Pursuant to the Law on Protection and Development of Forests dated August 12, 1991,

Pursuant to Decree No. 101/ dated October 20, 2015 of August 1/November 11, 1995 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry, Upon consideration of the proposal of the Director of the Ministry’s Office,

At the proposal of the Director of the Forest Inspection Department, The Director of the Forestry Development Department, Amending and supplementing certain points of the Regulation on Management and Use of Forest Marking Axes and Forest Inspection Axes issued pursuant to Decision No. 69/2001/QD-BNN-KL dated June 26, 2001 of the Minister of Agriculture and Rural Development, as follows:

Article 1. 1. Article 3. Clause 2, Point a and Point b2 shall be amended as follows:

"a3) Raw wood material not yet entered the processing workshop with specifications as prescribed in Clause 2 of this Article, which has been stamped with the Forest Inspection Axe but has been cut short for continued transportation;"

"b2) In the case of enterprises importing roundwood or sawn timber without the stamp of the exporting country's axe, they must also stamp the Forest Inspection Axe."2 2. Article 6. Point b, Clause 1 shall be supplemented with the following provision:

"In the case of cold wood, veneer, or knots, measure the diameter at the middle of the tree trunk."

3. Article 9.

a) Clause 2, Point b shall be amended as follows: "Directly stamp the Forest Marking Axe onto the objects of wood specified in Points a, b, c, and d, Clause 2, Article 2 of this Regulation;"

b) Clause 3, Point b of Article 9 shall be amended as follows: "Directly stamp the Forest Marking Axe onto the objects of wood specified in Point e, Clause 2, Article 2 of this Regulation."

4. Article 10.

a) Clause 2 shall be amended as follows:

"For wood belonging to the objects specified in Points c, d, and e, Clause 2, Article 2 of this Regulation, it is stipulated as follows:

a) Wood belonging to the object specified in Point e and wood utilized during main harvesting, such as branches and fallen trees during harvesting: stamp one mark of the Forest Marking Axe on the cross-section of the log (piece) of wood:

b) Wood belonging to the objects of utilization harvesting and wood utilized during main harvesting, standing on transport routes, transport areas, and wood storage areas: implement stamping according to the provisions of Clause 1, Article 10 of this Regulation;

c) Wood belonging to the objects of salvage harvesting: stamp two marks of the Forest Marking Axe opposite each other on the tree trunk, 50 cm away from the cross-section of the root."

b) Clause 5 shall be supplemented as follows: "The location for stamping the Forest Marking Axe is the area permitted for harvesting."

5. Article 14. Clause 4 shall be amended as follows:

"4. For wood specified in Point b2, Clause 2, Article 3 of this Regulation, the location for stamping the Forest Inspection Axe is stipulated as follows:

a) For wood imported via land, the location for stamping the Forest Inspection Axe is the place where the enterprise aggregates wood at the border gate;

b) For wood imported via waterways (river ports, sea ports) that have completed customs procedures, the location for stamping the Forest Inspection Axe is the warehouse of the direct importer, the entrusted importer, and the enterprise purchasing imported wood."

Heads of the Ministry’s Office, Heads of Departments, Bureaus, Institutes, Chief Inspectors of the Ministry, Directors of Provincial Departments of Agriculture and Rural Development; Chiefs of Forest Inspection Sub-departments of provinces and centrally-administered cities; relevant units and individuals are responsible for implementing this Decision./.

b) For imported timber via waterway (river port, sea port) that has completed customs procedures, the location for affixing the Forestry Inspectorate stamp shall be at the warehouse of the importing enterprise, the entrusted importing enterprise, and the enterprise purchasing imported timber.

Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.

Article 3. The Heads of the Ministry’s Office, Heads of Departments, Directorates, Institutes, Head of the Ministry’s Inspectorate, Directors of Provincial Departments of Agriculture and Rural Development; Chiefs of Forest Protection Branches of provinces and centrally governed cities; relevant units and individuals are responsible for implementing this Decision./.
