CIRCULAR
Guidelines for the process of preparing files and issuing health insurance cards for relatives of officers working in the People's Public Security Force

Pursuant to the Health Insurance Regulations issued together with Decree No. 63/2005/NĐ-CP dated May 16, 2005 of the Government and Circular Joint No. 21/2005/TTLT-BYT-BTC dated July 27, 2005 of the Ministry of Health and the Ministry of Finance guiding the implementation of mandatory health insurance
After reaching consensus with the Ministry of Health, the Ministry of Finance, the Ministry of National Defense, and the Vietnam Social Security, the Ministry of Public Security hereby guides the process of preparing files and issuing health insurance cards for relatives of officers working in the People's Public Security Force as follows:
This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.
1. Scope of Application Relatives of officers working in the People's Public Security Force (hereinafter referred to as "relatives of officers") who are eligible to receive medical examination and treatment under the health insurance system (BHYT) must meet both of the following conditions:
a. The relatives of officers (hereinafter referred to as "officers") include:
- The biological father, mother of the officer; the biological father, mother of the officer’s spouse;
- The adoptive father, adoptive mother, or legal guardian of the officer or the officer’s spouse;
- The spouse of the officer;
- The biological child, legally adopted child of the officer under 18 years old; the biological child, legally adopted child of the officer aged 18 or older but disabled and unable to work according to the law.
b. The relatives of officers (as specified in point a, Clause 1, Section I above) do not belong to the categories required to participate in mandatory health insurance as stipulated from Clause 1 to Clause 8 and Clause 10 to Clause 13 of Section I, Part I of Circular Joint No. 21/2005/TTLT-BYT-BTC dated July 27, 2005 of the Ministry of Health and the Ministry of Finance.
2. Responsibilities of Officers
a. Officers whose relatives meet the conditions for obtaining a health insurance card shall be responsible for preparing the file in accordance with Clause 1, Section II and submitting it to their current workplace.
In cases where multiple officers serving in the armed forces (Public Security, Military) have relatives meeting the conditions for obtaining a health insurance card, the process of preparing the file to issue a health insurance card for the relative of an officer shall be carried out as follows:
- If the relative resides with an officer, that officer shall be responsible for preparing the file.
- If the relative has both parents who are officers, the mother shall be responsible for preparing the file.
- If the relative resides with multiple officers or does not reside with any officer, the officer at the highest rank (highest position in the family) shall be responsible for preparing the file.
If the officer at the highest rank is unable to prepare the file to obtain a health insurance card for the relative, the officer who prepares the file must submit a written explanation and obtain confirmation from the unit directly managing the officer at the highest rank.
b. Report to the unit on the movement and changes in the status of relatives receiving health insurance benefits (if applicable); or when there is a need to change the initial registration for medical examination and treatment for the relative.
3. Responsibilities of Public Security Units and Localities
a. Based on the officer's personnel file, confirm the application form for issuing a health insurance card for the relative prepared by the officer currently working at the unit (Form No. 01).
b. Prepare and send a list (Form No. 02) along with the file of relatives of officers working in the units under the Ministry of Public Security who are residing in Hanoi or Ho Chi Minh City to the Social Security Department of the Ministry of Public Security, or to the Public Security Department of the province or centrally-administered city where the relative of the officer resides.
c. By the end of each year, based on reviewing and compiling the files (including those sent from other Public Security units and localities); the Public Security departments of the localities shall prepare a list of relatives of officers eligible for health insurance cards (Form No. 03) residing in the locality (including relatives of officers working in the locality and relatives of officers working in other Public Security units and localities) to purchase and issue health insurance cards for the relatives of officers.
Specifically, relatives of officers working in units under the Ministry of Public Security residing in Hanoi or Ho Chi Minh City shall be listed by the respective units (V11, V15, V26) to purchase and issue health insurance cards for the relatives.
The list (Form No. 03) shall be prepared in at least four copies:
- One copy sent to the Social Security Department of the province or centrally-administered city, along with a letter requesting a contract to purchase health insurance cards for the relatives of officers.
