On the procedures for applying to emigrate abroad

Pursuant to Point 1, Section III of the Joint Circular No. 04/TTLB dated June 2, 1988, issued by the Ministry of Interior and the Ministry of Foreign Affairs, the Ministry of Interior hereby specifies the procedures for Vietnamese citizens who wish to emigrate abroad as follows:

1. Place to apply for emigration:

Those who wish to emigrate abroad must complete all procedures at the Public Security Office of the province, city, or special administrative region directly under the central government where they reside (the place to receive applications and procedures at each locality shall be determined by the Public Security Office of the province, city, or special administrative region directly under the central government).

2. Procedures for applying for emigration:

- Two application forms for emigration (to be filled out by the head of household);

- Each person aged 14 years or older must fill out two personal registration forms for emigration (according to the model). If under 14 years old and without an accompanying person aged 14 or older, then the father, mother, or direct caregiver must fill out the form and declaration on their behalf;

- A sponsorship letter from relatives;

- An entry permit or promise of entry from the receiving countries (if available);

- Each person must submit six newly taken passport photos measuring 4x6 cm with a frontal view and bare head;

In particular cases where the receiving country's government requests, it is not mandatory to have a sponsorship letter, entry permit, or promise of entry;

- Submit relevant certificates proving eligibility according to the provisions of Section 1 of the Circular;

- For those currently serving as state employees, when submitting the application for emigration, they must include the opinion of the immediate supervisor managing such personnel (the supervisor has the authority to decide on termination of employment or dismissal of such personnel);

- Submit three pre-addressed envelopes with postage stamps attached along with the application;

- Pay the prescribed fee.

Note: All documents submitted to the public security agency for emigration purposes that are in a foreign language must be accompanied by an official translation into Vietnamese.

3. Notification of the result of the emigration application:

- The provincial, municipal, or special administrative region public security office directly under the central government is responsible for notifying the results to applicants for emigration.

- Hand over passports or substitute travel documents if granted permission to emigrate. In cases where the receiving country requires prior contact before granting entry, the applicant will be informed of the preliminary review result. Once the receiving country officially grants entry, the passport will be handed over for the applicant to proceed with departure formalities.

- Notify the reasons for denial of emigration.

- In cases deemed necessary, the Department of Foreigners Management and Emigration and Immigration under the Ministry of Interior may issue passports to the applicant at its office or directly notify the review result.

4. Other provisions:

For those who have been granted passports or substitute travel documents by the Ministry of Interior and whose entry has been approved by the receiving countries, they must complete other related procedures such as property settlement, tax clearance, debt repayment, etc., before leaving Vietnam.

Any previous provisions contrary to this provision are hereby abolished.
