JOINT CIRCULAR
Guidelines for Implementing Regulations and Policies for Organizations and Individuals Mobilized to Serve National Defense Pursuant to Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government on Mobilizing State Scientific and Technological Resources to Serve National Defense
Implementing Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government on Mobilizing State Scientific and Technological Resources to Serve National Defense; following the unified opinions of the Ministry of Science and Technology (in Circular No. 1555/BKHCN-TCCB dated June 29, 2004), the Ministry of Education and Training (in Circular No. 5452/KHTC dated July 1, 2004), the Ministry of Health (in Circular No. 4766/YT-KHTC dated July 1, 2004), and the Ministry of Labor, Invalids and Social Affairs (in Circular No. 2992/LĐTBXH-TL dated August 31, 2004), the Ministry of National Defense and the Ministry of Finance jointly issue guidelines for implementing regulations and policies for organizations and individuals engaged in scientific and technological activities mobilized to serve national defense as follows:
Chapter I. SCOPE OF APPLICATION, RANGE AND TIME OF MOBILIZATION
1. 1. State scientific and technological organizations, state-owned enterprises; scientific and technological organizations not under the state sector but voluntarily serving national defense pursuant to Article 4 of Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government (hereinafter referred to collectively as scientific and technological organizations).
1. 2. Individuals engaged in scientific and technological activities receiving salaries from the state budget; individuals engaged in scientific and technological activities not receiving salaries from the state budget (including individuals working in scientific and technological organizations and state-owned enterprises self-accounting) but voluntarily serving national defense pursuant to Article 4 of Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government.
a) Cadres, civil servants, public officials, and workers as stipulated in Article 2 of Decree No. 178/2024/NĐ-CP dated December 31, 2024 (amended and supplemented by Decree No. 67/2025/NĐ-CP dated March 15, 2025) of the Government on policies and treatment for cadres, civil servants, public officials, workers, and armed forces personnel in the process of organizational restructuring of the political system, having a total mandatory social insurance contribution period of at least 15 years when working in heavy, hazardous, or dangerous jobs or extremely heavy, hazardous, or dangerous jobs listed by the agency under the Government responsible for labor administration, or working in areas with particularly difficult socio-economic conditions including time worked in places with regional allowances of coefficient 0.7 or higher before January 1, 2021, and reaching the retirement age as specified in Appendix II issued together with Decree No. 135/2020/NĐ-CP, ceasing work immediately due to direct impact from organizational restructuring and implementation of the two-level local government model;
2. Range and time of mobilization
2. 1. Mobilizing scientific and technological organizations and individuals to serve in national defense units, including long-term and short-term mobilizations:
- Long-term mobilization is mobilization with a duration exceeding 24 months;
- Short-term mobilization is mobilization with a duration of 24 months or less.
2. 2. On-site mobilization is mobilizing scientific and technological organizations and individuals engaged in scientific and technological activities to serve national defense at their own workplace.
Chapter II. REGULATIONS AND POLICIES DURING THE PERIOD OF MOBILIZATION
1. For scientific and technological organizations
1. 1. Tax policy is applied according to current regulations on national defense and security.
1. 2. Credit policy and preferential policies for constructing material and technical infrastructure are implemented according to current state regulations.
1. 3. Regarding training human resources in science and technology; according to plans, personnel from the organization can be sent to participate in training courses organized by the Ministry of National Defense for mobilization tasks. Training costs are paid by the mobilizing national defense unit and settled according to Clause 19 of Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government.
1. 4. Reward system: annually and exceptionally, organizations with outstanding scientific and technological achievements will be recognized and recommended for rewards by the competent authorities through the management agency of the Ministry of National Defense, similar to those within the Ministry of National Defense.
2. For individuals
2. 1. For individuals receiving salaries from the state budget.
a) Long-term mobilization.
During the period of mobilization, individuals engaged in scientific and technological activities shall enjoy the following benefits and policies:
- Salary, health insurance, social insurance (illness, maternity; compensation and allowances for work-related accidents and occupational diseases; retirement, death benefits) and other allowances (if applicable) according to current regulations before mobilization, paid by the managing agency of officials, civil servants, and employees.
