CIRCULAR

DETAILING CERTAIN PROVISIONS OF THE GEOLOGY AND MINERALS LAW ON THE EXTRACTION OF GROUP IV MINERALS

Based on the Law on Geology and Minerals dated November 29, 2024;

Pursuant to the Law on Minerals dated November 17, 2010;

Pursuant to Decree No. 158/2016/NĐ-CP dated November 29, 2016 of the Government detailing the implementation of certain provisions of the Minerals Law;

Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director of the Vietnam Minerals Administration;

The Minister of Natural Resources and Environment promulgates this Circular detailing certain provisions of the Geology and Minerals Law on the extraction of Group IV minerals.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular details Point a Clause 1, Point d Clause 2, Point h Clause 4 Article 73, Clause 3 Article 74 of the Geology and Minerals Law on surveying and evaluating general information for Group IV minerals, reports on the results of Group IV mineral extraction activities; specifies the model of the mining permit for Group IV minerals, the model of documents in the application dossier for the mining permit for Group IV minerals, the model of the mining plan for Group IV minerals.

Article 2. Applicability

This Circular applies to state management agencies for geology and minerals; agencies, organizations, households, and individuals involved in activities related to the contents stipulated in Article 1 of this Circular.

Chapter II

SURVEYING AND EVALUATING GENERAL INFORMATION FOR GROUP IV MINERALS AND SAMPLE DOCUMENTS, MAPS, PLANS IN THE EXTRACTION OF GROUP IV MINERALS

Article 3. Surveying and evaluating general information for Group IV minerals

1. For areas not auctioned for mining rights, organizations and individuals shall conduct surveys and evaluations of general information for Group IV minerals according to the contents specified in Article 4 of this Circular after receiving written approval from the specialized agency on geology and minerals under the provincial People's Committee, except in cases provided for in Clause 3 of this Article.

2. For areas auctioned for mining rights, organizations and individuals winning the auction for mining rights shall conduct surveys and evaluations of general information for Group IV minerals according to the contents specified in Article 4 of this Circular after the competent state management agency approves the auction results for mining rights, except in cases provided for in Clause 3 of this Article.

3. Areas that are not required to conduct general information surveys and assessments for Group IV minerals include:

a) Areas with approved and recognized results of Group IV mineral exploration;

b) Areas where there are already survey and evaluation results of general information for Group IV minerals that meet the contents specified in Article 4 of this Circular.

The issuance of mining permits for Group IV minerals is based on the results of Group IV mineral exploration and previous general information surveys and assessments for Group IV minerals.

4. The organization and implementation of general information surveys and assessments for Group IV minerals shall be carried out as follows:

a) Individuals specified in Clauses 1 and 2 of this Article must enter into a contract with an organization having sufficient capacity to conduct surveys and evaluations of general information for Group IV minerals according to the contents specified in Article 4 of this Circular;

b) Organizations specified in Clauses 1 and 2 of this Article having sufficient capacity to conduct surveys and evaluations of general information for Group IV minerals according to the contents specified in Article 4 of this Circular may conduct such activities themselves or enter into a contract with an organization having sufficient capacity to conduct such activities. In case they do not have sufficient capacity, they must enter into a contract with an organization having sufficient capacity to conduct surveys and evaluations of general information for Group IV minerals according to the contents specified in Article 4 of this Circular;

c) The organization conducting surveys and evaluations of general information for Group IV minerals shall bear full responsibility under the law for the results of such surveys and evaluations.

5. Prior to conducting surveys and evaluations of general information for Group IV minerals, organizations and individuals must notify the specialized agency on geology and minerals under the provincial People's Committee and the People's Committee of the commune where the surveys and evaluations will be conducted of the time of implementation.

6. The results of surveys and evaluations of general information for Group IV minerals must be confirmed by the specialized agency on geology and minerals under the provincial People's Committee, except in cases provided for in Clause 2 of Article 72 of the Geology and Minerals Law.

