CIRCULAR
REGULATIONS ON THE IMPLEMENTATION OF DAYTIME IN-PATIENT TREATMENT AT TRADITIONAL MEDICINE DIAGNOSTIC AND TREATMENT FACILITIES
Pursuant to the Law on Medical Examination and Treatment 2009;
Decree No. 75/2017/ND-CP dated June 20, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Department of Traditional Medicine and Pharmaceutical Management,
The Minister of Health issues this Circular regulating the implementation of daytime in-patient treatment at traditional medicine diagnostic and treatment facilities.
Article 1. Scope of Regulation
This Circular regulates the implementation of daytime in-patient treatment at traditional medicine diagnostic and treatment facilities.
Article 2. Interpretation of Terms
Daytime in-patient treatment is a form of in-patient treatment at a medical examination and treatment facility during working hours (including holidays and public holidays).
Article 3. Regulations on daytime in-patient treatment at traditional medicine diagnostic and treatment facilities
1. Indications for daytime in-patient treatment The decision to provide daytime in-patient treatment shall be made by a doctor and must meet the following criteria:
a) The patient's health condition and disease require in-patient treatment but do not necessarily need 24-hour monitoring and treatment at the medical examination and treatment facility;
b) The time spent on monitoring and treating the patient in-patient during the day at the medical examination and treatment facility must be a minimum of 4 hours per day;
c) If the patient's condition can be treated as an outpatient, then daytime in-patient treatment shall not be applied;
d) For patients who do not reside in the same province or city where the medical examination and treatment facility is located, the patient may be provided with daytime in-patient treatment or 24-hour in-patient treatment.
2. Patients undergoing daytime in-patient treatment shall be examined clinically and paraclinically daily or according to the schedule set by the treating physician and shall enjoy in-patient treatment, monitoring, and care during working hours. Daily visits during the treatment period shall not be charged to the patient.
3. In cases where the patient's condition deteriorates severely, abnormally, or requires 24-hour monitoring and treatment at the medical examination and treatment facility, the patient shall be transferred to in-patient treatment and recorded in the medical record regarding the progression of the disease. The patient’s medical record will continue to be used. The in-patient treatment days shall be counted from the date the patient was transferred to 24-hour in-patient treatment.
4. Record-keeping regulations for medical records
a) Medical records used for daytime treatment shall be implemented according to the model of in-patient medical records for traditional medicine, with the phrase "Daytime Inpatient" stamped in the upper right corner of the cover page.
b) Where traditional medicine diagnostic and treatment facilities use electronic medical records, they shall use the electronic medical record model issued by the Minister of Health.
5. Procedures for medical examination and treatment, management of medical records, and costs for daytime in-patient treatment shall be carried out in accordance with the regulations applicable to 24-hour in-patient medical examination and treatment.
6. Bed charges for daytime in-patient treatment shall be implemented in accordance with the provisions of Circular No. 39/2018/TT-BYT dated November 30, 2018, issued by the Minister of Health on the unified pricing of medical services under health insurance between hospitals of the same level nationwide and guidelines for applying prices and settling costs for medical services under health insurance in certain cases.
Article 4. Effective date
This Circular shall take effect from April 15, 2019.
Article 5. Reference Provisions
In case the referenced documents in this Circular are replaced or amended, the replaced or amended documents shall apply.
Article 6. Responsibility for Implementation
1. The Director of the Department of Traditional Medicine and Pharmaceutical Management, the Head of the Ministry's Office, the Inspector General, the Heads of Departments, Directors of Bureaus, and General Directors of the Ministries' Departments, Bureaus, and General Directorates, the Directors of Provincial Health Departments, the Heads of Health Services of Ministries and Sectors, and the Heads of relevant agencies, organizations, and units shall be responsible for implementing this Circular.
2. Healthcare facilities shall be responsible for:
a) Inform the Ministry of Health, Health Departments of Ministries and Sectors, or Provincial Health Departments, and the Social Insurance Office of the province or city where the medical examination and treatment facility operates about the implementation of traditional medicine daytime in-patient treatment to facilitate the settlement of medical examination and treatment costs for persons holding health insurance cards;
b) Publicize widely through appropriate means the implementation of traditional medicine daytime in-patient treatment at the facility. During the implementation process, if there are difficulties or obstacles, they should promptly report to the Ministry of Health (Department of Traditional Medicine and Pharmaceutical Management) for consideration and resolution./.
