CIRCULAR
REGULATIONS ON SHIPPING FEES AND CHARGES AND THE RATES FOR COLLECTING SHIPPING FEES AND CHARGES
Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to the Decree on Fees and Charges dated August 28, 2001;
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to the Government's Decree No. 57/2002/NĐ-CP dated June 3, 2002 detailing the implementation of the Decree on Fees and Charges, and the Government's Decree No. 24/2006/NĐ-CP dated March 3, 2006 amending and supplementing certain articles of the Government's Decree No. 57/2002/NĐ-CP dated June 3, 2002;
Based on Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on management of seaports and maritime channels;
At the proposal of the Director of the Enterprise Finance Department,
The Minister of Finance hereby issues this Circular on shipping fees and charges and the rates for collecting shipping fees and charges.
PART I
GENERAL PROVISIONS
Article 1. Scope of regulation and applicable subjects
1. Scope of Regulation: This Circular regulates shipping fees and charges and the rates for collecting shipping fees and charges.
Shipping fees and charges regulated in this Circular include: tonnage fee; maritime security guarantee fee; maritime pilotage fee; anchorage fee at water areas and zones; fee for using bridges and floating piers in maritime areas; port entry and exit fee; and maritime protest certification fee.
2. Applicability: This Circular applies to organizations, individuals, and state agencies related to the collection and payment of shipping fees and charges.
Article 2. Definitions
In this Circular, the following terms are understood as follows:
1. Ships include merchant ships, military ships, public service ships, fishing vessels, inland waterway vessels, seaplanes, and other watercraft.
2. Gross Tonnage (GT): is the maximum gross tonnage of the ship recorded in the tonnage certificate issued by the inspection authority according to regulations.
3. Water Areas and Zones include pilot reception areas, quarantine areas, turning areas, anchorage areas, transshipment areas, and storm shelters within port waters.
4. Maritime Area: is the limit of waters under the responsibility of a maritime port authority. A port may have one or more maritime areas. The list of maritime areas is set forth in the Appendix attached to this Circular.
5. Goods: are goods transported on ships including both loaded containers and empty containers.
6. Exported goods: are goods with the place of dispatch (origin) in Vietnam and the place of receipt (destination) abroad.
7. Imported goods: are goods with the place of dispatch (origin) abroad and the place of receipt (destination) in Vietnam.
8. Transit Goods: are goods with the place of dispatch (origin) and the place of receipt (destination) outside the territory of Vietnam, either traveling directly or being transshipped through a Vietnamese port or stored in warehouses before continuing their journey.
9. Transshipment Goods: are goods transported from abroad to a Vietnamese port and stored in a designated transshipment area of the port for a certain period before being loaded onto another ship for transport out of the territory of Vietnam.
10. Special-Purpose Shipsinclude: ships used for oil exploration and production services (oil service ships), construction ships for marine works, ships for maritime safety operations, training ships, research ships, and public service ships.
11. LASH Ship (Lighter Aboard Ship) is a specialized ship designed to carry LASH barges for transporting dry bulk cargo capable of operating on rivers and seas.
12. LASH Barge: is a specialized barge designed to carry dry bulk cargo capable of operating deep inland where technical conditions of channels are limited.
13. Carrier: is a person who uses ships owned by themselves or others to transport goods and passengers.
14. Voyage: entering a maritime area and completing the arrival procedures at the port as prescribed by law by a competent state agency, or leaving a maritime area and completing the departure procedures at the port as prescribed by law by a competent state agency counts as one voyage.
15. Trip: entering a maritime area once and leaving a maritime area once counts as one trip.
16. Inland Waterway Transport Route from the Mainland to Islands: is an inland waterway transport route from the mainland to islands in Vietnamese territorial waters announced by the Ministry of Transport.
17. Vietnamese Port Area is divided into three areas:
a) Area I: ports north of the 20th parallel;
b) Area II: ports between the 11.5th parallel and below the 20th parallel;
c) Area III: ports south of the 11.5th parallel.
Article 3. Objects Subject to Maritime Fees and Charges
1. Objects subject to maritime fees and charges according to the international maritime activity fee and charge schedule.
a) Vessels exiting, entering, or transiting through, leaving, passing through, or mooring in maritime areas (including export processing zones); foreign vessels operating in Vietnam's territorial waters but not within port waters;
b) Vessels engaged in transporting exported, imported, transshipped, or transited goods in maritime areas including export processing zones;
c) Passenger vessels traveling from Vietnam to foreign countries or from foreign countries to Vietnam; specialized vessels operating on international routes entering, leaving, passing through, or mooring in maritime areas;
d) Exported, imported, transited, or transshipped goods, including goods entering or leaving export processing zones that are loaded, unloaded, received, stored, or moored in maritime areas;
đ) Passengers of passenger vessels arriving from foreign countries to Vietnam (or vice versa) by sea or inland waterways entering, leaving maritime areas;
2. Objects subject to maritime fees and charges according to the domestic maritime activity fee and charge schedule.
a) Domestic maritime vessels entering, leaving, passing through, or mooring in maritime areas;
b) Vessels engaged in transporting goods or passengers in domestic maritime activities entering, leaving, passing through, or mooring in maritime areas;
c) Vessels operating on inland waterway transport routes from shore to islands;
d) Specialized vessels serving oil and gas operations at offshore oil ports or specialized ports serving oil and gas within the responsibility area of maritime port authorities;
đ) Vessels of armed forces, customs, maritime port authorities, and specialized search and rescue vessels of Vietnam when performing official duties not regulated by this Circular; if engaging in commercial activities in Vietnam, they must pay maritime fees and charges as stipulated in Chapter III of this Circular.
