Regulations on awarding the Commemorative Medal "For the Cause of Inspection"

Pursuant to the Law on Competition and Reward dated December 26, 2003, the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated November 16, 2013; 11 Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated December 26, 2003 and amended on November 16, 2013; bPursuant to Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward; Decree No. 39/2012/ND-CP dated April 27, 2012 amending and supplementing certain provisions of Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government; Decree No. 65/2014/ND-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated 2013;

At the proposal of the Director of the Legal Department and the Director of the Organization and Cadre Department,i The Inspector General issues this Circular regulating the awarding of the Commemorative Medal "For the Cause of Inspection".No. Article 2. Commemorative Medal "For the Cause of Inspection"i Clause 1. The Commemorative Medal "For the Cause of Inspection" is a form of reward granted by the Inspectorate General to individuals who have made contributions to the cause of building and developing the Inspection sector in Vietnam (hereinafter referred to as the Commemorative Medal).i Clause 2. The Commemorative Medal has an emblem, shape, size, and color that reflect the characteristics of the Inspection sector in Vietnam, consistent with the general regulations of the State, accompanied by the Commemorative Medal is a Certificate of Award for the Commemorative Medal "For the Cause of Inspection".

Based on Decree No. 83/2012/NĐ-CP dated October 9, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Clause 1. The Commemorative Medal is awarded once to individuals meeting the conditions and criteria; it is not awarded to those who have already been awarded the Order "For the Cause of Inspection".

Clause 2. The awarding of the Commemorative Medal is conducted annually, ensuring objectivity, accuracy, fairness, transparency, democracy, and timeliness.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Clause 1. Civil servants, public officials, employees, officers, non-commissioned officers, and workers who have worked or are currently working in state inspection agencies, including:

Point a) Leaders of the Inspector General;

Point b) Civil servants, public officials, and workers employed at the Inspector General;

Point c) Civil servants, public officials, and workers employed at inspection organizations under ministries and agencies equivalent to ministries (hereinafter collectively referred to as inspection ministries), including:

Article 3. Principles for awarding the Commemorative Medal

- Civil servants, public officials, and workers employed at inspection ministries;

- Civil servants, public officials, and workers employed at inspection agencies under bureaus and equivalent organizations as prescribed in the Government's decrees on the organization and operation of inspections;

3. The consideration for the Memorial Medal must be carried out in accordance with the subjects, criteria, procedures prescribed in this Circular.

Chapter II

RECIPIENTS AND CRITERIA FOR AWARDING COMMENDATION MEDALS

1. Leaders and former leaders of the Party and State; leaders of the Central Committee of the Vietnam Fatherland Front.

- Officers, non-commissioned officers, and workers employed at inspection agencies as prescribed in the Government's decrees on the organization and operation of defense and police inspections.

Point d) Civil servants, public officials, and workers employed at provincial and municipal inspection agencies (hereinafter collectively referred to as provincial inspection agencies);

Point đ) Civil servants, public officials, and workers employed at departmental and equivalent inspection agencies (hereinafter collectively referred to as departmental inspection agencies);

Point e) Civil servants, public officials, and workers employed at district, urban district, town, and provincial city inspection agencies (hereinafter collectively referred to as district inspection agencies).

Clause 2. Individuals who have achieved results in leadership and direction contributing to the cause of building and developing the Inspection sector in Vietnam, including:

Point a) Leaders of the Vietnam Fatherland Front and political-social organizations at the central level;

Point b) Leaders of ministries and agencies equivalent to ministries;

Point c) Secretaries and Deputy Secretaries of provincial Party Committees directly under the Central Committee; Chairmen and Vice Chairmen of Provincial People's Councils and People's Committees;

Point d) Leaders of the Vietnam Fatherland Front and political-social organizations at the provincial level; Secretaries and Deputy Secretaries of district Party Committees; Chairmen and Vice Chairmen of District People's Councils and People's Committees;

Point đ) Directors and Deputy Directors of departments and equivalent agencies.

Clause 4. Other cases as proposed by departments, bureaus, and units under the Inspector General and the Standing Committee of the Competition and Reward Council of the Inspection Sector.

a) Leaders of the Vietnam Fatherland Front, leaders of political and social organizations at the central level;

b) Leaders of ministries, ministerial-level agencies;

c) Secretaries and Deputy Secretaries of provincial Party Committees and municipal Party Committees under the Central Government; Chairpersons and Vice Chairpersons of Provincial People's Councils and Municipal People's Councils under the Central Government, Chairpersons and Vice Chairpersons of Provincial People's Committees and Municipal People's Committees under the Central Government;

d) Leaders of the Vietnam Fatherland Front and leaders of political and social organizations at the provincial and municipal levels under the Central Government; Secretaries and Deputy Secretaries of county Party Committees, district Party Committees, town Party Committees, and city Party Committees under provincial governments; Chairpersons and Vice Chairpersons of County People's Councils, District People's Councils, Town People's Councils, and City People's Councils under provincial governments; Chairpersons and Vice Chairpersons of County People's Committees, District People's Committees, Town People's Committees, and City People's Committees under provincial governments;

đ) Directors and Deputy Directors of departments and equivalent positions;

3. Individuals who are overseas Vietnamese or foreigners who have contributed to the cause of building and developing the Inspection sector of Vietnam.