Article 4. Content of survey and evaluation of general information for Group IV minerals

1. The contents of general information surveys and assessments for Group IV minerals, except in cases provided for in Clause 2 of this Article, are as follows:

a) Conduct topographic mapping at a scale of 1:2,000;

b) The geological route shall be carried out as follows: the maximum distance between routes is 400 meters; the density of survey points ranges from 200 to 300 points per kilometer.²Each geological survey point on-site must describe the geological characteristics, composition, structure, and determine the boundaries of product layers and mineral bodies (if any) to serve as the basis for determining the average thickness of product layers and mineral bodies within the survey area.

c) Construction of geological works (outcrops, pits, wells, or drilling) must determine coordinates and elevations according to the national coordinate system and elevation system, control the entire thickness of product layers and mineral bodies or control up to the planned mining elevation, and shall be carried out as follows: the maximum distance between construction lines is 400 meters, and the maximum distance between works on the same line is 200 meters. For areas with an area of less than 1.0 hectares and a distribution length not exceeding 500 meters, there must be at least one representative geological work to ensure control over product layers and mineral bodies.

d) Hydrogeological and engineering geological surveys, collection of hydrological data, determination of rainfall in the survey area for the most recent three years;

d) Collecting and processing samples including: trench samples, core drilling samples, heavy sand samples (for placer deposits), rock samples, moisture samples, loose samples, soil mechanical samples, and radioactivity activity samples;

e) Sample analysis includes: basic chemical component analysis for trench samples and core drilling samples, and ICP 36 element analysis (taken from the basic chemical sample storage part, at least 10% of the basic chemical samples) to determine the beneficial and harmful elements in product layers and mineral bodies, mineral component analysis, comprehensive physical and mechanical index analysis, determination of moisture content, expansion coefficient, and radioactivity activity. including: basic chemical component analysis for trench samples, drill core samples, and ICP 36 elements (taken from the basic chemical sample storage section, at least 10% compared to the basic chemical sample) to determine the composition of beneficial and harmful elements in product layers, mineral bodies; mineralogical component analysis, comprehensive physical and mechanical index analysis, determination of moisture content, loose expansion coefficient, and radioactivity activity determination;

g) At least one sample per geological work, with a maximum sample length of 10 meters.

2. For cases provided for in Clause 2 of Article 72 of the Law on Geology and Minerals, the contents of general information surveys and assessments for Group IV minerals are as follows:

a) Conduct topographic mapping at a scale of 1:2,000;

b) Construct at least one representative geological work (outcrop, pit, well, or drilling) to ensure control over product layers and mineral bodies or up to the planned mining elevation; the geological work must determine coordinates and elevations according to the national coordinate system and elevation system.

c) Sampling, processing, and analysis of samples: ICP 36 elements to determine the beneficial and harmful element components in product layers and ore bodies; radioactivity activity sample.

3. Geological work construction techniques shall be implemented in accordance with Circular No. 16/2020/TT-BTNMT dated December 18, 2020, issued by the Ministry of Natural Resources and Environment, which stipulates technical requirements for excavation works and geological and mineral sampling; procedures for collecting, processing, analyzing samples and quality control and handling shall be carried out in accordance with current regulations; the method for calculating mineral volume shall be applied according to the methods for calculating reserves and resources and selected appropriately based on the characteristics of product layers and mineral bodies to ensure reliability, measured in cubic meters.³.

Article 5. Approval of survey and evaluation of general information for Group IV minerals in areas without auctioning mining rights

1. The selection of organizations and individuals to approve survey and evaluation of general information for Group IV minerals in areas without auctioning mining rights shall be carried out in the following priority order:

a) Organizations and individuals meeting the financial capacity conditions stipulated in Point c Clause 2 Article 53 of the Minerals Law;

b) In cases where more than one organization or individual meets the conditions stipulated in Point a of this clause, priority shall be given to approving survey and evaluation of general information for Group IV minerals for the organization or individual whose application meets the conditions stipulated in Clause 2 of this Article and was submitted first.

2. For the case provided for in Clause 1, Article 72 of the Law on Geology and Minerals, the components of the application documents for approval to survey and evaluate general information on Group IV minerals include:

a) Original: A request for approval to survey and evaluate general information on Group IV minerals;

b) A certified copy or a copy accompanied by the original for comparison or an electronically certified copy from the original: Documentation proving the owner's capital as prescribed in Article 9 of Decree No. 158/2016/NĐ-CP dated November 29, 2016, issued by the Government detailing the implementation of certain provisions of the Minerals Law.

