Pursuant to the Education Law dated December 2, 1998;

Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;

Pursuant to Decision No. 24/2000/QĐ-BGD&ĐT dated July 11, 2000 of the Minister of Education and Training promulgating the Charter of Vocational Secondary Schools;

Considering the proposal of the Principal of the Industrial Technical Secondary School (Proposal No. 339/THCN-TCHC dated November 18, 2004);

At the proposal of the Director of the Department of Organization and Cadres,

DECISION:

Article 1. Approves the Charter on Organization and Operation of the Industrial Technical Secondary School attached hereto.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

The Heads of the Office of the Ministry, the Inspectorate of the Ministry, the Directors of Departments, the Directors of Bureaus, the Heads of agencies and units under the Ministry, and the Principal of the Industrial Technical Secondary School are responsible for implementing this Decision.

CHARTER

 

Organization and Operation of the Industrial Technical Secondary School

(Issued together with Decision No. 02/2005/QĐ-BCN dated January 10, 2005)

PART I

GENERAL PROVISIONS

Article 1. The Industrial Technical Secondary School (hereinafter referred to as the School) is a vocational education institution directly under the Ministry of Industry, having the function of training and upgrading human resources with intermediate technical-industrial qualifications and technical workers in the fields of mechanical engineering, electronics and automation, industrial and residential electricity, information technology within the national education system, the system of educational and training certificates according to the Law on Education dated December 2, 1998. Simultaneously, the School is also a research and development center for science and technology serving management and production-business requirements of the industry sector and socio-economic development.

Vietnamese name: Industrial Technical Secondary School.

International trade name: INDUSTRIAL TECHNICAL SECONDARY SCHOOL; abbreviated: ITSS.

Main office located at: No. 202, Tran Nguyen Han Street, Bac Giang City, Bac Giang Province.

Article 2. The School is subject to comprehensive and direct leadership and management by the Ministry of Industry; state management by the Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs, and related ministries and sectors; and enjoys policies and systems applied to secondary vocational schools and vocational training institutions according to the State.

Article 3. The School is a self-financing educational institution with legal personality, operating on state budget funds and certain revenue-generating research, consulting, and service activities as prescribed by the State, opening accounts at the State Treasury and banks, and using seals (including embossed and reduced-size seals) for operations and transactions in accordance with the law.

Article 4. Establishing Party organizations and social organizations.

1. Establishing Party organizations of the Communist Party of Vietnam within the School, operating within the framework of the Constitution, laws, and the Charter of the Party, leading the School to implement the Party's guidelines, policies, and State laws, mobilizing all Party members and the masses to unite in fulfilling the political tasks of the School.

2. Social organizations within the School operate in accordance with the law, responsible for implementing educational goals and principles as prescribed by the Law on Education and consistent with the charter and objectives of the social organizations.

Chapter II

TASKS OF THE SCHOOL

Article 5. The School has the following tasks:

1. Training human resources with intermediate technical-industrial qualifications and technical workers in the fields of mechanical engineering, electronics and automation, industrial and residential electricity, information technology, and specialized economics according to the framework structure of the national education system and the system of educational and training certificates as prescribed by the Law on Education.

2. Retraining and upgrading cadres and technical-economic specialists and high-level technical workers to meet the standards set by the State and the requirements of agencies and enterprises.

3. Developing training programs and teaching plans based on the framework programs issued by the Ministry of Education and Training.

4. Organizing the compilation and approval of textbooks for the fields of training permitted by the School based on the assessment of the Evaluation Council established by the Principal.

5. Organizing and implementing student recruitment, student management; organizing training activities, graduation certification, and issuance of graduation certificates in accordance with the Law on Education.

6. Building and upgrading a teaching staff sufficient in number and balanced in qualification levels as prescribed by the Ministry of Education and Training.

7. Organizing specialized scientific and technological research and development; implementing the integration of training with scientific research and production work to enhance training quality in response to increasingly higher demands for management and production-business in the industry sector.

8. Implementing scientific and technical service activities including technology transfer, experimental production, production-business activities suitable to the fields of training; providing career counseling and job placement services for students and other interested parties as prescribed.

