Guidelines for the construction, management, and utilization of legal bookcases 1. The Ministry of National Defense shall base on this Decision to establish housing standards for active-duty military personnel, defense workers, and civil servants, coordinating with the Ministry of Construction to unify the criteria, conditions, and standards, and quotas for official housing before submitting to the competent authority for review and decision.at agencies, units, enterprises, and schools

Pursuant to Decree No. 86/2002/NĐ-CP of November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decision No. 13/2003/QĐ-TTg of January 17, 2003 of the Prime Minister approving the Program on Popularizing and Educating Law from 2003 to 2007;
Pursuant to Decree No. 122/2004/NĐ-CP of May 18, 2004 of the Government stipulating the functions, tasks, powers, and organization of legal departments of Ministries, ministerial-level agencies, government agencies, specialized agencies under provincial People's Committees, and state-owned enterprises;
The Ministry of Justice, the Ministry of Public Security, the Ministry of National Defense, the Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs, and the Vietnam General Confederation of Labor Unions jointly issue guidelines for the implementation of the construction, management, and utilization of legal bookcases at agencies, units, enterprises, and schools as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. Legal bookcase or legal bookshelf (hereinafter referred to as legal bookcase) at agencies, units, enterprises, and schools (hereinafter referred to as agencies and units) is a place for storing, utilizing, and using legal materials, books, and newspapers to serve the needs of research and understanding of laws by civil servants, public officials, staff members, teachers, students, employers, employees, and military personnel and police officers.

Legal bookcases are established at agencies and units without libraries. Legal bookshelves are established within libraries at agencies and units that already have libraries.

- Administrative state agencies, public service units;

- Units of the people's armed forces;

- Enterprises belonging to various economic sectors;

- Schools and other educational institutions in the national education system (collectively referred to as schools).

It is encouraged for all other agencies and units to establish, manage, and utilize legal bookcases according to the guidelines set forth in this Circular.

3. Legal bookcases shall be constructed, managed, and utilized in accordance with the actual conditions and specific characteristics of each agency and unit; it is encouraged to apply information technology in the activities of constructing, managing, and utilizing legal bookcases.

II. CONTENTS OF THE CONSTRUCTION, MANAGEMENT, AND UTILIZATION OF LEGAL BOOKCASES

1. Construction of legal bookcases

a) Decision to establish legal bookcases

The head of the agency or unit issues a decision to establish legal bookcases specifying details about: location of the bookcase; rights and obligations of the person responsible for the bookcase and readers; funding for the construction, management, and utilization of the bookcase; organization and operation of the legal bookcase.

Depending on specific conditions, agencies and units may combine the methods of constructing, managing, and utilizing legal bookcases through existing printed materials and legal documents from legal databases in CD-ROM format or on the Internet.

b) Content of legal bookcases

Legal bookcases must ensure four types of legal books, newspapers, and documents as follows:

- Regulatory legal documents: Central and local gazettes, collections of regulatory legal documents issued by central and local authorities; subject-specific collections of regulatory legal documents;

- General legal books: question-and-answer books, commentaries, and explanations of laws;

- Legal books and documents serving administrative work, professional guidance, teaching, and learning activities of agencies, units, enterprises, and schools;

- Specialized legal newspapers and magazines of the central and local levels;

In addition to the aforementioned types of legal books, newspapers, and documents, agencies and units should select and supplement other types of books, newspapers, and documents containing legal content suitable for their respective target audiences.

c) Location of legal bookcases

Legal bookcases must be placed in convenient locations such as libraries, administrative offices, archives, legal departments, and conference halls of agencies and units to facilitate reader usage.

d) Special equipment for legal bookcases

Special equipment for legal bookcases includes bookshelves, cabinets, tables, chairs, filing cabinets or boxes, general registration logs, individual registration logs, introduction boards, and guides for searching legal books, newspapers, and documents. Where conditions permit, photocopiers and internet-connected computers can be provided.

e) Supplementing legal books, newspapers, and documents to legal bookcases

Agencies and units base their provision of timely legal books, newspapers, and documents on their practical needs according to the periodic supplementary catalog provided by the Ministry of Justice.

2. Management and utilization of legal bookcases

a. The organization and operation of legal bookcases must be directly supervised by the head of the agency or unit; legal bookcases are registered and preserved according to state regulations. Legal departments of ministries, sectors, and judicial agencies at all levels are responsible for guiding the management and utilization of legal bookcases for the staff responsible for legal bookcases.

b. Staff responsible for legal bookcases

Each agency and unit must have at least one staff member responsible for legal bookcases. Depending on specific conditions, agencies and units may assign full-time or part-time staff to be responsible for legal bookcases.

- Standards for staff responsible for legal bookcases:

+ Possess a certain level of knowledge about laws;

+ Demonstrate a sense of responsibility and enthusiasm for the job.

- Tasks of staff responsible for legal bookcases:

+ Guide the use of legal books, newspapers, and documents;

+ Classify and arrange materials scientifically to facilitate searching and use;

+ Preserve legal books, newspapers, and documents according to regulations applicable to other assets of the agency or unit;

+ Propose the supplementation and updating of legal books, newspapers, documents, and new regulatory legal documents;

+ Carry out management and utilization activities of legal bookcases according to the guidance of legal departments of ministries, sectors, and judicial agencies at the same level;

+ Report to the head of the agency, unit, legal system department of the ministry, and the judicial agency at the same level on the organization and operation of the legal library, and bear responsibility before the head of the agency or unit for the entire legal library work.