Article 4. Persons Paying Maritime Fees and Charges
1. For vessels: the owner of the vessel, the carrier, or the person entrusted with the responsibility for payment.
2. For goods and passengers: the carrier or the person entrusted with the responsibility for payment.
Article 5. Authorities and Organizations Collecting Maritime Fees and Charges
1. Maritime Port Authorities collect the following types of maritime fees and charges:
a) Tonnage fees;
b) Marine guarantee fees, collected on behalf of maritime channels managed and operated by the two Northern and Southern Marine Safety Assurance Joint Stock Companies;
c) Mooring fees in water areas or zones;
d) Port entry and exit fees;
đ) Fees for certifying maritime protests;
e) Fees for using wharves, buoys belonging to maritime areas where the maritime port authority temporarily manages and operates port wharves or buoys.
2. Pilot organizations directly collect pilotage fees.
3. Businesses engaged in port operation, water area, and zone development, and businesses managing maritime channels self-invested may collect maritime fees as stipulated in this Circular. The rates of maritime fees issued together with this Circular include value-added tax.
Article 6. Basis and Principles for Determining the Amount of Maritime Fees and Charges
1. Gross Tonnage (GT): One of the basic units for calculating maritime fees and charges, including:
a) For liquid cargo tankers, gross tonnage is calculated as 85% of the largest GT recorded in the certificate issued by the inspection agency, regardless of whether the vessel has separate ballast tanks.
b) For passenger vessels, it is calculated as 50% of the largest GT recorded in the certificate issued by the inspection agency.
c) For vessels without recorded GT, conversion is as follows:
- Seagoing vessels and self-propelled inland waterway craft convert 1.5 tons of deadweight to 1 GT;
- Barges convert 1 ton of full load displacement to 1 GT;
- Towboats, pushboats, passenger vessels (including seaplanes), and floating cranes: 1 horsepower (HP, CV) equals 0.5 GT; 1 kilowatt (KW) equals 0.7 GT; 1 ton of crane capacity on board equals 6 GT;
- Passenger vessels without recorded engine power convert 1 seat for passengers to 0.67 GT; 1 berth to 4 GT.
- In the case of tugboat groups, pushing or alongside operations, the total gross tonnage of the group including barges, tugs, or pushers is used.
For conversions under point c, Clause 1, Article 6, the method yielding the highest gross tonnage is selected.
2. Unit of engine power: The main engine power of vessels is calculated in HP, CV, or KW; fractions less than 1 HP or 1 KW are rounded up to 1 HP, 1 CV, or 1 KW.
3. Unit of time:
a) For time unit of day: 1 day equals 24 hours; fractional parts of a day up to 12 hours are counted as half a day, over 12 hours as 1 day;
b) For time unit of hour: 1 hour equals 60 minutes; fractional parts up to 30 minutes are counted as half an hour, over 30 minutes as 1 hour.
4. Unit of cargo volume (including packaging): Ton or cubic meter (m3); Fractions less than 0.5 ton or 0.5 m3 are not counted, from 0.5 ton or 0.5 m3 upwards are counted as 1 ton or 1 m3. In a single bill of lading, the minimum volume for calculating fees is 1 ton or 1 m3. For goods occupying more than 2 m3 per ton, every 2 m3 is counted as 1 ton.
5. Fee distance: Nautical mile (NM); fractional parts less than 1 NM are counted as 1 NM.
6. Unit of wharf fee for vessels: Meter (m) of wharf, fractional parts less than 1 m are counted as 1 m.
7. Currency for collecting and paying maritime fees and charges:
a) For international maritime activities: The currency for collecting maritime fees and charges is US Dollar (USD) or Vietnamese Dong (VND);
b) For domestic maritime activities: The currency for collecting maritime fees and charges is Vietnamese Dong;
c) When paying maritime fees and charges converted from USD to Vietnamese Dong, the exchange rate for transfer transactions published by Vietcombank at the time of payment shall be applied.
8. In case vessels receive and deliver import and export goods at multiple maritime areas simultaneously while also receiving and delivering domestic goods, such activities shall be considered international transportation and shall be subject to the Maritime Fee and Charge Tariff for international maritime activities calculated for each entry or exit from the port. However, domestic cargo transported domestically shall not be charged anchorage fees.
9. If a vessel enters or exits a port with multiple fee levels applicable at the same time, only the lowest fee level shall apply for that single entry or exit.
10. Vessels (excluding those specified in point d, Clause 1, Article 13 of this Circular) operating within a maritime area where they only perform one entry or exit procedure from the maritime area shall only pay tonnage dues, maritime security fees, and port entry and exit charges once. Chapter II
Article 7. Tonnage Dues

a) Vessels entering or exiting maritime areas to refuel, obtain food, fresh water, change crew, repair, dismantle, or test run after repairs or construction without loading or unloading cargo or picking up or dropping off passengers shall be subject to a collection rate of 70% of the rate stipulated in Clause 1 of this Article;
b) Vessels (excluding passenger vessels) entering or exiting a maritime area more than three times per vessel per month, from the fourth trip onwards in that month, shall be subject to a collection rate of 60% of the rate stipulated in Clause 1 of this Article; c) Organizations and individuals with passenger vessels entering or exiting maritime areas shall be subject to tonnage dues as follows:
- Passenger vessels with a gross tonnage under 300 GT entering or exiting a maritime area at least ten times per month per maritime area shall be subject to a collection rate of 70% of the rate stipulated in Clause 1 of this Article for passenger vessels operated by organizations and individuals in that month.
- Passenger vessels with a gross tonnage from 300 GT to less than 1,500 GT entering or exiting a maritime area at least seven times per month per maritime area shall be subject to a collection rate of 60% of the rate stipulated in Clause 1 of this Article for passenger vessels operated by organizations and individuals in that month.