9. Organizing information activities in various forms such as specialized conferences, training seminars, surveys, study tours; printing and publishing publications, materials, and textbooks to serve training and scientific research activities in accordance with the law.

10. Implementing international cooperation and collaboration in training and upgrading human resources, research, and development of science and technology with domestic and foreign agencies, organizations, and individuals.

11. Managing, preserving, developing, and using state-assigned material assets, property, and capital sources effectively and for their intended purposes in accordance with current regulations.

12. Managing organizational structures and staffing in accordance with State regulations and the delegation of authority by the Ministry of Industry.

13. Protecting property, maintaining political security, social order, and safety, safeguarding state secrets, establishing and implementing labor safety regulations and measures within the School.

14. Implementing regular and ad hoc reporting systems as required by the Ministry of Industry.

15. Fulfilling other tasks as prescribed by law.

Article 6. Rights of the College

1. Engage in joint ventures, collaborations, receive sponsorships, and capital contributions from organizations and individuals both within and outside the country to train human resources for the development of the industry and society in accordance with state regulations.

2. Mobilize funds from staff members to serve training, scientific research, technological development, production, business, and service objectives as stipulated by law.

3. Be allocated land by the State, be able to lease land and borrow capital; enjoy tax exemptions and reductions as prescribed by current regulations.

4. Issue internal management regulations and rules consistent with existing state documents.

5. Decide on the establishment of subordinate organizations according to the organizational structure approved in writing by the Ministry of Industry, appoint and relieve from duties heads and deputy heads of departments, faculties, majors, centers, production workshops, stores, and make decisions regarding personnel issues from teachers down to specialists.

6. Decide on the recruitment, transfer, salary increase, retirement benefits, rewards and disciplinary actions, sending for study and work assignments both domestically and internationally according to the hierarchical management of cadres by the Ministry of Industry.

7. Provide vocational counseling and job placement services.

8. Other authorities as prescribed by law.

Chapter III

EDUCATION AND TRAINING ACTIVITIES

Article 7. Training Process

1. The school conducts training activities according to the academic year, which consists of two semesters; at the end of each semester, the school organizes examinations, assessments, and classifies students based on their academic performance and discipline.

2. At the end of the academic year, the school organizes final examinations, assesses, and promotes students to the next grade.

3. Upon completion of the program, the school organizes graduation examinations, evaluates, and confers graduation certificates.

Article 8. The school may open additional training programs when there is demand and sufficient conditions in terms of instructors, equipment, and facilities for training, as approved in writing by the Ministry of Industry and the Ministry of Education and Training.

Article 9. The school may organize admissions for permitted training programs according to the admission regulations and annual directives of the Ministry of Education and Training.

Article 10. Training activities of the school include:

1. Teaching theoretical and practical classes.

2. Organizing internships, experiments, scientific research, and production labor in line with the training programs.

3. Organizing extracurricular activities, including field trips, club activities, specialized knowledge exploration, and other activities.

Article 11. The school may organize non-formal education training and upgrading as prescribed by the Ministry of Education and Training.

Article 12. The school may collaborate with educational institutions, production, business, and service establishments, economic and social organizations to provide training based on employment needs and link training with employment in permitted fields and trades, as approved by the Ministry of Industry and the Ministry of Education and Training.

Chapter IV

ORGANIZATION AND STAFFING

Article 13. The organizational structure of the school includes:

1. Leadership:

a) Principal;

b) Deputy Directors.

2. Business units:

a) Training Department;

b) Finance and Accounting Department;

c) Organization and Administrative Office;

d) Administration and Living Services Department;

đ) Student Affairs Department.

3. Specialized units:

a) Mechanical Engineering Faculty;

b) Power Engineering Department;

c) Electrical-Electronics-Computer Science Department;

d) Basic Sciences and Fundamental Engineering Faculty;

đ) Subject Departments.