- Additional special allowance monthly equivalent to 80% of the basic salary plus any allowances (if applicable) before mobilization and other allowances (if applicable); paid by the mobilizing national defense unit and settled according to Clause 19 of Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government.
b) Short-term mobilization
During the period of mobilization, individuals engaged in scientific and technological activities shall enjoy the following benefits and policies:
- Benefits and policies similar to when they were working at their original agencies or units, paid by the managing agency of officials, civil servants, and employees.
- Additional special allowance monthly equivalent to 50% of the basic salary plus any position allowances (if applicable) before mobilization and other allowances (if applicable); paid by the mobilizing national defense unit and settled according to Clause 19 of Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government.
- If the mobilization period exceeds 24 months due to mission requirements, the extended period over 24 months shall enjoy benefits similar to those of long-term mobilization.
c) On-site mobilization
- Enjoy benefits and policies similar to when they were serving in their specialized positions at their units, paid by the managing agency of officials, civil servants, and employees.
- Additional special allowance monthly equivalent to 30% of the basic salary plus any service allowances (if applicable) before mobilization and other allowances (if applicable); paid by the managing agency of officials, civil servants, and employees.
The expenses are settled into the state budget allocated to ministries, sectors, provincial people's committees for national defense and security work.
- The special allowance stipulated in points a, b, and c above shall not be used as a basis for contributions and benefits under health insurance and social insurance.
2. 2. For individuals not receiving salaries from the state budget.
- The special preferential allowance regime prescribed in the points a, b, and c above shall not be used as a basis for contributing to and enjoying medical insurance and social insurance benefits.
2. 2. For individuals who do not receive salaries from the State budget.
For individuals not receiving salaries from the state budget, if they voluntarily participate in scientific and technological tasks serving national defense, the mobilizing unit shall enter into a labor contract with such individual in accordance with the laws on labor. The employee shall be entitled to salary and allowances as stipulated in the labor contract, and shall enjoy social insurance and health insurance benefits in accordance with current state regulations. The costs shall be borne by the mobilizing unit and settled within the funds allocated for the scientific and technological tasks that need to be mobilized.
2. 3. Other provisions (applicable to all subjects specified in this Circular)
- Individuals mobilized to serve national defense may participate in training courses serving the mobilization plan organized by the Ministry of National Defense and other state training courses aimed at serving national defense purposes. Training costs shall be covered by the mobilizing national defense unit and settled according to Article 19 of Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government.
- Intellectual property rights and copyright protection for research results and technological development achievements shall be provided in accordance with Article 26 of the Law on Science and Technology.
- Eligible to apply for and be recommended for science and technology awards of the Ministry of National Defense and the State for valuable research projects and technological solutions in accordance with current regulations, similar to those applicable to individuals under the Ministry of National Defense.
- Eligible to have achievements counted towards consideration for appointment to professor and associate professor titles in accordance with Decree No. 20/2001/NĐ-CP dated May 17, 2001 of the Government on standards and procedures for appointing and dismissing professor and associate professor positions.
- To be issued a certificate of service to national defense by the Ministry of National Defense. Procedures for issuing certificates shall be prescribed by the Ministry of National Defense.
After the mobilization period has expired, the agency or unit managing officials, civil servants, and employees shall be responsible for arranging employment and settling other benefits for the mobilized individual in accordance with current state regulations.
Chapter III. IMPLEMENTATION
1. Ministers of Ministries, agencies equivalent to ministries, agencies under the Government, and other central-level organizations, Chairpersons of People's Committees of provinces and centrally-administered cities, and organizations and individuals engaged in scientific and technological activities mobilized to serve national defense shall be responsible for organizing and implementing the provisions of this Circular.
2. This Circular shall take effect fifteen days after its publication in the Official Gazette. During implementation, any difficulties should be promptly reported to the relevant ministries and provincial People's Committees for study and resolution.
