Regulations on the model, principles for issuing and using Enforcement Officer Cards,
Enforcement Review Officer Cards,and uniforms, insignias, rank badges
of civil servants in the civil enforcement system

Pursuant to the Civil Enforcement Law on November 14, 2008;
Pursuant to Decree No. 93/2008/NĐ-CP dated August 22, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
Pursuant to Decree No. 74/2009/NĐ-CP dated September 9, 2009 of the Government detailing and guiding the implementation of certain provisions of the Civil Enforcement Law regarding management agencies for civil enforcement, civil enforcement agencies, and civil enforcement officials;
To meet management requirements, the Ministry of Justice stipulates the models, principles for issuing and using Enforcement Officer Cards, Enforcement Review Officer Cards, and uniforms, insignias, rank badges of civil servants in the civil enforcement system as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the models, principles for issuing and using uniforms, insignias, rank badges of civil servants under the Civil Enforcement General Department, local civil enforcement agencies (hereinafter collectively referred to as civil enforcement officials); models, principles for issuing and using Primary Enforcement Officer Cards, Intermediate Enforcement Officer Cards, Advanced Enforcement Officer Cards (hereinafter collectively referred to as Enforcement Officer Cards), Review Officer Cards, Chief Review Officer Cards, Senior Review Officer Cards for enforcement (hereinafter collectively referred to as Enforcement Review Officer Cards).
Article 2. General Principles
1. Civil enforcement officials must wear uniforms, insignias, rank badges of civil enforcement at their workplace and while performing official duties according to their current positions and titles.
2. The issuance and use of uniforms, insignias, rank badges, Enforcement Officer Cards, Enforcement Review Officer Cards must be in accordance with the intended purpose, target group, and regulations set forth by law.
3. It is strictly prohibited to use uniforms, insignias, rank badges, Enforcement Officer Cards, Enforcement Review Officer Cards to commit acts contrary to the law.
Chapter II
MODELS AND COLORS OF CIVIL ENFORCEMENT UNIFORMS
Article 3. Male Uniform
1. Outerwear for autumn-winter
a) Color: Dark heather gray fabric;
b) Style: Four-pocket coat with slightly curved flap pockets, round bottom pockets, chest pocket with hidden flap; V-neck collar; four-button front; star-shaped buttons with gold plating; square hem; shoulder straps; wide sleeves with 9.5 cm cuff; back slit; entire collar, neckline, lapels, pockets, and cuffs have double stitching; epaulets on shoulders; full lining on front and back with shirt fabric, short sleeves lined, front with two pockets; lining color matches the main fabric, shoulder pads made of foam.
2. Outerwear for autumn-winter and spring-summer
a) Color: Dark heather gray fabric;
b) Style: Two-ply trousers with diagonal side pockets, rear pocket with two flaps, rear pocket with button closure; zipper fly, waistband with hook and concealed button; crescent-shaped hem; six belt loops evenly distributed.
3. Long-sleeved shirt
a) Color: White fabric;
b) Style: Collar stand (upright); lapel turned inward; plastic buttons matching the color of the jacket; left breast pocket with rounded flap, top edge stitched with 3 cm seam; back yoke with shoulder seams, straight hem; sleeve cuffs with turn-backs, two-button cuffs.
4. Summer Spring Jacket
a) Color: Light pink fabric;
b) Style: Collar stand (upright); lapel turned outward; plastic buttons matching the color of the jacket; two chest pockets with curved flaps, round bottom pockets, chest pocket with hidden flap; back yoke with shoulder seams, straight hem; shoulder straps; sleeve cuffs with turn-backs, double stitching on entire collar, hem, sleeves, and pocket lapels.
5. Winter outerwear
a) Color: Dark heather gray fabric;
b) Style: Three-button front; K-shaped collar (inset collar, protruding collar); front with inset chest pocket, back with shoulder seams, back slit; inside with pocket, outside with fabric belt; diagonal slant pockets; pointed sleeve cuffs with one button; eight pleats, shoulder straps; chest pocket, sleeve cuffs with 2.5 cm buttons; two-lined pockets; entire body with hairline stitching.