4. Service units include: laboratories, libraries, cultural houses, clubs; production-business and scientific-technical service bases, part-time, computer science, foreign language, manpower training for labor export, practice workshops, production-internship workshops, production-business stores, product introduction stores, driving schools, vocational counseling, job placement services, and student living services.

Article 14. Principal

The Principal is the legal representative of the school, directly responsible for managing and directing the school's activities in accordance with laws and regulations of the Ministry of Industry. The Principal is appointed and relieved from duty by the Minister of Industry based on the standards set by the Ministry of Education and Training, with a term of five years, and may not hold the position for more than two consecutive terms. The Principal has the following responsibilities and authorities:

1. Develop and implement the school's development planning, training plans, and work programs.

2. Manage training activities; organize and direct the development of educational programs, teaching schedules; course syllabi and teaching-learning activities according to the directives of the Ministry of Industry and the Ministry of Education and Training.

3. Organize and direct scientific research and technology application; scientific and technical services; international cooperation in science and training; collaboration with research and production-business establishments to combine training with production labor, targeted training, and training linked to employment.

4. Organize and manage personnel; recruit, assign, rotate, transfer, send for further studies, enhance knowledge, and implement state policies and regulations for teachers, staff, and employees of the school as prescribed by law.

5. Manage students; decide on admissions, examinations, graduation recognition, classification of graduates, issuance of graduation certificates, and manage student activities organized by the school.

6. Manage administrative, documentation, and archival work; implement regular reporting systems as prescribed by the Ministry of Industry and relevant state management agencies.

7. Manage, preserve, develop, and use property, assets, and capital provided by the State and the Ministry of Industry for training purposes, building, and developing the school effectively.

8. Organize and direct movements, public welfare activities, cultural, sports activities, implementation of democratic regulations, compliance with laws, and maintenance of security and order within the school.

9. Organize inspection, audit, reward, and disciplinary actions for teachers, staff, and students in the school as prescribed by law.

10. Attend meetings of the Ministry of Industry leadership concerning matters related to the school's functions, tasks, organization, and activities.

11. Other responsibilities and authorities as prescribed in Article 27 of this Charter.

Article 15. Deputy Rector

The Deputy Principal assists the Principal in managing the school and is assigned by the Principal to oversee one or several areas of the school's operations. The Deputy Principal handles tasks and is accountable to the Principal for the assigned responsibilities and outcomes.

Act on behalf of the Principal to manage all aspects of the school's activities when authorized by the Principal.

The appointment and removal of the Deputy Director shall be proposed by the Director and decided by the Minister of Industry based on the standards set forth by the Ministry of Education and Training, with a term of five years.

Article 16. Business Units

Business units have the following main responsibilities:

1. Organize and implement tasks according to their functions and authorities delegated by the Director.

2. Proposing projects, initiatives, policies, and draft management decisions within their authority for the Director's consideration and decision.

3. Implementing the Director's decisions and handling regular tasks within their assigned functions and responsibilities.

4. Manage staff and employees according to the classification management level of the Director.

Heads and deputy heads of functional departments are directly supervised by the Director and appointed or removed by the Director upon the proposal of the Head of the Organization and Administrative Department.

Article 17. Professional Departments

Professional Departments Have the following main responsibilities:

1. Organize the implementation of training, teaching, learning processes, and other educational activities according to the school's teaching program and plan.

2. Organize the compilation of curricula and textbooks when assigned; organize research to improve teaching and learning methods; propose plans for supplementing and maintaining teaching equipment, practical and internship facilities.

3. Develop plans and organize the implementation of professional and vocational skill enhancement programs for teachers.

4. Organize the implementation of experimental activities, scientific research, science and technology services, and linking education with employment.

5. Manage teachers, staff, and students according to the classification management level of the Director.

Heads and deputy heads of departments and subject groups under the departments are directly supervised by the Director and appointed or removed by the Director upon the proposal of the Head of the Organization and Administrative Department.

Article 18. Subject Groups within Departments

Departments establish subject groups under their jurisdiction, responsible for one or a group of related subjects. The establishment of subject groups is proposed by the department head and decided by the Director. Subject groups have the following main responsibilities:

1. Be responsible for the content, quality, and progress of teaching and learning one or several subjects in the department's general teaching program and plan.

