Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Based on Resolution No. 98/2019/QH14 dated November 27, 2019 of the National Assembly approving the Supplementary Agreement to the 1985 State Border Delimitation Treaty and the 2005 Supplementary Agreement and the Boundary Marker Agreement on the Land Border between the Socialist Republic of Vietnam and the Kingdom of Cambodia

Pursuant to the ASEAN Framework Agreement on Facilitation of Intra-Regional Land Transport signed on December 10, 2009;

The Government issues this Decree on management and development of industrial clusters.

Pursuant to resolution number 98/2019/QH14 dated November 27, 2019 of the National Assembly approving the Supplementary Treaty to the 1985 State Boundary Delimitation Treaty and the 2005 Supplementary Treaty and the Memorandum of Understanding on the demarcation and erection of boundary markers on the land border between the Socialist Republic of Vietnam and the Kingdom of Cambodia;

At the proposal of the Minister of Natural Resources and Environment

The Prime Minister issues this Decision on the support policy for organizations, households, and individuals affected in production and daily life when implementing boundary demarcation on the actual land border between the Socialist Republic of Vietnam and the Kingdom of Cambodia according to the provisions of Resolution No. 98/2019/QH14 dated November 27, 2019 of the National Assembly

Article 1. Scope of Regulation

1. This Decision stipulates the support policy for organizations, households, and individuals affected in production and daily life due to the transfer of land area currently being cultivated within the Vietnamese managed area exceeding (measured from the boundary line described in the Boundary Marker Agreement to the previously recognized actual management boundary line by both sides) when implementing boundary demarcation on the actual land border according to the Supplementary Agreement to the 1985 State Border Delimitation Treaty and the 2005 Supplementary Agreement and the Boundary Marker Agreement on the Land Border between the Socialist Republic of Vietnam and the Kingdom of Cambodia signed on October 5, 2019 and Resolution No. 98/2019/QH14 dated November 27, 2019 of the National Assembly

2. The support policy prescribed in this Decision shall apply to the four provinces along the land border between the Socialist Republic of Vietnam and the Kingdom of Cambodia, namely Tien Giang, Long An, An Giang, and Kien Giang Provinces

Article 2. Applicability

1. State agencies exercising the rights and responsibilities as representatives of the people's ownership over land, performing the unified state management tasks over land

2. Organizations, households, and individuals affected in production and daily life due to the transfer of land area currently being cultivated within the Vietnamese managed area exceeding (measured from the boundary line described in the Boundary Marker Agreement to the previously recognized actual management boundary line by both sides) when implementing boundary demarcation on the actual land border according to the Supplementary Agreement to the 1985 State Border Delimitation Treaty and the 2005 Supplementary Agreement and the Boundary Marker Agreement on the Land Border between the Socialist Republic of Vietnam and the Kingdom of Cambodia signed on October 5, 2019 and Resolution No. 98/2019/QH14 dated November 27, 2019 of the National Assembly

3. Other related entities

Article 3. Support policy for organizations, households, and individuals affected in production and living when implementing boundary demarcation on the actual land border between the Socialist Republic of Vietnam and the Kingdom of Cambodia.

Organizations, households, and individuals specified in Clause 2 of Article 2 of this Decision shall enjoy support equivalent to compensation, assistance, and resettlement for persons whose land is expropriated by the State for national defense, security purposes; economic and social development for national interests and public benefits according to the provisions of the Land Law at the time of approving the support plan.

Article 4. Organization of Implementation

1. The Ministry of Foreign Affairs shall take the lead and coordinate with relevant ministries, sectors, and People's Committees of the provinces of Tây Ninh, Long An, An Giang, and Kiên Giang to develop a Support Plan for organizations, households, and individuals affected in production and living when implementing boundary demarcation on the actual land border between the Socialist Republic of Vietnam and the Kingdom of Cambodia in accordance with Resolution No. 98/2019/QH14 dated November 27, 2019 of the National Assembly for approval by the Prime Minister.

2. The People's Committees of the provinces of Tây Ninh, Long An, An Giang, and Kiên Giang shall be fully responsible for the accuracy and completeness of information and data, and the organization and implementation within their jurisdiction, ensuring compliance with the target group, objectivity, fairness, transparency, and adherence to the law; they shall also be responsible for disseminating and widely promoting among the political system and the people, including organizations, households, and individuals affected in production and living when implementing boundary demarcation on the actual land border between the Socialist Republic of Vietnam and the Kingdom of Cambodia, aiming to create consensus and support during the implementation process.

Article 5. Effective Date

1. This Decision takes effect from January 17, 2024.

2. Based on the functions and tasks assigned, the Ministers of the Ministries of Foreign Affairs, Defense, Public Security, Finance, Natural Resources and Environment, Planning and Investment; the Chairmen of the People's Committees of the provinces of Tây Ninh, Long An, An Giang, and Kiên Giang, and related organizations, households, and individuals shall be responsible for implementing this Decision.
