CIRCULAR

Regulations on certain measures to implement state management functions regarding physical education and sports for national sports associations

Pursuant to the Law on Physical Education and Sports dated November 29, 2006 and the Law Amending and Supplementing Certain Provisions of the Law on Physical Education and Sports dated June 14, 2018;

Pursuant to Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on organization, operation, and management of associations and Decree No. 33/2012/NĐ-CP dated April 13, 2012 of the Government amending and supplementing certain provisions of Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on organization, operation, and management of associations;

Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017, of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director-General of the General Department of Physical Training and Sport;

The Minister of Culture, Sports and Tourism promulgates this Circular regulating certain measures to implement state management functions regarding physical education and sports for national sports associations.

Article 1. Scope of Regulation

This Circular regulates certain measures to implement state management functions regarding physical education and sports for national sports associations.

Article 2. Applicability

1. This Circular applies to:

a) The General Department of Sports;

b) National sports associations;

c) Organizations and individuals related to the state management functions for national sports associations.

2. National sports associations referred to in this Circular include:

a) Vietnam Olympic Committee;

b) Vietnam Paralympic Association;

c) National federations and associations of sports for a particular sport or several sports.

Article 3. Developing and implementing policies, programs, plans for the development of physical education and sports

1. Developing policies for the development of physical education and sports:

a) The General Department of Sports and Physical Training shall seek opinions from national sports associations when developing strategies, planning, and policies for the development of physical education and sports;

b) National sports associations shall proactively propose to the General Department of Sports and Physical Training and competent state management agencies about policies and activities linked to the state's tasks to develop national sports associations and sports under their jurisdiction.

2. The General Department of Sports and Physical Training shall be responsible for notifying approved strategies, plans for the development of physical education and sports; annual work directions and plans to national sports associations so that they can coordinate and organize implementation.

3. Based on requirements for the development of professional sports, national sports federations and associations shall develop proposals, plans, programs, and regulations on organizing professional activities of the sport and submit them to the General Department of Sports and Physical Training for review, submission to the Ministry of Culture, Sports and Tourism for consideration, and implementation after approval.

Article 4. Managing the organization of sports competitions

1. Hosting and organizing regional, continental, and world sports congresses and sports congresses for people with disabilities held in Vietnam:

a) The Vietnam Olympic Committee and the Vietnam Paralympic Association shall notify the General Department of Sports and Physical Training of plans to organize regional, continental, and world sports congresses and sports congresses for people with disabilities for reporting to the Ministry of Culture, Sports and Tourism for consideration of hosting.

b) The General Department of Sports and Physical Training shall take the lead in coordinating with the Vietnam Olympic Committee and the Vietnam Paralympic Association to develop hosting proposals for regional, continental, and world sports congresses and sports congresses for people with disabilities held in Vietnam and report to the Minister of Culture, Sports and Tourism for approval.

c) The Vietnam Olympic Committee and the Vietnam Paralympic Association shall be responsible for coordinating with the General Department of Sports and Physical Training to develop and implement plans to organize regional, continental, and world sports congresses and sports congresses for people with disabilities held in Vietnam according to approved proposals.

2. Hosting and organizing regional, continental, and world sports competitions for people with disabilities held in Vietnam: The Vietnam Paralympic Association shall submit hosting applications for organizing regional, continental, and world sports competitions for people with disabilities held in Vietnam to the General Department of Sports and Physical Training for review, submission to the Minister of Culture, Sports and Tourism for decision; and coordinate with the General Department of Sports and Physical Training to organize implementation after approval.

3. Hosting and organizing national and international championships and youth championships for each sport at the regional, continental, and world levels held in Vietnam: National sports federations and associations shall submit hosting applications for organizing national and international championships and youth championships for each sport at the regional, continental, and world levels to the General Department of Sports and Physical Training for review, submission to the Minister of Culture, Sports and Tourism for decision; and coordinate with the General Department of Sports and Physical Training to organize implementation after approval.

4. Organizing other national and international sports competitions:

a) For sports competitions using state budget funds: The General Department of Sports and Physical Training shall take the lead in coordinating with national sports federations and associations and the Vietnam Paralympic Association to organize international sports competitions not covered by Articles 1, 2, and 3 of this Circular, the National Sports Congress, national championships, annual national youth championships for each sport, national mass sports competitions, matches organized or hosted by national sports federations and associations and the Vietnam Paralympic Association after approval by competent authorities.

b) For other sports competitions not using state budget funds: National sports federations and associations shall report to the General Department of Sports and Physical Training plans to organize competitions and matches for which they are responsible for funding, without using state funds, to be included in the annual national competition plan and organize the competition according to the plan after approval by competent authorities.

5. The General Department of Sports and Physical Training shall be responsible for inspecting and supervising the implementation of competition laws, competition rules, and regulations on organizing professional sports activities of sports under the authority of the President of national sports federations and associations.

6. The General Department of Sports and Physical Training shall cooperate with the National Sports Association to implement anti-corruption measures and ensure security, order, and safety in sports competition activities, provide professional and technical guidance to sports federations and associations at both sectoral and local levels, and facilitate conditions for sports fan clubs to participate in cheering at sports competitions.

Article 5. Formation of national sports teams to participate in international sports congresses and competitions

1. Formation of national sports teams:

a) The General Department of Sports and Physical Training shall take the lead and coordinate with national sports associations to select members of national sports teams for each sport, and submit to the Minister of Culture, Sports and Tourism for the decision to establish national sports teams;

b) The Vietnam Olympic Committee and the Vietnam Paralympic Association shall cooperate with national sports federations and associations to register team members for participation in international sports congresses and competitions for people with disabilities at regional, continental, and world levels.