2. Organize the development of content, curricula, and the compilation of textbooks and teaching materials related to the specialized fields of training assigned by the department.

3. Implement teaching and learning plans, scientific and technological activities, and manage facilities and equipment assigned by the department.

Heads and deputy heads of subject groups are appointed or removed by the Director upon the proposal of the department head.

Article 19. Student Classes

1. Students are organized into classes according to their training majors and academic terms. Each class shall not exceed forty students, with a class president and one to two vice-presidents elected at the beginning of the academic year. Each student class has a class teacher.

2. Specific duties of the class teacher and the student class are defined by the Director.

Article 20. Academic Council

1. The Academic Council is an advisory body to the Director for the implementation of the school's duties and powers, established at the beginning of each academic year with the Director as its Chair.

2. Members of the Academic Council include: Deputy Director, Secretary of the Party Committee, Secretary of the Ho Chi Minh Communist Youth Union, Chairman of the Trade Union, Heads of Departments, Heads of Subject Groups under Departments, some Heads of Departments, and reputable teachers.

3. The Academic Council convenes twice a year, with additional meetings as necessary, decided by the Director.

Article 21. Other advisory councils

Advisory Councils (Salary Council, Staffing and Recruitment Council, Commendation and Disciplinary Council) are established by the Director, with separate operational regulations; their composition follows state and Ministry of Industry regulations.

Article 22. Service and Training Facilities

The school organizes service and training facilities, including:

1. Service facilities include: laboratories, practice rooms, internships, tradition rooms, libraries, clubs, sports and cultural houses, dormitories.

2. Service facilities include: Science and Technology Service Centers, Foreign Language Centers, Computer Centers, Part-time Training Centers, Human Resource Training Centers for Labor Export, Experimental Production Centers, Production and Business Centers, Driving Schools, Career Counseling Centers, Employment Introduction Centers, and Student Life Service Centers.

The Director decides on the establishment of service and training facilities, defines their functions, responsibilities, authorities, and appoints management positions. For facilities with legal personality, bank accounts, and seals for operation, the Director develops proposals for review and decision by the Ministry of Industry.

Chapter V

TEACHERS, STAFF, AND EMPLOYEES

Section 1. TEACHERS

Article 23. Teachers

Teachers include those individuals within the establishment's staff who engage in teaching activities, as well as economic and technical officers, management personnel working inside and outside the establishment who concurrently teach with a university-level or higher professional qualification, possessing pedagogical competence, meeting the professional standards set forth by the Ministry of Education and Training, and having the ability to teach theoretical and practical subjects at the secondary vocational level and below.

1. Teachers have the following responsibilities:

a) Delivering assigned courses according to the school’s teaching plan, curriculum, and training objectives. Evaluating and assessing students' academic performance and discipline.

b) Implementing or participating in scientific research and applying scientific advancements to improve teaching content and methods, as well as student education.

c) Adhering to legal regulations, the School's Organizational and Operational Charter, and training rules; respecting, assisting, and protecting students' legitimate rights.

d) Cultivating moral character, continuing education, enhancing professional qualifications and pedagogical capabilities, maintaining teacher integrity and honor.

đ) Participating in cultural and social activities, fulfilling civic duties, and other tasks as prescribed by law.

2. Teachers have the following rights and authorities:

a) Being assigned teaching duties according to their field of expertise, using technical means for teaching, guiding students in practical exercises, internships, and production work as per the school's training plan.

b) Leading or participating in scientific and technological research and implementation; receiving training and further education in professional skills, foreign languages, and pedagogy; being eligible for promotion and transfer within the teaching cadre according to the Civil Servant Ordinance.

c) Enjoying material and spiritual benefits, health care services as stipulated by state policies for educators.

d) Expressing wishes, making suggestions, and providing feedback to the school or superior agencies regarding issues related to organizational and educational management.

đ) Being considered for national awards such as National Teacher, Distinguished Teacher, Medal for the Education Cause, and other commendations.

