Regarding the issuance of connection charges between international terrestrial fixed telecommunications networks and domestic terrestrial fixed telecommunications networks within provinces for international telephone services

MINISTER OF INFORMATION AND COMMUNICATIONS

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government on the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decision No. 39/2007/QĐ-TTg dated March 21, 2007 of the Prime Minister on the management of pricing for postal and telecommunications services;

At the proposal of the Director of the Department of Planning and Finance,

DECISION:

Article 1. Issuing connection charges between international terrestrial fixed telecommunications networks (international network) and domestic terrestrial fixed telecommunications networks within provinces (fixed network) for international telephone services as follows:

1. For outgoing international telephone calls originating from the fixed network:

1.1. If the fixed network of Hanoi, Da Nang, and Ho Chi Minh City connects directly to the international network, the international network shall pay connection charges to the fixed network initiating the call at a rate of 0.03 USD per minute.

1.2. If the fixed network within provinces and cities other than Hanoi, Da Nang, and Ho Chi Minh City connects directly to the international network, the international network shall pay connection charges to the fixed network initiating the call at a rate of 0.035 USD per minute.

1.3. In the case where an outgoing international telephone call is transferred through the long-distance Public Switched Telephone Network (PSTN) to connect internationally, the international network, in addition to paying connection charges to the fixed network as specified in Clauses 1.1 and 1.2, shall also pay connection charges to the long-distance PSTN:

a) In the case where the international network connects to one toll switch (1 Toll), the connection charge is 300 VND per minute;

b) In the case where the international network connects to two toll switches (2 Toll), the connection charge is 250 VND per minute;

c) In the case where the international network connects to three toll switches (3 Toll), the connection charge is 200 VND per minute;

1.4. In the case where an outgoing international telephone call is transferred through the long-distance Voice over Internet Protocol (VoIP) network (VoIP inter-provincial network) to connect internationally, the connection charge paid to the long-distance VoIP inter-provincial network shall be agreed upon by enterprises but shall not exceed the connection charge when connecting with the long-distance PSTN and shall not discriminate among enterprises.

2. For incoming international telephone calls terminating in the fixed network:

2.1. If the call terminates in the fixed network of Hanoi, Da Nang, and Ho Chi Minh City, the international network shall pay connection charges to the fixed network at a rate of 0.03 USD per minute.

2.2. If the call terminates in the fixed network within provinces and cities other than Hanoi, Da Nang, and Ho Chi Minh City, the international network shall pay connection charges to the fixed network at a rate of 0.035 USD per minute.

2.3. In the case where an incoming international telephone call is transferred through the long-distance PSTN to terminate in the fixed network, the international network, in addition to paying connection charges to the fixed network as specified in Clauses 1.1 and 1.2, shall also pay connection charges to the long-distance PSTN:

a) In the case where the international network connects to one toll switch (1 Toll), the connection charge is 300 VND per minute;

b) In the case where the international network connects to two toll switches (2 Toll), the connection charge is 250 VND per minute;

c) In the case where the international network connects to three toll switches (3 Toll), the connection charge is 200 VND per minute;

2.4. In the case where an incoming international telephone call is transferred through the long-distance VoIP network (VoIP inter-provincial network) to terminate in the fixed network, the connection charge paid to the long-distance VoIP inter-provincial network shall be agreed upon by enterprises but shall not exceed the connection charge when connecting with the long-distance PSTN and shall not discriminate among enterprises.

3. Connection charges between the international telephone network and the intra-city wireless network shall be calculated like connection charges between the international network and the fixed network.

Article 2. Connection charges during off-peak hours

The connection charges stipulated in Clause 1, Article 1 of this Decision shall be reduced by 30% during the following off-peak hours: From 11 PM the previous night to 7 AM the next morning on weekdays; all day Saturday, Sunday, and public holidays (including compensatory days off).

Article 3. The connection charges stipulated in this Decision do not include Value Added Tax.

Article 4. This Decision shall take effect fifteen days after its publication in the Official Gazette. All previous regulations that conflict with the provisions of this Decision shall be abolished.

Article 5. The Head of the Office, Heads of Planning and Finance Departments, Heads of agencies and units under the Ministry of Information and Communications, General Directors, Directors of enterprises providing international telephone services, fixed-line telephone services, and related units are responsible for implementing this Decision./.