4. Other cases as proposed by departments, bureaus, and units under the Government Inspectorate and the Standing Office of the Ministry of Inspection's Awards and Commendations Council.

Article 5. Subjects not eligible or not yet eligible for the Commendation Medal

1. The Commendation Medal shall not be awarded to individuals who have been compulsorily dismissed from their positions or stripped of military rank, titles, or police status.

2. The Commendation Medal shall not be awarded to individuals currently under disciplinary review; those subject to disciplinary measures ranging from reprimand upwards; those under investigation, prosecution, trial, or convicted and serving a criminal sentence.

The period of disciplinary action and the period of serving a criminal sentence, including periods during which disciplinary records or criminal convictions have not been expunged, shall not be counted towards eligibility for the Commendation Medal.

Article 6. Conditions and criteria for awarding Commendation Plaques

1. Individuals falling within the category specified in Point a Clause 1 Article 4 of this Circular, with at least four years of service up to the year of nomination.

2. Individuals falling within the categories specified in Points b, c, d, đ, e Clause 1 Article 4 of this Circular, with a total of at least ten years of service in state inspection agencies up to November 23 of the year of nomination.

3. Individuals falling within the category specified in Clause 2 Article 4 of this Circular must have outstanding achievements in leadership and direction contributing to the construction and development of the Vietnamese Inspection sector and meet the following conditions and standards:

a) Individuals falling within the categories specified in Points a, b, c must have held a position for at least five years and have spent at least four years in charge of or overseeing inspection work.

b) Individuals falling within the categories specified in Points d, đ must have held a position for at least ten years and have spent at least eight years in charge of or overseeing inspection work.

4. Individuals falling within the category specified in Clause 3 Article 4 of this Circular must have made outstanding contributions and achievements in building and consolidating international cooperation relations, positively contributing to the construction and development of the Vietnamese Inspection sector.

5. Individuals falling within other categories specified in Clause 4 Article 4 of this Circular must have made particularly outstanding contributions and achievements or have innovative scientific works of practical value that positively and effectively contribute to the construction and development of the Vietnamese Inspection sector.

Article 7. Priority Cases for Awarding the Commendation Medal

Officials, civil servants, employees, officers, non-commissioned officers, and workers employed in state inspection agencies are given priority for awarding the Commendation Medal when they meet one of the conditions stipulated in this Article, and only the highest achievement will be considered.

1. Individuals conferred the title of Heroic Laborer or Heroic People's Armed Forces shall be immediately nominated for the Commendation Medal upon receipt of the commendation decision.

2. Individuals awarded the Labor Order of various classes or National Model Worker shall be nominated for the Commendation Medal two years earlier.

3. Individuals awarded a Certificate of Merit by the Prime Minister or conferred the title of Model Worker at the ministry, sector, or provincial level shall be nominated for the Commendation Medal one year earlier.

4. Individuals awarded a Certificate of Merit by the Inspector General or conferred the title of Model Worker at the grassroots level shall be nominated for the Commendation Medal six months earlier.

Chapter III

PROCEDURES FOR AWARDING COMMENDATION PLAQUES

Article 8. Responsibilities for Establishing Nomination Files and Recommending the Commendation Medal

1. Heads of departments, bureaus, and units under the Inspector General are responsible for establishing nomination files and recommending the Commendation Medal for subjects specified in Points a, b Clause 1; Point a Clause 2 and Clause 4 Article 4 of this Circular.

2. Chief Inspectors of ministries are responsible for establishing nomination files and recommending the Commendation Medal for subjects specified in:

a) Point c Clause 1, Point b Clause 2 Article 4 of this Circular;

b) Point đ Clause 1 and Point đ Clause 2 Article 4 of this Circular (for ministries and sectors organized vertically from central to local levels).

3. Chief Inspectors of provinces are responsible for establishing nomination files and recommending the Commendation Medal for subjects specified in:

a) Point d, e Clause 1 and Points c, d Clause 2 Article 4 of this Circular;

b) Point d Clause 1 and Point đ Clause 2 Article 4 of this Circular (for departments under ministries and sectors not organized vertically from central to local levels).

