DETAIL REGULATIONS IMPLEMENTING CERTAIN ARTICLES OF DECREE NO. 79/2012/NĐ-CP OF THE GOVERNMENT DATED OCTOBER 5, 2012 ON PERFORMANCES OF ARTS, FASHION SHOWS; BEAUTY CONTESTS AND MODELING; DISTRIBUTION AND BUSINESS OF AUDIO AND VIDEO RECORDINGS OF MUSIC, DANCE, OPERA AND DECREE NO. 15/2016/NĐ-CP OF THE GOVERNMENT DATED MARCH 15, 2016 AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF DECREE NO. 79/2012/NĐ-CP

Pursuant to Decree No. 79/2012/NĐ-CP dated October 5, 2012 of the Government on performances of arts, fashion shows; beauty contests and modeling; distribution and business of audio and video recordings of music, dance, opera;

Pursuant to Decree No. 15/2016/NĐ-CP dated March 15, 2016 of the Government amending and complementing certain provisions of Decree No. 79/2012/NĐ-CP dated October 5, 2012 of the Government;

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Department of Performing Arts,

The Minister of Culture, Sports and Tourism promulgates this Circular detailing the implementation of certain articles of Decree No. 79/2012/NĐ-CP dated October 5, 2012 of the Government on performances of arts, fashion shows; beauty contests and modeling; distribution and business of audio and video recordings of music, dance, opera and Decree No. 15/2016/NĐ-CP dated March 15, 2016 of the Government amending and complementing certain provisions of Decree No. 79/2012/NĐ-CP.

Article 1. Other types of performing arts (as stipulated inClause 2, Article 2 of Decree No. 79/2012/NĐ-CP)

Other types of performing arts include: Artistic dancing; performance in installation art; street performance.

Article 2. Notification of the content of artistic performance programs, fashion shows; beauty contests and modeling (as stipulated in Clause 2, Article 1 of Decree No. 15/2016/NĐ-CP)

1. The entity organizing artistic performances, fashion shows; beauty contests and modeling shall submit directly or through postal service one set of notification documents to the Department of Culture, Sports and Tourism or the Department of Culture and Sports at the location where the activity will be held. The set includes:

a) One notification document (Form No. 01);

b) Performance permit for artistic performances, fashion shows along with the list of approved program contents; permit for foreign organizations and individuals, Vietnamese individuals residing abroad to perform arts, fashion shows or permit for organizing beauty contests, modeling (certified copy or copy accompanied by original for verification);

c) List of program contents including the name of the work, author and performer (for artistic performance programs, fashion shows not required to apply for a permit as stipulated in Clause 1, Article 11, Clause 1, Article 13, Clauses 1 and 2, Article 15 of Decree No. 79/2012/NĐ-CP; Clause 1, Article 12, Clause 2, Article 14 of Decree No. 79/2012/NĐ-CP amended and supplemented in Clauses 7 and 8, Article 1 of Decree No. 15/2016/NĐ-CP).

2. Within four working days from the date of receiving complete and valid documents, the Department of Culture, Sports and Tourism or the Department of Culture and Sports shall respond in writing to the notifying entity (Form No. 02) and may only refuse in cases of national mourning; natural disasters; epidemics or situations affecting public order and social security seriously due to political and security conditions in the locality.

Article 3. Acts of artistic performers, fashion models; beauty pageant winners and model titleholders shall not be carried out, disseminated, or circulated (as stipulated in Clause 2, Article 1 of Decree No. 15/2016/NĐ-CP)

1. The acts that artistic performers, fashion models; beauty pageant winners and model titleholders shall not carry out include:

a) Taking photographs, recording images of individuals without clothing or using costumes, makeup that are inappropriate and intentionally or unintentionally disseminating, circulating on telecommunications networks;

b) Taking photographs, recording audio and video of group or individual performances containing content violating the provisions of Article 6 of Decree No. 79/2012/NĐ-CP dated October 5, 2012 of the Government and intentionally or unintentionally disseminating, circulating on telecommunications networks;

c) Engaging in actions or making statements inconsistent with societal values, moral standards, local customs, Vietnamese cultural traditions, and laws, and intentionally or unintentionally disseminating through media or outside society causing adverse effects.

2. The Appraisal Council established pursuant to Circular No. 15/2013/TT-BVHTTDL dated December 24, 2013 of the Minister of Culture, Sports and Tourism shall be responsible for concluding and evaluating the nature and severity of the acts committed by artistic performers, fashion models; beauty pageant winners and model titleholders and recommending competent authorities to apply sanctions according to the law.

