Regarding the issuance of Agricultural Planning and Rural Development Prices

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 73-CP dated November 1, 1995 of the Government on the issuance of functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government promulgating the Investment Management and Construction Regulation; Decree No. 88/1999/NĐ-CP dated September 1, 1999 of the Government promulgating the Bidding Regulation;

Pursuant to Agreement No. 3337/BXD-VKT dated December 23, 1999 of the Ministry of Construction on the issuance of "Agricultural and Rural Planning Prices";

At the proposal of the Director of the Department of Planning and Planning;

DECISION:

Article 1. Attached to this Decision is the set of Agricultural and Rural Planning Prices.

Article 2. The Agricultural and Rural Planning Prices shall be used as a basis for selecting bids for consultancy services in Design Planning, signing economic contracts, and paying investigation and project planning costs for Agricultural and Rural Planning throughout the country.

Article 3. This Decision shall take effect from the date of signing.

All previous Agricultural and Rural Planning Price tables that conflict with this Decision are hereby abolished.

Article 4. The Heads of the Ministry's Office, Heads of relevant Departments, Heads of subordinate units under the Ministry, Directors of Provincial Departments of Agriculture and Rural Development are responsible for implementing this Decision./.

Agricultural and Rural Planning Prices

Part 1:

GENERAL PROVISIONS AND GUIDELINES FOR APPLICATION

1. The Agricultural and Rural Planning Prices specified in this price set are the maximum prices serving as a basis for tender selection of planning organizations.

2. Scope of application: applicable to Agricultural and Rural Planning projects funded by the following sources:

- State budget funds;

- State-guaranteed credit funds, state investment development credit funds;

- Self-raised capital for state-owned enterprise development investments, commercial credit not guaranteed by the state.

3. This price set specifies the following types of Agricultural and Rural Planning products:

- Comprehensive Agricultural and Rural Planning.

- Agricultural Sector Planning.

- Agricultural Land Evaluation Planning.

4. Management review and approval costs for Agricultural and Rural Planning: calculated as a percentage of the cost of preparing Agricultural and Rural Planning.

5. Basis for establishing Agricultural and Rural Planning prices:

5.1. Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government on the issuance of the Investment Management and Construction Regulation.

5.2. General Agricultural and Rural Sector Planning Process 10TCN 345-98 of the Ministry of Agriculture and Rural Development in 1999.

5.3. Agricultural Sector Planning Process 10TCN 344-98 of the Ministry of Agriculture and Rural Development in 1999.

5.4. Land Evaluation Process for Agricultural Use 10TCN 343-98 of the Ministry of Agriculture and Rural Development in 1999.

5.5. State regulations on wage systems and material prices at the end of the fourth quarter of 1999.

6. The Agricultural and Rural Planning prices specified in Part II of this price set include the following expenses: materials, labor, machinery and equipment, social insurance, health insurance, union fees, management costs, pre-tax income (Agricultural and Rural Planning prices do not include value-added tax).

7. Agricultural and Rural Planning prices including value-added tax are determined based on the Agricultural and Rural Planning prices without value-added tax plus the current value-added tax rate.

8. The Agricultural and Rural Planning prices do not include costs for surveying, mapping topographic maps, geological surveys, mineral resources, hydrology, water quality. If these works are carried out, the prices of other industries according to current regulations may be applied.

9. The content and products of Agricultural and Rural Planning projects are defined in agricultural and rural sector standards such as:

10. The Agricultural and Rural Planning prices stipulated in this document are determined based on the following standard conditions:

10.1. Planning area boundary: within one administrative unit requiring planning (commune, district, province, national economic-ecological region).

10.2. Terrain type: plain region.

10.3. Ratio of agricultural land area to total natural land area of the planning region:

+ Plain: 80%

+ Midland: 25%

+ Mountainous: 8%

11. The Comprehensive Agricultural and Rural Planning prices and Agricultural Sector Planning prices will be adjusted in the following cases:

11.1. The planning area boundary lies within two or more administrative units requiring planning (commune, district, province, national economic-ecological region): K = 1.05.

11.2. Terrain type:

- Midland region: K = 1.1;

- Mountainous region: K = 1.2.

11.3. The ratio of agricultural land area to total natural land area of the planning region exceeds the levels specified in Point 10.3: K = 1.05.

12. When preparing Comprehensive Agricultural and Rural Planning projects and Agricultural Sector Planning projects with scales not matching those specified in the price tables in Part II (Table 1, Table 2), the project preparation costs, management, review, and approval costs for planning shall be determined based on interpolation methods based on the scale, price level, or cost level closest to the corresponding table of the planning project type. The specific calculation formula is as follows:

Q_a : Quy mô cận dưới quy mô cần tính (ha);

Q_x : Quy mô Quy hoạch tổng thể Nông nghiệp - Nông thôn, Quy hoạch ngành hàng Nông nghiệp cần tính (ha).

12.2. Giá lập dự án Quy hoạch tổng thể Nông nghiệp - Nông thôn, Quy hoạch ngành hàng nông nghiệp ngoài quy định ở các bảng giá (bảng 1, bảng 2):

Trong đó:

G_y: Giá lập Dự án Quy hoạch tổng thể Nông nghiệp - Nông thôn, Quy hoạch ngành hàng Nông nghiệp cho quy mô cần tính (triệu đồng);

Q_y: Quy mô dự án cần quy hoạch (ha);

G_a: Giá lập Dự án Quy hoạch tổng thể Nông nghiệp - Nông thôn, Quy hoạch ngành hàng Nông nghiệp cùng loại quy mô lớn nhất trong bảng giá (nếu Q_y > Q_a) hoặc của quy mô nhỏ nhất trong bảng giá (nếu Q_y < Q_a) (triệu đồng);

Q_a: Quy mô Dự án Quy hoạch tổng thể Nông nghiệp - Nông thôn, Quy hoạch ngành hàng Nông nghiệp cùng loại cao nhất (nếu Q_y > Q_a) hoặc quy mô cùng loại nhỏ nhất (nếu Q_y < Q_a) (ha).

12.3. Nội ngoại suy về tỷ lệ chi phí quản lý, thẩm định, xét duyệt dự án quy hoạch Nông nghiệp - Nông thôn được tính tương tự theo phương pháp trên.

13. Đối với những Dự án quy hoạch Nông nghiệp và Nông thôn chưa được quy định trong Văn bản này thì chi phí Quy hoạch nông nghiệp và Nông thôn được xác định bằng cách lập dự toán trình cấp có thẩm quyền phê duyệt