4. Director of the International Cooperation Department, Inspector General is responsible for coordinating with relevant units under the Inspector General to establish nomination files and recommend the Commendation Medal for subjects specified in Clause 3 Article 4 of this Circular.

Article 9. Documents and time for nominating to be awarded the Commendation Medal

1. Nomination file for the Commendation Medal (one set), includes:

a) A letter requesting the award of the Commendation Medal;

b) A list of nominees for the Commendation Medal (to be implemented according to Form No. 01 attached to this Circular);

c) A summary of the career (to be implemented according to Form No. 02 attached to this Circular) for subjects specified in Clause 1 Article 4 of this Circular;

d) Copies of commendation decisions and related files confirmed by the managing authority (if applicable) for priority cases;

đ) For subjects specified in Clauses 2 and 3 Article 4 of this Circular, the nominating unit must submit a report on the individual's achievements contributing to the construction and development of the Vietnamese Inspection sector;

e) For cases specified in Clause 4 Article 4 of this Circular, the nominating unit must submit a report on the individual's particularly outstanding achievements or innovative scientific works of practical value contributing positively and effectively to the construction and development of the Vietnamese Inspection sector.

2. Agencies and units must submit the nomination file for the Commendation Medal to the Organization and Cadre Affairs Department, Inspector General before September 1 each year.

Article 10. Procedure for awarding the Commendation Medal

1. The Organization and Cadre Affairs Department, Inspector General is responsible for compiling the nomination files for the Commendation Medal and submitting them to the Ministry of Inspection's Commendation and Reward Council before October 1 each year.

2. The Standing Committee of the Ministry of Inspection's Commendation and Reward Council is responsible for reviewing and verifying the files and recommending the Ministry of Inspection's Commendation and Reward Council to consider and submit to the Inspector General for approval to award the Commendation Medal to individuals meeting the conditions and standards stipulated in Article 6 of this Circular before October 30 each year.

3. For other cases, the Standing Committee of the Department of Competition and Rewards of the Inspection Agency shall be responsible for receiving the files, submitting to the General Inspector for decision, and reporting back to the Department of Competition and Rewards of the Inspection Agency.

Article 11. Organizing the Presentation of the Commendation Medal

1. The ceremony for awarding the Commemorative Medal shall take place during the anniversary of the Inspection Agency's traditional day (November 23) every year.

2. Agencies and units with individuals to be awarded the Commemorative Medal shall be responsible for hosting and assisting the Standing Committee of the Department of Competition and Rewards of the Inspection Agency in organizing the award ceremony.

3. The Office of the Government Inspectorate shall be responsible for coordinating with the Personnel Organization Department of the Government Inspectorate to advise the Chief Inspector of the Government Inspectorate on organizing the awarding of the Commemorative Medal to leaders of the United Front and political-social organizations at the central level, individuals who have worked and are currently working at the Government Inspectorate, and certain special cases as stipulated in Clause 3 and 4, Article 4 of this Circular.

Article 12. Rights and responsibilities of organizations and individuals proposing to be considered for the award of the Commemorative Medal

1. Individuals awarded the Commemorative Medal shall be presented with a Certificate of Recognition, the Commemorative Medal "For the Cause of Inspection", and a monetary reward not exceeding 0.6 times the national minimum wage.

2. Individuals awarded the Commemorative Medal shall be responsible for preserving the medal and setting a good example by strictly adhering to the policies and laws of the Party and State, continuing to uphold the traditions of the Vietnamese Inspection Service.

3. Organizations and individuals proposing to be considered for the award of the Commemorative Medal shall be responsible for the accuracy and truthfulness of the application file.

4. Organizations and individuals proposing to be considered for the award of the Commemorative Medal have the right to appeal or report complaints regarding the proposal and consideration for the award of the Commemorative Medal in accordance with the law on appeals and complaints.

Chapter IV

IMPLEMENTATION

Article 13. Implementation Organization

1. This Circular shall take effect from May 25, 2017, and replace Circular No. 03/2015/TT-TTCP dated May 20, 2015, issued by the Government Inspectorate, concerning the awarding of the "Commemorative Medal For the Cause of Inspection".

2. The Standing Committee of the Department of Competition and Rewards of the Inspection Agency, heads of departments, bureaus, and units under the Government Inspectorate, Inspectors-in-Chief of ministries, Inspectors-in-Chief of provinces and centrally-administered cities, and related agencies, units, and individuals shall be responsible for implementing this Circular.

3. In the course of implementation, if there are difficulties or obstacles, the heads of agencies and units shall promptly report to the Standing Committee of the Department of Competition and Rewards of the Inspection Agency for reporting to the Chief Inspector of the Government Inspectorate to consider timely amendments and supplements./.