3. For the case provided for in Clause 2, Article 72 of the Law on Geology and Minerals, the components of the application documents for approval to survey and evaluate general information on Group IV minerals include:

a) Original: Request for approval of survey and evaluation of general information for Group IV minerals; introduction letter from the project investor, construction project, construction item, and emergency mobilization measures as stipulated in Points a and b Clause 2 Article 72 of the Geology and Mineral Law;

b) Certified copy or copy with original for comparison or certified electronic copy from the original: A document approving the selection as a contractor.

4. The procedures for approving surveying and evaluating general information on Group IV minerals are carried out as follows:

a) Organizations and individuals requesting approval of survey and evaluation of general information for Group IV minerals shall submit one set of documents in accordance with Clause 2 and Clause 3 of this Article to the specialized agency on geology and minerals under the provincial People's Committee. If the documents are complete, the specialized agency on geology and minerals under the provincial People's Committee shall accept the documents in accordance with regulations. If the documents are incomplete, they will not be accepted, and the reasons for non-acceptance will be clearly stated in the supplementary and completion request form in accordance with the Government's regulations on accepting administrative procedures.

b) Within no more than five working days from the date of receiving complete documents, the specialized agency on geology and minerals under the provincial People's Committee shall be responsible for checking the coordinates and area of the proposed survey and evaluation site and conducting on-site inspections (if necessary); if necessary, send a document to seek opinions from relevant agencies regarding prohibited mining areas and temporarily prohibited mining areas for the proposed survey and evaluation site.

The time of on-site inspection (if any) shall be decided by the specialized agency on geology and minerals under the provincial People's Committee but must be completed before approving the survey and evaluation of general information for Group IV minerals as stipulated in Point d of this clause.

c) Within no more than three working days from the date the specialized agency on geology and minerals under the provincial People's Committee sends the document seeking opinions as stipulated in Point b of this clause, the agency sought for opinions shall be responsible for responding in writing to related issues. After the deadline specified in this clause, if the agency sought for opinions does not provide a written response, it shall be deemed to have agreed and shall bear responsibility for the relevant contents in the mining permit application.

d) Within no more than one working day from the completion of the contents specified in points b and c of this clause, the specialized agency on geology and minerals under the provincial People's Committee shall approve or disapprove the survey and evaluation of general information for Group IV minerals and notify the organization or individual applying for approval of the results of the survey and evaluation of general information for Group IV minerals. In case of non-approval, a written response must be provided with clear reasons stated.

Article 6. Confirmation of Survey and Evaluation Results for Group IV Minerals

1. The application dossier for confirmation of survey and evaluation results for Group IV minerals includes the original: Request for confirmation of survey and evaluation results for Group IV minerals; report on the results of survey and evaluation of general information for Group IV minerals (in cases where paper applications are submitted, an electronic copy must be attached).

2. The procedures for confirming survey and assessment results for common information on Group IV minerals shall be carried out as follows:

a) The organization or individual applying for confirmation of survey and evaluation results for Group IV minerals shall submit one set of application dossier in accordance with Clause 1 of this Article to the specialized agency on geology and minerals under the provincial People's Committee. If the dossier is complete, the specialized agency on geology and minerals under the provincial People's Committee shall accept it according to regulations. If the dossier is incomplete, it will not be accepted, and the reasons for non-acceptance will be clearly stated on the supplementary request form in accordance with the Government's regulations on administrative procedures.

b) Within no more than ten days from the date of receiving the dossier, the specialized agency on geology and minerals under the provincial People's Committee shall be responsible for checking, reviewing the dossier, and assessing the contents of the report on the results of survey and evaluation of general information for Group IV minerals.