Article 24. Responsibilities and authorities of class teachers

In addition to the responsibilities and rights of teachers as specified in Article 23 of this Charter, class teachers also have the following responsibilities and authorities:

1. Assisting the Principal in managing, educating, and disciplining students.

2. Organizing, directing, and guiding classroom activities assigned by the school.

3. Coordinating with subject teachers in the class for student education and training.

4. Other responsibilities and authorities as stipulated in Article 27 of this Charter.

Article 25. Conduct, language, and attire of teachers

1. The conduct, language, and attire of teachers must serve as exemplary models for student education.

2. Teachers are strictly prohibited from engaging in the following behaviors:

a) Insulting the dignity and personal integrity of colleagues and students, physically assaulting them.

b) Cheating during examinations, evaluations, admissions, and recruitment processes.

c) Smoking, drinking alcohol, or beer during classes and while participating in educational activities at the school.

Article 26. Commendation and handling of violations

1. Teachers with outstanding achievements will be rewarded, recognized with commendations, and honored with high distinctions.

2. Teachers who commit faults will be dealt with according to the nature and severity of their violations, in accordance with administrative penalties in the education sector, the Civil Servant Ordinance, and other state regulations.

Section 2. STAFF AND EMPLOYEES

Article 27. Staff and employees

The staff and employees of the School include leaders and managers of the School, functional units, specialized units, service units, administrative staff, technical workers working within the organizational structure of the School and have the following tasks and authorities:

1. To be assigned clear tasks and be responsible for completing the assigned work.

2. Strictly comply with regulations and decisions of the Rector and current laws.

3. To use work equipment as required by their job and have the obligation to maintain and preserve the common property of the School.

4. Participate in discussions and provide opinions to build programs, work plans, mid-term and final reviews of their units and the School. They can propose measures to improve organizational management, working conditions, material and spiritual life, environmental hygiene, and training and development of staff and employees to meet the requirements of the School's tasks.

5. Participate in discussions and contribute to building rules on organizational management and rights and obligations of staff and employees at the School.

6. Propose to the Rector for allocation, utilization, and implementation of state policies and systems for staff and employees according to the Labor Code; the Ordinance on Cadres and Civil Servants.

The positions, tasks, and authorities, working systems of staff members (excluding Party and mass organization staff) shall be decided by the Rector according to the cadre management classification of the Ministry of Industry.

Chapter VI

STUDENTS

Article 28. Students of the School

Vietnamese citizens who meet the conditions stipulated in the Admissions Regulations, aged from 15 to 30, with a minimum educational level of completion of junior high school are eligible to apply for admission to the School.

Article 29. Students have the following tasks:

1. Study and train according to the School’s training plan and program.

2. Complete the prescribed period for all learning, experimental, research, practical, internship, production labor, service activities, and other activities as specified in the training plan and program of the School.

3. Strictly comply with state laws, the Charter, rules, regulations, and internal rules of the School and training rules, as well as dormitory and non-dormitory student rules as currently prescribed.

4. Respect teachers and staff of the School.

5. Fulfill the obligation to pay tuition fees fully according to the current regulations of the State.

6. Participate in class activities, youth organization activities, public welfare labor, and social service activities.

7. Maintain and protect property, public facilities inside and outside the School, protect the environment, and maintain social order and safety.

8. Practice civilized and healthy lifestyles contributing to building, protecting, and promoting the traditions of the School.

9. Students enrolled under the quota system must comply with the dispatching of competent state management agencies; if they fail to comply, they must compensate for scholarships and training costs according to the law.

Article 30. Students have the following rights:

1. Be respected and treated equally by the School and provided with timely and complete information about study, research, and training.

2. Have their study systems guaranteed according to the Ministry of Education and Training regulations.

3. Participate in youth organization and social organization activities as prescribed by law.

4. Use teaching equipment, study materials, and other means to serve study, research, enhance professional knowledge and skills, culture, physical education, and sports according to the School's regulations.

5. Directly or through organizations and youth groups to make suggestions and contributions to the School regarding training work, School construction, and protecting legitimate interests of students and student collectives.