2. Formation of national sports teams:

a) Based on the proposal of the national sports team coaching staff, the General Department of Sports and Physical Training shall take the lead, consult with national sports federations and associations before deciding to form national sports teams and junior national sports teams (collectively referred to as national sports teams) for training and participation in international competitions using funds from the state budget allocated to the General Department of Sports and Physical Training;

b) National sports federations and associations shall decide to propose to the General Department of Sports and Physical Training to form national sports teams for training and participation in international competitions using funds from the national sports federations and associations;

c) National sports federations and associations shall be responsible for registering the national sports teams to participate in international sports competitions according to the decision of the General Department of Sports and Physical Training.

Article 6. Management of athletes, coaches, and referees in sports

1. Establishing, managing records, and confirming the qualifications of athletes, coaches, and sports referees:

a) National sports federations and associations, the Vietnam Paralympic Association shall be responsible for establishing, managing records, and confirming the qualifications of athletes, coaches, and referees in their respective sports in accordance with their own regulations and those of corresponding international sports organizations;

b) The General Department of Sports and Physical Training shall be responsible for establishing and managing records of athletes and coaches of national sports teams.

2. Awarding ranks to athletes, coaches, and referees in sports:

a) The General Department of Sports and Physical Training shall take the lead and coordinate with national sports federations and associations to develop criteria for awarding ranks to athletes, coaches, and referees in each sport, and submit to the Minister of Culture, Sports and Tourism for promulgation;

b) National sports federations and associations shall decide on awarding ranks to athletes, coaches, and referees in their respective sports.

Article 7. Recognition of standards for material infrastructure and equipment for high-performance sports training and competition

1. National sports federations and associations shall inspect and recognize material infrastructure and equipment for high-performance sports training and competition that meet Vietnamese standards and comply with the regulations of international sports organizations or reach international standards.

2. The recognition of material infrastructure and equipment for high-performance sports competition meeting professional standards shall be publicly announced within national sports federations and associations and their member organizations.

Article 8. Training and Recognition of Professional Sports Standards

1. For professional coaches:

a) National sports federations and associations shall be responsible for developing training programs for professional coaches and organizing training for coaches in accordance with the regulations of the International Sports Federation.

b) National sports federations and associations shall be responsible for sending coaches to train abroad or coordinating with international sports federations of which the national sports federations and associations are members to organize training for professional coaches in Vietnam.

2. For professional athletes: National sports federations and associations shall recognize athletes who meet the professional sports activity standards of the sport managed by the national sports federations and associations, or cease to recognize the status of professional athlete if they do not meet the required standards.

3. National sports federations and associations shall issue procedures for checking, recognizing, and not recognizing the status of professional coaches and athletes, and uniformly manage professional coaches and athletes of the sport managed by the national sports federations and associations.

4. Annually, national sports federations and associations shall report to the General Department of Physical Education and Sports the number of professional sports teams, lists of professional coaches and athletes of the sport.

Article 9. Management and Coordination of International Cooperation Activities

1. Responsibilities of the General Department of Physical Education and Sports:

a) Informing the national sports federation about international treaties, international agreements on physical education and sports that have been signed by the State with countries and international organizations;

b) Guiding and creating conditions for the national sports federation to participate in international cooperation activities in physical education and sports;

c) Providing opinions to competent authorities to decide on the national sports federation joining international sports organizations;

d) Deciding to send individuals under the management authority of the General Department of Physical Education and Sports to be members of the national sports federation participating in elections at international sports organizations upon the proposal of the national sports federation.

2. Responsibilities of the national sports federation:

a) The national sports federation shall inform the General Department of Physical Education and Sports: - Annual international cooperation plans of the federation; - Contents of professional sports cooperation agreements between the federation and international sports organizations; - Plans to organize regional, continental, and world sports congresses; - Plans for participation in international sports competitions by national sports teams, plans to host international sports competitions, international sports conferences, and training courses in Vietnam; - Joining as members of corresponding international sports organizations and federation members elected to leadership or specialized committees of international sports organizations; - Other international cooperation activities.

b) Implementing decisions of state management agencies concerning important issues in international cooperation between the National Sports Federation and international sports organizations as stipulated by law.

Article 10. Information and Reporting System

1. Within fifteen days from the completion of tasks specified in Clause 4 of Articles 4, 6, 7, and 8 of this Circular, the national sports federation shall be responsible for reporting to the General Department of Physical Education and Sports for monitoring.

2. By December 1st each year, the national sports federation shall be responsible for reporting organizational structure, activities, and the next year's activity plan to the General Department of Physical Education and Sports.

Article 11. Effective Date

1. This Circular takes effect from March 20, 2021.

2. Circular No. 01/2013/TT-BVHTTDL dated January 2, 2013, of the Ministry of Culture, Sports and Tourism regarding certain state management tasks for the national sports federation shall cease to be effective from the date this Circular takes effect.

Article 12. Implementation Organization

1. The General Department of Physical Education and Sports shall be responsible for monitoring, inspecting, and supervising the implementation of tasks of the national sports federation as stipulated in this Circular.

2. The General Department of Physical Education and Sports, heads of agencies and units under the Ministry, relevant organizations and individuals shall be responsible for implementing this Circular, compiling periodic annual reports to the Minister of Culture, Sports and Tourism.

3. During the implementation process, if any difficulties arise, relevant agencies and organizations are requested to promptly reflect them to the Ministry of Culture, Sports and Tourism for research and resolution.