- Rights of the staff responsible for the legal library:

+ To be trained and provided with materials to enhance professional skills in building, managing, and utilizing the legal library, as well as legal matters;

+ To be rewarded by the competent authority according to the general regulations of the State when achieving outstanding results in managing, utilizing the legal library, and disseminating and educating the law;

+ To enjoy remuneration and other benefits according to the general regulations of the State and the regulations of the agency or unit.

c. Time and form of service

Based on actual conditions and the need to understand the law of readers, the legal library may operate daily during working hours of the agency or unit, or arrange appropriate service times that suit the living, working, and study conditions of each group.

The legal library provides services through on-site reading and lending with a time limit.

d. Methods of utilizing the legal library

Introduce new books, newspapers, and legal documents on bulletin boards, information stations, internal radio broadcasts; send notifications to all units to facilitate readers' access, research, and understanding of the law;

- Organize talks and book introductions to enhance the effectiveness of utilizing the legal library; organize reader meetings and book clubs;

- Promote and mobilize civil servants, employees, teachers, workers, students, and soldiers to read and understand the books, newspapers, and legal documents in the legal library;

- Supplement various types of books, newspapers, and legal documents suitable for the nature, tasks, and target audience of the legal library. Widespread dissemination of these types of books promptly through catalog information, search guidance, and other forms of information and promotion; fully utilize the resources within the legal library to serve readers;

- Ensure connectivity between legal libraries of different agencies and units through computer networking, borrowing, and exchanging legal books and documents.

đ. Rules of the legal library

The head of the agency or unit shall issue operational rules for the legal library with the following basic contents:

- Service hours;

- Forms of service;

- Rights and responsibilities of the staff responsible for the legal library;

- Benefits and responsibilities of readers.

The rules of the legal library must be posted at the location where the legal library is placed.

3. Budget for constructing, managing, and utilizing the legal library

The management and use of the budget for constructing, managing, and utilizing the legal library in agencies, units, enterprises, and schools shall be carried out in accordance with current financial regulations and Circular No. 63/2005/TT-BTC dated August 5, 2005, issued by the Ministry of Finance guiding the management and use of funds to ensure the work of disseminating and educating the law.

III. IMPLEMENTATION

1. Ministry of Justice

Take the lead and coordinate with central ministries, sectors, and mass organizations in directing, guiding, inspecting, summarizing, concluding, recommending, and awarding agencies, units, and individuals who have achieved outstanding results in building, managing, and utilizing the legal library in agencies and units nationwide.

The Department of Justice is responsible for advising and assisting the People's Committee of the province in directing the construction and enhancing the efficiency of utilizing and using the legal library in agencies and units within the provincial territory, and also serves as the main coordinating body to assist the People's Committee of the province in directing, guiding, and managing the construction, management, and utilization of the legal library in agencies and units.

2. Ministry of Education and Training

Direct, manage, and coordinate with the Ministry of Justice in the construction, management, and utilization of the legal library in educational institutions.

Departments of Education and Training of provinces and centrally-administered cities are responsible for coordinating with the Department of Justice to direct and guide the construction, management, and utilization of the legal library in educational institutions and other educational facilities under local management.

3. Ministry of National Defense, Ministry of Public Security

Direct, manage, and coordinate with the Ministry of Justice in the construction, management, and utilization of the legal library in units under the People's Army and People's Public Security.

4. Ministry of Labor, Invalids, and Social Affairs

Direct, manage, and coordinate with the Ministry of Justice in the construction, management, and utilization of the legal library in universities and high schools under the Ministry, vocational training centers, care facilities for war invalids and those meritorious to the revolution, and social welfare facilities under the Ministry and sector.

The Department of Labor, Invalids, and Social Affairs directs, manages, and coordinates with the Department of Justice in the construction, management, and utilization of the legal library in vocational training centers and social welfare facilities under local management.

5. Vietnam General Confederation of Labor

Direct, manage, and coordinate with the Ministry of Justice in the construction, management, and utilization of the legal library in agencies and enterprises. The Vietnam General Confederation of Labor has plans to guide levels of trade unions, heads of agencies, and enterprises to implement the construction of the legal library to enhance legal knowledge among cadres, civil servants, employees, employers, and workers.

6. Heads of agencies and units

Direct the construction, management, and utilization of the legal library in agencies and units; consider this as an important and ongoing task contributing substantially to improving the quality and effectiveness of legal dissemination and education, and law enforcement in agencies and units.

Each year, agencies and units shall plan the construction and maintenance of the legal library; develop activity programs, investment plans, consolidation, and development, and implement plans to purchase books from supply units in accordance with the specified time frame for leadership approval.

Specify the specific provisions regarding remuneration for cadres concurrently managing legal book cabinets. Direct and regularly inspect and evaluate the operation of the legal book cabinet, implement the periodic inventory system for the legal book cabinet. Annually and during mid-term and final reviews of the construction work of the legal book cabinet, relevant agencies and units must report on the progress of implementation and operational results to their directly supervising superior agencies. Ministries, sectors, and localities shall compile reports to the Ministry of Justice.

IV. EFFECTIVE DATE OF IMPLEMENTATION

This Circular takes effect fifteen days from the date of publication in the Official Gazette.

During the implementation process, if there are difficulties or obstacles, agencies and units are requested to reflect them to the Ministry of Justice, the Ministry of Education and Training, the Ministry of National Defense, the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, and the Vietnam General Confederation of Labor for timely guidance.
