PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
4. Do not consume alcohol in the office; do not drink alcohol before, during, or after lunch breaks on working days; strictly comply with laws on preventing the harmful effects of alcohol.
Article 2. Applicability
This Circular applies to civil servants and officials working in state inspection agencies and civil servants engaged in public reception work at the Public Reception Office and other public reception locations.
Chapter II
GENERAL CODE OF CONDUCT
Article 3. Spirit and Attitude towards Work
1. Respect and be dedicated to serving the people; comply with and set an example in implementing the Party's policies and the State's laws and regulations; always maintain organizational discipline and a sense of responsibility in performing duties and official tasks; strictly adhere to the internal rules and regulations of the agency or unit.
2. Continuously cultivate and refine moral character; lead a healthy lifestyle, oppose bureaucracy, corruption, waste, individualism, opportunism, factionalism, and other negative phenomena.
3. Do not misuse the name of the organization or use public property, equipment, or means for personal purposes; actively create a clean, beautiful, and civilized workplace environment.
4. Fulfill the responsibilities and tasks of civil servants and officials as prescribed by the Labor Code, Civil Servant Law, Official Law, Inspection Law, Complaints Law, Accusation Law, Public Reception Law, Law on Practicing Thrift and Combating Waste, Anti-Corruption Law, and other relevant legal documents.
Article 4. Dress Code and Professional Conduct
1. When working at the office and during duty hours, dress neatly and appropriately, wear shoes with straps or backless sandals; wear uniforms, badges, nameplates, shoulder boards, and insignias as required; maintain a serious and courteous demeanor.
2. Strictly follow working hours and meeting times; do not engage in personal activities or leave the office or workplace without a valid reason; keep the workspace tidy and clean.
3. Do not smoke within the premises of the agency; set an example by complying with laws and regulations concerning tobacco control.
4. Do not consume alcohol in the office; do not drink alcohol before, during, or after lunch break on working days; strictly comply with laws and regulations regarding alcohol control.
Article 5. Communication through telephone, email, and social networks
1. When communicating through telephone and other online communication methods, civil servants, public officials, and employees must state their name, position, title, workplace; exchange information concisely and clearly with sufficient volume for hearing, and maintain a courteous attitude.
2. Use official email accounts in accordance with regulations; ensure information security and safety; refrain from using social networks during working hours; do not use emails or social networks to disseminate false information that affects the reputation and image of the organization or unit.
Article 6. Conduct of civil servants, public officials, and employees holding leadership and management positions
1. Fulfill duties and powers in leadership and management; maintain internal unity; promote exemplary responsibility and build a professional and friendly working environment within the organization or unit.
2. Implement democracy, objectivity, and fairness in organizational activities; respect, listen to, and promptly understand the thoughts, wishes of subordinate civil servants and public officials; be impartial and fair in managing, utilizing, and evaluating civil servants and public officials.
Article 7. Conduct between civil servants, public officials and superiors and colleagues
1. Maintain a respectful attitude and strictly comply with directives, management, and assigned tasks from superiors; provide constructive opinions to superiors to promptly address existing shortcomings and limitations, and improve directive and management work; shall not abuse criticism or comments to affect the reputation and honor of superiors.
2. Actively and positively cooperate and support colleagues in performing tasks; be sincere and friendly in relations with colleagues; shall not abuse criticism or comments to affect the reputation and honor of colleagues.
Article 8. Conduct towards organizations, individuals related to work and news media agencies
1. Behave culturally, respecting the dignity and reputation of organizations, entities, and individuals related to work; be sincere and cooperative, supporting each other to complete tasks. In cases where the related organization, entity, or individual makes inappropriate statements, attitudes, or behaviors, one must remain calm, proactive, and flexible in handling situations in accordance with assigned responsibilities and tasks.
2. Provide statements, information, and materials on inspection, citizen reception, complaint resolution, accusation handling, and anti-corruption to news media agencies and relevant agencies when there is a formal conclusion from the competent authority and upon authorization by leadership in accordance with the law.
3. Civil servants, public officials, and employees may answer interviews and surveys based on their professional experience but shall not disclose state secrets, work secrets, or affect the performance of organizational tasks.
