Guidelines for adjusting the monthly allowance level
from October 1, 2006, for village cadres who have retired according to

Pursuant to Decree No. 93/2006/NĐ-CP dated September 7, 2006 of the Government adjusting pensions, social insurance allowances, and adjusting monthly allowances for retired village cadres (hereinafter referred to as Decree No. 93/2006/NĐ-CP);
Pursuant to Decree No. 94/2006/NĐ-CP dated September 7, 2006 of the Government adjusting the minimum wage (hereinafter referred to as Decree No. 94/2006/NĐ-CP);
The Ministry of Interior and the Ministry of Finance issue guidelines for adjusting the monthly allowance level from October 1, 2006, for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers as follows:
I. APPLICABLE OBJECTS
The applicable objects of this Circular are village cadres who have retired and are receiving monthly allowances according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111/HĐBT dated October 13, 1981 of the Council of Ministers (hereinafter referred to as retired village cadres).
II. ADJUSTMENT OF MONTHLY ALLOWANCE LEVEL
From October 1, 2006, implement the adjustment of the monthly allowance level for retired village cadres according to Article 6 of Decree No. 93/2006/NĐ-CP (increasing the monthly allowance by 10% over the allowance received at the time of September 2006) and Clause 1 of Article 2 of Decree No. 94/2006/NĐ-CP (increasing the monthly allowance by 28.6% after the initial increase of 10% on the allowance received at the time of September 2006) as follows:

In which: The monthly allowance received at the time of September 2006 is the allowance stipulated in Clause 2 Item II of Circular Joint No. 115/2005/TTLT-BNV-BTC dated November 2, 2005 of the Ministry of Interior and the Ministry of Finance guiding the implementation of Decree No. 119/2005/NĐ-CP dated September 27, 2005 of the Government regarding the adjustment of allowances for retired village cadres according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111/HĐBT dated October 13, 1981 of the Council of Ministers.
2. The monthly allowance level received from October 1, 2006, for retired village cadres (rounded off according to the calculation formula specified in Clause 1 above) is as follows:
a) For cadres who were originally Party Secretaries, Chairmen of Village People's Committees: VND 562,100/month (an additional VND 164,800/month compared to the allowance received at the time of September 2006);
b) For cadres who were originally Deputy Secretaries, Deputy Chairmen, Standing Members of the Party Committee, Secretaries of the People's Committee, Secretaries of the People's Council, Village Militia Chiefs, Heads of Public Security Stations: VND 541,000/month (an additional VND 158,600/month compared to the allowance received at the time of September 2006);
c) For other positions: VND 499,500/month (an additional VND 146,400/month compared to the allowance received at the time of September 2006).
III. IMPLEMENTATION
1. Provincial People's Committees and municipal people's committees directly under the central government shall guide and implement the payment of monthly allowances from October 1, 2006, according to the provisions of this Circular for the objects within their jurisdiction.
2. The source of funds for adjusting the monthly allowance for retired elderly village cadres shall be implemented according to the guidance of the Ministry of Finance.
3. Retired village cadres who move to a new legal place of residence within the same district must present a transfer certificate issued by the People's Committee of the commune; within the same province, a transfer certificate issued by the Department of Interior - Labor, Invalids and Social Affairs of the district; outside the province, a transfer certificate issued by the Department of Interior; the transfer certificate must be accompanied by the file and decision on retirement (in case of loss, there must be a confirmation letter from the competent authority at the same level). The department at the place of transfer will continue to pay the transferred cadre. Retired village cadres who moved to a new legal place of residence before the effective date of Decree No. 93/2006/NĐ-CP and Decree No. 94/2006/NĐ-CP will continue to be paid by the current paying entity.
This Circular takes effect 15 days after its publication in the Official Gazette. Circular Joint No. 115/2005/TTLT-BNV-BTC dated November 2, 2005 of the Ministry of Interior and the Ministry of Finance guiding the implementation of Decree No. 119/2005/NĐ-CP dated September 27, 2005 of the Government regarding the adjustment of allowances for retired village cadres according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111/HĐBT dated October 13, 1981 of the Council of Ministers is hereby abolished.
5. The provisions of this Circular shall be implemented from October 1, 2006.
During the implementation process, if there are difficulties, ministries, sectors, and localities should report to the Ministry of Interior and the Ministry of Finance for research and resolution./.
