Provision to suspend the effectiveness of certain provisions of Circular No. 08/2018/TT-BTNMT dated September 14, 2018, and Circular No. 09/2018/TT-BTNMT dated September 14, 2018, issued by the Minister of Natural Resources and Environment on national technical standards for the environment.
Pursuant to the Law on Legislative Regulatory Documents 2015;
On the basis of Decision No. 36/2017/NĐ-CP dated April 4, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to Resolution No. 09/NQ-CP dated February 3, 2019, of the Government regarding the regular meeting of the Government in January 2019;
At the proposal of the Director General of the Environmental Protection Department, the Head of the Science and Technology Department, and the Head of the Legal Affairs Department;
The Minister of Natural Resources and Environment hereby issues this Circular to provide for the suspension of the effectiveness of certain provisions of Circular No. 08/2018/TT-BTNMT dated September 14, 2018, and Circular No. 09/2018/TT-BTNMT dated September 14, 2018, issued by the Minister of Natural Resources and Environment on national technical standards for the environment,
Article 1. Suspension of the effectiveness of certain provisions of Circular No. 08/2018/TT-BTNMT and Circular No. 09/2018/TT-BTNMT dated September 14, 2018, issued by the Minister of Natural Resources and Environment on national technical standards for the environment.
1. Suspension of the effectiveness of the following provisions:
a) Article 2 of Circular No. 08/2018/TT-BTNMT and Circular No. 09/2018/TT-BTNMT dated September 14, 2018, issued by the Minister of Natural Resources and Environment on national technical standards for the environment (hereinafter referred to as Circular No. 08/2018/TT-BTNMT and Circular No. 09/2018/TT-BTNMT).
b) Provisions on the responsibility of state inspection agencies for the quality of imported waste materials under the national technical standards for the environment for imported waste materials issued together with Circular No. 08/2018/TT-BTNMT and Circular No. 09/2018/TT-BTNMT, specifically:
Section 1.3.6 Part 1 - Common Provisions of the Standards: QCVN 31:2018/BTNMT - National Technical Standard for the Environment for Imported Scrap Iron and Steel Used as Raw Materials for Production; QCVN 32:2018/BTNMT - National Technical Standard for the Environment for Imported Scrap Plastic Used as Raw Materials for Production; QCVN 33:2018/BTNMT - National Technical Standard for the Environment for Imported Scrap Paper Used as Raw Materials for Production; QCVN 66:2018/BTNMT - National Technical Standard for the Environment for Imported Scrap Non-Ferrous Metals Used as Raw Materials for Production;
Section 1.3.5 Part 1 - Common Provisions of the Standards: QCVN 65:2018/BTNMT - National Technical Standard for the Environment for Imported Scrap Glass Used as Raw Materials for Production; QCVN 67:2018/BTNMT - National Technical Standard for the Environment for Imported Blast Furnace Slag (Small Slag, Slag Sand from Iron or Steel Industry) Used as Raw Materials for Production.
c) Suspension of the effectiveness of provisions on the responsibilities of relevant inspection agencies related to inspection activities, receipt of documents on the results of waste material import consignment inspections (inspection certificates), notification of state inspection results or handling according to regulations for cases where imported waste materials do not meet standards, decisions to take samples of imported waste materials at Part 3 - Inspection Procedures and Determination Methods of the Standards: QCVN 31:2018/BTNMT - National Technical Standard for the Environment for Imported Scrap Iron and Steel Used as Raw Materials for Production; QCVN 32:2018/BTNMT - National Technical Standard for the Environment for Imported Scrap Plastic Used as Raw Materials for Production; QCVN 33:2018/BTNMT - National Technical Standard for the Environment for Imported Scrap Paper Used as Raw Materials for Production; QCVN 65:2018/BTNMT - National Technical Standard for the Environment for Imported Scrap Glass Used as Raw Materials for Production; QCVN 66:2018/BTNMT - National Technical Standard for the Environment for Imported Scrap Non-Ferrous Metals Used as Raw Materials for Production; QCVN 67:2018/BTNMT - National Technical Standard for the Environment for Imported Blast Furnace Slag (Small Slag, Slag Sand from Iron or Steel Industry) Used as Raw Materials for Production (hereinafter referred to as national technical standards for the environment for imported waste materials).
d) Suspension of the effectiveness of Section 4.1 Part 4 - Management Provisions of the National Technical Standards for the Environment for Imported Waste Materials; the responsibilities of inspection agencies at Section 4.2 Part 4 - Management Provisions of the National Technical Standards for the Environment for Imported Waste Materials and the responsibility to receive documents on the results of waste material import consignment inspections (inspection certificates) of inspection agencies at Section 4.5 Part 4 - Management Provisions of the National Technical Standards for the Environment for Imported Waste Materials.
2. Continue to implement the provisions at Clause 2 (except Point b) and Clause 3 (except Point d) of Article 10 of Circular No. 41/2015/TT-BTNMT dated September 9, 2015, of the Minister of Natural Resources and Environment on environmental protection in the import of waste materials for production raw materials.
3. Organizations and individuals who have submitted State Inspection Registration Files for imported waste materials before the date this Circular takes effect shall not be required to continue implementing the State Inspection provisions as stipulated in Circular No. 08/2018/TT-BTNMT and Circular No. 09/2018/TT-BTNMT.
Article 2. Effective Date
This Circular shall take effect from the date of issuance until the effective date of new regulatory legal documents that regulate the contents stipulated in Article 1 of this Circular.
Article 3. Implementation Organization
1. The Environmental Protection Administration shall be responsible for organizing the implementation of this Circular.
2. Ministries, ministerial-level agencies, People's Committees of provinces and centrally-run cities, Departments of Natural Resources and Environment of provinces and centrally-run cities, and organizations and individuals concerned shall be responsible for implementing this Circular./.