Article 9. Conduct towards foreign organizations and individuals
1. Adhere to legal provisions and organizational regulations when interacting and working with foreign organizations and individuals, and implement foreign policy and international cooperation policies correctly.
2. Shall not take advantage of foreign activities and international cooperation for personal benefit.
Chapter III
CONDUCT IN THE PERFORMANCE OF INSPECTION TASKS,
CITIZEN RECEPTION, COMPLAINT AND ACCUSATION RESOLUTION, AND
ANTI-CORRUPTION EFFORTS
Article 10. Conduct in performing inspection tasks
1. State officials, civil servants, and employees in state inspection agencies shall perform the following tasks:
a) Enhance their sense of responsibility for preventing and combating corruption and practicing thrift and curbing waste in inspection activities. They must comply with the principles, contents, inspection powers, procedures, and formalities prescribed in the Inspection Law, the Law on Prevention and Combating Corruption, and other relevant legal documents;
b) Maintain a cautious, objective, and comprehensive attitude when examining and evaluating matters; listen to and respect reasonable explanations from the inspected entities; guide the inspected entities to understand and comply with legal regulations;
c) Report to the person issuing the inspection decision or the Head of the inspection team when state officials, civil servants, and employees conducting inspections have relationships with inspected entities that may improperly affect the performance of their duties; promptly report to the Head of the inspection team when conflicts of interest are discovered during the execution of inspection tasks;
d) Avoid social relations that could lead to concessions in inspection activities;
đ) Promptly provide information and report to the person issuing the inspection decision or the Head of the inspection team upon discovering acts of corruption or negative practices;
2. State officials, civil servants, and employees in state inspection agencies shall not perform the following tasks:
a) Exploit the status of state officials, civil servants, or employees to commit unlawful acts; abuse power, harass, create difficulties, or cause inconvenience to inspected entities; use the means and assets of inspected entities for personal benefit;
b) Advise or act as intermediaries for organizations and individuals within and outside the country regarding matters within their jurisdiction and other matters where such advice or intermediary services could harm national interests or the agency/unit;
c) Accept gifts from inspected entities in any form; if unable to refuse, report to the person issuing the inspection decision or the Head of the inspection team for management and handling of the gift according to the law;
d) Conclude, recommend, or decide on unlawful handling; report false information; shield persons who violate the law; coerce or suggest to inspected entities to respond or present matters according to their subjective wishes;
đ) Illegally obstruct or interfere with inspection activities or supervision of inspection teams; disclose information or documents about the content of inspections before the Inspection Conclusion has been publicly announced and handed over according to the law;
e) Retaliate, threaten, or oppress persons who report violations committed by themselves;
Article 11. Conduct in performing citizen reception tasks
1. Officials and civil servants engaged in citizen reception work shall perform the following tasks:
a) Citizen reception must ensure transparency, objectivity, democracy, and promptness; simple and convenient procedures; maintain confidentiality and ensure safety for complainants according to the law;
b) Respect, listen to, and patiently explain thoroughly any concerns related to the content of complaints, reports, suggestions, or reflections; guide and facilitate citizens to file complaints, reports, suggestions, or reflections according to the law;
c) Maintain appropriate attitudes, listen, accept complaints, reports, suggestions, or reflections or record fully and accurately the content presented by the person making complaints, reports, suggestions, or reflections;
d) Explain and guide the person making complaints, reports, suggestions, or reflections to comply with policies, laws, conclusions, and decisions already in effect issued by competent authorities; guide complainants, reporters, suggesters, or reflectors to the correct authority or person with jurisdiction;
đ) Require violators of the rules at the reception venue to cease their violations; if necessary, prepare a record of the violation and request the competent authority to handle it according to the law;
2. Officials and civil servants engaged in citizen reception work shall not perform the following tasks:
a) Cause inconvenience, harassment, or obstruction to persons making complaints, reports, suggestions, or reflections;
b) Be negligent in citizen reception work; lose or distort information or documents provided by complainants, reporters, suggesters, or reflectors;
c) Discriminate against citizens during reception.
