CIRCULAR

Guidelines for Implementing Decree No. 15/CP dated March 19, 1996 of the Government on the Management of Livestock Feed

 

In implementing Decree No. 15/CP dated March 19, 1996 of the Government on the Management of Livestock Feed, the Ministry of Fisheries provides detailed guidelines on the management of aquatic animal feed as follows:

 

I. IN THIS CIRCULAR, THE FOLLOWING TERMS ARE UNDERSTOOD AS FOLLOWS:

1. Aquatic animal feed referred to in this Circular means a product that has been industrially processed from plant, animal, microbial, chemical, or mineral sources, providing nutrients necessary for the survival, growth, development, and reproduction of aquatic animals.

2. Complete mixed feed for aquatic animals refers to pelletized feed (pieces or pellets collectively called pellets) made from various single feeds formulated to ensure all necessary nutrients for maintaining the life, growth, development, and reproduction of farmed aquatic animals without requiring additional feed. The size of the pellets must be suitable for each stage of the cultured species. The feed should have buoyancy or sinking characteristics appropriate to the feeding habits of each species.

 

II. REGISTRATION FOR PRODUCTION AND DISTRIBUTION

1. Domestic and foreign organizations and individuals producing and trading aquatic animal feed within the territory of Vietnam must meet the following conditions:

a. They must have production sites, factories, testing equipment, and production processes that comply with quality standards and environmental hygiene requirements.

b. They must have technical staff who meet the technological requirements for production and quality testing of aquatic animal feed.

2. Situations requiring registration for production and distribution of aquatic animal feed include:

a. New feed products being produced for the first time.

b. Feed products previously registered but now changed in name, nutrient content, formula, product form, packaging, or brand.

c. Feed products manufactured abroad but now seeking registration for production in Vietnam.

d. Feed products manufactured abroad but intended for sale in Vietnam through authorized agents or branches.

3. Documents required for registration of production and distribution of aquatic animal feed:

a. Application for registration of production and distribution of aquatic animal feed according to the model (Annex 1).

b. Production and trading permit issued by the competent authority (photocopy certified true copy).

c. Quality registration certificate for goods according to Model 01 TS/ĐKCL issued by Decision No. 14/KHCN dated January 9, 1997 of the Minister of Fisheries (if the feed falls under the list of goods required to be quality registered).

4. Each registration certificate may allow the production and distribution of one or more types of aquatic animal feed.

5. The result of the registration will be notified no later than seven days from the date the registration authority receives a complete application.

 

III. PRODUCTION AND DISTRIBUTION OF AQUATIC ANIMAL FEED

1. The list of permitted and prohibited types of aquatic animal feed for production and distribution in Vietnam is specified in Annex 2 of this Circular. Specific names of permitted feed types for circulation will be announced and updated annually by the Ministry of Fisheries.

2. Aquatic animal feed can only be produced and distributed after obtaining registration from the competent authorities as stipulated in Section V of this Circular.

3. Each batch of aquatic animal feed upon leaving the factory must undergo testing and samples must be retained for six months for monitoring purposes, while test records must be kept at the facility for a minimum of three years.

4. Strictly forbidden is the production and distribution of aquatic animal feed not listed in the permitted list, substandard feed, expired feed, feed of unknown origin, feed without quality inspection marks, unregistered feed, or feed whose registration has been revoked.

5. Production and distribution sites for aquatic animal feed must display a sign with the business name or store name registered. The sign must be clear and placed where it is easily visible.

6. Commercial aquatic animal feed must have packaging and labels according to the registered standards.

7. Label contents must be written in Vietnamese, and may also be written in another language, but the font size of the other language must be smaller than that of Vietnamese and placed below the Vietnamese text. Labels must contain the following information:

a. For complete mixed feed and concentrated feed:

Name of the organization or individual producing the feed.

Place of production.

Trade name of the feed.

Quality registration number.

Net weight.

Names and proportions of major nutritional components (crude protein, fat, fiber, calcium, phosphorus, solubility, moisture...).

Suitable for which aquatic species, size of cultured species, method of use.

Date of production.

Expiry date.

Storage instructions.

b. For supplementary feed: The label must include all the information as for complete mixed feed and concentrated feed, and must also specify the names and proportions of the supplements.

8. Transportation must ensure safety, preventing contamination of aquatic animal feed with harmful substances, bacteria, or changes that affect feed quality.

9. Storage locations and retail stores for aquatic animal feed must have warehouses to maintain feed quality, aquatic veterinary hygiene, and environmental conditions. No items such as chemical fertilizers, pesticides, gasoline, oil... that could damage or affect the quality of aquatic animal feed should be stored.

10. Any new type of aquatic animal feed developed by organizations or individuals must undergo trial farming and can only be produced commercially after approval by the Ministry of Fisheries.

11. Organizations and individuals producing aquatic animal feed must report their production status quarterly and annually to the registration authority.

 

IV. EXPORT AND IMPORT OF FEED AND RAW MATERIALS FOR

AQUATIC ANIMAL FEED

1. Import.

a. Importation of various types of feed and raw materials for aquatic animal feed shall be carried out in accordance with the specialized import and export regulations for aquatic products issued by the Ministry of Fisheries.

b. Imported feed and raw materials for aquatic animal feed can only be circulated after meeting one of the following two conditions:

Has been inspected and issued a State certificate for quality.