- Passenger vessels with a gross tonnage from 1,500 GT to less than 50,000 GT entering or exiting a maritime area at least four times per month per maritime area shall be subject to a collection rate of 50% of the rate stipulated in Clause 1 of this Article for passenger vessels operated by organizations and individuals in that month.
- Passenger vessels with a gross tonnage of 50,000 GT or more entering or exiting a maritime area shall be subject to a collection rate of 40% of the rate stipulated in Clause 1 of this Article.
Vessels transferring oil in Van Phong Bay - Khanh Hoa shall be subject to a collection rate of 50% of the rate stipulated in Clause 1 of this Article; this regulation shall be applied until December 31, 2020;
d) Container vessels engaged in export, import, and transshipment

Cai Me - Thi Vai port terminals with a gross tonnage of 50,000 GT or more shall be subject to a collection rate of 60% of the rate stipulated in Clause 1 of this Article; this regulation shall be applied until December 31, 2020. 3. The following cases are not within the scope of tonnage dues collection: a) Vessels entering or exiting maritime areas to avoid typhoons, adverse weather conditions that do not ensure safe passage, for medical emergencies, or to hand over rescued persons at sea without loading or unloading cargo or picking up or dropping off passengers, confirmed by the maritime port authority; vessels participating in search and rescue operations, flood prevention, and disaster relief upon command or with the approval of competent state authorities;
b) Foreign military vessels visiting maritime areas for official or social visits upon invitation by the Government of Vietnam; foreign youth vessels visiting maritime areas for cultural and sports exchanges upon invitation by ministries or ministerial-level agencies under the Government of Vietnam;
c) Boats or speedboats of mother vessels carrying passengers anchored in passenger embarkation or disembarkation areas;
d) Lash barges operating in maritime areas alongside Lash vessels;
e) Vessels transiting to Cambodia.

đ) Vessels transiting to Cambodia;
Article 8. Maritime Security Fee
1. Rate of the maritime security fee collection
Ships entering, leaving maritime zones, dedicated ports, offshore oil and gas ports, and transiting to Cambodia must pay the maritime security fee as follows:

2. Specific regulations on the collection of the maritime security fee:
b) Vessels (excluding passenger vessels) entering or exiting a maritime area more than three times per vessel per month, from the fourth trip onwards in that month, shall be subject to a collection rate of 60% of the rate stipulated in Clause 1 of this Article; c) Organizations and individuals with passenger vessels entering or exiting maritime areas shall be subject to tonnage dues as follows:
b) Ships (excluding passenger ships) entering, leaving more than three times per ship per month in a maritime zone shall apply a collection rate equal to 80% of the rate specified in Clause 1 of this Article from the fourth trip onwards in that month;
c) Organizations and individuals with ships carrying passengers entering, leaving maritime zones shall apply the maritime security fee collection rate as follows:
- Ships with gross tonnage under 300 GT entering, leaving maritime zones at least ten times per month per maritime zone shall be charged at 70% of the rate specified in Clause 1 of this Article for passenger ships of organizations and individuals in that month.
- Ships with gross tonnage from 300 GT to under 1,500 GT entering, leaving maritime zones at least seven times per month per maritime zone shall be charged at 60% of the rate specified in Clause 1 of this Article for passenger ships of organizations and individuals in that month.
- Ships with gross tonnage from 1,500 GT to under 50,000 GT entering, leaving maritime zones at least four times per month per maritime zone shall be charged at 50% of the rate specified in Clause 1 of this Article for passenger ships of organizations and individuals in that month.
- Ships with gross tonnage of 50,000 GT or more entering, leaving maritime zones shall be charged at 30% of the rate specified in Clause 1 of this Article.
d) entering or exiting the
Cai Me - Thi Vai port terminals with a gross tonnage of 50,000 GT or more shall be subject to a collection rate of 60% of the rate stipulated in Clause 1 of this Article; this regulation shall be applied until December 31, 2020. 3. The following cases are not within the scope of tonnage dues collection: berths on the Cái Mép – Thị Vải River with a capacity of 50,000 GT or more shall be subject to a collection rate of 60% of the rate specified in Clause 1 of this Article; this provision shall be applicable until December 31, 2020;
e) Ships sailing at sea and requesting to enter a port due to urgent typhoon avoidance without loading or unloading cargo or embarking or disembarking passengers shall be subject to a collection rate of 50% of the rate specified in Clause 1 of this Article.
3. The following cases are not within the scope of objects subject to the maritime security fee collection:
a) Boats or speedboats of mother ships carrying passengers moored in maritime zones permitted to transport passengers into and out of port areas;
b) Ships entering, leaving port areas for emergency medical assistance, transferring rescued persons at sea without loading or unloading cargo or embarking or disembarking passengers confirmed by the maritime port authority; ships participating in search and rescue operations, flood and storm prevention, natural disaster response according to dispatch orders or approved by competent state authorities;
c) Ships engaged in cargo handling at port berths, wharves required to move to another maritime zone based on the Port Departure Permit issued by the maritime port authority for urgent typhoon avoidance shall not be subject to the maritime security fee for entry and departure at the port to avoid typhoons and departure at the port permitted to depart for typhoon avoidance;
d) Foreign military force ships arriving in maritime zones for official visits or courtesy calls upon invitation by the Government of Vietnam; foreign youth ships arriving in maritime zones for cultural and sports exchanges upon invitation by ministries or ministerial-level agencies under the Government of Vietnam.