Article 4. Procedures for revoking licenses (as stipulated in Clause 3, Article 1 of Decree No. 15/2016/NĐ-CP)

1. Based on the nature and degree of violation, competent state agencies shall decide to revoke licenses in the following cases:

a) Licenses issued beyond authority;

b) Organizations or individuals violating any of the contents prescribed in Article 6 of Decree No. 79/2012/NĐ-CP and Points a, b, c, g, h of Clause 2, Points a, b of Clause 3, Clause 5 of Article 7 of Decree No. 79/2012/NĐ-CP amended and supplemented at Clause 2 of Article 1 of Decree No. 15/2016/NĐ-CP.

2. Procedures and formalities:

a) Specialized inspection teams for culture, sports, and tourism shall be responsible for drafting administrative violation records when discovering licenses issued beyond authority or organizations or individuals committing violations and recommending the issuing agency to decide to revoke the license;

b) Within three working days from the date of drafting the administrative violation record, the agency drafting the record shall send copies of the record and the recommendation to revoke the license to the competent licensing authority (Form No. 03);

c) Within three working days from the date of receipt of the recommendation to revoke the license, the licensing agency shall examine and issue a decision to revoke the license and notify relevant organizations and individuals (Form No. 04). In cases where the license is not revoked, a written response must be provided with reasons stated.

Article 5. Organization of contests and art festivals (as stipulated inArticle 16 of Decree No. 79/2012/NĐ-CP)

1. Authority to organize:

The Ministry of Culture, Sports and Tourism, based on the characteristics of each art form, organizational capacity, and effectiveness of each contest and festival, assigns the Performing Arts Department or specialized arts associations at the central level (Vietnam Stage Actors Association, Vietnam Dance Artists Association, Vietnam Musicians Association) to be responsible for organizing.

2. Timing of organization:

a) Contests for artistic units including forms such as Tuong, Cheo, Cai Luong, Drama, Folk Opera, and music, dance, and instrumental art are held every three years;

b) Contests for groups of artists and individual artists for stage and music, dance, and instrumental art are held every three years;

c) Festivals are organized alternately between two contest periods. The timing of festivals for each art form is every three years;

d) International contests and festivals hosted by Vietnam are implemented according to the Plan of the Ministry of Culture, Sports and Tourism.

3. Prize structure:

a) Prizes for contests for artistic units:

- Gold and silver medals for plays, programs, performances, and performing artists;

- Outstanding awards for groups of artists, authors, directors, painters, musicians, choreographers, orchestra conductors, costume designers, sound and lighting designers.

b) Prizes for contests for groups of artists and individual performing artists: Gold and silver medals;

c) Prizes for domestic festivals: Gold and silver medals for programs and performances associated with groups of artists or individual performing artists;

d) Prizes for domestic contests and festivals include cash awards and certificates. The amount of cash award is determined by the Minister of Culture, Sports and Tourism or the Chairman of the Provincial People's Committee;

đ) Prizes for international festivals: Gold and silver medals for programs and performances associated with units and performing artists, along with certificates and commemorative cups.

Article 6. Candidates with natural beauty (as prescribed in Point a Clause 1 Article 19 Decree No. 79/2012/NĐ-CP)

A candidate with natural beauty is a candidate who has not undergone plastic surgery.

Article 7. Content and form of the proposal to organize a beauty pageant or model contest (as prescribed in Clause 12 Article 1 Decree No. 15/2016/NĐ-CP)

1. The name of the contest shall be in Vietnamese (in cases where the name of the contest uses a foreign language, it shall be written in Vietnamese first, followed by the foreign language name).

2. The purpose and significance of the contest must be clearly stated and consistent with the name of the contest, its scale, and scope of organization.

3. The rules of the contest shall clearly stipulate the conditions and criteria for candidates participating in the contest.

4. Content, procedures for organizing, time, and location of the contest.

5. Titles, prize structure, value of prizes, and time of awarding prizes.

6. Rights and obligations of organizations and individuals organizing the contest.

7. Rights and obligations of candidates participating in the contest and winners.

a) For participating candidates:

- Adhering strictly to the rules and regulations of the beauty pageant or model contest as stipulated by the organizing unit;

- Participating fully in all stages of the contest as specified in the proposal to organize the contest.

b) For winning candidates:

Within a maximum period of 24 months from the date of winning the beauty pageant or model contest, they must carry out social and charitable activities according to the plan approved by the Organizing Committee.

