CIRCULAR

Financial regulations concerningthe issuance of rules for managing financial funds of social and charitablefunds;

Pursuant to Circular No. 08/2000/TT-BYT dated April 21, 2000 of theMinistry of Health; The Ministry of Finance guidesseveral provisions of Decree No. 73/1999/NĐ-CP dated August 19, 1999 of theGovernment on policies encouraging socialization in educational, health, cultural,and sports activities;

Pursuant to Circular No. 19/2000/TT-BYT dated November 24, 2000 of theMinistryOrganizing free medical check-ups and treatments, organizing free homehealthcare services.

Article 5. Medical facilities providing humanitarian medical services must complywith the professional technical regulations stipulated by the Ministry Y Circular No. 08/2000/TT-BYT dated April 21, 2000 of the Ministry ofHealth; Health guiding the implementation of Decree No. 73/1999/NĐ-CP datedAugust 19, 1999 of the Government on policies encouraging

socialization in activities within the fields of education, health,culture, and sports.

For Traditional Chinese Medicine Clinics: Implement according to Article10 Chapter IIIAdhering to current professional regulations: Prescription and Medicinesales Regulation, Poisonous Drugs Management Regulation, Narcotic DrugsManagement Regulation, Psychotropic Drugs and Precursor Chemicals ManagementRegulation, etc...

 

CHAPTER III

FILE, PROCEDURES, AUTHORITY FOR ISSUING LICENSE TO PRACTICE HUMANITARIANMEDICAL SERVICES

MEDICAL SERVICES

Article 11.

1. Medical practice: Implemented according to the provisions of ChapterIII of Circular No. 21/2001/TT-BYT dated September 28, 2001 of the Minister ofHealth regarding conditions and scope of private medical practice.

2. Traditional Chinese Medicine practice: Implemented according to theprovisions of Chapter IVfrom abroad in accordance with the law.

Participate in related professional technical activities.

Refuse to provide or sell drugs if it affects the user's health.

Participate in professional organizations such as medical, pharmaceuticalor traditional Chinese medicine associations established in accordance with thelaw.

No need to pay registration fees for humanitarian medical service forms.

Personnel engaged in professional technical work in humanitarian medicalfacilities can study long-term according to the state's admission regulations toimprove their skills; regularly participate in professional training andcontinuing education activities of the industry. Those engaged in humanitarianmedical services can attend training sessions to update knowledge, especiallydangerous diseases (malaria, cholera, typhoid, HIV/AIDS...). The provincialDepartment of Health is responsible for coordinating with the ProvincialMedical Pharmaceutical Association to organize training, instruction, improveproficiency, and update knowledge for those engaged in humanitarian medicalservices.

Humanitarian medical facilities or personnel working in these facilitieswho have outstanding achievements in serving patients will be commended andrewarded according to the general regulations of the State.

2. Obligations:

Must comply with the professional technical regulations of the Ministry ofHealth. Not allowed to use types of drugs or medical equipment that have not beenregistered for circulation, nor apply new techniques without permission from theMinistry of Health.

Humanitarian medical facilities have the obligation to participate indealing with epidemics and national health programs.

 

CHAPTER V

MANAGEMENT OF HUMANITARIAN MEDICAL SERVICES ACTIVITIES

Article 14. Foreign-invested traditional medicine healthcare facilities and foreigners practicing traditional medicine in Vietnam must fully comply with the provisions of this Circular and other relevant legal provisions; if they violate, they will be handled according to current regulations; if they cause damage to patients, they must compensate for the damage according to Vietnamese law: The provincial Department of Health is the agency assisting the People'sCommittee of the province in performing state management functions overhumanitarian medical services activities, having a dedicated department or staffresponsible for overseeing and managing humanitarian medical services activities.

Article 15. Credit organizations on The entity standing to establish a humanitarian medical facility willdirectly and comprehensively manage that facility.

Article 16. Revenue sources of humanitarian medical facilities

1. Donations from domestic and foreign organizations and individuals.

2. Support from local authorities (if any).

3. Income from medical services provided based on the needs of the localpopulation.

4. The management and use of the financial resources under items 1, 2, and3 of this Article must comply with the current laws.

Article 17:

1. Periodic reports of the provincial Department of Health sent to theMinistry of Health (Treatment Department) must include the management ofhumanitarian medical services activities in the locality. 2. Annually, all provincial Departments

of Health submit separate reports on humanitarian medical servicesactivities to the Ministry of Health (Treatment Department for medicalpractice, Traditional Chinese Medicine Department for each province, Heads of relevant units are responsible forimplementing this Circular.
