This Circular amends and supplements certain provisions of Circular No. 07/2018/TT-BKHCN and Circular No. 08/2019/TT-BKHCN relating to national technical regulations on electromagnetic compatibility for household electrical and electronic equipment, as well as LED lighting products. This document aims to adjust the circulation period for products produced before the implementation of new standards.

Amending and supplementing certain provisions of Circular No. 07/2018/TT-BKHCN dated June 6, 2018 and Circular No. 08/2019/TT-BKHCN dated September 25, 2019 issued by the Minister of Science and Technology

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to Resolution No. 32/2021/QH15 dated November 12, 2021 of the National Assembly on the socio-economic development plan for 2022;
Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain articles of the Law on Technical Standards and Regulations and Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing certain provisions of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain articles of the Law on Technical Standards and Regulations;
Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
Implementing Resolution No. 86/NQ-CP dated August 6, 2021 of the Government on urgent measures to prevent and control the COVID-19 pandemic to implement Resolution No. 30/2021/QH15 dated July 28, 2021 of the National Assembly, 15th term;
At the proposal of the Director General of the National Standardization, Metrology and Quality Control Department and the Head of the Legal Affairs Department;
The Minister of Science and Technology issues this Circular amending and supplementing certain provisions of Circular No. 07/2018/TT-BKHCN dated June 6, 2018 and Circular No. 08/2019/TT-BKHCN dated September 25, 2019 issued by the Minister of Science and Technology.
Article 1. Amending and supplementing Clause 3, Article 4 of Circular No. 07/2018/TT-BKHCN dated June 6, 2018 issued by the Minister of Science and Technology amending 1:2018 QCVN 9:2012/BKHCN National Technical Regulation on Electromagnetic Compatibility for Household Electrical and Electronic Equipment and Similar Purposes as follows:
"3. Electrical and electronic equipment that has been produced, traded, and imported before the corresponding date specified in Article 2 of this Circular shall continue to circulate in the market but not more than six months from the date specified in Article 2 of this Circular.
Microwave ovens (including combination types) and electric stoves (including induction cooktops) that have been produced, traded, and imported before July 1, 2021 shall continue to circulate in the market but not more than eighteen months."
Article 2. Amending and supplementing Article 3 and Clause 2, Article 4 of Circular No. 08/2019/TT-BKHCN dated September 25, 2019 issued by the Minister of Science and Technology promulgating QCVN 19:2019/BKHCN National Technical Regulation on LED Lighting Products
1. AMENDING AND SUPPLEMENTING ARTICLE 3 AS FOLLOWS:
"Article 3. Transitional Provisions
1. Products specified in the Appendix attached to QCVN 19:2019/BKHCN that were produced or imported before the timeline specified in Clause 1, Article 4 of this Circular shall continue to circulate in the market until June 1, 2022.
2. Products specified in the Appendix attached to QCVN 19:2019/BKHCN that were produced or imported before the timeline specified in Clause 2, Article 4 of this Circular shall continue to circulate in the market until December 31, 2023."
2. Amending and supplementing Clause 2 of Article 4 as follows:
"2. As of January 1, 2023, products specified in the Appendix attached to QCVN 19:2019/BKHCN must meet all requirements stipulated in Section 2 (Technical Requirements) of QCVN 19:2019/BKHCN before circulating in the market."
Article 3. Implementation Provisions
1. This Circular takes effect from April 1, 2022.
2. The amended and supplemented provisions regarding electrical and electronic equipment specified in Article 1 and LED lighting products specified in Clause 2, Article 2 of this Circular shall be applied from January 1, 2022.
3. The Director of the General Department of Standardization, Metrology and Quality Control shall be responsible for organizing guidance and implementation of this Circular.
4. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and relevant organizations and individuals shall be responsible for implementing this Circular.
5. In the course of implementation, if any difficulties arise, agencies, organizations, and individuals shall promptly report in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements to ensure compliance./.
