CIRCULAR

Guidelines for implementing Point c Clause 2 Article 6 of Decree No. 03/2000/NĐ-CP dated February 3, 2000, guiding the implementation of certain provisions of the Enterprise Law.

Pursuant to Point c Clause 2 Article 6 of Decree No. 03/2000/NĐ-CP dated February 3, 2000, guiding the implementation of certain provisions of the Enterprise Law, the Ministry of Fisheries guides on issuing certificates for practicing veterinary drug business and aquatic animal health service business as follows:

I. General Provisions

1. Concepts used in this Circular:

a. Aquatic animal veterinary practice certificate is a document certifying that the competent state authority has issued to individuals who have sufficient professional qualifications and work experience in aquatic animal veterinary drug business or aquatic animal health service business.

b. Aquatic animal veterinary drug business includes activities of producing and trading (excluding personal consumption) various types of aquatic animal veterinary drugs.

c. Aquatic animal health services include activities such as consulting, diagnosing, and treating diseases of aquatic animals.

2. Organizations and individuals engaged in the production, trading of aquatic animal veterinary drugs and aquatic animal health services must submit an application for issuance of a practice certificate, comply with all provisions of this Circular and other relevant laws.

3. Issuing authorities:

a. At the central level: The Fisheries Resource Protection Department assists the Minister of Fisheries in managing production and trading establishments of aquatic animal veterinary drugs and aquatic animal health services nationwide; issues practice certificates for production and trading of aquatic animal veterinary drugs and aquatic animal health services in regions where there is no Fisheries Resource Protection Sub-department or authorized unit.

b. At the local level: The Fisheries Resource Protection Sub-department or authorized unit assists the Director of the Fisheries Department or the Department of Agriculture and Rural Development responsible for fisheries management in implementing management and issuing practice certificates for production and trading of aquatic animal veterinary drugs and aquatic animal health services at the local level.

4. Subjects eligible for issuance of practice certificates for production and trading of aquatic animal veterinary drugs and aquatic animal health services as stipulated in Clause 3 Article 6 of Decree No. 03/2000/NĐ-CP are specified as follows:

a. For State-owned enterprises and enterprises of political-social organizations: one of the enterprise managers (a member of the Board of Directors or the Management Council).

b. For individual producers and traders: the owner of the production or trading establishment, or the technical supervisor (for drug production establishments), the salesperson (for drug trading establishments), or the person directly providing consulting, diagnosing, and treating diseases of aquatic animals (for health service establishments).

II. Conditions and Procedures for Issuing Practice Certificates

||| 1. Conditions

Professional conditions for issuance of practice certificates for production and trading of aquatic animal veterinary drugs and aquatic animal health services for the subjects mentioned in Clause 4 Part II are as follows:

a. For production of aquatic animal veterinary drugs:

+ Must hold a bachelor's degree in one of the following fields: Veterinary Medicine, Biology, Biochemistry, Pharmacy, or Aquaculture.

b. For trading of aquatic animal veterinary drugs:

+ At least hold a diploma in veterinary medicine or aquaculture.

c. For aquatic animal health services:

+ Must hold a bachelor's degree in one of the following fields: Veterinary Medicine or Aquaculture.

+ Must have a certificate of completion from training courses on aquatic animal diseases provided by the Institute of Aquaculture Research I, II, the Center for Aquaculture Research III, or the University of Fisheries Nha Trang, Can Tho University, and the University of Agriculture and Forestry Ho Chi Minh City.

2. Procedure for Issuing Practice Certificates

a. Application dossier includes:

- Application form for issuance of a practice certificate (according to Form No. 1)

- Certified copy of professional qualification certificate

- Health examination report

- Certified copy of certificate of completion from training courses on aquatic animal diseases

b. Upon receipt of the dossier, the competent authority issuing the certificate shall be responsible for reviewing, guiding the applicant to supplement missing information. Within ten working days from the date of receiving a complete and valid dossier, the competent authority issuing the certificate must issue the practice certificate for production and trading of aquatic animal veterinary drugs and aquatic animal health services or provide a written response stating the reasons for refusing to issue the practice certificate.

III. Handling Violations:

1. Organizations and individuals engaging in production, trading of aquatic animal veterinary drugs and aquatic animal health services who fail to comply with or violate the provisions of this Circular will be subject to administrative penalties according to the law.

2. The Fisheries Resource Protection Specialized Inspectorate is responsible for inspecting and supervising compliance with the provisions of this Circular; detecting, preventing, and handling violations within its authority or recommending competent authorities to handle violations of laws related to production, trading of aquatic animal veterinary drugs and aquatic animal health services.

IV. Implementation Organization

1. The Director of the Fisheries Resource Protection Department is responsible for directing and inspecting the implementation of this Circular.

2. This Circular takes effect fifteen days from the date of issuance. Any amendments or supplements to the content of this Circular shall be decided by the Minister of Fisheries in writing.