6. Winter thermal jacket
a) Color: Dark heather gray fabric;
b) Style: Three-layer quilted jacket, long-sleeved coat style, two collars, inner collar with zipper, outer collar with K-shaped fold; four buttons on lapel matching jacket color, square hem; four pockets, two upper flap pockets with triangular flaps, round bottom pockets, center pocket with hidden flap, two lower slant pockets, 3.8 cm wide; shoulder straps; round sleeves with ribbed lining inside, pointed sleeve cuffs; double stitching on entire collar, neckline, lapels, pockets, sleeve cuffs; side waist with belt loops, 4 cm wide belt; back with inset back pocket; lining throughout the jacket matching the main fabric, between outer and inner layers of body is 100 gram cotton batting, between outer and inner layers of sleeves is 80 gram cotton batting, between outer and inner layers of lapels, collar, pocket flaps, shoulder straps, sleeve cuffs is 40 gram cotton batting.
Article 4. Women's Uniform
1. Outerwear for autumn-winter
a) Color: Dark heather gray fabric;
b) Style: A two-pocket coat with a V-shaped collar; the chest has four buttons; the buttons are gold-plated star-shaped; the hem is square; the coat has two outside pockets with slightly curved flaps and round edges, with a sunken pocket in the middle; the shoulders have shoulder pads; the sleeves are wide cuffs measuring 9 cm, with a back slit; the entire collar, neckline, pocket flaps, and cuffs are sewn with two rows of stitching; the body of the coat is fused with interfacing; the front and back of the coat are fully lined with polyester, the sleeves are half-lined, and the front has a pocket lining next to the seam; the lining fabric matches the main fabric color, and the shoulder pads are made of foam.
2. Winter trousers and spring-summer trousers worn over
a) Color: Dark heather gray fabric;
b) Style: Two-ply European-style trousers with diagonal side pockets; the zipper fly has a hook and a button inside; the trousers have six evenly spaced darts.
3. Long-sleeved shirt
a) Color: White fabric;
b) Style: Collar fastened (stand-up); lapels folded inward; plastic buttons matching the shirt color; straight hem; the front of the shirt has two darts from the hem up to the chest, and the back also has two darts from the hem up; the sleeves have turn-ups, with two buttons.
4. Outerwear for spring-summer
a) Color: Light pink fabric;
b) Style: Collar fastened (stand-up); lapels folded outward; plastic buttons matching the shirt color; two chest pockets with curved flaps and round edges, with a sunken pocket in the middle; the shoulders have shoulder pads; straight hem; the front of the shirt has two darts from the hem up to the chest, and the back has two darts from the hem up; the sleeve hems are turned out; the entire collar, sleeve hems, pocket flaps, and shoulder pads are sewn with two rows of stitching.
5. Winter outerwear
a) Color: Dark heather gray fabric;
b) Style: A three-button straight-front jacket; the collar is shaped like a K (the collar is inset, the neck protrudes); the front has a bust dart, the back has a shoulder dart, and a back slit; the inside of the jacket has a pocket, the outside has a fabric belt; the pockets are diagonal; there are pointed cuffs with one button each; all seams are raised with eight layers, the shoulders have shoulder pads; the chest and sleeves have buttons spaced 2.5 cm apart; there are two pocket linings with double borders; the entire body of the jacket is structured with padding.
6. Winter thermal jacket
a) Color: Dark heather blue shirt;
b) Style: A three-layer cotton jacket, long-sleeved, with two collars, the inner collar has a zipper, the outer collar folds into a K shape; the lapels have four buttons matching the shirt color, the hem is square; the jacket has two under pockets with diagonal flaps measuring 3.8 cm wide; the shoulders have shoulder pads; the sleeves are rounded, with ribbed cuffs on the inside, and pointed cuffs; the entire collar, lapels, pockets, and cuffs are sewn with two parallel rows of stitching; both sides of the waist have straps, the belt is 4 cm wide; the back has a dart that is integrated into the jacket; the lining fabric matches the main fabric color, between the outer layer and the lining of the body is a 100-gram cotton layer, between the outer layer and the lining of the sleeves is an 80-gram cotton layer, and between the outer layer and the lining of the lapels, collar, pocket flaps, shoulder pads, and cuffs is a 40-gram cotton layer.
Article 5. Kepi Hat
1. Color: The hat is dark heather blue;
2. Style: The hat has a curved brim, the crown and top are made of the same fabric, with a black plastic visor that gradually slopes downward; the hat has a yellow adjustable strap with metal star-shaped buttons at both ends; the front of the hat has a central eyelet; both sides of the hat have four eyelets; the front part of the hat is reinforced with thin plastic; the hat lining is made of plastic-coated fabric, with foam padding attached inside.
Article 6. Cravat
1. Color: Dark heather blue cravat;
2. Style: The cravat has a moderate length and width; it is pre-tied with a zipper closure and an automatic lock mechanism.