Article 9. Pilotage Fees
1. Level of Collection of Pilotage Fees

For international route vessels with a gross tonnage of 20,000 GT using maritime pilotage services, with a distance of 35 nautical miles (NM), the pilotage fee payable is as follows:
Example: - First 10 NM: 20,000 GT x 0.0034 USD/GT/NM x 10 NM = 680 USD;
- Next 20 NM: 20,000 GT x 0.0022 USD/GT/NM x 20 NM = 880 USD;
- Last 5 NM: 20,000 GT x 0.0015 USD/GT/NM x 5 NM = 150 USD.
Total pilotage fee payable by the vessel: 1,710 USD.
b) On certain pilotage routes listed below,

For international route vessels with a gross tonnage of 20,000 GT using maritime pilotage services, with a distance of 35 nautical miles (NM), the pilotage fee payable is as follows:
- Departure: 0.03 USD/GT.
d) Vessels with a total tonnage under 200 GT (including fishing vessels) shall be subject to a charge of 40 USD per vessel per guidance trip;
đ) Vessels moving within a port using pilots shall be subject to charges as follows:
- For distances less than 05 nautical miles, the charge is 0.015 USD/GT. The minimum charge is 100 USD per vessel per movement;
- For distances of 05 nautical miles or more, the charge is as specified in point a, Clause 1 of this Article.
2. Specific regulations on the collection of pilotage fees:
a) When requesting pilotage services, the carrier must notify the pilot organization at least 6 hours before the time of the pilotage request; for offshore oil ports, notification must be made at least 24 hours in advance. In case of changing the time of the pilotage request or canceling the request, the carrier must inform the pilot organization at least 3 hours before the previously scheduled time; for offshore oil ports, it is 8 hours.
If the pilotage request is canceled and the notice to the pilot organization is given less than 3 hours before the previously scheduled time, for offshore oil ports less than 8 hours, the carrier must pay waiting fees at a rate of 10 USD per person per hour, 20 USD per person and vessel per hour, calculated as follows:
- If the pilot has not left the starting position: counted as 1 hour;
- If the pilot has left the starting position: waiting time is calculated from the departure time until the pilot returns to the original position, with a minimum waiting time of 1 hour in this case.
- If the pilot has completed guiding the vessel, if the captain still retains the pilot, additional waiting fees will be charged based on the number of hours retained.
The pilot will only wait at the pick-up location for no more than 4 hours after the time of the service request; beyond this time, the service request is considered canceled, and the vessel must pay 80% of the pilotage fee based on the distance requested earlier and the rate specified in Clause 1 of this Article.
b) Vessels on a voyage to test machinery and equipment, calibrate compasses shall be subject to a charge equal to 110% of the rate specified in Clause 1 of this Article;
c) Vessels unable to operate due to technical issues shall be subject to a charge equal to 150% of the rate specified in Clause 1 of this Article based on the actual distance traveled; d) Vessels requesting emergency pilotage (outside the provisions of points a, b, c, Clause 2 of this Article) shall be subject to a charge equal to 110% of the rate specified in Clause 1 of this Article;
đ) If the pilot arrives at the position but the vessel cannot operate due to force majeure (confirmed by the maritime port authority), the charge will be the minimum rate (300 USD);
e) If the vessel does not proceed directly to the destination port but requests anchorage en route (except for routes that do not allow night navigation), the carrier must pay additional costs for the means of transportation used in picking up and dropping off the pilot. The cost for the means of transportation shall not exceed 30 USD per vessel per occasion;
g) If the vessel arrives at the designated waiting position for the pilot at the time requested by the ship's representative, approved by the maritime port authority and the pilot organization, but the pilot does not arrive causing the vessel to wait, the pilot must pay the vessel for waiting time at a rate of 100 USD per hour, based on the actual waiting time;
h) Vessels (excluding passenger vessels) entering or leaving a maritime area more than three times per month per vessel, from the fourth trip onwards in the month, shall be subject to a charge equal to 80% of the rate specified in Clause 1 of this Article but not lower than the minimum charge;
i) Organizations or individuals with passenger vessels entering or leaving a maritime area at least four times per month per maritime area shall be subject to a charge equal to 50% of the rate specified in Clause 1 of this Article for their passenger vessels in that month but not lower than the minimum charge;
k) Organizations or individuals with passenger vessels with a total tonnage of 50,000 GT or more entering or leaving a maritime area shall be subject to a charge equal to 40% of the rate specified in Clause 1 of this Article but not lower than the minimum charge;
l) Vessels required to move between piers within the port range according to the request of the port company director shall be subject to port pilotage fees for domestic maritime vessels;
m) Vessels transferring oil in Van Phong Bay - Khanh Hoa shall be subject to a charge equal to 50% of the rate specified in Clause 1 of this Article but not lower than the minimum charge; this provision applies until December 31, 2020;.
Container vessels engaged in import, export, and transshipment at Cai Mep - Thi Vai port with a gross tonnage of 50,000 GT or more shall be subject to a charge equal to 50% of the rate specified in Clause 1 of this Article.
l) For vessels required to move between piers within the port area at the request of the port enterprise director, the fee for pilotage within the port shall be applied to domestic maritime vessels;
m) For vessels loading and unloading oil in Vân Phong Bay - Khánh Hòa, the fee for pilotage shall be fifty percent of the rate specified in Clause 1 of this Article but not less than the minimum charge; this provision shall apply until December 31, 2020;
n) Vessels carrying containers for import, export, and transshipment 3. The following cases are not within the scope of tonnage dues collection: at Cái Mép - Thị Vải Port with a gross tonnage of 50,000 GT or more shall be subject to a fee of fifty percent of the rate specified in Clause 1 of this Article but not lower than the minimum income level. This provision shall be applied until December 31, 2020;
o) Vessels entering or leaving the maritime area to refuel, obtain food and fresh water, change crew members, repair, dismantle, or test-run without loading or unloading cargo, or picking up or dropping off passengers shall be subject to a fee equal to 70% of the rate prescribed in Clause 1 of this Article;
p) Vessels entering or leaving the port to hand over rescued persons at sea without loading or unloading cargo, without receiving or delivering passengers, confirmed by the maritime port authority; vessels participating in search and rescue operations, flood prevention, and disaster relief upon dispatch orders or with the approval of competent state agencies shall not be within the scope of objects subject to pilotage fees.
