linking the utilization of Legal Bookshelves with other forms and methods of disseminating and educating the law.
4. Directors of Provincial Departments of Justice need to develop plans and specific schemes for collecting and systematizing legal normative documents in the locality for periodic publication (every three months, every six months) to be submitted to the Chairman of the People's Committee of the province for approval.
5. During the implementation process, Directors of Provincial Departments of Justice need to regularly summarize and evaluate this work to report to the Chairman of the People's Committee of the province and the Minister of Justice.
Specifically for directed guidance work, timely experience sharing should be organized to adjust methods and build models suitable for the requirements set.
6. The Heads of the Department of Popularizing and Educating Law, the Director of the Institute of Legal Science Research, the Head of the Department of Organization and Training, and the Chief of the Office of the Ministry are responsible for assisting the Minister in overseeing, urging, and inspecting the implementation of this Directive; regularly reporting to the Minister on the results of its implementation./.