Article 7. Leather shoes, leather belts, enforcement helmets
1. Leather belt: made of leather, black color.
2. Leather shoes: made of leather, black color, with laces.
3. Enforcement helmet: a helmet with dark slate blue color, on the right side of the outer surface of the helmet, there is printed text "ENFORCEMENT OF CIVIL EXECUTION".
Article 8. Other types of uniforms
Other types of uniforms include: leather sandals, socks, raincoats, leather bags for carrying documents, decided by the Director of the General Department of Civil Execution (for civil servants of the General Department of Civil Execution) and the Director of the Civil Execution Department of provinces and centrally governed cities (for civil servants of local execution agencies) in accordance with the characteristics of each locality within the price range prescribed by the Minister of Justice.
Chapter III
SAMPLE OF ENFORCEMENT OFFICER BADGE AND CIVIL EXECUTION AUDITOR BADGE
Article 9. Sample and Content of Enforcement Officer Badge
1. The Enforcement Officer Badge has dimensions: length 95 mm, width 70 mm; the Badge consists of two sides, the front side of the Badge is light pink in color, in the middle of the Badge is faintly printed the National Emblem of the Socialist Republic of Vietnam, at the lower left corner there are two red diagonal stripes (one large and one small) extending to the bottom edge of the Badge, above the diagonal stripes is the text "Senior Enforcement Officer" or "Mid-level Enforcement Officer" or "Junior Enforcement Officer" (to distinguish between different ranks of Enforcement Officers); the back side of the Badge has a bright red background.
2. The content of the Badge is as follows:
a) The front side of the Badge includes two parts:
The left part of the Badge: at the top of the Badge is the text "Ministry of Justice", below the text is the emblem of the judicial sector in red color, below the emblem is a photo of the Enforcement Officer measuring 2x3 cm, with a raised seal at the lower right corner of the photo, below the photo is the badge number of the Enforcement Officer.
The right part of the Badge: contains the following content from top to bottom:
At the very top is the State Emblem of the Socialist Republic of Vietnam
Below is the text "Enforcement Officer Badge" with the following information: full name; date of birth; position; place of work; date of issuance of the Badge.
At the bottom is the signature and name of the Minister of Justice.
b) The back side of the Badge contains the following text: excerpted from Article 11 of the Civil Execution Law as follows:
"Responsibilities for cooperation of agencies, organizations, and individuals with civil execution agencies and Enforcement Officers:
1. Within their respective duties, rights, and obligations, agencies, organizations, and individuals have the responsibility to cooperate with civil execution agencies in the execution of judgments.
2. Agencies, organizations, and individuals related to the matter shall fulfill the requirements of civil execution agencies and Enforcement Officers as stipulated by the Civil Execution Law.
Any acts that obstruct or interfere with the activities of civil execution agencies and Enforcement Officers contrary to the law shall be dealt with according to the provisions of the law."
Along the left edge of the Badge is the text "Senior Enforcement Officer" or "Mid-level Enforcement Officer" or "Junior Enforcement Officer".
The detailed sample of the Enforcement Officer Badge is recorded in Appendix No. 01 issued together with this Circular.
Article 10. Sample and Content of Civil Execution Auditor Badge
1. The Civil Execution Auditor Badge has dimensions: length 95 mm, width 70 mm; the Badge consists of two sides, the front side of the Badge is dark blue in color; the back side of the Badge is light blue, at the lower left corner there are two red diagonal stripes (one small and one large) extending to the bottom edge of the Badge, above these diagonal stripes is the text "Senior Auditor" or "Principal Auditor" or "Auditor" (to distinguish between different ranks of Auditors); both the front and back sides of the Badge are faintly printed with patterns resembling bronze drums.
2. The content of the Badge is as follows:
a) Front side of the Badge: At the very top is the text "Socialist Republic of Vietnam", below is the National Emblem of the Socialist Republic of Vietnam, below the Emblem is the text "Auditor Badge";
b) Back side of the Badge includes two parts:
The left side of the Card: at the top, there is the phrase "Ministry of Justice", below this phrase is the emblem of the judicial sector, beneath the judicial sector emblem is the image of an Inspector measuring 2 x 3 cm, with a raised seal affixed at the bottom right corner of the image, below the image is the Inspector's card number.
The right part of the Badge: contains the following content from top to bottom:
At the very top is the National Emblem of the Socialist Republic of Vietnam.
Below it is recorded as the Inspector's card containing the following information: full name; date of birth; position; workplace; date of issuance of the card.
At the bottom is the signature of the Minister of Justice.
Details of the Inspector's Card model are recorded in Appendix No. 02 issued together with this Circular.