6. Enjoy material and spiritual benefits according to state policies for students; enjoy benefits from scientific research, production labor, services, and production contributions according to the law.

7. Receive diplomas immediately upon graduation.

Article 31. Behavior, language, and attire of students

1. Behavior and language should be cultured, appropriate to the morals and lifestyle of students at the School.

2. Students' attire must be clean, neat, simple, suitable for age, convenient for studying and living at the School.

Article 32. Prohibited behaviors for students of the School

1. Rudeness, insulting personal dignity and honor, infringing on the body of teachers, staff, and students of the School.

2. Cheating in studies, examinations, and tests.

3. Gambling, transporting, storing, using drugs, weapons, explosives, flammable substances, harmful chemicals, and distributing obscene cultural products.

4. Fighting, causing disturbances, disrupting order inside and outside the School.

5. Smoking, drinking alcohol in the School.

Article 33. Rewards and disciplinary actions

1. Students who achieve success in studies and training will be rewarded by the School and educational management levels in the following forms:

a) Praise before the class and before the School;

b) Awarding titles and receiving awards for outstanding and excellent students;

c) Issuing certificates and commendations if winning prizes in selection exams for excellent students;

d) Other forms of rewards.

2. Students who commit shortcomings during the process of study and training shall bear the following disciplinary measures:

a) Criticism before the class and before the School;

b) Reprimand and notify parents;

c) Warning recorded in the academic record;

d) Suspension of studies for a limited time;

đ) Forced withdrawal from studies.

Chapter VII

ASSETS AND FINANCES

Article 34. Assets of the School transferred by the State and the Ministry of Industry:

The main office of the School is located within the premises at No. 202 Tran Nguyen Han Street, Bac Giang City, Bac Giang Province, including: Administrative land, schoolyard, sports activity area, military training area; sanitary facilities, water supply and drainage system, parking area, external service facilities, dormitories, external production, business, service, and research facilities, all architectural structures, and the entire infrastructure within the planned area approved by the Ministry of Industry. The School is responsible for:

1. Properly preserving and using physical facilities and assets in accordance with their intended purposes and effectively in the various fields of activity of the School.

2. Conducting an annual inventory and revaluation of the School's assets.

3. All assets must be fully recorded and documented in accordance with the State's regulations.

Article 35. The liquidation, transfer, and reallocation of the School's assets must comply with the State's regulations.

Article 36. Sources of financial resources ensuring the operation of the School

1. The state funding for vocational training includes: salaries, administrative expenses, repair and upgrade costs for equipment, investment projects for construction and upgrading of facilities, national, ministry, and grassroots research topics, and training and development quotas assigned by the State.

2. Tuition fees and service charges as prescribed by the State.

3. Revenue from cooperative training results, experimental production, production-business, service, scientific and technological research-experimentation.

4. Other sources of income as prescribed by law, including: sponsorship, aid, support, gifts, and capital contributions from organizations, enterprises, and individuals both within and outside the country, as currently regulated for expanding and developing the School.

5. Borrowed funds and capital mobilization from staff members in accordance with the provisions of the law.

6. Supplementary capital from the School's operations after fulfilling its obligations to the State.

Article 37. Contents of expenditures of the School.

1. Regular expenditures according to the functions and tasks assigned by the competent authority, including:

a) Expenditures for employees, including: salaries, wages, allowances, social insurance contributions, health insurance contributions, training and development programs for teachers, staff members, and employees, and union activity funds as prescribed;

b) Administrative management expenditure, including: office supplies, administrative services, communication and information, travel expenses, conference fees;

c) Expenditures for professional activities, teaching, learning, and scientific research conducted by teachers, staff members, and students;

d) Expenditure on purchasing assets and regular maintenance of fixed assets and material facilities.

2. Production and service provision operational expenditures and fulfillment of budgetary obligations to the State regarding tax payments and depreciation of fixed assets.

3. Expenditures for implementing research projects at the School, Ministry level, and national level; Programs with specific goals; expenditures for counterpart funds to implement projects with foreign capital as prescribed.

