Pursuant to the Law on Organization of the Government dated December 25, 2001;

Based on the Law on Forest Protection and Development dated August 19, 1991;

Considering the proposal of the Ministry of Agriculture and Rural Development (document number 2048/BNN-KL dated July 31, 2002, and document number 4822/BNN-KL dated December 24, 2002) and the proposal of the People's Committee of Nam Dinh Province (report number 98/VP3 dated July 11, 2002, and report number 185/VP3 dated December 6, 2002).

DECISION:

Article 1. Convert the Xuan Thuy Wetland Conservation Area in Nam Dinh Province into a national park within the system of special-use forests in Vietnam, including the following contents:

1. Name:

Xuan Thuy National Park.

2. Location, geographical coordinates, and area scale of Xuan Thuy National Park:

- Geographical location:

Xuan Thuy National Park is located in the southeastern part of Giao Thuy District, Nam Dinh Province, comprising the inner parts of Cau Ngan, Cau Lu, and Cau Xanh (Cau Mo) islands.

Boundaries:

To the northeast, it borders the Red River.

To the northwest, it borders the communes of Giao Thien, Giao An, Giao Lac, Giao Xuan, and Giao Hai.

To the southeast and southwest, it borders the East Sea.

- Geographic coordinates:

From 200 10' to 200 15' north latitude,

From 106 20' to 106 32' east longitude.

- Area scale:

Total area: 7,100 hectares,

Where:

Area of land with forest: 3,100 hectares,

Area of flooded forest: 4,000 hectares,

The buffer zone of Xuan Thuy National Park has an area of 8,000 hectares, including the remaining area of Cau Ngan island (the boundary extends from inside the sea dyke to the Vop River channel), the area of the inner part, and the areas of five communes: Giao Thien, Giao An, Giao Lac, Giao Xuan, and Giao Hai, in Giao Thuy District.

3. Objectives and tasks of Xuan Thuy National Park:

- Preserve the typical wetland ecosystem of the Red River estuary, characteristic animal and plant species of the wetland ecosystem, especially aquatic species and migratory water birds.

- Serve scientific research, environmental education, and ecotourism development.

- Establish infrastructure and facilities to support training, scientific research, environmental education, and ecotourism development, contributing to economic and social development and creating employment for local communities.

4. Issues related to investment, construction, and development of the park, ecotourism, and organizational staffing of Xuan Thuy National Park shall be implemented according to current state regulations.

Article 2. Entrust the People's Committee of Nam Dinh Province to manage Xuan Thuy National Park; Direct the preparation and submission to competent authorities for approval of projects on investment, construction, and development of the park, buffer zone, and ecotourism development at Xuan Thuy National Park in accordance with current regulations.

Article 3. Organizational structure of Xuan Thuy National Park:

Entrust the Chairman of the People's Committee of Nam Dinh Province to decide on the organizational structure of Xuan Thuy National Park in accordance with the provisions of the Regulation on Management of Special-Use Forests, Protective Forests, and Naturally Produced Timber Forests issued together with Decision No. 08/2001/QĐ-TTg dated January 11, 2001 of the Government Prime Minister and the consensus of the Ministry of Agriculture and Rural Development and the Ministry of Home Affairs.

Article 4. This Decision shall take effect fifteen days from the date of signature.

Ministers, Heads of ministerial-level agencies, and government-affiliated agencies, and the Chairman of the People's Committee of Nam Dinh Province are responsible for implementing this Decision./.