Article 10. Fees for Berthing in Water Areas and Zones
1. For vessels:
a) Vessels berthing in water areas and zones, during the first 30 days (720 hours), shall be subject to a fee of: 0.0005 USD/GT/hour
b) Vessels berthing in water areas and zones, from day 31 (hour 721 onwards), shall be subject to a fee of: 0.0003 USD/GT/hour
c) Vessels berthing at offshore oil ports shall be subject to the following berthing fees:
- During the first 30 days (720 hours), the fee shall be: 0.0003 USD/GT/hour;
- From day 31 (hour 721 onwards), the fee shall be: 0.0002 USD/GT/hour.
d) The total actual berthing time at multiple positions within water areas and zones of a maritime area shall be calculated for vessels berthing at multiple positions.
đ) Organizations or individuals having passenger-carrying vessels enter or leave the maritime area at least four times/month/one maritime area shall be subject to a fee equal to 50% of the rate prescribed in points a and b of Clause 1 of this Article for the passenger-carrying vessels of such organizations or individuals in that month.
e) Organizations or individuals having passenger-carrying vessels with a gross tonnage of 50,000 GT or more entering or leaving the maritime area shall be subject to a fee equal to 40% of the rate prescribed in point a and b of Clause 1 of this Article.
g) Vessels transferring oil in Van Phong Bay - Khanh Hoa shall be subject to a fee equal to 50% of the rate prescribed in points a, b, c, and d of Clause 1 of this Article; this provision shall be applied until December 31, 2020.
h)||| Vessels entering or leaving the maritime area to repair, dismantle, or test-run without loading or unloading cargo, or picking up or dropping off passengers shall be subject to a fee equal to 70% of the rate prescribed in point a of Clause 1 of this Article.
i) No berthing fee shall be charged for vessels in the following cases:
- Waiting for tide in port waters before docking;
- Waiting for daylight according to the order of the maritime port authority due to night navigation restrictions;
- Avoiding typhoons, bad weather that does not ensure safety for the vessel's journey, rescuing patients, or handing over rescued persons at sea without loading or unloading cargo, without picking up or dropping off passengers, confirmed by the maritime port authority.
2. For goods:
a) Goods transshipped in water areas and zones to be transported to other maritime areas must pay berthing fees as follows:
- Ordinary goods: 0.07 USD/ton;
- Refrigerated trucks, crawler cranes, clamshell buckets, road rollers, forklifts, cranes: 2 USD/unit;
- Cars with 15 seats or less, vehicles with a load capacity of 2.5 tons or less: 0.7 USD/unit;
- Other cars outside those specified above: 1.3 USD/unit.
b) In the case of goods transshipped to be transported to wharves within the same maritime area, no berthing fee shall be paid;
c) Goods imported into Vietnam at Van Phong Bay shall be subject to a berthing fee equal to 20% of the rate prescribed in point a of Clause 2 of this Article;
d) Goods in transit (temporary import for re-export) at Van Phong Bay shall not be required to pay berthing fees.
Article 11. Fees for using maritime bridges and mooring buoys
1. For vessels:
a) Vessels moored at bridges or buoys shall pay fees as follows:
- At bridges: 0.0031 USD/GT/hour;
- At buoys: 0.0013 USD/GT/hour.
For vessels moored at multiple positions within the water area of a seaport, the fee shall be calculated based on the actual total time spent moored at each position.
b) Organizations or individuals with passenger-carrying vessels making at least four trips per month per maritime zone shall apply a fee rate equal to 50% of the rate specified in point a of Clause 1 of this Article. for the passenger-carrying vessels of such organizations or individuals in that month.
c) Organizations or individuals with passenger-carrying vessels with a gross tonnage of 50,000 GT or more entering and leaving the maritime zone shall apply a fee rate equal to 40% of the rate specified in point a of Clause 1 of this Article.
d) Vessels ordered to leave the port but still occupying bridges or buoys shall pay fees according to the following rates:
- Occupying bridges: 0.006 USD/GT/hour;
- Occupying buoys: 0.002 USD/GT/hour.
đ) Vessels moored alongside other vessels at bridges or buoys shall pay fees according to the following rate: 0.0015 USD/GT-hour;
e) In cases where operations cannot be carried out due to weather conditions for more than one day (24 consecutive hours) or when yielding the bridge to other vessels upon the maritime port authority's order, no fees will be charged for the non-operational period.
g) Vessels moored at specialized berths serving oil and gas that perform cargo operations or receive oil and water shall pay fees according to the rate of 0.3 USD/m-hour, with a minimum charge of 90 USD per vessel for each berth visit.
h) Vessels directly moored at offshore oil and gas ports without performing cargo operations or receiving oil and water shall pay fees according to the rate of 0.35 USD/m-hour, with a minimum charge of 100 USD per vessel for each berth visit.
i) Vessels moored alongside other vessels at specialized berths serving oil and gas shall pay fees according to the rate of 0.08 USD/m-hour, with a minimum charge of 25 USD per vessel for each alongside mooring.
