CIRCULAR
REGULATIONS ON THE EVALUATION OF THE POPULAR PHYSICAL EDUCATION AND SPORTS MOVEMENT
Pursuant to Clause 3, Article 12 of the Law on Physical Education and Sports dated November 20, 2006, amended and supplemented according to Point b, Clause 4, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Physical Education and Sports dated June 14, 2018;
Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017, of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
At the proposal of the Director-General of the General Department of Physical Training and Sport;
The Minister of Culture, Sports and Tourism issues this Circular to regulate the evaluation of the popular physical education and sports movement.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular specifies the detailed criteria for evaluating the popular physical education and sports movement as provided for in Clause 2, Article 12 of the Law on Physical Education and Sports, which has been amended and supplemented according to Point a, Clause 4, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Physical Education and Sports.
Article 2. Applicability
This Circular applies to state management agencies for physical education and sports; organizations and individuals related to physical education and sports activities.
Article 3. Principles of Evaluation
1. Compliance with current laws; emphasizing the self-evaluation responsibility of the Popular Physical Education and Sports Movement by all levels of People's Committees and the responsibility of the General Department of Physical Education and Sports for summarizing and evaluating the Popular Physical Education and Sports Movement as stipulated in this Circular.
2. Ensuring honesty, accuracy, objectivity, completeness, and comprehensiveness throughout the organization and implementation process.
3. Ensuring the suitability of data synthesis methods for each evaluation criterion.
Chapter II
CONTENT OF CRITERIA FOR EVALUATING THE POPULAR PHYSICAL EDUCATION AND SPORTS MOVEMENT
Article 4. Criterion for the number of people regularly practicing physical education and sports
1. A person regularly practicing physical education and sports is someone who practices at least three times a week, with each practice lasting at least 30 minutes.
2. The criterion for the number of people regularly practicing physical education and sports is determined as a percentage (%) of the total number of people regularly practicing physical education and sports compared to the total population in the area.
Article 5. Criterion for the number of sports families
1. A sports family is a household where at least 50% of its members regularly practice physical education and sports.
2. The criterion for the number of sports families is determined as a percentage (%) of the total number of sports families compared to the total number of households in the area.
Article 6. Criterion for the number of physical education and sports collaborators
1. A physical education and sports collaborator is a person with specialized knowledge in physical education and sports who performs tasks to mobilize, organize, guide people in practicing physical education and sports, perform sports demonstrations and competitions, and participate in developing the popular physical education and sports movement.
2. The criterion for the number of physical education and sports collaborators is determined as a percentage (%) of the total number of physical education and sports collaborators compared to the total population in the area.
Article 7. Criterion for the number of sports clubs
1. Sports clubs include:
a) Grassroots sports clubs established and recognized according to the provisions of the law, with the function of promoting and organizing activities to disseminate and guide popular physical education and sports to meet the needs of physical training, entertainment, health improvement, cultural and spiritual enhancement, and improving sports achievements for practitioners.
b) Business establishments engaged in sports activities.
2. The criterion for the number of sports clubs is determined as the total number of grassroots sports clubs and business establishments engaged in sports activities in the area.
Article 8. Criteria for the number of sports facilities
1. The number of sports facilities includes:
a) The total number of multi-purpose and single-sport training and competition halls;
b) The total number of swimming pools including: the total number of 50-meter pools; the total number of 25-meter pools; the total number of other types of pools;
c) The total number of outdoor training and competition fields including: the total number of stadiums with stands; the total number of stadiums without stands; the total number of mini football fields; the total number of volleyball courts; the total number of basketball courts; the total number of badminton courts; the total number of tennis courts; the total number of other types of outdoor training and competition fields.
2. The criteria for the number of sports facilities are determined by the total number of sports facilities currently being used for physical exercise and sports activities within the area.
Article 9. Criteria for the number of annual sports competitions
1. The criteria for the number of annual sports competitions are determined by the total number of mass sports competitions organized within the area.
2. The total number of mass sports competitions as stipulated in Clauses 1, 2, and 3 of Article 13 of the Law on Physical Education and Sports, amended and supplemented according to Clause 5 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Physical Education and Sports, shall be determined by the General Department of Physical Education and Sports.