When necessary, the specialized agency on geology and minerals under the provincial People's Committee may seek opinions from experts and related agencies regarding the contents of the report on the results of survey and evaluation of general information for Group IV minerals. The time taken to seek opinions does not count towards the dossier assessment period.

c) Within no more than five working days from the date the specialized agency on geology and minerals under the provincial People's Committee issues a document seeking opinions in accordance with point b of this clause (if applicable), the agency sought for opinions shall provide a written response on relevant issues. After the deadline stipulated in this clause, if the agency sought for opinions does not provide a written response, it will be deemed to have agreed and shall bear responsibility for the relevant contents.

d) In cases where the contents of the report on the results of survey and evaluation of general information for Group IV minerals need to be supplemented or completed, the specialized agency on geology and minerals under the provincial People's Committee shall issue a document requesting supplementation or completion, specifying the required contents. The request for supplementation or completion shall only be made once. If the report on the results of survey and evaluation of general information for Group IV minerals does not meet the initial requirements after supplementation or completion, further supplementation or completion may be requested, but no new requirements shall arise.

In cases where, after re-supplementation or re-completion, the report on the results of survey and evaluation of general information for Group IV minerals still fails to meet the requirements, the specialized agency on geology and minerals under the provincial People's Committee shall suspend the assessment and return the application dossier for confirmation of survey and evaluation results for Group IV minerals. Organizations or individuals in such cases have the right to resubmit the dossier, which will be treated as a new submission.

đ) Within no more than two working days from the completion of the contents specified in points b, c, and d of this clause, the specialized agency on geology and minerals under the provincial People's Committee shall decide whether to confirm or not confirm the results of survey and evaluation of general information for Group IV minerals and notify the organization or individual applying for confirmation of the results of the survey and evaluation of general information for Group IV minerals. In case of non-confirmation, a written response must be provided with clear reasons stated.

Article 7. Templates for documents, maps, and plans in the exploitation of Group IV minerals

1. The application form in the dossier related to the exploitation of Group IV minerals shall be carried out as follows:

a) The application form requesting approval for surveying and evaluating general information on Group IV minerals as stipulated in Form No. 01 attached to this Circular;

b) The application form requesting confirmation of the results of surveying and evaluating general information on Group IV minerals as stipulated in Form No. 02 attached to this Circular;

c) The application form requesting issuance of a Mining Exploitation Permit; as stipulated in Form No. 03 attached to this Circular;

2. The map templates in the dossier for issuing a mining exploitation permit for Group IV minerals shall be carried out as follows:

a) The map shall be prepared according to the provisions of Form No. 04 attached to this Circular;

b) The maps shall be prepared based on the VN-2000 coordinate system.

3. Templates for permits, decisions, approval documents, and confirmation documents in the exploitation of Group IV minerals shall be carried out as follows:

a) The Mining Exploitation Permit for Group IV minerals as stipulated in Form No. 05 attached to this Circular;

b) The Mining Exploitation Permit for Group IV minerals (extension) as stipulated in Form No. 06 attached to this Circular;

c) The approval document for surveying and evaluating general information on Group IV minerals as stipulated in Form No. 07 attached to this Circular;

d) The confirmation document for the results of surveying and evaluating general information on Group IV minerals as stipulated in Form No. 08 attached to this Circular;

4. Report templates in the exploitation of Group IV minerals shall be carried out as follows:

a) The report on the results of mineral exploitation activities for Group IV minerals as stipulated in Form No. 09 attached to this Circular;

b) The report on the results of surveying and evaluating general information on Group IV minerals as stipulated in Form No. 10 attached to this Circular;

c) Before February 1st each year, organizations and individuals must submit annual periodic reports on the results of mineral exploitation activities for Group IV minerals to the specialized agencies on geology and minerals under the provincial People's Committees. In cases where there are requirements from state management agencies on minerals, organizations and individuals engaged in mineral activities must prepare ad hoc reports.

5. The exploitation plan for Group IV minerals shall be carried out as stipulated at Form No. 11 attached to this Circular.

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Effective Date

This Circular takes effect from January 15, 2025.

Article 9. Responsibility for Implementation

1. Ministries, ministerial-level agencies, government agencies, and all levels of People's Committees are responsible for directing the implementation of this Circular.

2. Specialized agencies on geology and minerals under provincial People's Committees are responsible for assisting the People's Committees in implementing this Circular locally.

3. Organizations and individuals concerned are responsible for implementing this Circular.
