GUIDELINES FOR IMPLEMENTING RESOLUTION NO. 522B/NQ-UBTVQH13 OF THE NATIONAL ASSEMBLY STANDING COMMITTEE ON UNIFORMS AND PROSECUTOR ID CARDS FOR PROSECUTION OFFICIALS

Pursuant to the Law on the Organization of the People's Procuracy 2002;

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

To implement Resolution No. 522b/NQ-UBTVQH13 dated August 16, 2012 of the National Assembly Standing Committee on uniforms for prosecution officials and Prosecutor ID cards;

The Supreme Procurator and the Minister of Finance issue this Joint Circular guiding the implementation of Resolution No. 522b/NQ-UBTVQH13 dated August 16, 2012 of the National Assembly Standing Committee on uniforms for prosecution officials and Prosecutor ID cards as follows:

Article 1. Scope of application

1. The subjects eligible to be issued uniforms for use when performing official duties are officers, civil servants, and employees of the People's Procuracy.

2. The subjects eligible to be issued Prosecutor ID cards for use when performing official duties are officers and civil servants appointed to the position of Prosecutor.

Article 2. Standards and service life of uniforms

1. The service life of uniforms issued according to Clause 1, Article 1 of Resolution No. 522b/NQ-UBTVQH13 dated August 16, 2012 of the National Assembly Standing Committee is specified as follows:

2. Uniforms issued once

Uniforms issued once are specified in Clause 2, Article 1 of Resolution No. 522b/NQ-UBTVQH13 dated August 16, 2012 of the National Assembly Standing Committee, specifically as follows:

a) Emblem of the Prosecution;

b) Cap;

c) Single pine branch insignia attached to the collar of the formal attire;

d) Ribbon for medal attachment (for formal attire during major ceremonies);

đ) Insignia set attached to the collar of regular attire;

e) Rank insignia set attached to the shoulder;

g) Nameplate and position plate.

Article 3. Principles for issuing and using uniforms

1. Issuing and using uniforms must be in accordance with their intended purpose, the designated recipients, and the prescribed service life. Provincial and centrally-administered city People's Procuracies and direct budgetary units under the Supreme Procuracy must maintain records to manage the issuance and use of uniforms for each officer, civil servant, and employee accurately and in compliance with regulations.

2. If issued uniforms are damaged, they will be replaced. If issued uniforms are lost, individuals must replace them at their own expense to meet the uniform requirements for official duties.

3. For cases where individuals cease employment, retire, transfer jobs, or take other leave before the end of the service life of the issued uniforms, such uniforms need not be returned; if the service life has expired and new uniforms have not been issued, they will not be issued.

4. The uniforms for officers, civil servants, and employees of the People's Procuracy as stipulated in Clauses 1 and 2 of Article 2 of this Circular shall be issued in physical form.

For shoes, sandals, belts, raincoats, socks, and document cases, based on specific conditions, the Supreme Procurator may decide to provide funds for individuals to purchase these items themselves in accordance with the standards, appearance, color, style, and prices determined by the Supreme Procurator.

Article 4. Budgeting, managing, and settling accounts for expenses on uniforms and Prosecutor Identification Cards

1. Establishment of budget projections:

Annually, based on the recipients of uniforms, the quantity and types of uniforms reaching the replacement period or needing supplementation, units under the People's Public Prosecution Office shall prepare the budget for uniform expenses according to this Circular and incorporate it into their unit's budget to be submitted to the Supreme People's Public Prosecution Office for consolidation and submission to the Ministry of Finance in accordance with regulations.

Expenses for making Prosecutor Identification Cards are incorporated into the annual budget of the entire sector and implemented within the approved state budget expenditure plan as stipulated.

2. Managing and settling accounts for expenses on uniforms:

The management and settlement of accounts for clothing expenses shall be carried out in accordance with the provisions of the State Budget Law and the current guiding documents.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The Supreme People's Public Prosecution Office is responsible for managing, guiding, and inspecting the issuance and use of uniforms in accordance with current regulations.

Expenditures for issuing uniforms not in compliance with this Circular, upon discovery during inspection, must be recovered and paid into the state budget. Individuals who issue incorrect orders will be subject to disciplinary action, administrative penalties, and reimbursement of improperly spent funds as prescribed, depending on the severity of the violation.

2. Based on specific circumstances, the President of the Supreme People's Public Prosecution Office decides to apply the issuance of certain types of uniforms suitable for indefinite-term contract workers in accordance with Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government within the Public Prosecution Sector.

3. This Circular takes effect from October 1, 2013, and replaces Joint Circular No. 02/2003/TTLT-VKSTC-BTC dated October 15, 2003, issued by the Supreme People's Public Prosecution Office and the Ministry of Finance to guide the implementation of Resolution No. 219/2003/NQ-UBTVQH dated January 9, 2003, of the Standing Committee of the National Assembly regarding uniforms for civil servants in the Public Prosecution Sector and Prosecutor Identification Cards.

The provisions set forth in this Joint Circular shall be implemented from August 16, 2012.

4. In case of difficulties or obstacles during implementation, please report to the Ministry of Finance and the Supreme People's Public Prosecution Office for appropriate amendments and supplements.