- One copy sent to the Social Security Department of the Ministry of Public Security for consolidation and monitoring.
- One copy sent to the Financial Department of the Ministry of Public Security as the basis for allocating funds to purchase health insurance cards.
- One copy retained by the Public Security unit or locality.
d. Monitor and inspect the medical examination and treatment activities of relatives of officers who have been issued health insurance cards within the jurisdiction.
e. Settle accounts for the costs of purchasing health insurance cards with the Financial Department of the Ministry of Public Security in accordance with regulations.
f. Notify the Public Security department of the locality where the relative of the officer resides when there is a change in the status of the relative of the officer (adding or removing relatives eligible for health insurance cards, changing residence...) or when the relative of the officer requests to change the initial registration for medical examination and treatment.
g. Resolve issues arising from changes in the status of relatives of officers or when there is a request to change the initial registration for medical examination and treatment for the relative.
h. Conduct a review and adjustment every six months, transferring the funds for purchasing health insurance cards for relatives of officers to the Social Security Department of the province or centrally-administered city according to the contract.
4. Responsibilities of the Social Security Department of the Ministry of Public Security
a. Take the lead and coordinate with relevant agencies of the Vietnam Social Security and related agencies to guide, inspect, and urge Public Security units and localities under the Ministry of Public Security in the process of purchasing and issuing health insurance cards and resolving issues arising during the implementation of purchasing and issuing health insurance cards for relatives of officers.
b. Compile the number of family members of operational officers entitled to health insurance benefits within the Public Security force; coordinate with the Department of Finance under the Ministry of Public Security to prepare the budget and allocate funds for purchasing health insurance cards for the family members of operational officers within the Public Security force.
5. Responsibilities of the Department of Finance
a. Take the lead and coordinate with General Department III (Social Insurance Agency - Ministry of Public Security) to prepare the budget and settle accounts with the Ministry of Finance regarding the funds for purchasing health insurance cards for the family members of operational officers within the Public Security force.
b. Allocate and settle accounts for the funds used to purchase health insurance cards for the family members of operational officers from local public security units.
c. Coordinate to monitor the use of funds and the issuance of health insurance cards for the family members of operational officers from local public security units.
II. IMPLEMENTATION
1. Local public security units shall organize the study, dissemination, and implementation of this Circular to all officers in their units to recognize the concern of the Party and State towards the armed forces in general and the Public Security force in particular. At the same time, they should promptly proceed with the necessary procedures to issue health insurance cards to the family members of operational officers who meet the prescribed conditions as soon as possible.
2. Each year, the purchase and issuance of health insurance cards for the family members of operational officers will be carried out in two rounds:
a. Round I: In December of the previous year to issue cards for the following year.
b. Round II: In May to issue supplementary cards for newly arising cases.
3. The monthly contribution rate for health insurance for the family members of operational officers specified in point a, Clause 1, Section I is 3% of the national minimum wage set by the State.
The funds for purchasing health insurance for the family members of operational officers are allocated in the annual regular budget for security expenses of the Ministry of Public Security.
Administrative fees to ensure the organization and implementation of purchasing and issuing health insurance cards, registering for medical examination and treatment for the family members of operational officers (including publicity, implementation, printing forms, compiling lists, reviewing, purchasing and issuing health insurance cards to each family member of operational officers) amount to 2% of the total funds for purchasing health insurance cards for the family members of operational officers, funded by the State budget.
4. Any individual or unit that falsifies information or confirms inaccurately to enable the family members of operational officers to obtain health insurance cards must reimburse the funds used to purchase and issue those health insurance cards and may be subject to administrative responsibility or criminal liability depending on the severity of the violation according to the provisions of the law.
5. This Circular takes effect fifteen days after its publication in the Official Gazette. During the implementation process, if there are any difficulties, local public security units shall report them to the Ministry (through General Department III) for consideration and resolution.