2. Goods passing through bridges and mooring buoys shall pay fees as follows:
a) Cargo handling at bridges:
- Goods: 0.18 USD/ton;
- 20-foot containers: 1.6 USD/container;
- 40-foot containers: 3.2 USD/container;
- Containers over 40 feet: 4.0 USD/container.
b) Cargo handling at buoys: 0.09 USD/ton.
c) Goods that are transport means: :
- Refrigerated trucks, chain trucks, clamshell buckets, road rollers, forklifts, cranes: 2.7 USD/unit;
- Passenger cars up to 15 seats, trucks up to 2.5 tons: 0.9 USD/unit;
- Other types of cars not mentioned above: 1.8 USD/unit;
d) Liquid goods (liquefied gas, fuel, liquid asphalt...): 0.9 USD/ton;
đ) Goods passing through specialized ports serving oil and gas: 0.9 USD/ton.
3. Passengers passing through bridges and mooring buoys shall pay fees as follows:
a) Through bridges and mooring buoys:
- Entry: 1 USD/person;
- Departure: 1 USD/person;
- No fee for children under 12 years old.
b) In cases where vessels are allowed to use other water transport means to pick up and drop off passengers for sightseeing tours on land or islands while moored in anchorage areas, the vessels must pay anchorage fees as stipulated in Clause 1 of Article 10; the bridge fees for passengers are 1 USD/person (including both entry and departure), and point a of Clause 3 of this Article does not apply.
Article 12. Fees for entering and exiting seaports and fees for certifying maritime protests
1. Vessels entering and exiting maritime zones, specialized ports, offshore oil and gas ports; foreign vessels operating in Vietnam's territorial waters outside seaport waters must comply with state management procedures as prescribed by Vietnamese law and pay seaport entry and exit fees as follows:

When handling entry procedures into the maritime zone, the person paying the fee may pay once for the entire voyage (entry and exit).
2. International maritime vessels when processing maritime protest procedures must pay a fee for certifying maritime protests: 50 USD/per instance.
Chapter III
SCHEDULE OF FEES AND CHARGES FOR DOMESTIC MARITIME ACTIVITIES
Article 13. Port Tonnage Fee
Vessels entering or exiting
a) Vessels entering and leaving maritime zones, dedicated ports, offshore oil ports shall pay the port tonnage fee as follows:
- Entry: 250 dong/GT;
- Departure: 250 dong/GT.
b) Vessels operating on inland waterway transport routes from shore to islands shall pay the port tonnage fee at a rate of 500 dong/GT/each time they move from shore to island and vice versa when docking at a port;
c) Dedicated vessels serving the oil and gas industry, each time moving from a maritime zone to an offshore oil exploration zone or vice versa shall pay the port tonnage fee at the following rates:
- Entry: 450 dong/GT;
- Departure: 450 dong/GT.
d) Vessels providing towing services, fuel supply, food in a maritime zone: the collection rate is 100 dong/GT/actual day of operation; the collection and payment of the port tonnage fee can be implemented monthly based on this collection rate. In cases where vessels are not operational, the vessel owner must provide documentation proving non-operation to the maritime port authority for confirmation to serve as grounds for not collecting fees during days of non-operation.
2. Specific regulations on the collection of the port tonnage fee:
a) Vessels (excluding passenger vessels and those specified in point d, Clause 1 of this Article) entering and leaving a maritime zone more than three times per vessel per month, from the fourth trip onwards in that month, shall apply a collection rate equal to 60% of the rate stipulated in Clause 1 of this Article;
b) Vessels entering and leaving maritime zones to refuel, obtain provisions, fresh water, change crew members, c) Organizations and individuals with passenger vessels entering or exiting maritime areas shall be subject to tonnage dues as follows:
- Passenger vessels with a gross tonnage from 300 GT to less than 1,500 GT entering or exiting a maritime area at least seven times per month per maritime area shall be subject to a collection rate of 60% of the rate stipulated in Clause 1 of this Article for passenger vessels operated by organizations and individuals in that month.
- Vessels with a gross tonnage under 500 GT entering and leaving a maritime zone a minimum of ten times per month per maritime zone shall be charged at 70% of the rate stipulated in Clause 1 of this Article for passenger vessels operated by organizations and individuals in that month.
- Vessels with a gross tonnage from 500 GT to less than 1,500 GT entering and leaving a maritime zone a minimum of seven times per month per maritime zone shall be charged at 60% of the rate stipulated in Clause 1 of this Article for passenger vessels operated by organizations and individuals in that month.
- Vessels with a gross tonnage of 1,500 GT or more entering and leaving a maritime zone a minimum of four times per month per maritime zone shall be charged at 50% of the rate stipulated in Clause 1 of this Article for passenger vessels operated by organizations and individuals in that month.
b) Foreign military vessels visiting maritime areas for official or social visits upon invitation by the Government of Vietnam; foreign youth vessels visiting maritime areas for cultural and sports exchanges upon invitation by ministries or ministerial-level agencies under the Government of Vietnam;
a) Vessels entering and leaving maritime zones to avoid typhoons, adverse weather conditions that do not ensure safe travel, to rescue patients, or to hand over rescued persons at sea without loading or unloading cargo, picking up or dropping off passengers, with confirmation from the maritime port authority; vessels participating in search and rescue operations, flood prevention, and disaster relief according to dispatch orders or with approval from competent state authorities;
b) Boats or speedboats of passenger vessels moored in waters transporting passengers from the vessel to shore and vice versa;
c) Barges Lash operating in maritime zones together with Lash vessels;
d) Fishing vessels and sports vessels of Vietnam.
