Issuing three national technical regulations on
environmental quality

Pursuant to Decree No.Decision No. 08/2022/NĐ-CPJanuary 10, 2022 of the Government detailing implementation of certain provisions of the Environmental Protection Law and Decree No.05/2025/NĐ-CPJanuary 6, 2025 of the Government amending and supplementing certain provisions of Decree No. 08/2022/NĐ-CP dated January 10, 2022 of the Government detailing implementation of certain provisions of the Environmental Protection Law;
Pursuant to Decree No.Decision No. 127/2007/NĐ-CPAugust 1, 2007 of the Government detailing implementation of certain provisions ofLaw on Standards and Technical Regulationsand Decree No.78/2018/NĐ-CPMay 16, 2018 of the Government amending and supplementing certain provisions of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing implementation of certain provisions of the Law on Standards and Technical Regulations;
Pursuant to Decree No.Decision No. 35/2025/NĐ-CP issued on February 25, 2025 by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
At the proposal of the Director of the Environment Department, the Head of the Science and Technology Department;
The Minister of Agriculture and Rural Development issues this Circular to issue three national technical regulations on environmental quality.
Article 1. Attached to this Circular are three national technical regulations on environmental quality, including:
1. QCVN 26:2025/BNNMT - National technical regulation on noise;
2. QCVN 27:2025/BNNMT - National technical regulation on vibration;
3. QCVN 43:2025/BNNMT - National technical regulation on sediment quality.
Article 2. Effective Date
1. This Circular takes effect from November 14, 2025.
From the date this Circular takes effect, the following national technical regulations shall cease to be implemented:
a) QCVN 26:2010/BTNMT - National technical regulation on noise (issued together with Circular No. 39/2010/TT-BTNMT dated December 16, 2010 of the Minister of Natural Resources and Environment stipulating national technical regulations on environment);
b) QCVN 27:2010/BTNMT - National technical regulation on vibration (issued together with Circular No. 39/2010/TT-BTNMT dated December 16, 2010 of the Minister of Natural Resources and Environment stipulating national technical regulations on environment);
c) QCVN 43:2017/BTNMT - National technical regulation on sediment quality (issued together with Circular No. 78/2010/TT-BTNMT dated December 29, 2017 of the Minister of Natural Resources and Environment issuing national technical regulations on environment).
Article 3. Transitional Provisions
Facilities that have commenced operation, investment projects for which the competent authority has issued a decision approving the environmental impact assessment report or has accepted complete and valid application files for environmental impact assessment report review, issuance of environmental permit, or registration before the date this Circular takes effect may continue to apply QCVN 26:2010/BTNMT, QCVN 27:2010/BTNMT, and local government regulations until December 31, 2026.
Article 4. Implementation timeline
From the date this Circular takes effect, new investment projects (including new investment projects, expanded scale investment projects, increased capacity investment projects submitting application files for environmental impact assessment report review, issuance of environmental permit, or registration after the date this Circular takes effect) must comply with the provisions of QCVN 26:2025/BNNMT and QCVN 27:2025/BNNMT.
As of January 1, 2027, cases specified in Article 3 of this Circular must meet the requirements set forth in QCVN 26:2025/BNNMT and QCVN 27:2025/BNNMT.
It is encouraged that cases specified in Article 3 of this Circular apply the provisions of QCVN 26:2025/BNNMT and QCVN 27:2025/BNNMT from the date this Circular takes effect.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. Ministries, agencies equivalent to ministries, People's Committees at all levels, Departments of Agriculture and Rural Development of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular.
2. During the implementation of this Circular, if any difficulties arise, relevant agencies, organizations, and individuals must promptly report in writing to the Ministry of Agriculture and Rural Development for consideration and resolution./.
