THE MINISTER OF JUSTICE
Pursuant to the Civil Enforcement Law dated January 14, 2004;
Pursuant to Decree No. 62/2003/NĐ-CP dated June 6, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;
Pursuant to Decree No. 50/2005/NĐ-CP dated April 11, 2005 of the Government on the management agency for civil enforcement, civil enforcement agencies, and civil enforcement officials and staff;
Based on the proposal of the Director of the Civil Enforcement Agency.
DECISION:
Article 1. Amending and supplementing Clause 3, Article 2 of the Delegation Regulation for the Director of the Department of Justice of the province and city under the central administration to manage certain aspects of organizational and personnel work of the Civil Execution Office of the province and city under the central administration, Civil Execution Office of districts, towns, city districts, and provincial cities issued together with Decision No. 1148/2005/QĐ-BTP dated May 18, 2005 of the Minister of Justice, as follows:
1. Points a.2 and a.3 under point a of Clause 3 are combined into point a.2 and amended as follows:
"a.2) On the basis of the results of the examination and recruitment for civil servants, the Director of the Department of Justice decides to announce the recruitment results. Within thirty days from the date of announcing the recruitment results, the Director of the Department of Justice issues a decision on the recruitment of civil servants for local civil execution agencies, and at the same time sends the list of those recruited (along with their files, examination and recruitment results, and related documents) to the Ministry of Justice for verification and management."
2. Supplementing point d of Clause 3 as follows:
"d) Appoint probationary staff to the civil servant rank. On the basis of the results of the probation period, the Director of the Department of Justice examines and decides to appoint to the rank or revoke the recruitment decision for civil servants according to the provisions of the law and report to the Ministry of Justice for management."
Article 2. The Director of the Civil Enforcement Agency assists the Minister of Justice in implementing the inspection of the recruitment of civil servants and other tasks related to the organization and personnel of local civil execution agencies, and reports the results annually to the Minister of Justice.
Article 3. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
The Head of the Office, the Director of the Civil Enforcement Agency, the Heads of units under the Ministry of Justice, the Directors of the Departments of Justice, and the Heads of local civil execution agencies are responsible for implementing this Decision./.
