THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Law on Protection and Development of Forests dated August 12, 1991;
Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
At the proposal of the Director of the Forest Protection Department and the Director of the Forestry Development Department,
DECISION:
Article 1. Amending and supplementing certain points of the Regulation on Management and Use of Forestry Axes and Forest Inspection Axes issued pursuant to Decision No. 69/2001/QĐ-BNN-KL dated June 26, 2001 of the Minister of Agriculture and Rural Development, as follows:
Article 3. Clause 2, Points a and b2 are amended as follows:
"a3) Unprocessed raw timber with specifications as prescribed in Point a, Clause 2 of this Article, which has been stamped with the forest inspection axe but has been cut shorter for continued transportation;"
"b2) In cases where enterprises import roundwood or sawn timber without the stamp of the exporting country, they must also stamp it with the forest inspection axe."
Article 6. Point b, Clause 1 is supplemented with the following content regarding measuring wood:
"In cases of flake, edge, or knot wood, measure the diameter at the middle of the tree trunk."
Article 9.
a) Point b, Clause 2 is amended as follows: "Directly stamp the forestry axe onto the objects of wood specified in Points a, b, c, and d, Clause 2 of Article 2 of this Regulation;"
b) Point b, Clause 3, Article 9 is amended as follows: "Directly stamp the forestry axe onto the objects of wood specified in Point e, Clause 2 of Article 2 of this Regulation."
Article 10.
a) Clause 2 is amended as follows:
"For wood belonging to the objects specified in Points c, d, and e, Clause 2 of Article 2 of this Regulation, the following applies:
a) Wood belonging to the object specified in Point e and wood utilized during main harvesting, such as branches and fallen trees during harvesting: stamp one forestry axe mark on the cross-section of the log (piece) of wood;
b) Wood belonging to the objects of utilization harvesting and wood utilized during main harvesting, which are standing trees along transport routes, transport areas, and planned wood storage areas: implement the forestry axe stamping as prescribed in Clause 1, Article 10 of this Regulation;
c) For wood belonging to the objects of salvage harvesting: stamp two forestry axe marks opposite each other on the tree trunk, 50 cm away from the cross-section of the root."
b) Clause 5 is supplemented as follows: "The location for stamping the forestry axe is the area permitted for harvesting."
Article 14. Clause 4 is amended as follows: "4. For wood specified in b2, Point b, Clause 2 of Article 3 of this Regulation, the location for stamping the forest inspection axe is as follows:
a) For wood imported via land routes, the location for stamping the forest inspection axe is the wood collection point of the enterprise at the border gate;
b) For wood imported via waterways (river ports, sea ports) that have completed customs procedures, the location for stamping the forest inspection axe is the warehouse of the direct importing enterprise, the entrusted importing enterprise, and the enterprise purchasing imported wood."
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.
Article 3. Heads of the Ministry's Office, Heads of Departments, Bureaus, Institutes, Chief Inspectors of the Ministry, Directors of Provincial Departments of Agriculture and Rural Development; Chiefs of Forest Protection Bureaus of provinces and centrally-administered cities; relevant units and individuals are responsible for implementing this Decision.
