Joint Circular No. 01/2010/TTLT-BCA-BGTVT stipulates on cooperation in providing registration and inspection data for road motor vehicles, traffic accident data, and procedures for issuing, renewing, revoking, and suspending driving licenses and certificates of traffic law knowledge training.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

These Circulars regulate the cooperation in providing registration data, periodic technical inspection data for motor vehicles (hereinafter referred to as registration and inspection data for motor vehicles), traffic accident data, and issuance, renewal, revocation, and suspension of driving licenses and certificates of traffic law training.

Article 2. Applicability

These Circulars apply to public security units and localities related to vehicle registration and inspection work, traffic accident investigation and resolution, issuance, renewal, revocation, and suspension of driving licenses and certificates of traffic law training; agencies and units under the Ministry of Transport; organizations and individuals related to the exploitation and use of registration and inspection data for motor vehicles, traffic accident data, and issuance, renewal, revocation, and suspension of driving licenses and certificates of traffic law training.

Article 3. Principles for providing registration and inspection data for motor vehicles, traffic accident data, and issuance, renewal, revocation, and suspension of driving licenses and certificates of traffic law training

1. Ensuring completeness, objectivity, accuracy, timeliness, within deadlines, and compliance with legal provisions.

2. Ensuring confidentiality of registration and inspection data for motor vehicles, traffic accident data, and issuance, renewal, revocation, and suspension of driving licenses and certificates of traffic law training in accordance with the Law on Protection of State Secrets and guiding documents.

Chapter II

SPECIFIC PROVISIONS

Article 4. Responsibility for Providing Data

1. Responsibilities of units under the Public Security sector

a) Police departments at the county, district, city, and provincial level (hereinafter referred to as County-level Police Departments) provide the Traffic Police Department of the Provincial Public Security Service (hereinafter referred to as Provincial-level Traffic Police Department) with motorcycle and motorbike registration data within their jurisdiction;

b) Provincial-level Traffic Police Departments provide the Highway Police Corps - Railways, Provincial Department of Transport, Provincial Road Safety Committee (hereinafter referred to as Provincial-level Road Safety Committee) with registration data for motor vehicles, data on suspension of driving licenses and certificates of traffic law training, and traffic accident data within their jurisdiction;

c) The Highway Police Corps - Railways provides the Vietnam Highway Administration, Vietnam Vehicle Inspection Corporation, Department of Road Safety (Ministry of Transport), National Road Safety Committee Office with registration data for motor vehicles, data on suspension of driving licenses and certificates of traffic law training, and traffic accident data nationwide and reports to the Administrative Management Police Bureau of the Ministry of Public Security.

2. Responsibilities of agencies and units under the Transport sector

a) Provincial Department of Transport provides the Provincial-level Traffic Police Department, Provincial-level Road Safety Committee, Vietnam Highway Administration with new issuance, renewal, and revocation data for driving licenses and certificates of traffic law training; data on specialized motorcycles managed by the province or centrally-administered municipality;

b) Vietnam Highway Administration provides the Highway Police Corps - Railways, National Road Safety Committee Office, Ministry of Transport with new issuance, renewal, and revocation data for driving licenses and certificates of traffic law training; data on specialized motorcycles participating in road traffic nationwide;

c) Vietnam Vehicle Inspection Corporation provides the Highway Police Corps - Railways, National Road Safety Committee Office, Ministry of Transport with technical inspection data for motor vehicles nationwide.

Article 5. Content of Data Provision

1. Data on traffic accidents

a) Total number of traffic accidents, including serious traffic accidents causing particularly severe consequences, very severe consequences, severe consequences, less severe consequences, and traffic collisions; number of deaths, injuries, and property damage; causes of traffic accidents;

b) Results of investigations and resolutions of road traffic accidents.

2. Data on registration of motor vehicles

a) Total number of newly registered cars and motorcycles by type of motor vehicle during the reporting period;

b) Total number of registered cars and motorcycles by type of motor vehicle up to the reporting date.

3. Data on technical inspections of motor vehicles

a) Total number of cars and specialized motorcycles currently permitted to participate in traffic by type of motor vehicle;

b) Total number of cars and specialized motorcycles currently permitted to participate in traffic undergoing inspection, number of vehicles meeting standards, number of vehicles not meeting standards, ratio of non-compliance;

c) Total number of motor vehicles reaching the end of their service life according to regulations, specifying types of motor vehicles reaching the end of their service life.