Article 8. The judging panel of the beauty pageant or model contest (as prescribed in

1. Each beauty pageant or model contest shall establish only one Judging Panel.

2. The Judging Panel shall consist of experts in fields such as anthropometry, aesthetics, performing arts, film, photography, and sociology. Depending on the nature of each contest, the Organizing Committee may invite additional experts from other relevant fields.

3. The licensing authority, organizing unit, and sponsors shall not participate in the Judging Panel. Clause 12 Article 1 Decree No. 15/2016/NĐ-CP)

Article 9. Procedures for requesting approval of the venue for hosting the final round of the beauty pageant or model contest (as prescribed in

The entity organizing the contest shall submit one set of application documents directly or through postal service to the Department of Culture, Sports and Tourism or the Department of Culture and Sports requesting the provincial People's Committee's approval of the venue for hosting the final round of the beauty pageant or model contest. The application documents include:

a) One application form (Form No. 06);

b) Proposal to organize the contest; Clause 12 Article 1 Decree No. 15/2016/NĐ-CP)

c) One copy of the decision on establishment or business registration certificate.

2. Time limit for response:

Within seven working days from the date of receiving complete and valid application documents, the Department of Culture, Sports and Tourism or the Department of Culture and Sports shall have the responsibility to report to and the provincial People's Committee shall issue a document approving the venue for hosting the final round of the beauty pageant or model contest (Form No. 07). In case of disapproval, a written response must be provided with clear reasons.

Article 10. Cases where permission to organize a beauty pageant or model contest will not be granted (as prescribed in

1. The application documents do not meet the required conditions and components as stipulated in Clause 12 Article 1 of Decree No. 15/2016/NĐ-CP and this Circular.

2. The entity requesting permission cannot prove its capability and experience in the proposal to organize the contest.

3. The beauty pageant or model contest does not comply with the provisions of Clauses 4 and 5 Article 2 of Decree No. 79/2012/NĐ-CP. Clause 12 Article 1 Decree No. 15/2016/NĐ-CP)

1. The file does not meet the conditions and components as prescribed in Clause 12, Article 1 of Decree No. 15/2016/NĐ-CP and this Circular.

2. The organization requesting the permit cannot prove its capacity and experience in the project proposal for organizing the contest.

3. The beauty and model contest does not comply with the provisions of Clauses 4 and 5, Article 2 of Decree No. 79/2012/NĐ-CP.

Article 11. Main titles at beauty and model contests (as stipulated in Clause 13, Article 1 of Decree No. 15/2016/NĐ-CP) Main titles are one of three titles awarded to contestants with the highest scores, ranked from highest to lowest.

Article 12. Disposal of audio and video recordings beyond their retention period (as stipulated in Clause 15, Article 1 of Decree No. 15/2016/NĐ-CP)

1. The Department of Performing Arts, the Department of Culture, Sports and Tourism, or the Department of Culture and Sports shall organize the liquidation or public destruction of audio and video recordings beyond their retention period. 2. The liquidation or destruction file includes:

a) Decision establishing the Liquidation or Destruction Board for audio and video recordings beyond their retention period issued by the Department of Performing Arts, the Department of Culture, Sports and Tourism, or the Department of Culture and Sports. Members of the Liquidation Board include leaders of the agencies specified in Clause 1 of this Article, representatives of specialized departments, finance departments, and offices;

b) Minutes of the liquidation or destruction of audio and video recordings beyond their retention period.

1. This Circular takes effect from May 15, 2016.

2. Repeal Circular No. 03/2013/TT-BVHTTDL dated January 28, 2013, issued by the Minister of Culture, Sports and Tourism detailing certain Articles of Decree No. 79/2012/NĐ-CP dated October 5, 2012, of the Government regarding artistic performances, fashion shows; beauty and model contests; distribution and sale of audio and video recordings of music and dance, stage performances.

3. Repeal Article 3 of Circular No. 19/2014/TT-BVHTTDL dated December 8, 2014, issued by the Minister of Culture, Sports and Tourism amending and supplementing certain Articles of Circulars No. 88/2008/TT-BVHTTDL, No. 17/2010/TT-BVHTTDL, and No. 03/2013/TT-BVHTTDL.
