OF THE STATE BANK OF VIETNAM
Guidelines for implementing Decree No. 02/CP dated January 5, 1995 of the Government on goods and services prohibited from commercial trade and goods and services subject to conditions for commercial trade in the domestic market concerning gold trading activities On January 5, 1995, the Government issued Decree No. 02/CP stipulating goods and services prohibited from commercial trade and goods and services subject to conditions for commercial trade in the domestic market. According to Appendix 2 of Decree No. 02/CP, gold falls under goods and services subject to conditions for commercial trade. The State Bank guides the issuance of certificates of eligibility for gold trading and certificates of eligibility for gold processing and manufacturing as follows:

1. For enterprises with a need to engage in gold trading, branches of the State Bank of provinces and cities shall base their decisions on points a, b, and c of Clause 2, Section II of Circular No. 07/NH-TT dated October 29, 1993 of the State Bank guiding the implementation of Decree No. 63/CP of the Government on state management over gold trading activities to consider issuing Certificates of Eligibility for Gold Trading.
2. For individuals with technical skills at level four or higher who have a need to process and manufacture gold (but do not have the necessary conditions to establish an enterprise), they shall be based on the provisions of Clause 6, Section II of Circular No. 07/NH-TT dated October 29, 1993 to consider issuing Certificates of Eligibility for Gold Processing and Manufacturing.
3. Procedures for issuing Certificates of Eligibility for Gold Trading shall be carried out according to Clause 3, Section II of Circular No. 07/NH-TT (except for the provision regarding applications for gold trading licenses, which are now changed to applications for Certificates of Eligibility for Gold Trading according to the attached model).
4. Procedures for issuing Certificates of Eligibility for Gold Processing and Manufacturing shall be carried out according to Clause 6, Section II of Circular No. 07/NH-TT (except for the provision regarding applications for gold processing and manufacturing, which are now changed to applications for Certificates of Eligibility for Gold Processing and Manufacturing).
5. Fees for issuing Certificates of Eligibility for Gold Trading and Certificates of Eligibility for Gold Processing and Manufacturing shall be implemented according to point a, Clause 1, Article 2 of the Regulations of the State Bank on collecting various fees and charges in gold and precious stone trading activities (annexed to Decision No. 61/QĐ-NH7 dated April 7, 1994 of the Governor of the State Bank).
6. Enterprises and individuals who have been granted Gold Trading Licenses and Gold Processing and Manufacturing Licenses before the issuance of this Circular must now exchange them for Certificates of Eligibility for Gold Trading and Certificates of Eligibility for Gold Processing and Manufacturing issued by the Director of the State Bank Branches of provinces and cities. Procedures for exchanging Licenses for Certificates of Eligibility for Gold Trading and Certificates of Eligibility for Gold Processing and Manufacturing shall be carried out according to the unified model specified in Appendix 1 attached to the original License and sent to the Director of the State Bank Branch.
7. The period for exchanging Licenses shall commence from the date of issuance of this Circular until September 30, 1996. Beyond the aforementioned period, enterprises and individuals who wish to continue engaging in gold trading and gold processing and manufacturing must reapply according to the provisions of Points 3 and 4 of this Circular.
8. Issuance of Certificates of Eligibility for Gold Trading and Certificates of Eligibility for Gold Processing and Manufacturing (including exchanges of Licenses for Certificates) shall be completed within twenty days from the date of receipt of complete and valid application files from enterprises and individuals. Within this period, the Director of the State Bank Branches of provinces and cities must respond to enterprises and individuals regarding the issuance or non-issuance of Certificates of Eligibility for Gold Trading and Certificates of Eligibility for Gold Processing and Manufacturing.
This Circular takes effect from the date of signature. All previous regulations contrary to this Circular are hereby abolished.
