JOINT CIRCULAR

Amending and supplementing certain provisions of Circular Joint Circular No. 04/2002/TTLT/BCA-BNG dated January 29, 2002 guiding the implementation of Decree No. 21/2001/NĐ-CP dated May 28, 2001 of the Government detailing the implementation of the Ordinance on Entry into, Exit from, and Residence of Foreigners in Vietnam

1. Repealing the content of the provision at the first bullet point of point b, item 1, part III of Circular Joint Circular No. 04/2002/TTLT/BCA-BNG dated January 29, 2002 guiding the implementation of Decree No. 21/2001/NĐ-CP dated May 28, 2001 of the Government detailing the implementation of the Ordinance on Entry into, Exit from, and Residence of Foreigners in Vietnam, and replacing it with the following content:

"For individuals exempted from visa requirements under international treaties to which Vietnam is a party, a temporary residence certificate shall be issued for the duration specified in such international treaties. If an international treaty on visa exemption does not specify a specific period of temporary residence, a temporary residence certificate for thirty days shall be issued. In cases where the period allowed by the relevant country for Vietnamese citizens to reside temporarily without a visa differs from the aforementioned period, the Ministry of Foreign Affairs shall consider reciprocal application and notify the Ministry of Public Security, the Ministry of Defense, and other relevant agencies to implement uniformly."

This Circular shall take effect fifteen days after its publication in the Official Gazette.

Each ministry shall guide subordinate agencies under their jurisdiction to implement this Circular based on their respective functions and responsibilities./.