Article 14. Maritime Security Fee
1. Collection Rate for the Maritime Security Fee:
Vessels entering and leaving maritime zones, dedicated ports, offshore oil ports shall pay the maritime security fee as follows:
a) Vessels with a gross tonnage under 2,000 GT:
- Entry: 300 dong/GT;
- Departure: 300 dong/GT.
b) Vessels with a gross tonnage of 2,000 GT or more
- Entry: 600 dong/GT;
- Departure: 600 dong/GT.
c) Vessels operating on inland waterway transport routes from shore to islands, each time moving from shore to island and vice versa shall pay the maritime security fee at a rate of 550 dong/GT/each time docking at a port;
d) Dedicated vessels serving the oil and gas industry, each round trip from a maritime zone to an offshore oil exploration zone and back shall be counted as one voyage and shall pay the maritime security fee as follows:
- Entry: 950 dong/GT;
- Departure: 950 dong/GT.
2. Regulations on the Collection of the Maritime Security Fee
a) Vessels (excluding passenger vessels) entering and leaving a maritime zone more than three times per vessel per month, from the fourth trip onwards in that month, shall apply a collection rate equal to 80% of the rate stipulated in Clause 1 of this Article;
b) Vessels entering or leaving the maritime area to refuel, obtain food and fresh water, change crew members, undergoing repair, dismantling, or trial runs after being repaired or newly built without loading or unloading cargo, picking up or dropping off passengers shall apply a collection rate equal to 70% of the rate stipulated in Clause 1 of this Article;
c) Organizations and individuals with ships carrying passengers entering, leaving maritime zones shall apply the maritime security fee collection rate as follows:
- Vessels with a gross tonnage under 500 GT entering and leaving a maritime zone a minimum of ten times per month per maritime zone shall be charged at 70% of the rate stipulated in Clause 1 of this Article for passenger vessels operated by organizations and individuals in that month.
- Vessels with a gross tonnage from 500 GT to less than 1,500 GT entering and leaving a maritime zone a minimum of seven times per month per maritime zone shall be charged at 60% of the rate stipulated in Clause 1 of this Article for passenger vessels operated by organizations and individuals in that month.
- Vessels with a gross tonnage of 1,500 GT or more entering and leaving a maritime zone a minimum of four times per month per maritime zone shall be charged at 50% of the rate stipulated in Clause 1 of this Article for passenger vessels operated by organizations and individuals in that month.
d) Vessels traveling on the high seas and requesting to enter a port due to urgent typhoon avoidance purposes without loading or unloading cargo, picking up or dropping off passengers shall apply a collection rate equal to 50% of the rate stipulated in Clause 1 of this Article.
3. The following cases are not within the scope of objects subject to the maritime security fee collection:
a) Boats or speedboats of passenger vessels moored in waters transporting passengers from the vessel to shore and vice versa;
b) Self-propelled inland waterway vessels with a gross tonnage under 500 GT (excluding those operating on inland waterway transport routes from shore to islands);
c) Inland waterway vessels that are tugboats, push boats, or barges;
d) Vessels entering and leaving maritime zones to rescue patients or hand over rescued persons at sea without loading or unloading cargo, picking up or dropping off passengers, with confirmation from the maritime port authority; vessels participating in search and rescue operations, flood prevention, and disaster relief according to dispatch orders or with approval from competent state authorities;
e) Vessels engaged in cargo operations at a wharf or pier that must move to another maritime zone based on a departure permit from the maritime port authority to urgently avoid typhoons shall not be charged the maritime security fee for entry and departure at the port to which they moved to avoid typhoons and departure at the permitted port to avoid typhoons.
Article 15. Pilotage Fee
1. Level of pilotage fee collection:
a) Vessels using maritime public service pilotage services shall pay pilotage fees at a rate of 25 dong/GT/HL; the minimum collection level per trip: 500,000 dong/1 trip guiding a vessel;
b) Special-purpose vessels serving oil and gas operations at offshore oil ports that use pilotage shall pay pilotage fees at a rate of 35 dong/GT/HL; the minimum collection level per trip: 2,000,000 dong/1 trip guiding a vessel;
c) Certain routes apply pilotage fee collection levels as follows:

d) Vessels entering, leaving, or moving within the area of oil and gas platforms that use pilotage must pay pilotage fees as follows:
- Entering: 150 dong/GT;
- Leaving: 150 dong/GT.
- For distances of 05 nautical miles or more, the charge is as specified in point a, Clause 1 of this Article.
- For distances of less than five nautical miles, the collection level is 60 dong/GT. The minimum collection level is 300,000 dong/1 vessel/1 movement;
- For distances of five nautical miles or more, the collection level is as specified in point a, Clause 1 of this Article. The minimum collection level is 300,000 dong/1 vessel/1 movement.
If the pilotage request is canceled and the notice to the pilot organization is given less than 3 hours before the previously scheduled time, for offshore oil ports less than 8 hours, the carrier must pay waiting fees at a rate of 10 USD per person per hour, 20 USD per person and vessel per hour, calculated as follows:
a) When requesting pilotage services, the carrier must notify the pilot organization at least six hours before the time of the pilotage request. In case of changing the time of the pilotage request or canceling the pilotage request, the carrier must inform the pilot organization at least three hours before the previously scheduled time of the pilotage request.
In case of canceling the pilotage request where the time of informing the pilot organization about the cancellation is less than three hours before the previously scheduled time of the pilotage request, the carrier must pay waiting charges as follows:
- Pilot: 20,000 dong/1 person/1 hour;
- Pilot and means of transport: 200,000 dong/1 person and means of transport/1 hour.
