THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

鉴于2001年4月4日颁布的《机要条例》；

Considering the proposal of the Minister of Home Affairs,

DECREE:

PART I

GENERAL PROVISIONS

Article 1. Scope of application

本决定规定了正在从事机要工作的人员的基本物质后勤标准，包括：日常伙食标准和在训练、战斗值班、战备演练、防洪救灾任务中的伙食补助标准；医疗站和医院的治疗伙食标准；疗养伙食标准；服装标准；医疗用药品、绷带、化学物品的标准；医疗设备配备标准；生活用水清洁使用定额；营房集体宿舍、办公室、公务住房及公共生活设施面积标准；装备物资定额和电力使用定额。

Article 2. Applicability

1. 正在从事机要工作并按军官军衔工资表或军队专业军人工资表领取工资的人员，在政府机关机要局和各部、地方执行本决定规定的物质后勤标准。

2. 正在从事机要工作的现役军人按照2003年10月22日国务院第123号令关于现役军人物质后勤标准的规定执行；正在从事机要工作的人民警察按照2006年3月10日国务院第25号令关于人民警察物质后勤标准的规定执行，并且还应遵守本决定附表13、14和15中规定的物质后勤标准。

Article 3. 物质后勤标准保障原则

1. 确保满足日常生活、学习、训练、教育、战备和作战服务的需求。

2. 符合越南机要任务的要求，适应经济和社会条件以及国家预算能力的不同阶段。

3. Being consistent with overall development trends and specific characteristics of each region, locality, and particular group.

4. 物质后勤标准可以通过货币或实物形式提供，某些具体标准可以计入正在从事机要工作的人员的工资和补贴。如果标准已作为计算工资和补贴的基础，则不应再计入发放标准；如果发放则必须从工资和补贴中扣除。

5. 鼓励节约合理地保障正在从事机要工作的人员的物质后勤标准；具备条件的单位应主动组织生产，以改善正在从事机要工作的人员的生活。

6. 严禁利用保障正在从事机要工作的人员的物质后勤标准谋取私利或损害国家财产的行为。

Chapter II

正在从事机要工作的人员的物质后勤标准

Article 4. 正在从事机要工作的人员的伙食标准

1. 正在从事机要工作的人员承担特别繁重、有害或危险任务时的伙食标准，包括参加训练、战斗值班、演习、防洪救灾、事故救援和其他一些任务。

a) The caloric intake, quantitative structure, and ratio of heat-producing substances shall be specified in accordance with the tasks of each category;

b) 承担特别繁重、有害或危险任务的正在从事机要工作的人员的伙食金额比陆军下士和士兵的伙食标准高出1.3到3.5倍。

2. 正在从事机要工作的人员因伤或病在军事医疗站或医院接受治疗期间，按照疾病伙食标准进食。

Article 5. 正在从事机要工作的人员的服装标准

1. 正在从事机要工作的人员的服装标准包括个人管理和经常使用的服装，以及公用服装，包括常服、年度制服和防寒服。

2. 正在从事机要工作的人员的专业服装标准是为直接执行训练、作战服务和专门技术工作的人员配备的。

Article 6. 餐厅、厨房和配餐设备的配备标准

1. 集体餐厅、学校、学院、医疗站的厨房和配餐设备的配备标准适用于分散单位和独立作业单位的单个厨房。

2. 针对各局和技术密码保障中心的餐厅、厨房和配餐设备的配备标准根据各单位编制规模而定。

Article 7. 药品、绷带、化学品的标准

药品、绷带、化学品的配备标准包括单位内使用的药品、绷带；病床使用的药品、绷带；为具有上校及以上军衔工资水平和慢性疾病的正在从事机要工作的人员提供的辅助药品；为执行特别繁重、有害或危险任务，参与作战工作，前往基层执行任务的正在从事机要工作的人员提供的辅助药品；用于防疫、化学品和生物制品的药品和化学品。

药品、绷带、化学品的配备标准根据不同单位和不同类型的正在从事机要工作的人员进行分配。

Article 8. 医疗设备配备标准

1. The standards for initial medical equipment and devices and annual replacement equipment.

2. 根据卫生部的规定，医疗设备配备标准适用于机要行业内的各种医疗机构。

3. 根据卫生部的规定，配备医疗职业服装。

Article 9. 卫生杂费标准

卫生杂费标准根据不同地区的地理区域分类，仅适用于医疗机构。

Article 10. 生活用水清洁使用定额

1. 生活用水清洁使用定额确保每人每天至少有130至150升清洁用水，适用于有清洁水源的地区。

2. Units of work on the territory that have not yet had a common clean water source shall be equipped with machinery, equipment, and chemicals to exploit and treat water sources using a prepaid water purchase method, ensuring at least 130 - 150 liters of clean water per person per day.

Article 11. Standards for collective housing area, working houses, official residence, public living facilities, and some auxiliary works within the camp

1. The standard area for collective housing in camps is divided according to salary grade in the secretarial sector, ensuring a minimum average living area of 6m2 and a maximum of 18m2 per person.

2. The standard area for working houses includes standards for working houses for leaders at all levels in the secretarial sector and standards for working houses for those engaged in secretarial technical professions.

