Guidelines on positions of civil servant jobs in specialized inspection professions

Pursuant to the Civil Servants Law dated November 13, 2008 and the Law Amending and Supplementing Certain Provisions of the Civil Servants Law and the Public Officials Law dated November 25, 2019;

Pursuant to the Inspection Law on November 14, 2022;

Pursuant to Decree No. 50/2018/NĐ-CP dated April 9, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government stipulating positions of work and civil servant quotas;

Pursuant to Decree No. 43/2023/NĐ-CP dated June 30, 2023 of the Government detailing certain provisions and implementing measures of the Inspection Law;

After reaching consensus with the Ministry of Home Affairs; based on the proposal of the Director of the Cadre and Civil Servant Organization Department;

The General Inspector of the Government issues this Circular guiding positions of work for civil servants in specialized inspection professions.

Article 1. Scope of Regulation

This Circular guides the list of positions of work, job descriptions, and competency frameworks for positions of work for civil servants in specialized inspection professions.

Article 2. Applicability

This Circular applies to inspection agencies, including:

1. Inspection agencies according to administrative levels, including:

a) The Government Inspectorate;

b) Provincial and centrally-run city inspectorates;

c) District and town inspectorates under provinces and centrally-run cities;

d) Inspection agencies in special administrative-economic units.

2. Inspection agencies according to sectors and fields, including:

a) Ministries' inspectorates and inspectorates of agencies equivalent to ministries;

b) Inspectorates of general administrations and departments under ministries;

c) Inspection agencies within government confidential agencies;

d) Department inspectorates.

3. Inspection agencies within government bodies.

Article 3. Principles and bases for determining positions of work for civil servants in specialized inspection professions

1. Positions of work for civil servants in specialized inspection professions are determined based on the principles stipulated in Article 3 of Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government on positions of work and civil servant quotas (hereinafter referred to as Decree No. 62/2020/NĐ-CP).

2. The basis for determining positions of work for civil servants in specialized inspection professions shall be implemented in accordance with Clause 1, Article 4 of Decree No. 62/2020/NĐ-CP.

Article 4. List of positions of work, job descriptions, and competency frameworks for positions of work for civil servants in specialized inspection professions

1. The list of positions of work for civil servants in specialized inspection professions in the inspection agencies mentioned in Article 2 is specified in Appendix I attached hereto.

2. Job descriptions and competency frameworks for each position of work for civil servants in specialized inspection professions in the inspection agencies mentioned in Article 2 are specified in Appendices II.A, II.B, II.C, and II.D attached hereto.

3. The level framework for determining competencies for positions of work for civil servants in specialized inspection professions in the inspection agencies mentioned in Article 2 is specified in Appendix III attached hereto.

Article 5. Procedures for approving job positions; documents submitted, contents, and time limits for reviewing the job position proposal; adjustment of job positions

1. The procedure for approving positions of work is carried out in accordance with Article 7 of Decree No. 62/2020/NĐ-CP.

2. The submission dossier, contents, and time limit for reviewing the Position Work Plan Proposal are carried out in accordance with Article 8 of Decree No. 62/2020/NĐ-CP.

3. Adjustments to positions of work are carried out in accordance with Article 9 of Decree No. 62/2020/NĐ-CP.

Article 6. Implementation Organization

The inspection agencies mentioned in Article 2 of this Circular are responsible for developing their own Position Work Plans, submitting them to competent authorities for approval in accordance with Article 5 of this Circular and other relevant laws.

Article 7. Transitional Provisions

In cases where civil servants currently hold higher grades than those required by the positions of work stipulated in this Circular, they will retain their current grades until new guidelines are issued.

Article 8. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from December 18, 2023.

2. The Minister, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally-run city People's Committees, inspection agencies, and related individuals are responsible for implementing this Circular.

3. In case the legal normative documents cited in this Circular are amended, supplemented, or replaced, implementation shall follow the newly issued documents. Any difficulties or obstacles encountered during implementation should be reported to the Government Inspectorate for guidance or appropriate amendments and supplements.