4. Expenditure on streamlining staffing in accordance with the State's regulations.

5. Development investment expenditures, including: expenditures for constructing physical facilities, purchasing fixed assets, equipment, and other investment projects as prescribed by the State.

6. Expenditure on urgent tasks assigned by the competent authority.

7. Repayment of loans and capital contributions.

8. Other expenditures.

Article 38. Financial Management

The School manages its finances in accordance with the financial regulations applicable to public service units with revenue as follows:

1. Financial management and utilization are carried out in accordance with the State's regulations.

2. Management of borrowed funds, Bank loans, Development Support Fund, and other funds to expand and improve the quality of educational, scientific research, production organization, service provision activities, and bear responsibility for repaying borrowed capital.

3. Establishment and active use of funds: Income Stabilization Reserve, Awards, Welfare, and Development of Public Service Activities in accordance with the law.

4. Subordinate units of the School that operate with revenue and have legal personality, seals, and separate accounts must report their financial status regularly to the School in accordance with the law. Subordinate units without separate legal personality must manage their finances through the School’s Finance and Accounting Department.

5. Open accounts at the National Treasury to reflect budgetary funds and revenue from public services; open deposit accounts at banks to reflect revenue from production and service provision activities of the School; fulfill obligations to the bank and enjoy tax exemptions on production and service provision activities with revenue.

6. Prepare annual revenue and expenditure budgets and report them to the Ministry of Industry and the National Treasury where the School has accounts. For expenditures from the State budget, they must be reflected in the accounts at the National Treasury in accordance with current regulations. Funds from the State budget ensuring regular operations and public service revenues not spent in the year may be carried over to the next year for continued use.

7. Organize accounting, statistics, financial reporting, and publicly disclose financial information in accordance with the law.

8. Implement audit systems as a basis for evaluating the effectiveness of capital and asset management; subject to inspection and supervision by the Ministry of Industry and related state management agencies.

Chapter VIII

RELATIONSHIP OF THE SCHOOL WITH STATE AGENCIES AND

LOCAL AUTHORITIES

Article 39. The School is subject to inspection and supervision by the Ministry of Industry and relevant state management agencies in accordance with the functions prescribed by law, as follows:

1. Adhere to laws and implement relevant State and Ministry of Industry regulations concerning the School's areas of operation.

2. Adhere to financial, credit, tax, profit distribution, accounting, and statistical systems as prescribed by law.

3. Comply with State and Ministry of Industry regulations regarding organizational and personnel work, including: establishment, division, merger, restructuring, dissolution; approval, amendment, and supplementation of the School Charter; appointment, dismissal, transfer, commendation, and disciplinary action of the Principal and Deputy Principals.

4. Implement State regulations on external relations.

5. Fulfill rights and obligations towards teachers, staff members, and workers in the School in accordance with the law.

Article 40. Relationship of the School Principal:

1. With the Party Committee of the School, implemented in accordance with Decision No. 97/QĐ-TW dated March 22, 2004 of the Central Committee of the Communist Party of Vietnam.

2. With the Trade Union Committee, a cooperative relationship to resolve issues related to the implementation of trade union functions, responsibilities, powers, obligations, and rights of members as stipulated in the 1990 Trade Union Law.

3. With the Ho Chi Minh Communist Youth Union, providing conditions for work and necessary information to fulfill functions, responsibilities, powers, obligations, and rights as prescribed in the Ho Chi Minh Communist Youth Union Charter.

Article 41. The School is subject to administrative territorial management by the People's Committee where the School is located.

Chapter IX

IMPLEMENTING PROVISIONS

Article 42. Subordinate units, teachers, staff members, and students of the Industrial Technical Secondary School are responsible for implementing this Charter.

Article 43. Based on the provisions of the School Charter, the Principal is responsible for establishing and promulgating regulations on the functions, responsibilities, and powers of each department within the School's organizational structure suitable to the scale at each stage of development.

Article 44. On the basis of the Principal's proposal, the Ministry of Industry will consider and decide to amend, supplement, or revoke the School Charter./.