3. The total number of mass sports competitions as stipulated in Clauses 4 and 5 of Article 13 of the Law on Physical Education and Sports, amended and supplemented according to Clause 5 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Physical Education and Sports, shall be determined by the People's Committees at all levels within their scope of state management.
Chapter III
EVALUATION OF THE MASS PHYSICAL EDUCATION AND SPORTS MOVEMENT
Article 10. Method of Evaluation
The mass physical education and sports movement is evaluated by comparing the indices of the criteria specified in Articles 4, 5, 6, 7, 8, and 9 of this Circular with the following indices:
1. Indices of the criteria determined in the previous evaluation period;
2. Target indices of the criteria determined in the annual activity plan of the agency.
Article 11. Evaluation Period
The evaluation of the mass physical education and sports movement is conducted annually once. The information evaluation date is set for October 31 each year. The time reference for the first evaluation period is November 1, 2019.
Article 12. Responsibilities for Synthesis, Evaluation, and Reporting
1. Annually, within the scope of state management assigned, People's Committees at all levels self-evaluate, using the evaluation results of the directly subordinate People's Committee to evaluate the mass physical education and sports movement within their area based on the criteria specified in Articles 4, 5, 6, 7, and 8, Clause 1 and Clause 3 of Article 9 of this Circular.
2. The People's Committee at the commune level and the People's Committee at the district level have the responsibility to report to the immediately superior People's Committee the results of evaluating the mass physical education and sports movement within their area according to the reporting form prescribed by the provincial People's Committee.
3. Before November 30 each year, the People's Committee at the provincial level has the responsibility to report the results of evaluating the mass physical education and sports movement within their province or centrally-administered city to the Ministry of Culture, Sports and Tourism through the General Department of Physical Education and Sports according to the reporting form prescribed in Clause 4 of this Article.
4. The reporting form for the results of evaluating the mass physical education and sports movement within the province or centrally-administered city is prescribed in the Appendix attached to this Circular.
Based on the reporting form for the results of evaluating the mass physical education and sports movement within the province or centrally-administered city prescribed in this Clause, the People's Committee at the provincial level prescribes the reporting form for the results of evaluating the mass physical education and sports movement within the commune, ward, town, district, city district, and city under the province or centrally-administered city.
5. Before December 15 each year, the General Department of Physical Education and Sports compiles the results of evaluating the mass physical education and sports movement within the provinces and centrally-administered cities; evaluates the national mass physical education and sports movement, reports to the Minister of Culture, Sports and Tourism.
Article 13. Announcing and Providing Information on the Evaluation Results
The results of the national mass physical culture and sports movement evaluation shall be announced by the Ministry of Culture, Sports and Tourism before January 15 of the year immediately following the year of the evaluation period; they shall be published on the Ministry of Culture, Sports and Tourism's electronic portal and the General Department of Physical Culture and Sports' electronic portal.
Chapter IV
IMPLEMENTATION AND EFFECTIVE PROVISIONS
Article 14. Implementation Organization
1. The General Department of Physical Culture and Sports shall be responsible for taking the lead, advising the Minister of Culture, Sports and Tourism to direct, guide, monitor, urge, and inspect the implementation of this Circular.
2. Based on their assigned functions and tasks, the People's Committee of the province shall direct, guide specialized agencies, the People's Committee of the district, and the People's Committee of the commune to organize the implementation of this Circular.
3. The Department of Culture, Sports and Tourism, the Department of Culture and Sports of the centrally governed cities and provinces, the Cultural and Information Office, and cultural-social officials shall advise the People's Committee and the Chairman of the People's Committee at the same level to implement the task of evaluating the mass physical culture and sports movement within their jurisdiction as stipulated in this Circular.
Article 15. Implementation Provisions
1. This Circular shall take effect from March 5, 2019.
2. Circular No. 08/2012/TT-BVHTTDL dated September 10, 2012 of the Ministry of Culture, Sports and Tourism regarding the content of physical culture and sports development evaluation shall cease to be effective from the date this Circular takes effect.
3. During the implementation process, if any difficulties arise, it is requested that agencies, organizations, and individuals promptly reflect them to the Ministry of Culture, Sports and Tourism for research and resolution./.
