Regulations on quality management

 clinker Portland cement for trade

Pursuant to the Product Quality Law No. 05/2007/QH12 dated November 21, 2007 of the National Assembly;

Pursuant to the Government Decree No. 132/2008/NĐ-CP dated December 31, 2008 detailing the implementation of certain provisions of the Product Quality Law;

Pursuant to Decree No. 17/2008/NĐ-CP dated February 4, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to the actual needs of managing the quality of clinker Portland cement for trade. The Ministry of Construction hereby promulgates the following regulations:

Article 1. Scope of Regulation

This Circular stipulates the list of quality criteria, the bases for inspection, and the quality management procedures for clinker Portland cement for trade.

Article 2. Applicability

Organizations and individuals producing, trading, and using clinker Portland cement for trade in Vietnam.

Article 3. Product Group

Clinker Portland cement for trade (clinker Portland cement for exchange and sale) is a product and commodity belonging to Group 2 under the Product Quality Law.

Article 4. List of Quality Criteria and Bases for Quality Inspection of Clinker Portland Cement for Trade

The list of quality criteria and the bases for quality inspection for clinker Portland cement for trade (hereinafter referred to as the List) shall be prescribed as follows:

Article 5. Quality Management of Clinker Portland Cement for Trade

1. Quality Management of Domestic Clinker Portland Cement for Trade Production:

a) Organizations and individuals producing clinker Portland cement for trade must declare the product quality in accordance with the provisions of Article 4 (hereinafter referred to as conformity declaration).

b) The quality of clinker Portland cement for trade must be certified as conforming to the provisions of Article 4 (hereinafter referred to as conformity certification) by an assessment body designated by the Ministry of Construction to carry out such certification.

c) When circulating in the market and being used, clinker Portland cement for trade must have conformity declaration and conformity certification documents as provided in points a and b of this clause.

d) Conformity declaration for domestically produced clinker Portland cement for trade is based on self-assessment results of organizations and individuals producing it or test and inspection results of an assessment body recognized according to current regulations for representative samples of clinker Portland cement for trade batches that comply with the provisions of Article 4.

e) Requirements for conformity certification for domestically produced clinker Portland cement for trade include:

- Conformity declaration.

- Certification of the manufacturer's quality management system compliance with ISO 9001:2008 standard or ISO 9001:2000 standard still within its validity period.

- Test and inspection results of representative samples of clinker Portland cement for trade batches that comply with the provisions of Article 4 conducted by an assessment body designated by the Ministry of Construction.

2. Quality Management of Imported Clinker Portland Cement for Trade:

a) Organizations and individuals importing clinker Portland cement for trade must make conformity declarations for imported products and commodities, and the quality of clinker Portland cement for trade must be certified as conforming to the provisions of Article 4 by an assessment body designated by the Ministry of Construction to carry out such certification.

b) When circulating in the market and being used, imported clinker Portland cement for trade must have conformity declaration and conformity certification documents as provided in points a and b of this clause.

c) Conformity declaration is based on one of the following grounds:

- Self-assessment results of the importer regarding the quality of clinker Portland cement for trade that complies with the provisions of Article 4.

- Test and inspection results of representative samples of clinker Portland cement for trade at the import gate that comply with the provisions of Article 4 conducted by an assessment body designated by the Ministry of Construction.

d) Requirements for conformity certification for imported clinker Portland cement for trade include:

- Conformity declaration.

- Certification of the manufacturer's quality management system compliance with ISO 9001:2008 standard or ISO 9001:2000 standard still within its validity period.

- Environmental management system certification of the production facility issuing clinker Portland cement for trade that complies with ISO 14001 standard still within its validity period.

- Test and inspection results of representative samples of clinker Portland cement for trade at the import gate that comply with the provisions of Article 4 conducted by an assessment body designated by the Ministry of Construction.

e) Provisional clearance before full testing conditions are met, subject to having test and inspection results for strength activity index at 3 days ± 45 minutes and other criteria complying with the provisions of Article 4. Subsequently, test and inspection results for strength activity index at 28 days ± 45 hours must comply with the relevant provisions of Article 4, allowing the importer to use or circulate in the market only after obtaining these results.

3. Provisions on Batch Size and Sample Collection for Testing are as follows:

- Each batch weight does not exceed 3,000 tons, as stipulated in Clause 6.1, Article 6 of TCVN 7024:2002.

- Samples are collected for testing in accordance with Clause 5.1 (points 5.1.1 and 5.1.2) of Article 5 of TCVN 7024:2002, as follows: Samples are taken from at least 10 different positions in each batch of clinker, approximately 20 kg from each position, then mixed thoroughly, and divided using the quartering method to obtain about 80 kg for testing; The test sample is divided into two equal parts, one part for storage and one part for testing.

4. A list of assessment bodies designated by the Ministry of Construction to conduct testing, inspection, examination, and certification of conformity is attached as an appendix to this Circular and will be updated and supplemented on the Ministry of Construction’s website.

Article 6. Implementation Organization

1. The Science, Technology, and Environment Department of the Ministry of Construction is responsible for assisting the Minister of Construction in managing the activities of assessment bodies for clinker Portland cement for trade quality in accordance with the regulations.

2. The Construction Materials Department shall be responsible for coordinating with provincial construction departments and relevant competent authorities to implement quality management work in production, business, importation, and use of commercial clinker Portland cement in accordance with the provisions set forth.

3. Organizations and individuals engaged in domestic production, importation, and use of commercial clinker Portland cement shall be responsible for complying with the provisions of this Circular.

4. This Circular shall take effect 45 days from the date of signature.

5. In the course of implementation, if there are any difficulties, it is requested that agencies, organizations, and individuals promptly report them to the Ministry of Construction for study and supplementary guidance./.
