Circular No. 02/2003/TT-BCA(C11) Regarding the Supplement to Certain Provisions of Circular No. 01/2002/TT-BCA(C11) dated January 4, 2002, of the Ministry of Public Security on Guidelines for the Organization of Vehicle Registration and Issuance of Number Plates for Motor Vehicles

CIRCULAR

Regarding the supplementation of certain provisions of Circular No. 01/2002/TT-BCA(C11)dated January 4, 2002

of the Ministry of Public Security on guiding the organization of registration and issuance of license platesfor road motor vehicles

Implementing Resolution No. 13/2002/NQ-CP dated November 19, 2002 of the Government on measures to curb the increase and gradually reduce traffic accidents and traffic congestion, the Ministry of Public Security amends and supplements certain provisions of Circular No. 01/2002/TT-BCA(C11) dated January 4, 2002 on guiding the organization of vehicle registration and issuance of license plates for road motor vehicles as follows:

1. Point 1.1 Part I on "scope, subjects of application" is supplemented as follows:

For trailers and semi-trailers of domestic and foreign organizations and individuals residing or having offices within the territory of the Socialist Republic of Vietnam must be registered and have license plates attached according to the provisions of Circular No. 01/2002/TT-BCA(C11) dated January 4, 2002 and the amendments and supplements provided in this Circular.

2. Section A Part II on "documents of the vehicle owner when registering the vehicle" is amended and supplemented as follows:

When registering motorcycles or motorbikes, the person named in the registration must have a permanent residence registration in the province or city where the vehicle is being registered. In particular, vehicle owners who are officers or soldiers in the armed forces (Police, Military) still follow Circular No. 01/2002/TT-BCA(C11) dated January 4, 2002. Each person may only register one motorcycle or motorbike.

The registration file must include copies of the following documents (when submitting copies, the original must be presented for verification):

+ Driver's license as prescribed (except for vehicle owners who are organizations);

+ Compulsory civil liability insurance certificate for motor vehicles.

3. Point 1 Section B Part II on "procedures for vehicle registration" is supplemented with point 1.5 as follows:

- Proof of payment of various fees and charges for vehicle registration as prescribed by the Ministry of Finance.

4. Point 4.1 Section B Part II on "proof of origin of imported vehicles" is supplemented as follows:

For trailers and semi-trailers imported from abroad, the proof of registration and issuance of license plates is: the import declaration form for goods as prescribed by the Ministry of Finance.

5. Point 4.2 Section B Part II on "proof of origin of domestically produced and assembled vehicles" is supplemented as follows:

For trailers and semi-trailers produced and assembled domestically and registered with license plates, there is no need for an origin declaration form as prescribed by the Ministry of Finance.

6. Point 3.1 Part V on "regulations on license plates" is now supplemented as follows:

- For trailers and semi-trailers, the license plate must be affixed to the rear of the vehicle (only one square type license plate like cars, marked with the letter R).

7. Vehicle registration certificate for trailers and semi-trailers: shall use the model of the vehicle registration certificate for cars as prescribed by the Ministry to issue for trailers and semi-trailers.

8. Implementation:

This Circular takes effect 15 days after the date of signature. Other contents not mentioned in this Circular continue to be implemented according to the provisions of Circular No. 01/2002/TT-BCA(C11) dated January 4, 2002 of the Ministry of Public Security.

The General Administration of Police will direct and inspect the implementation of this Circular. The Highway Police Corps - Railways Police Bureau will guide, inspect, and urge traffic police forces to implement this Circular and other relevant laws and regulations concerning vehicle registration and management of road motor vehicles properly./.
