THE MINISTER OF AQUATIC RESOURCES

Pursuant to Decree No. 43/2003/NĐ-CP dated May 2, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Aquatic Resources;

Pursuant to Directive No. 37/2005/CT-TTg dated October 28, 2005 of the Prime Minister on measures to strengthen management of chemicals and antibiotics for food production and business;

Considering the requirements for quality control and food safety of aquatic products from the markets of the United States and Canada;

At the proposal of the Director of the Science and Technology Department.

DECISION:

Article 1. The inspection and certification of quality and food safety of Vietnamese aquatic products and aquatic product exports to the United States and Canada shall be carried out upon request of the aquatic product production and business establishments or pursuant to bilateral agreements between competent authorities of Vietnam and importing countries.

Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette. The enhanced inspection regime for aquatic products exported to the United States and Canada as stipulated in Decision No. 29/2005/QĐ-BTS dated November 1, 2005 of the Minister of Aquatic Resources on strengthening inspection of aquatic products for export to the United States and Canada is hereby abolished.

Article 3. The Bureau of Quality Control, Food Safety, and Aquatic Animal Health has the responsibility to notify and guide aquatic product production and business establishments to implement the provisions of cooperation agreements signed with competent authorities of importing countries.

Article 4. The Head of the Office, Heads of Departments, Bureaus, Inspectors, Heads of subordinate units under the Ministry, Directors of Fisheries Departments, Departments of Agriculture and Rural Development responsible for fisheries management, and heads of aquatic product processing and exporting enterprises are responsible for implementing this Decision.
