DIRECTIVE

On strengthening the management of state assets in the administrative and public service sectors following the comprehensive inventory and revaluation of fixed assets pursuant to

Decision No. 466/TTg dated July 2, 1997.

In recent years, along with the development of the national economy and society, state assets in the administrative and public service sectors have continuously increased and have met the requirements of administrative management and public service activities, contributing to enhancing the efficiency of work at agencies and organizations. Through the comprehensive inventory and revaluation of fixed assets in the administrative and public service sectors at 00:00 on January 1, 1998, according to Decision No. 466/TTg dated July 2, 1997 of the Prime Minister, it is evident that the amount of fixed assets of the State entrusted to administrative and public service agencies for management and use is very large, but the management has been somewhat lax and lacking in strictness; in many places, the use is wasteful, not in accordance with the purpose, inefficient, and even leading to significant loss and damage of State assets.

To address the above issues and ensure the management and use of State assets in accordance with regulations, effectively and economically, contributing to the implementation of the Decree on thrift and anti-waste, the Prime Minister instructs:

1. Heads of state management agencies, public service agencies, political organizations, political-social organizations, social organizations, and occupational social organizations (referred to collectively as administrative and public service agencies), based on the results of the inventory and revaluation of fixed assets at 00:00 on January 1, 1998, shall record assets in accordance with the current accounting system for administrative and public service agencies; register state-owned assets such as buildings, land, other construction works attached to land, means of transportation, and other fixed assets of significant value with the financial authority in accordance with Article 9 of Government Decree No. 14/1998/NĐ-CP dated March 6, 1998 on the management of state assets and the guidance of the Ministry of Finance; promptly report to competent state authorities to handle assets being used for purposes not in accordance with standards and usage norms prescribed by the State, unused assets, or assets that are no longer usable.

2. Ministers, heads of ministerial-level agencies, government-affiliated agencies, central mass organizations, Chairmen of provincial and centrally-administered city People's Committees shall be responsible for:

- Deciding on the handling of cases where state assets are used for purposes not in accordance with standards and usage norms and assets requiring liquidation as stipulated in Articles 13 and 15 of Government Decree No. 14/1998/NĐ-CP dated March 6, 1998; reporting the results of handling fixed assets after the inventory of their ministries, sectors, and localities to the Ministry of Finance before June 30, 1999 for consolidation and submission to the Prime Minister; simultaneously proposing the handling of assets after the inventory that fall outside the jurisdiction of their ministries, sectors, and localities to the Ministry of Finance for consideration and decision-making within its authority or submission to the Prime Minister for decision-making;

- Determining the investment and procurement needs for administrative and public service agencies under their management that lack assets compared to the standards and usage norms prescribed by the State, and incorporating them into the annual state budget in accordance with the Law on State Budget;

- Directing and inspecting the management and use of fixed assets of administrative and public service agencies under their management to ensure the allocation and use of state assets in accordance with their intended purposes, standards, and usage norms prescribed by the State.

3. The Ministry of Finance shall provide guidance on the handling of assets after the inventory and revaluation of fixed assets, decide within its authority or submit to the Prime Minister for decision-making based on proposals from ministries, sectors, and localities; coordinate with relevant ministries and sectors to urgently implement tasks as prescribed in Government Decree No. 14/1998/NĐ-CP dated March 6, 1998 on the management of state assets.

4. Ministers, heads of ministerial-level agencies, government-affiliated agencies, central mass organizations, Chairmen of provincial and centrally-administered city People's Committees are responsible for implementing this Directive./.
