JOINT CIRCULAR
Guidelines for procedures and levels of support for relatives of martyrs visiting graves and relocating remains of martyrs

Pursuant to Clause 4, Article 6 of Decree No. 16/2007/NĐ-CP dated January 26, 2007 of the Government on the search, collection, and management of martyrs' remains, graves, cemeteries, memorials, and name plaques of martyrs;
The Ministry of Labor, Invalids, and Social Affairs and the Ministry of Finance provide guidelines for procedures and levels of support for relatives of martyrs when visiting graves and relocating remains of martyrs as follows:
I. APPLICABLE OBJECTS
Parents, spouse, children, persons who have raised martyrs, and full-blooded siblings of martyrs (collectively referred to as relatives of martyrs), persons authorized by relatives of martyrs (confirmed by the People's Committee of the commune, ward, or town where they reside).
II. PROCEDURES AND LEVELS OF SUPPORT FOR VISITING GRAVES AND RELOCATING REMAINS OF MARTYRS
1. Visiting Graves of Martyrs
a) Procedures:
Based on the notification of the Department of Labor, Invalids, and Social Affairs regarding the grave of a martyr or confirmation of the grave by the cemetery management authority where the martyr is buried, and the relative's request to visit the grave, confirmed by the People's Committee of the commune, ward, or town where the relative resides, the Department of Internal Affairs - Labor, Invalids, and Social Affairs where the relative resides issues an introduction letter for visiting the grave of a martyr.
b) Level of Support:
When relatives of martyrs visit the grave, they are supported with meal expenses and travel costs once a year for up to three people, specifically as follows:
- The Department of Labor, Invalids, and Social Affairs where the relative resides: supports travel costs according to the fare price of public transportation means (bus, train seat) from the place of residence of the relative to the cemetery where the martyr is buried.
- The Department of Labor, Invalids, and Social Affairs where the relative visits:
+ Supports travel costs according to the fare price of public transportation means (bus, train seat) from the cemetery where the martyr is buried back to the place of residence.
+ Supports meal expenses at a rate of 50,000 VND/day/person. The support period is based on the distance from the relative's place of residence to the locality where the martyr's grave is located, specifically:
Under 500 km: not exceeding 3 days.
From 500 km to under 1,000 km: not exceeding 5 days.
From 1,000 km to under 1,500 km: not exceeding 7 days.
From 1,500 km to under 2,000 km: not exceeding 9 days.
2,000 km or more: not exceeding 11 days.
2. Relocating Remains of Martyrs
a) Procedures:
- When relocating the remains of martyrs, the objects specified in Section I of this Circular must have the notification of the Department of Labor, Invalids, and Social Affairs regarding the grave of a martyr or confirmation of the grave by the cemetery management authority and a request to relocate the remains of a martyr, confirmed by the People's Committee of the commune, ward, or town where they reside.
- The Department of Internal Affairs - Labor, Invalids, and Social Affairs where the relative resides issues an introduction letter for the relative to relocate the remains of a martyr.
b) Authority to resolve the relocation of remains of martyrs:
The Director of the Department of Labor, Invalids, and Social Affairs managing the grave, based on the relative's request and the introduction letter of the Department of Internal Affairs - Labor, Invalids, and Social Affairs, resolves the relocation, confirms that the remains have been relocated, and supports the cost of relocating the remains of a martyr.
c) Relatives of martyrs are supported with meal expenses and travel costs as stipulated in paragraph b, point 1, section II of this Circular; additionally, they are supported with 2,000,000 VND by the local Department of Labor, Invalids, and Social Affairs where the remains of the martyr are currently buried to excavate and relocate one set of remains of a martyr.
III. IMPLEMENTATION
1. Reception and Burial Ceremony of Remains of Martyrs
- Based on the confirmation of the relocation of the grave of a martyr by the Director of the Department of Labor, Invalids, and Social Affairs managing the grave, the People's Committee of the commune, ward, or town organizes the reception and burial ceremony of the remains of martyrs.
- For the remains of martyrs that relatives wish to retain for construction of a tomb within the family to continue long-term management (not placed in a martyrs' cemetery): Relatives are supported with 1,500,000 VND to construct a tomb cover for martyrs.
2. Funding for Visiting Graves and Relocating Remains of Martyrs is guaranteed from the central budget from the funds allocated for implementing policies for those who have contributed to the revolution.
3. The levels of expenditure prescribed in this Circular shall be implemented from January 1, 2008.
4. The Department of Labor, Invalids and Social Affairs shall be responsible for:
- Creating conditions and assisting relatives to visit graves and relocate remains of martyrs.
- Managing and directing the implementation of work related to graves and martyrs' cemeteries in the locality in accordance with the provisions of the law and guidance of the Ministry of Labor, Invalids, and Social Affairs.
5. This Circular takes effect 15 days after its publication in the Official Gazette.
This Circular replaces Circular No. 49/2002/TTLT-BTC-BLĐTBXH dated May 28, 2002 of the Joint Ministry of Finance - Ministry of Labor, Invalids, and Social Affairs guiding the implementation of funding for work related to martyrs' graves.
In the process of organizing implementation, if there are difficulties, localities should promptly reflect them to the Ministry of Labor, Invalids, and Social Affairs - Ministry of Finance for consideration and resolution./.