- Calculation of waiting time is as follows
+ If the pilot has not departed: calculate 1 hour;
+ If the pilot has left the departure position: the waiting time is calculated from the departure time until the pilot returns to the original position, in this case, the waiting time is calculated for a minimum of 1 hour;
+ If the pilot has completed the guiding work and the captain still retains the pilot, additional waiting charges will be calculated based on the retention time.
The pilot will only wait at the vessel pick-up location for a maximum of four hours after the time of the pilotage service request. Beyond this period, the pilotage service request is considered canceled, and the vessel must pay 80% of the pilotage fee according to the distance guided previously requested and the collection level specified in Clause 1 of this Article.
b) Vessels with a voyage to test machinery, equipment, or adjust the compass apply a collection level of 110% of the collection level specified in Clause 1 of this Article;
c) Vessels unable to operate due to technical failure apply a collection level of 150% of the collection level specified in Clause 1 of this Article;
d) Organizations or individuals with vessels carrying passengers entering, leaving maritime areas at a minimum of four trips/month/one maritime area apply a collection level of 50% of the collection level specified in Clause 1 of this Article for passenger-carrying vessels of organizations or individuals in that month but not lower than the minimum collection level.
đ) Vessels that do not directly arrive at the destination port but request anchoring along the way (except for routes not allowed to sail at night), the shipowner must pay the cost of means of transport generated for picking up and dropping off the pilot. The cost of means of transport does not exceed 300,000 dong/1 vessel/1 time;
e) Vessels have arrived at the pilot waiting position at the correct time as requested by the shipowner's representative and approved by the maritime port authority and the pilot, if the pilot is not present causing the vessel to wait, the pilot must pay waiting charges to the shipowner at a rate of 250,000 dong/hour based on the actual waiting time of the vessel;
g) In cases where the pilot has arrived at the position but the vessel cannot operate due to force majeure, confirmed by the maritime port authority, the collection level is the minimum collection level specified in Clause 1 of this Article;
h) Vessels entering or leaving the port to hand over rescued persons from the sea without loading or unloading cargo, without receiving or delivering passengers, confirmed by the maritime port authority; Vessels participating in search and rescue, flood prevention, and disaster relief operations upon dispatch orders or with the approval of competent state authorities are not subject to pilotage fee collection.
Article 16. Fees for mooring in water areas and zones
1. Vessels mooring in water areas and zones must pay mooring fees at a rate of 5 dong/GT/hour.
2. Organizations and individuals with vessels carrying passengers entering and leaving maritime areas at least four times per month per maritime area shall apply a collection rate equal to 50% of the rate specified in Clause 1 of this Article. for the passenger-carrying vessels of such organizations or individuals in that month.
3. Vessels waiting in accordance with Article 20 of Circular No. 10/2013/TT-BGTVT dated May 8, 2013 of the Ministry of Transport guiding the implementation of certain Articles of Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on port management and maritime channels, shall apply the following collection rates:
a) For vessels with a gross tonnage under 100,000 GT: 10 dong/GT/day;
b) For vessels with a gross tonnage of 100,000 GT or more: 8 dong/GT/day.
4. Vessels mooring in water areas and zones for repair, demolition, or trial runs without loading or unloading cargo or embarking or disembarking passengers shall apply a collection rate equal to 70% of the rate specified in Clause 1 of this Article.
5. For vessels mooring at multiple locations within water areas and zones belonging to a maritime area of a seaport, the total actual mooring time at each location shall be calculated.
6. Mooring fees shall not be collected in the following cases:
- Waiting for tide in port waters before docking;
- Waiting for daylight according to the order of the maritime port authority due to night navigation restrictions;
- Avoiding typhoons, bad weather that does not ensure safety for the vessel's journey, rescuing patients, or handing over rescued persons at sea without loading or unloading cargo, without picking up or dropping off passengers, confirmed by the maritime port authority.
Article 17. Fees for using wharves and buoys
1. Vessels using wharves and buoy berths shall pay fees as follows:
a) Vessels moored at wharves: 15 dong/GT/hour;
b) Vessels moored at buoys: 10 dong/GT/hour.
2. For vessels moored at multiple locations within water areas and zones belonging to a maritime area of a seaport, the total actual mooring time at each location shall be calculated.
3. Organizations and individuals with vessels carrying passengers entering and leaving maritime areas at least four times per month per maritime area shall apply a collection rate equal to 50% of the rate specified in Clause 1 of this Article for the passenger-carrying vessels of such organizations or individuals in that month.
Article 18. Port entry and exit fees and fees for certifying maritime protests
1. Vessels entering and exiting maritime areas, dedicated ports, offshore oil ports must comply with state management procedures as prescribed by Vietnamese law and pay port entry and exit fees as follows:

When handling entry procedures into the maritime zone, the person paying the fee may pay once for the entire voyage (entry and exit).
2. Domestic maritime vessels when submitting maritime protest procedures must pay a fee for certifying maritime protests: 100,000 dong/per submission.
Chapter IV
IMPLEMENTATION
Article 19. Effective Date
1. This Circular takes effect from February 20, 2016; The Decision No. 98/2008/QĐ-BTC dated November 4, 2008 of the Ministry of Finance promulgating regulations on maritime fees and the schedule of maritime fee collections; Circular No. 41/2012/TT-BTC dated March 9, 2012 of the Ministry of Finance on guidelines for collecting certain types of maritime fees for large-tonnage vessels docking at Cái Mép-Thị Vải Port and other regulatory documents inconsistent with this Circular are hereby abolished.
2. This Circular also promulgates the List of Maritime Areas within the jurisdiction of the Marine Port Authorities.
3. The Vietnam Maritime Administration is responsible for implementing and enforcing this Circular.
4. During the implementation process, if there are any difficulties, relevant agencies and units should report to the Ministry of Finance for review and resolution./.