4. Data on issuing, renewing, revoking, and confiscating driving licenses and certificates for traffic law knowledge enhancement

a) The total number of driving licenses by category and certificates for traffic law knowledge enhancement newly issued, renewed, or revoked during the reporting period.

b) The total number of driving licenses by category and certificates for traffic law knowledge enhancement newly issued, renewed, or revoked up to the reporting date.

c) Data on confiscating driving licenses and certificates for traffic law knowledge enhancement.

Article 6. Form and Procedure for Providing Data

The provision of data on vehicle registration, inspection, traffic accidents, and issuing, renewing, revoking, and confiscating driving licenses and certificates for traffic law knowledge enhancement shall be conducted regularly monthly, semi-annually, and annually, through written reports, via computer networks, or fax. In cases where there is a written request from authorized agencies, this data shall be provided through ad hoc or specialized reports, signed and stamped by the head of the providing agency or unit.

Article 7. Timeframe for Providing Data

1. For data on vehicle registration, inspection, traffic accidents, and issuing, renewing, revoking, and confiscating driving licenses and certificates for traffic law knowledge enhancement provided monthly, the data shall be compiled from the 1st to the last day of the month and submitted to relevant units before the 5th day of the following month.

2. For data on vehicle registration, inspection, traffic accidents, and issuing, renewing, revoking, and confiscating driving licenses and certificates for traffic law knowledge enhancement provided semi-annually, the data shall be compiled from January 1st to June 30th of the reporting year and submitted to relevant units before July 10th of the same year.

3. For data on vehicle registration, inspection, traffic accidents, and issuing, renewing, revoking, and confiscating driving licenses and certificates for traffic law knowledge enhancement provided annually, the data shall be compiled from January 1st to December 31st of the reporting year and submitted to relevant units before January 10th of the following year.

4. For data on vehicle registration, inspection, traffic accidents, and issuing, renewing, revoking, and confiscating driving licenses and certificates for traffic law knowledge enhancement provided upon request or according to specialized topics, it shall be carried out based on the time requirements set by the requesting authorized agency.

Article 8. Exploitation, Management, and Use of Provided Data

1. The Highway Police Corps, Vietnam Road Administration General Department, and Vietnam Vehicle Inspection General Bureau are responsible for applying necessary technical and operational measures to ensure the confidentiality of provided data for management purposes. The data on vehicle registration, inspection, traffic accidents, and issuing, renewing, revoking, and confiscating driving licenses and certificates for traffic law knowledge enhancement must be exploited, managed, and used for their intended purposes effectively.

2. The extraction and use of data on vehicle registration, inspection, traffic accidents, and issuing, renewing, revoking, and confiscating driving licenses and certificates for traffic law knowledge enhancement must be truthful, with clear source identification. It is strictly prohibited to use such data to harm national interests or the interests of agencies, organizations, or individuals.

Chapter III

IMPLEMENTATION

Article 9. Effective Date

This Circular takes effect forty-five days from the date of signature.

Article 10. Responsibility for Implementation

1. Responsibilities of Public Security Agencies

a) The Administrative Management General Bureau for Order and Safety is responsible for directing, inspecting, and guiding units within the People's Public Security Force to implement this Circular;

b) The heads of General Bureaus, heads of units under the Ministry of Public Security, Provincial Public Security Directors, and Ho Chi Minh City Fire and Rescue Service Directors within their respective functions and tasks have the responsibility to organize the implementation of this Circular.

2. Responsibilities of agencies and units under the Transport sector

a) The Director of the Vietnam Road Administration General Department and the Director of the Vietnam Vehicle Inspection General Bureau are responsible for directing, inspecting, and guiding subordinate units to implement this Circular;

b) Heads of agencies and units under the Ministry of Transport, Provincial Transport Department Directors within their respective functions and duties have the responsibility to organize the implementation of this Circular.

3. During the implementation process, if any difficulties arise, they should be reported to the Ministry of Public Security (through the Administrative Management General Bureau for Order and Safety) or the Ministry of Transport (through the Vietnam Road Administration General Department or the Vietnam Vehicle Inspection General Bureau) for timely guidance.
