THE MINISTER OF INDUSTRY
Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;
Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 88/2003/NĐ-CP dated July 30, 2003 of the Government stipulating the organization, operation, and management of associations;
At the suggestion of the Director of the Department of Organization and Cadres,
DECISION:
Article 1. This Decision promulgates the Management Regulation of the Ministry of Industry for Associations and Industry Trade Unions of industrial sectors.
Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
The Head of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of Bureaus under the Ministry, Chairpersons of Associations and Industry Trade Unions of industrial sectors related to this Decision shall be responsible for its implementation./.

REGULATIONS
Management of the Ministry of Industry for Associations and Industry Trade Unions of Industrial Sectors
(Issued together with Decision No. 02/2004/QĐ-BCN

PART I
GENERAL PROVISIONS
Article 1. This Regulation stipulates the management work of the Ministry of Industry towards Associations and Industry Trade Unions of industrial sectors (hereinafter referred to as "Industry Sector Associations") established and operating according to Decree No. 88/2003/NĐ-CP dated July 30, 2003 of the Government on organization, operation, and management of associations.
Article 2. Industry Sector Associations are subject to state management by the Ministry of Industry in accordance with the provisions of the law, and implement a regular reporting system on the results of their activities to the Ministry of Industry.
Chapter II
STATE MANAGEMENT OF THE MINISTRY OF INDUSTRY
WITH INDUSTRY SECTOR ASSOCIATIONS
Article 3. Participate in writing with the Ministry of Home Affairs and other competent state management agencies regarding permission to establish; division, separation; merger; consolidation; dissolution; approval of the charter of the Association, recognition of the organizing committee for establishing Industry Sector Associations.
Article 4. Guide and create conditions for Industry Sector Associations to participate in industry sector activities. Organize to collect opinions from associations to perfect state management regulations within the industry sector.
Article 5. Inspect the implementation of state management regulations on industry for Industry Sector Associations. Handle or recommend relevant state authorities to handle violations of the Associations in accordance with the law.
Chapter III
WORKING REGIME
Article 6. Based on the assignment of the Minister of Industry, Deputy Ministers in charge of sectors and fields shall lead regular meetings with leaders of Industry Sector Associations on assigned areas of work.
Article 7. Based on Decision No. 1573/QĐ-TCCB dated July 3, 2003 of the Minister of Industry on the functions, tasks, and powers of the Office, Inspectorate, and functional Departments under the Ministry of Industry; Functional Departments under the Ministry of Industry shall manage specialized industry sector associations according to the following fields:
1- Department of Machinery, Metallurgy, and Chemicals: Manage, guide, and inspect the activities of machinery, metallurgy, chemical industry associations, and other heavy industry associations.
2- Department of Energy and Oil and Gas: Manage, guide, and inspect the activities of energy industry associations.
3- Department of Consumer Industry and Food: Manage, guide, and inspect the activities of consumer industry and food associations.
4- Department of Science and Technology: Coordinate with functional departments in managing, guiding, and inspecting the activities of science and technology industry associations.
5- Department of Organization and Cadres: Manage, guide, and inspect organizational and cadre work of industry sector associations.
Article 8. Every six months, excluding urgent cases requiring immediate resolution, the leadership of the Ministry of Industry will organize meetings with the Associations.
Specialized Departments, the Ministry of Industry Office, and Industry Sector Associations will unify the preparation of meeting content, participants, time, and location.
Article 9. The main contents of the meetings include:
1. Announcing policies, guidelines, resolutions of the Party, new normative legal documents, especially government policies, and the Ministry of Industry's policies in the industrial sector to Industry Sector Associations.
2. Announcing the activities of the Associations in the past period, advantages, difficulties, and recommendations for support and resolution.
3. Announcing the operational situation, production and business activities, difficulties of enterprises, suggestions, and proposed solutions.
4. Announcing and soliciting opinions from Industry Sector Associations on development projects, expansion plans for production and business activities, industry planning or adjustments, draft laws, and draft normative legal documents of the industry sector according to current regulations.
5. Exchanging views on organizational and cadre work of the Associations, rewards and punishments for the Association's leadership team, and directing association congresses in accordance with the law.
6. Agreeing and cooperating with Industry Sector Associations in areas of production and business development, international cooperation, scientific and technological information, integration, training, and human resource development, and areas of mutual interest.
Article 10. After the meetings, the Head of the Ministry's Office will coordinate with the assigned functional Departments to inform the content, results of the work, and matters that need to be resolved, which have been agreed upon by the leadership of the Ministry of Industry and the leadership of Industry Sector Associations.
Article 11. In addition to formal meetings, through the activities of the Ministry's Leadership, the Association, the specialized functional departments of the Ministry of Industry, and the Committees (Subcommittees) of the Association; the Ministry of Industry and industry associations regularly exchange and reflect on their operational situations, as well as make recommendations regarding policies related to industrial development.
Chapter IV
IMPLEMENTING PROVISIONS
Article 12. During implementation, if there are issues requiring amendments, supplements, or adjustments; the Director of the Ministry’s General Office, the Heads of the functional Departments, and the Heads of relevant agencies shall report to the Minister of Industry for consideration and decision./.