Chapter IV
BADGES AND ISSUANCE OF CIVIL ENFORCEMENT BADGES
Article 11. Badges and issuance of civil enforcement badges
Badges and insignia for civil enforcement officials include:
1. Badge attached to the cap;
2. Insignia attached to the shoulder strap;
3. Insignia attached to the lapel.
The model of badges and insignia for civil enforcement, the subjects eligible for badges and insignia shall be implemented according to Articles 42, 43, 44, and 45 of Decree No. 74/2009/NĐ-CP dated September 9, 2009 of the Government detailing and guiding the implementation of certain provisions of the Civil Enforcement Law on management agencies for civil enforcement, civil enforcement agencies, and civil enforcement officials, and according to regulations of the Minister of Justice.
Chapter V
MANAGEMENT, DISTRIBUTION, RECOVERY, USE OF UNIFORMS, BADGES, INSIGNIA, ENFORCEMENT OFFICER CARDS, INSPECTOR CARDS
ENFORCEMENT OFFICER CARD, INVESTIGATION OFFICER CARD
Article 12. Management, procurement, distribution of uniforms, badges, insignia
1. The Director of the Civil Enforcement General Department assists the Minister of Justice in managing uniformly the uniforms, badges, and insignia for civil enforcement officials.
If the uniforms, badges, and insignia of civil enforcement officials are damaged or lost due to objective reasons, they will be replenished by the issuing agency. In cases of damage or loss for other reasons, the officials must bear the entire cost of procurement.
2. When civil enforcement officials retire, resign, or transfer to another job, their uniforms, badges, and insignia that have been issued will not be recovered.
3. The price range for purchasing each type of uniform, badge, insignia, Enforcement Officer Card, and Inspector Card for civil enforcement is stipulated by the Minister of Justice. Based on the eligible recipients, quantity, and service life of each type of uniform, badge, and insignia for civil enforcement, the Director of the Provincial Civil Enforcement Department (hereinafter referred to as the Provincial Civil Enforcement Department) establishes a budget estimate along with the annual budget estimate and sends it to the Civil Enforcement General Department for consolidation into the overall budget of the sector according to the corresponding chapter, type, item, and sub-item of the State Budget Manual as prescribed. The procurement budget for uniforms, badges, and insignias is allocated within the scope of the budget assigned to the civil enforcement system by the competent authority.
4. Uniforms, badges, and insignias for civil enforcement are distributed specifically as follows:
a) The Civil Enforcement General Department uniformly distributes badges and insignias for civil enforcement throughout the civil enforcement system;
b) Types of uniforms such as leather shoes, leather belts, leather sandals, socks, raincoats, leather document bags are provided by the Director of the Civil Enforcement General Department (for distribution to officials under the General Department) and the Director of the Provincial Civil Enforcement Department (for distribution to officials under local enforcement agencies) through monetary allocation for officials to purchase based on the price range, standards, and models prescribed by the Minister of Justice.
c) The Director of the Civil Enforcement General Department and the Director of the Provincial Civil Enforcement Department are responsible for procuring and distributing the remaining types of uniforms (excluding those specified in point b, Clause 4 of this Article) to subordinate officials according to the regulations of the Minister of Justice.
5. The settlement and finalization of the procurement budget for uniforms, badges, and insignias for civil enforcement officials shall be carried out in accordance with the State Budget Law and related implementing documents.
6. The Director of the Civil Enforcement General Department and the Director of the Provincial Civil Enforcement Department ensure the distribution of uniforms, badges, and insignias in accordance with the prescribed principles; distribute to each individual official; maintain records for management in accordance with regulations.
Article 13. Management of funds for printing, issuing, and recalling Enforcement Officer Cards and Execution Inspection Officer Cards
1. The Director of the Civil Enforcement General Department assists the Minister of Justice in uniformly managing Enforcement Officer Cards and Execution Inspection Officer Cards and has the following tasks and powers:
a) Submit to the Minister of Justice for approval the model, issuance, modification, and recall of Enforcement Officer Cards and Execution Inspection Officer Cards;
b) Implement the printing of information of the person receiving the card, establish a tracking book, coordinate with the Ministry of Justice Office to issue Enforcement Officer Cards and Execution Inspection Officer Cards;
2. The Director of the Ministry of Justice Office is responsible for printing and managing blank Enforcement Officer Cards and Execution Inspection Officer Cards; managing card numbers, stamping Enforcement Officer Cards and Execution Inspection Officer Cards after checking all relevant information provided by the Civil Enforcement General Department.