3. The standard area for official residence for leaders in the secretarial sector at the Bureau level and above who are subject to policy relocation and rotation without their own residences and have a need for housing can lease one official residence apartment according to the regulations stipulated in the Law on Housing and detailed implementing decrees.

4. The standard area for some public and auxiliary works within the camp is classified according to specific secretarial units.

5. The standard area in collective dining halls of camps, schools, and hospitals is divided according to the object: having a salary equivalent to the rank pay of officers, senior officers, and generals.

Sanitary equipment for collective housing and public working houses is provided according to the number of personnel, and for secretarial units with female members, separate arrangements must be made for men and women.

Article 12. Standard quota for equipment

1. The standard quota for equipment in the secretarial sector is divided according to the usage standards for equipment in collective housing in camps, working houses for various objects, duty rooms, classrooms, meeting rooms, reception rooms, archive rooms, security rooms, dining rooms, and study rooms. Each specific standard is divided according to the salary grade of those engaged in secretarial work or according to unit level in the secretarial sector.

2. The Minister of Interior shall specify the dimensions and models of various types of equipment to be provided in agencies, units, and training institutions under the Government Secretariat and secretarial sectors of ministries, departments, provinces, and cities.

Article 13. Standard electricity consumption

1. The standard electricity consumption in the secretarial sector includes standards for electricity consumption for daily life and work; standards for electricity consumption for command readiness combat; standards for electricity consumption for warehouse work; standards for electricity consumption for training; standards for electricity consumption for disease prevention, medical examination, and treatment; and standards for electricity consumption for other tasks. Units of work on the territory that have not yet had electricity from the national grid shall be equipped with generator systems for these units.

2. The Minister of Interior shall specify in detail about:

a) Electricity consumption for the import, export, storage, maintenance, repair, and sealing of technical and professional confidential equipment, materials, and transportation means and spare parts at warehouses and technical areas;

b) The standard electricity consumption for each specific unit listed in Section V Item 5 "Standard Electricity Consumption" issued together with this Decree;

c) Equipping generator systems for units of work on the territory that have not yet had electricity from the national grid.

Article 14. List of standards

1. Issued together with this Decree are detailed lists regarding certain basic material logistics standards for those engaged in secretarial work:

a) List No. 1: standards for uniforms for those engaged in secretarial work;

b) List No. 2: standards for medicines, bandages, chemicals; standards for medical equipment and medical uniforms; standards for hygiene expenses;

c) List No. 3: standards for collective housing, working, public living facilities, and some auxiliary works within the camp;

d) List No. 4: standard quotas for equipment;

đ) List No. 5: standard electricity consumption.

2. In addition to the material standards already included in the lists attached to this Decree, there are other material standards that cannot be expressed through lists such as:

a) Meal allowances and food rations for training, standby readiness combat, exercises, and other tasks;

b) Professional uniforms, additional uniforms;

c) Models of equipment in working houses, camp housing, and official residences;

d) Electricity consumption for warehouse activities, maintenance, repair of technical and professional equipment, support tools, workshop, warehouse, technical area, and other tasks;

đ) Standards for equipping generator systems for units of work on the territory that have not yet had electricity from the national grid.

3. In cases where necessary, the Minister of Interior shall submit to the Prime Minister for amendments and supplements to the detailed lists prescribed in Clause 1 of this Article.

Chapter III

IMPLEMENTING PROVISIONS

Article 15. Effectiveness

This Decree takes effect 45 days from the date of signature.

Repeal the provisions on uniform standards in Chapter II, Section 1 of Decree No. 211/2004/NĐ-CP dated December 22, 2004 of the Government detailing certain provisions of the Ordinance on Secretarial Work concerning uniform standards; rest and annual compulsory labor service obligations for those engaged in secretarial work; and the material standards for health care for those engaged in secretarial work as stipulated in Article 7 of Decree No. 153/2006/NĐ-CP dated December 22, 2006 of the Government on medical examination and treatment and material standards for health care for those engaged in secretarial work; mandatory health insurance for relatives of those engaged in secretarial work.

Article 16. Implementation guidance

1. Students in the secretarial sector who enjoy subsistence allowance but are not part of the People's Army or Public Security shall implement material logistics standards similar to those for infantry non-commissioned officers and soldiers in the People's Army.

2. The Ministry of Home Affairs shall be responsible for:

a) Coordinate with the Ministry of Finance, the Ministry of Planning and Investment, the Ministry of Defense, and relevant ministries and sectors to guide the application of material logistics standards according to specific levels and for different objects engaged in work and study in the secretarial sector, suitable to the characteristics of secretarial work in different regions.

b) Annually establish plans and budgets for funding the provision of logistical material standards for equipment for personnel currently engaged in cryptographic work, military personnel working at the Government Cryptographic Department, and students studying cryptographic engineering at the Cryptographic Technical Academy, in accordance with the provisions of this Decree.

3. Funding for the provision of logistical material standards for equipment in the cryptographic sector shall be allocated within the annual budget estimates of relevant ministries, sectors, and localities in accordance with the State Budget Law and guiding documents for its implementation.

Article 17. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial People's Committees under the central city shall be responsible for implementing this Decree./.
