DECREE
On the tasks, powers, and organization of the Government Price Board
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Decree No. 2/CP dated October 26, 1992 of the Government on the establishment of the Government Price Board;
At the proposal of the Chairman of the Government Price Board and the Minister, Head of the Government Organization-Civil Service Board;
DECREE:
Article 1.
The Government Price Board is an agency under the Government with the function of researching policies and assisting the Government in managing and directing price work nationwide.
Article 2.
The Government Price Board has the following tasks and powers:
1- Researching and drafting mechanisms, policies, and regulatory documents for state management of prices, measures to stabilize prices for submission to the Government for decision-making to serve the strategy of economic and social development.
2- Drafting projects for laws, ordinances, and other regulatory documents on prices for submission to the National Assembly, the Standing Committee of the National Assembly for promulgation or for the Government to promulgate within its authority. Participating in opinions on draft laws, ordinances, policies, and development projects related to pricing policies and regulations submitted by Ministries, agencies at the ministerial level, and government agencies to the Government.
Issuing guiding documents to implement the Government's regulations on price management, price registration, negotiation, and price display.
3- Reviewing price schemes proposed by Ministries, agencies at the ministerial level, and government agencies before the Government makes decisions; deciding certain commodity and service prices according to the delegation from the Prime Minister.
4- Coordinating with sectors and localities in investigating production costs, circulation costs, capital costs, and exchange rates for important goods and services; collecting, analyzing, and forecasting market price indices domestically and internationally to report to the Government for timely measures.
5- Organizing scientific research, information dissemination, and policy and legal education on price management; planning training and capacity building for price professionals. Implementing international cooperation in the field of prices in accordance with the Government's regulations.
6- Submitting to the Prime Minister for decision on the organizational structure to carry out national-level state management tasks on prices in line with the new economic management mechanism. Managing the organizational structure, staffing, and assigned facilities.
7- Guiding, inspecting, and supervising Ministries, agencies at the ministerial level, government agencies, provincial People's Committees directly under the Central Government, and enterprises belonging to various economic sectors, social organizations in complying with price management regulations; requesting Ministries, agencies at the ministerial level, government agencies, provincial People's Committees directly under the Central Government, units, and individuals to provide necessary materials and information for state management of prices; recommending measures to the Prime Minister to handle violations of Government regulations on price management by Ministries, agencies at the ministerial level, government agencies, and provincial People's Committees directly under the Central Government.
Article 3.
The organizational structure of the Government Price Board includes:
1- General Department.
2- Department of Production Input Prices.
3- Department of Industrial Consumer Goods and Service Prices.
4- Department of Agriculture, Forestry, and Aquatic Product Prices.
5- Price Inspection.
6- Office (including organizational and personnel affairs).
7- Institute of Market Price Science Research.
Other non-profit organizations shall be decided by the Chairman of the Government Price Board after consultation with the Government Organization-Civil Service Board and relevant government agencies.
Article 4.
The Government Price Board is headed by the Chairman, assisted by Deputy Chairmen. The Chairman and Deputy Chairmen of the Government Price Board are appointed and relieved of duty by the Prime Minister.
The Chairman of the Government Price Board is responsible to the Prime Minister for all activities of the Board. Deputy Chairmen assist the Chairman in directing certain aspects of work and are responsible to the Chairman.
Article 5.
This Decree takes effect from the date of issuance. The Decree No. 14-CP dated January 13, 1975 of the Council of Ministers on the Charter of the State Price Commission's organization and operation and other documents stipulating the functions and tasks of the State Price Commission contrary to this Decree are hereby abolished.
Article 6
The Chairman of the Government Price Board, Ministers, Heads of agencies at the ministerial level, government agencies, Chairmen of provincial People's Committees directly under the Central Government are responsible for implementing this Resolution./.
