Issuing the Charter on Organization and Operation of the Information Center

THE MINISTER OF SCIENCE AND TECHNOLOGY
Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;
Considering the proposals of the Directors of the Information Center and the Director of the Department of Organization and Cadres;
DECISION:
Article 1: The Charter on Organization and Operation of the Information Center under the Ministry of Science and Technology is hereby promulgated together with this Decision.
Article 2This Decision shall take effect fifteen days from the date of publication in the Official Gazette. The Heads of the Office, the Director of the Department of Organization and Cadres, the Director of the Information Center, and the Heads of units concerned shall be responsible for implementing this Decision.
CHARTER
ORGANIZATION AND OPERATION OF THE INFORMATION CENTER
(Issued together with Decision No. 01/2004/QĐ-BKHCN dated April 29, 2004 of the Minister of Science and Technology)
PART I
GENERAL PROVISIONS
Article 1. The Information Center is a unit under the Ministry of Science and Technology, having the function of organizing the development and application of information technology (IT) and computerization of administrative management to serve the state management work of the Ministry.
The Information Center has the international trade name of Information Communication Technology Centre, abbreviated as ICTC.
The main office of the Information Center is located in Hanoi, and representative offices are established in some localities.
Article 2. The Information Center is a public service entity with revenue, possessing legal personality, its own seal, and accounts opened at the State Treasury and banks for its operations and transactions in accordance with the law (referred to as the Center).
PART II
TASKS AND POWERS
Article 3The Center has the following main tasks and powers:
1. To take the lead in coordinating with units within the Ministry to develop regulations on the exploitation and use of licensed IT equipment, hardware, software, and information systems on networks; regulations on submitting information to the Ministry's IT network system; and submit these regulations to the Minister for issuance.
2. To take the lead in coordinating with units within the Ministry to develop long-term and annual plans for the development and application of IT to serve the state management work of the Ministry and organize their implementation after approval; prepare plans for purchasing, distributing, and guiding the use of licensed IT equipment, hardware, and software for units within the Ministry.
3. To build and manage the IT and computer systems of the Ministry, including:
a. Design and construct information systems serving administrative management of the Ministry;
b. Take the lead and coordinate with units within the Ministry and related units to build databases on areas of state management of the Ministry;
c. Organize the provision, exploitation of information, databases, and Internet access through the Ministry’s network system for individuals and units in accordance with regulations;
d. Organize the construction and exploitation of IT services and online public services in areas of state management of the Ministry through the Ministry’s network system;
e. Lead research, construction, management, and operation of computer networks for science and technology based on the STE-NET network. Organize the connection of computer networks between the Ministry and provincial departments, scientific and technological organizations nationwide.
4. To build and ensure the management of IT infrastructure of the Ministry, including:
a. Research and develop IT infrastructure serving administrative management of the Ministry;
b. Organize the design, construction, and installation of IT equipment systems according to plans for units within the Ministry;
c. Maintain and repair the Ministry’s computer systems and network equipment; fix technical issues of the system equipment, ensuring continuous, smooth, safe, and secure operation of the system.
5. To organize the design, construction, and guidance on the use (preparation, leasing, purchase) of common software, application software, and specialized software within the scope of state management of the Ministry;
6. To take the lead in receiving, developing, and organizing the implementation of projects and programs with domestic and foreign funding sources related to the application and development of IT and computerization of administrative management within the scope of state management of the Ministry after approval by competent authorities;
7. To organize and coordinate with units with relevant functions to organize training, upgrading, and certification activities in IT in accordance with current laws;
8. To sign economic contracts on IT services with organizations and individuals in accordance with current laws;
9. To take the lead and participate in implementing research topics in the field of IT when assigned;
10. To coordinate with related units of the Ministry to implement international cooperation in IT in the field of state management of the Ministry;
11. To manage and use assets and working equipment effectively in accordance with the provisions of the Ministry; To perform other tasks assigned by the Minister.
CHAPTER III
ORGANIZATIONAL STRUCTURE
Article 4. The organizational structure of the Center includes: the Director and several Deputy Directors responsible for specific fields of work assigned.
Business units under the Center:
1. Office;
2. Network Development and Assurance Section;
3. Software Section;
4. Information Assurance and Database Integration Section.
5. Training Section.
Article 5. The Center operates under a director-led system combined with collective discussion.
The Director of the Center is responsible to the Minister for the entire organization and operation of the Center.
Deputy Directors assist the Director, perform tasks assigned by the Director, and are responsible to the Director for the tasks they oversee.
In the absence of the Director, one Deputy Director may be authorized to lead and manage the Center's operations.
The Director is responsible for defining the functions, tasks, organization, and operation of business units under the Center.
Article 6. The Center implements a specialist direct reporting system to Center leadership. When necessary, the Director may establish teams or groups for specific tasks and clearly define their responsibilities.
, Clause 1, Clause 2 Article 7a of this Regulation.The human resources of the Center include:
1. Staff within the quota allocated by the Ministry;
2. Staff working under labor contracts:
a. Type of labor contract using the Ministry's salary fund, after agreement from the Department of Organization and Cadres, the Office will proceed to sign the contract.
b. Type of labor contract funded by the Center's own resources, signed directly by the Center with employees in accordance with the Labor Code within the scope of job requirements and the Center's financial capacity (no need for agreement from the Cadres and Civil Servants Organization Department).
For indefinite-term labor contracts, a report must be submitted to the Cadres and Civil Servants Organization Department for monitoring.
3. Staff working as contributors.
Article 8. The Center implements personnel management systems, pays salaries, wages, and other income, and implements insurance policies for staff working at the Center in accordance with current state regulations and those of the Ministry.
PART IV
WORK RELATIONSHIPS
Article 9. The Director of the Center manages all activities of the Center based on the Charter of Organization and Operation of the Center; implements work schedules and relationships with heads of subordinate units of the Ministry according to the Ministry’s work regulations and other provisions issued by the Minister.
Article 10. The Center is responsible for closely collaborating with units under the Ministry of Posts and Telecommunications, information technology centers of various ministries and sectors, science and technology departments of localities, and other related organizations in carrying out assigned tasks.
CHAPTER V
FINANCIAL MANAGEMENT OF THE CENTER
Article 11. Financial operations
1. Sources of revenue:
a. From the State budget;
b. From service, consulting, and IT training activities as stipulated by law;
c. Other sources of revenue as prescribed (if any): Aid projects, gifts, loans...
2. Expenditures:
a. Expenditure for regular tasks and scientific research when assigned;
b. Expenditure for service, consulting, and IT training activities according to signed contracts;
c. Expenditure for hiring labor;
d. Other expenditures;
Article 12. The Director of the Center is responsible for managing and using the Center's financial resources effectively; fulfilling obligations to the State; establishing development funds for public services, income stability reserves, welfare, and rewards; and implementing accounting procedures in accordance with current state regulations.
Chapter VI
IMPLEMENTING PROVISIONS
Article 13. The Director of the Center collaborates with the Head of the Cadres and Civil Servants Organization Department to implement this Charter.
Article 14. Any amendments or supplements to this Charter shall be proposed by the Director of the Center in collaboration with the Head of the Cadres and Civil Servants Organization Department to the Minister of Science and Technology for review and decision./.
