JOINT CIRCULAR
Guidelines on the organization of vocational training management at central and local levels

Pursuant to Article 4 and Article 5 of Decree No. 33/1998/NĐ-CP dated May 23, 1998 of the Government on the establishment of the General Department of Vocational Training under the Ministry of Labor, Invalids and Social Affairs, the Ministry of Labor, Invalids and Social Affairs and the Government's Organizational and Cadre Affairs Board issue guidelines on the organization of vocational training management in Ministries, agencies equivalent to Ministries, and government agencies (collectively referred to as Ministries) and in provinces and centrally governed cities (collectively referred to as provinces) as follows:
A. ORGANIZATION OF VOCATIONAL TRAINING MANAGEMENT IN MINISTRIES
I. REGARDING THE OBJECT AND SCOPE:
Due to different characteristics and nature of sectoral or field-specific management, the functions and tasks of Ministries managing sectors or fields also differ. Therefore, in the vocational training sector, some Ministries do not have vocational training institutions. Consequently, it is not necessary for every Ministry to have a specialized organization responsible for vocational training management.
These joint circulars stipulate the organization of vocational training management in Ministries with functions and tasks related to vocational training and having vocational training institutions.
II. FUNCTIONS AND TASKS OF THE VOCATIONAL TRAINING MANAGEMENT ORGANIZATION:
The Department of Organization and Cadres of the Ministry shall be responsible for assisting the Minister in performing the function of vocational training management, including the following tasks:
1/ Drafting documents (Decisions, Directives, etc.) within the scope of responsibility of the Ministry regarding vocational training.
Drafting the vocational training curriculum, technical level standards, objectives, programs, internal regulations, teaching methods; detailing the organizational and operational regulations of vocational training institutions, teacher standards, classroom standards, examination regulations, issuance of graduation certificates and certificates for various types of training institutions under the Ministry in accordance with state regulations and guiding their implementation.
2/ Developing the planning system for vocational training institutions, including those under State-owned Corporations and those directly under the Ministry.
3/ Compiling and developing long-term and annual plans for vocational training (including training quotas, trades, training costs; training, upgrading, supplementing cadres and teachers, and investment in infrastructure development) for vocational training institutions under the Ministry. Guiding the implementation after approval of the plan.
4. Implementing international cooperation in the vocational training sector under the Ministry when assigned by the Minister or the head of the agency.
5/ Monitoring and inspecting the implementation of regulations, internal rules, training programs, and compliance with laws and policies on vocational training for vocational training institutions under the Ministry’s management.
6/ Periodically compiling reports on the organizational structure and activities of vocational training institutions under the Ministry’s management.
7/ Performing other tasks related to vocational training as assigned by the Minister.
III. ORGANIZATION AND STAFFING
Depending on the tasks, workload, and number of vocational training institutions under the management of each Ministry, the corresponding organization and staffing should be determined as follows:
Establishing a specialized unit with staffing dedicated to vocational training management within the Department of Organization and Cadres (or an equivalent organization with training management functions).
B. ORGANIZATION OF VOCATIONAL TRAINING MANAGEMENT IN PROVINCES:
I. FUNCTIONS AND TASKS OF THE VOCATIONAL TRAINING MANAGEMENT ORGANIZATION
The Department of Labor, Invalids and Social Affairs shall be responsible for assisting the Provincial People's Committee in performing the state management function of vocational training, including the following main tasks:
1/ Drafting documents (Decisions, Directives) within the scope of authority of the Provincial People's Committee regarding vocational training:
Participating in drafting the vocational training curriculum, technical level standards, objectives, programs, teaching methods; detailing the organizational and operational regulations of vocational training institutions in the locality, classroom standards, examination regulations, issuance of graduation certificates and certificates for various types of training institutions in the province in accordance with state regulations and guiding their implementation.
2/ Developing the planning system for vocational training institutions, including those under provincial Departments, Bureaus, and State-owned Enterprises within the province's jurisdiction.
3/ Compiling and developing long-term and annual plans for vocational training (including training quotas, trades, training costs; training, upgrading, supplementing cadres and teachers, and investment in infrastructure development) for vocational training institutions in the locality and guiding their implementation after approval of the plan.
4/ Implementing international cooperation in the vocational training sector of the locality according to the delegation and authorization of the Provincial People's Committee.
5/ Inspecting and monitoring the implementation of regulations, program content, and compliance with laws and policies on vocational training for vocational training institutions under the province's management.
6/ Periodically compiling reports on the organizational structure and activities of vocational training institutions under the province's management.
7/ Performing other tasks related to vocational training as assigned by the Provincial People's Committee.
II. ORGANIZATION AND STAFFING
Depending on the specific conditions, workload, and number of vocational training institutions under the province's management, determine whether to establish a Vocational Training Management Division or a Vocational Training Management Unit with the necessary staffing within the Department of Labor, Invalids and Social Affairs to assist the Director of the Department of Labor, Invalids and Social Affairs in implementing the tasks outlined in Section I of Part B of these joint circulars.
C. ORGANIZATION OF VOCATIONAL TRAINING MANAGEMENT IN DISTRICTS, COUNTIES, TOWNS, AND CITIES UNDER PROVINCES
The Labor, Invalids and Social Affairs Office or the Labor, Invalids and Social Affairs Organization Office of districts, counties, towns, and cities under provinces (collectively referred to as districts) shall be responsible for assisting the District People's Committee in performing the state management function of vocational training according to the delegation of the Provincial People's Committee.
D. IMPLEMENTATION:
1/ The Ministers of the Ministries, ministerial-level agencies, heads of government agencies, and Chairpersons of the People's Committees of provinces and centrally governed cities shall base themselves on Government Decree No. 33/1998/NĐ-CP dated May 23, 1998, and this Joint Circular to issue appropriate decisions regarding the organization and staffing for vocational training management within their respective areas of responsibility.
This Circular takes effect fifteen days from the date of issuance.
During implementation, if there are any difficulties, suggestions for supplementation, or amendments, the ministries and localities are requested to promptly report them to the Ministry of Labor - Invalids and Social Affairs and the Civil Service Committee of the Government for consideration and resolution.