3. Funds for printing and purchasing blank Enforcement Officer Cards and Execution Inspection Officer Cards shall be allocated by the competent authority within the annual budget estimate of the Ministry of Justice Office.
4. Issuance, replacement, reissuance, and recall of Enforcement Officer Cards and Execution Inspection Officer Cards shall be carried out in the following cases:
a) An Enforcement Officer or Execution Inspection Officer who receives a Decision on appointment to a position shall be issued a Card to serve their work;
b) An Enforcement Officer or Execution Inspection Officer who has been issued a Card, when there is a change in position or title (such as a初级级执行员被任命为副处长;初级执行员被任命为中级执行员,中级执行员被任命为高级执行员或执行检查员被任命为正执行检查员,正执行检查员被任命为高级执行检查员)或者卡片损坏时,可以更换新卡;
c) An Enforcement Officer or Execution Inspection Officer who has been issued a Card but lost it must immediately report to the head of the direct management agency and go through the procedures to reissue the Card.
5. Procedures for issuing, replacing, and reissuing Enforcement Officer Cards and Execution Inspection Officer Cards shall be carried out as follows:
a) For the cases mentioned in point a and point b of Clause 4 of this Article, the Director of the Provincial Civil Enforcement Department or the Director of the Civil Enforcement Department under the Ministry of National Defense within their respective jurisdictions shall be responsible for compiling a list (including two 2x3cm photos in the new rank uniform and insignia) to send to the Civil Enforcement General Department for issuance or replacement of the Card according to regulations.
In the case of card replacement, after receiving the new card, the cardholder must return the old card to their agency head for destruction;
b) For the case mentioned in point c of Clause 4 of this Article, the Director of the Provincial Civil Enforcement Department or the Director of the Civil Enforcement Department under the Ministry of National Defense within their respective jurisdictions shall be responsible for compiling a list and a confirmation letter from the head of the unit where the Enforcement Officer or Execution Inspection Officer works (including two 2x3cm photos in the current rank uniform and insignia) to send to the Civil Enforcement General Department for reissuance of the Card according to regulations.
6. If an Enforcement Officer or Execution Inspection Officer is disciplined or for other reasons is no longer an Enforcement Officer or Execution Inspection Officer, their Card will be recalled. The person whose Card is recalled is responsible for returning the Card to the head of the agency where they work (if the person being recalled is the head of a civil enforcement agency, then the superior agency head or higher-level management agency will recall the Card).
When an Enforcement Officer or Execution Inspection Officer transfers to another job, they are responsible for handing over their Card to the head of the agency before transferring.
Article 14. Transitional Provisions
1. Insignias, rank badges, and Enforcement Officer Cards issued in accordance with Decision No. 1265/2005/QĐ-BTP dated June 16, 2005, of the Minister of Justice on the issuance of models, colors, principles of use of uniforms, insignias of Enforcement Officers, and other civil servants of local civil enforcement agencies and Civil Enforcement Departments under the Ministry of Justice; card models, issuance, modification, and recall of Enforcement Officer Cards (hereinafter referred to as Decision No. 1265/2005/QĐ-BTP) shall be applied until June 30, 2011.
From July 1, 2011, insignias, rank badges, and Enforcement Officer Cards stipulated in Decision No. 1265/2005/QĐ-BTP shall no longer be valid for use or circulation.
2. Within the scope of their assigned responsibilities and powers, the Director of the Civil Enforcement General Department and the Director of the Ministry of Justice Office are responsible for implementing the procurement, issuance of insignias, rank badges, and Enforcement Officer Cards as stipulated in Clause 1 of this Article.
The Director of the Provincial Civil Enforcement Department is responsible for recalling all old insignias, rank badges, and Cards of Enforcement Officers under their management for destruction.
Article 15. Effectiveness and Responsibility for Implementation
1. This Circular shall take effect from February 25, 2011.
The Decision No. 1265/2005/QĐ-BTP dated June 16, 2005 of the Minister of Justice on the issuance of regulations regarding the model, color, principles of use of uniforms and insignia of Enforcement Officers and other civil servants of local enforcement agencies, Civil Execution Cadares under the Ministry of Justice; the model of the Enforcement Officer Card, issuance, change, and recovery of such cards is hereby abolished.
2. Heads of units under the Ministry of Justice, Directors of Civil Execution Cadres under the Ministry of National Defense, Heads of local civil enforcement agencies, and Heads of civil enforcement agencies within the Military shall be responsible for organizing and implementing the provisions of this Circular within their assigned duties and authorities./.