Has been inspected and issued a quarantine certificate for aquatic products.

c. Types of feed for aquatic animals being introduced to Vietnam for the first time must undergo testing. The Ministry of Fisheries will designate research agencies under the Ministry to conduct the tests. All testing costs shall be borne by the consignor. Based on the test results, the Ministry of Fisheries will consider allowing circulation in the market.

2. Export.

All types of feed for aquatic animals listed in the permitted production and business catalog, ensuring quality according to registered standards and having been issued a State certificate for quality (for types of feed that are required to be inspected and issued a State certificate for quality) may be exported.

The export of feed for aquatic animals shall be carried out in accordance with the annual import and export mechanism prescribed by the Ministry of Trade for general goods exports.

 

V. STATE MANAGEMENT OF FEED FOR AQUATIC ANIMALS

1. Central level.

The Ministry of Fisheries uniformly manages state affairs concerning feed for aquatic animals. The Ministry of Fisheries assigns the Fisheries Resource Protection Agency to be the leading agency to implement this work. The Agency has the following tasks:

Lead and coordinate with relevant Departments to research and draft guiding documents for the management of feed production and business for aquatic animals to be issued by the Ministry or submitted to the Government for issuance. - Issue registration certificates for production and business of various types of feed for aquatic animals to foreign-invested enterprises (joint ventures or wholly foreign-owned companies), units directly under the Ministry of Fisheries, central sectors producing and trading feed for aquatic animals, and branches of foreign companies selling such feed in Vietnam.

Implement or delegate to the Fisheries Resource Protection Sub-Agencies to organize the registration of quality for various types of feed for aquatic animals produced in Vietnam or produced abroad but registered for consumption in Vietnam according to the Registration Regulation for Quality of Specialized Aquatic Products issued by Decision No. 14/QD-KHCN dated January 9, 1997 of the Minister of Fisheries.

Organize inspection and issue State certificates for quality of feed for aquatic animals for export and import according to the Inspection and Certification Regulation for Quality of Aquatic Products issued by Decision No. 1184/QD-KHCN dated February 21, 1996 of the Minister of Fisheries.

Inspect and issue quarantine certificates for aquatic products for feed and raw materials for feed not included in the list of goods that must be inspected and certified for quality.

Organize supervision and inspection of state management of feed for aquatic animals nationwide.

Coordinate with Departments and competent agencies to propose the list of feed types allowed to be produced and traded and feed types prohibited from being produced and traded to be announced annually by the Ministry.

The Department of Science and Technology leads and coordinates with the Fisheries Resource Protection Agency and related agencies to develop quality standards, production procedures, and regulations for feed for aquatic animals to be proposed for issuance by the Ministry of Fisheries or the Ministry of Science and Industry and Environment.

2. Provincial level.

The Fisheries Department or the Department of Agriculture and Rural Development (where there is no Fisheries Department) advises the People's Committee of the province or centrally-administered city to perform state management functions regarding feed for aquatic animals within their jurisdiction and direct the Fisheries Sub-Agency or the aquatic resource protection agency to carry out the following tasks:

Develop guiding documents for the implementation of state management of feed for aquatic animals at the local level.

Issue registration certificates for production and business of various types of feed for aquatic animals produced and traded within the jurisdiction of the locality.

Issue registration certificates for quality of feed for aquatic animals according to the Registration Regulation for Quality of Specialized Aquatic Products issued by Decision No. 14-QD/KHCN dated January 9, 1997 of the Minister of Fisheries.

Organize inspection and issue State certificates for quality of feed for aquatic animals listed in the catalog requiring inspection and certification of quality within the jurisdiction of the locality.

Inspect and issue quarantine certificates for aquatic products for feed and raw materials for feed within the jurisdiction of the locality.

Supervise, inspect, and handle violations of state management of feed for aquatic animals at facilities managed by the locality or by the central government (when authorized).

b. For localities without a Fisheries Resource Protection Agency, the Fisheries Resource Protection Agency directs the Departments of Agriculture and Rural Development to carry out the above tasks.

 

VI. REWARD AND DISCIPLINARY MEASURES

1. Organizations, individuals, and state officials who have achieved success in implementing Decree No. 15/CP of the Government issued on March 19, 1996 will be rewarded according to current regulations.

2. Organizations, individuals, and state officials who violate the provisions of Decree No. 15/CP of the Government and related regulations, depending on the extent of damage, will be subject to administrative penalties and must compensate for material losses in accordance with the law.

 

VII. IMPLEMENTATION PROVISIONS

This Circular takes effect from the date of signature. Previous regulations contrary to this Circular are abolished.

Departments, Agencies, Institutes, and Research Centers under the Ministry of Fisheries and Fisheries Departments, Departments of Agriculture and Rural Development shall guide, urge, and supervise the implementation of this Circular according to their functions and authorities.

Any issues encountered during implementation should be reported promptly to the Ministry of Fisheries for revision and supplementation./.