Article 12. Conduct in performing tasks to handle complaints and denunciations
1. State officials, civil servants, and employees in state inspection agencies shall perform the following tasks:
a) Adhere to the viewpoints and policies of the Party, laws of the State, perform the task of receiving citizens, handling complaints and denunciations within the scope of authority, in accordance with the procedures and formalities prescribed in the Law on Complaints and the Law on Denunciations and other relevant legal documents;
b) Guide and assist complainants and denouncers to understand and comply with legal regulations; provide advice for thorough resolution in accordance with legal provisions;
c) Guide and publicize the procedures for performing specialized tasks, administrative procedures that have been approved by competent authorities, ensuring that requests from organizations and individuals are resolved in accordance with the law;
d) When verifying, concluding, and making recommendations, be cautious and objective;
đ) In cases where there are errors, delays, or lateness in complaint and denunciation files, strictly implement the act of apologizing as prescribed;
e) If discovering acts of violating the law that may cause damage to the interests of the State, the rights and legitimate interests of citizens, report to the competent agencies, organizations, or individuals to apply timely preventive measures;
2. State officials, civil servants, and employees in state inspection agencies shall not perform the following tasks:
a) Have a domineering attitude, intimidate, create tension, difficulties, harassment, solicitation, delay, prolong the processing time of organizational and citizen's affairs;
b) Refuse to resolve the demands of organizations and individuals within the assigned responsibilities and tasks without justifiable reasons;
c) Be indifferent, uncaring, lack responsibility towards the difficulties and grievances of organizations and citizens; take advantage of duties and positions to harass, cause inconvenience, and seek personal gain;
d) Lose, damage, distort complaint and denunciation files, results; coerce or suggest complainants and denouncers to present their cases according to one's subjective wishes;
đ) Obstruct and illegally interfere in the handling of complaints and denunciations; disclose names, addresses, handwriting, or information about denouncers;
Article 13. Conduct in performing anti-corruption tasks
1. State officials, civil servants, and employees in state inspection agencies shall perform the following tasks:
a) When participating in inspection teams on anti-corruption, follow the provisions of Clause 1, Article 10 of this Circular;
b) Comply with principles, authority, procedures, and formalities for verifying assets, income, and preventing corruption as prescribed by law;
c) Provide truthful information and reports on anti-corruption work to agencies and organizations as prescribed by law;
d) Create conditions for the Vietnam Fatherland Front and its member organizations, enterprises, business associations, industry associations, press agencies, journalists, citizens, People's Inspection Committees, Investment Supervision Committees... to participate in anti-corruption activities as prescribed by law;
2. State officials, civil servants, and employees in state inspection agencies shall not perform the following tasks:
a) When participating in inspection teams on anti-corruption, do not engage in actions prohibited under Clause 2, Article 10 of this Circular;
b) Engage in acts that distort files, information, documents, and false reports about anti-corruption efforts;
c) Take advantage of anti-corruption efforts to cause disturbances, disrupt internal unity, insult the dignity and reputation of individuals, and damage the credibility of agencies and organizations;
d) Take advantage of asset and income verification to cause difficulties, harassment, and obstruction of normal activities of those being verified; disclose information about the assets and income of those being verified in violation of the law;
đ) Shield corrupt behavior; obstruct and illegally interfere in the process of resolving corruption cases;
e) Disclose information about persons who report, denounce, accuse, or provide information about corrupt behavior;
g) Obstruct and illegally interfere in the process of resolving corruption cases;
Chapter IV
IMPLEMENTING PROVISIONS
Article 14. Effective Date
1. This Circular takes effect from May 1, 2021.
Decision No. 1860/QD-TTCP dated June 9, 2007 of the Government Inspector General on the issuance of the Code of Conduct for Inspectors ceases to be effective from the date this Circular becomes legally binding.
2. Civil servants and public officials when performing official duties must, in addition to complying fully with the provisions of this Circular, also comply with regulations on official ethics, office culture, rights and obligations of civil servants, public officials, and matters that civil servants, public officials are not allowed to do as prescribed by other related laws.
3. During implementation, if any difficulties or new issues arise, agencies, organizations, and units are requested to promptly reflect them to the Government Inspectorate for study, amendment, and supplementation to ensure appropriateness./.
